Refinanced in early 2008 with Countrywide Mortgage.Countrywide did not accept appraisal from appraiser, home was appraised at $270, 000.00 in January 2008.We wanted to refinance out of a interest only loan to a fixed conventional loan. New loan was to be $214, 000, Countrywide would not accept appraisal at $270, 000 and had their valued opinion/guess value come back at $245, 000, so that we would have to pay PMI. If we had to refinance, $250, 000 or so I can almost bet they would have accepted the appraisal at $2700, 000, but because we only had to refinance with a loan of $214, 000 they valued our home at $245, 000 just so we would have to pay PMI. We as consumers pay a lot of money to licensed appraisers for their services to have a company like Countrywide do and say as they wish. It appears that the services we all pay for on appraisals are wasted and Countrywide can do as they please with our American dream of owning a home. It took me 2 e-mails, and 4 phone calls to finally get a copy of the paperwork that I should have gotten the closing in March, 2008. Countrywide Mortgage didn't want us to see or have a copy of their value opinion/guess value.
I urge ALL consumers who have a problem with Countrywide Mortgage to file a complaint with the Federal Trade Commission, I am putting my complaint package together and filing a complaint against Countrywide Mortgage. If all who have a problem with Countrywide Mortgage do the same as I am, The Federal Trade Commission has to do something about this company. The Federal Trade Commission investigates all complaints, so lets ALL file a complaint against Countrywide with the Federal Trade Commission and STOP this unfair practice from Countrywide Mortgage. The more information you provide the Federal Trade Commission the better, so get your cases in order and file. Let the consumer provale!

b.o.a. closed my credit card account
I have had a credit card with Bank of America/MBNA since 1997. And, I have used my credit card account for balance transfers since 1997. Just recently, I was told about a companion card to go along with my current B.O.A. card. I was told by a representative that I could transfer some of my credit available on my current B.O.A. to this new account once I received the new card in the mail in order to take advantage of a 0% balance transfer for 15 months.
I called a few days ago on Monday to see if I was going to get that companion card in the mail and I was told that I had been rejected for the new card. I asked why, and I was told that upon closer review of my currently revolving credit lines and balances with other cards that I was rejected for the new card and that my existing credit available($10, 177.00) would be taken away from my current account and it would be closed even though I currently have a balance of $5, 822.00 at a 1.99% rate until March 2009. And, also, I have never been late or missed a payment the whole time I have had this card since 1997. So, my credit card account has never been a delinquent account. I have very good history with them and they acknowledged that, but they said that was the right decision.
I have made balance transfers with them about every year since 1997 and they have never had a problem with this before. They just processed my most recent balance transfer in July 2008($6, 000.00) at the 1.99% rate until March 2009, and the balance is now down to $5, 822.00 like I said earlier. So, I have shown that I can make my payments every month and I have not missed any payments on my other credit cards and they admitted that I do have a good credit score. So, I asked them why do they have to close my account even though I have a balance, have not missed any payments etc., and they told me that all it takes is for me to miss one payment on one of my credit cards and then all of my credit card interest rates and payments will go up and that means that I will probably eventually not be able to pay them. Well, I have never demonstrated that I would or could miss or make a payment late! I have been with them since 1997! I don't understand this! I have excellent credit and they acknowledged that! This is not fair! They even closed my husband's Bank of America card account too, all in one phone call!
Now, because they have closed mine and my husband's credit card accounts, our credit will be ruined because credit reports will show that they closed our 2 credit card accounts and I still have a balance on one of them! The fact that they(Bank of America) closed our credit card accounts is going to now lower our credit score and cause our other credit card companies to possibly raise our interest rates and our payments and will also, most definitely cause them(other credit card companies) to stop offering us any low rate balance transfer offers! So, in effect, Bank of America is going to cause the very scenario that they were trying to avoid in the first place! By closing my accounts and ruining my credit in the process, they may cause my other credit card interest rates to go up, therefore increasing my minimum payments, and also causing them(other credit card companies) not to offer any low interest balance transfers which will in turn, cause me not to be able to pay off my current balance with them(Bank of America)! I have tried to get them to reverse their decision about closing my credit card account, but they said that they can't and I have spoke with supervisor after supervisor to no avail. They are ruining my credit by closing my accounts!
What can I do? Do they have the right to do this? Do I have any recourse? What can I do about this? Can someone help me?

Bank of america recently cheated my money, too.
I don't understand why a bank as big as bank of america has such poor customer service. It takes an act of god to get ahold of a person by phone. I have never had so much trouble getting a hold of a customer service rep. With any other business. Every number they provide sends you to the same automated phone service leading to a dead end. To me its obvious they don't care about their customers. They don't make their local business #s available to the public. So if you inquire any problems you always have to go to the bank and wait in line for 15-20 minutes and hopefully the can help you with your problem. Very unsatisfied customer. I do not see staying with this bank.

I received a packet from BAC for a modification on my current loan in March of 2010. I complied with all the documention and information requested and returned via fed-ex to BAC. After several months of continous follow-up calls and being advised that all my documentation was in place and that the file was being reviewed, on Jan. 5 2011 I was notified via Fed-Ex that my modification was denied due to missing documents. Is somebody kidding me! I called and again got the run around. My mortgage payments went from $1487 a month to $1883 a month due to an escrow account being set up. So now what? I do believe that these people need to get with the program! I have been paying into a program I haven't even been approved for yet! Who's idea was that?
I have gone to the bank for the last couple of months to make my payment. well it appears that when you make the payment in the bank they are to put the payment towards your mortgage account. RIGHT? well no they play with the money don't know where it goes? so then they finally realize it's the house payment they put it in the account but now I have a late payment. keep your receipts from the bank. I had this happen 3 times already. they assure me this never happens? well it happened 3 times already plus this last payment i did it over the phone "check over the phone" and they made a type-O error instead of the 2, 017.64 she made 2, 017.14 so according them I owe 50cents and a late charge...crazy huh. but they removed it but i was on the phone over 3 hours different days clearing this up...closed by personal accounts already. to bad they have my mortgage acct.

We currently have two Bank of America accounts. One mortgage, and one unsecured line of credit. We had been victims of the economy, with a job loss for 13 months and now finally back to work! We did everything in our power to stay current on all of our accounts, and most banks/credit cards like Discover and Chase, were VERY accomodating. Bank of America did NOTHING to help with late fees or interest rates. We stayed current on our mortgage for the entire 13 months, but received two late charges for being nore than 15 days late the last two months. Customer service said there was nothing they could do help us being we had 2 late charges in the last 18 months. I probably would have preferred a slap in the face. It sickens me that a company like this gets away with raising interest rates, refusing to help the consumer in an economy that they helped create!
Topic: “Banking companies that protect the offenders when customer accounts are compromised.” Background: I received a new checking card in the mail with a note saying my account had been compromised. I called Bank of America to learn which merchant was responsible so I could avoid them. I was told that information could not be shared with the customer. They said it was the responsibility of the “reporting entity” to advise us of the crime.
So the concern is this, the banking customer is inconvenienced as we must modify our financial lives to accommodate new account information, but we are not told who violated our account wherein we can do our part by not patronizing that entity again.
Why do the rights of the criminal supersede the rights of the violated banking customer? How many violators are given the freedom to repeat their crime when the same customers unknowingly support their business? It’s clear the banks are doing “something” to cover their interest, but what of our other information? What if it were a medical office? The banking information has been modified, but what of our SSN, medical record(s) or personal contact information?
At what point does the violated individual have the right to protect themselves?

I have had a card with Bank of America for over 5 years and have been paying faithfully on my account. I have never been late with a payment but today received a bill saying my interest rate had been raised from 9.90% to 24.99%! This is outrageous. I pay on time, every time and yet I am being punished. I cannot pay this new bill. It has more than doubled my bill. They said it was common but they are the only company who has done this. She said she can lower the rate but I can never use the card again. So, again; I am being punished even though I pay on time, every time. No wonder there is so much bankruptcy and foreclosures.

here is the content of a letter I sent to customer service at B of A concerning a "hold" they have on check I deposited a week ago. This is a scam being run by B of A. What they do is withhold deposits for the full legal time they can withhold them to get the advantage of your money for a period of time. Meanwhile, you can't pay the bills. The spirit of the law is to protect from phony deposits from disreputable sources. I can only say that the source of this deposit is in better shape than BofA-and BofA knows it.
I would ask you to immediately release the rest of the funds from a deposit I made a week ago. The check was from a a major insurance company, as reputable a source as any. (if the source was suspect I would possibly understand). The only possible justification for holding back the money-which is causing us huge problems-is that Bank of America is stealing-holding the money hostage so they can use it for the full legal time they are allowed to do so. If done on a massive scale this could benefit the company, at the expense of the deposit holders.This is disgraceful behavior. I know you have stated you will release it Monday. Release it today.

This is a capitalist society what do you expect? Businesses want to make money so they have policies that lead to that end. If Bank of America did not make money then you wouldn't want to bank with them. What do you think pays for the tellers, branches, security, website, debit cards and the convenient ATM machines that are located just about anywhere? If the bank didn't have money making policies then you never would have entered one to begin with. I have banked with B of A for 7 years and the only money they have ever made off of me has been through using my money while they have it to the best of their ability. From a business standpoint why would they want to change this policy if it is lawful and makes them money without bothering a large number of their customers?. I am happy to allow them to take advantage of my money for the smal time they have it so long as I gain the security and convenience that banking with a large bank provides.
Why isn't everyone outraged over this! Bank of America has done the same dirty little tricks to me, and I have been robbed of hundreds of dollars by them since they bought out LaSalle Bank in April of 2008. B of A WILL lose a whole population of customers b/c they are greedy pigs. I disdain most banking policies - they are created to take, take, take and not much else. However, nobody has balls the size of Bank of America, don't you think? They just helped themselves to how many billions of dollars in taxpayer money for their so-called "bailout"? They sicken me. bait and switch fraud
This mega bank is playing bait and switch with CD rates.
We asked to move a CD to the interest rate that was advertised on their web-site, when the CD matured and I was assured by their Customer Service dept. over the phone, that would be done, twice!
But, after it was too late to move the CD, as it had passed it's 10 day 'grace' period, up comes a response on their obscure customer service page that "Sorry, that can't be done".
The complaint has been investigated and resolved to the customer’s satisfaction.
Lesson to be learned. Never do any banking transactions over the phone.

Reps there lie about their names and mphantom offers for buyers who do not exist. They will call you with a fake name then call you back with another to close you. The pitch goes like this: hI YOU ARE A CLIENT OF OURS... DO YOU HAVE YOUR ADMIN NUMBER? ( A FAKE NUMBER, NO MATTER WHAT YOU SAY YOUR WRONG...) THEN THEY WILL PROCEED TO TELL YOU, HEY HOLD ON LET ME GET MY PROPERTY MANAGER OR VICE PRESIDENT OR WHOEVER... LIES ALL JUST SALESMAN... SO DONT BE FOOLED WITH AN ILLEGITIMATE COMPANY... ALL THEY DO IS STEAL MONEY FROM PEOPLE AND RUN... NEVER RETURNING PHONE CALLS AFTER YOU SEND THEM MONEY!
They gave my info to a 3rd party
Through my bank, Huntington National Bank, I applied for a Master Card. FIA processed the application, turned me down and still has not sent a decline letter.
What they did do was illegally send the letter to an address I had more than ten years ago and no longer use! FIA claims the address was on the hand-written application. WRONG! The app was generated on a bank pc that had only current info on it! I though it was illegal to send personal info to an UN-authorized third party, but FIA says otherwise. When I find out the culprit, I will file charges with the feds.

excessive overdraft charges
My son has an account with Bank of America. He is new to the Banking business. He thought he had more in the bank than he did. He used his ATM card for a small purchase of $6.89. The following day a purchase of $ 7.66. Atm card no problems right? no he was charged 2 overdraft fees of $35.00 each. My complaint is when does the Bank stop allowing you to overdraw your account? Are they out to collect as many fees as they can? Would they allow you to come into the bank and withdraw money that wasn't there? At what point do they look out for you when you overlook something and put a stop before you incur numerous fees? I also have an account with BOA and have never activated or used ay of my ATM cards because of this reason.I just keep enough money in to keep it open so if I need to cash a check or anything I can But my banking loyalties belong to Wells Fargo even though I bank from afar due to there are no Wells Fargo Banks in they city I live in or close by for that matter. Think twice before trusting BOA as they apparently are looking out for the bottom line not you.
Very similar situation happened to me several times over the years with BOA!
I was going through chemo and didn't know my balance had dropped below by less than ONE DOLLAR and I accrued almost $300 in over-draft fees because they continued to pay bills going out.
It was awful and didn't help while fighting for my life!

Beware old customer or new customer:
Bank of america is doing what is called a research fee which charges you 20.00 an hour. I just opened an account with boa which should not be there name they do not represent america. Anyways I put in my payroll check which is from a huge and well known company. I took out half my check than 3 days later I got a decline on my atm card without any warning. My account was closed out by boa risk department and a hold was put on my check for 2-15 business days. After calling the risk department and sales associates hanging up on me I finally got information from the branch that stated my company check was being researched for fraud and that is why they closed my account out here is the part that they scam you by... They charged my account 60.00 for that research and will not refund me! Beware they can research your account anytime they want and can close you out anytime they want. Do not sign the signature card that is for the personal schedule of fees that has that research fee.
This is amazing, I have been a BoA member for 30 years back to the days of bank of the West, and a week ago opened up my 7th small business account. This was a new account and since I had a large deposit, I was rushed into the bank manager's office and given the grand two hour tour of benefits. I paid over $400 in extra protection fees, fancy checks, extra overflow accounts, etc. In the past two days I had received alerts on my phone for small (very small) monthly industry association fees that had been returned. I also had a $45, 000+ vendor check returned back to one of my vendors, and actually called them to aggressively share my displeasure. After two days of trying to reach the right person, I learned that without notice, and with a heavy positive balance, the fraud risk department had shut down my account and declined all activity, meaning the vendor check was returned BY MY BANK, and without ANY notice to me. I have been trying for days to understand what in the world has happened after a 30+ year history and all I keep hearing is that I will receive a letter in 10-14 business days, and a check of the balance, less any associated fees (what fees?). So while my business needs interaction ans cash to run, I am completely on hold until I receive this LETTER and an apparent paper check. Are you kidding me?
Okay so i notice all these complaints against bank of America, i to recently submitted a complaint which was quickly resolved. I started thinking seeing all these complaints. They can't keep up with the crooks. They try but probably keep getting pushed back. Honestly, i think the people doing the thinking on prevention of fruad are missing the most important thing. You got to be able to think like a crook. Not take learned knowledge from reports or books but really think like one. When you have this many comments about the same thing someone needs to talk to the person in charge of this department. For what it is worth, Bank of America is trying to do the right thing but needs to find people who know when its the right time to do it. I would love to help with this problem but unfortunately my background keeps me from jobs like that. So people dont get discouraged by the banks actions im sure someone will help you if you do what i did, file a complaint on their website and they will help you resolve your case. Jan 2013 my account information got compromised and a customer service rep closed my account and did not reopen my account correctly. . Since then my new account was not put back like my original account. I have fought with reps over the phone to fix my account. Every time notes are not annotated correctly from the previous rep. I have been charged for a lot of things that I never got charged for. I am an army veteran suffering from PTSD and headaches, so I am constantly in and out of hospitals. I put two stop payments on electronic funds transfer in the middle of June, 2015. My wife had a short week in her pay and we spoke to the creditors and they understood. We would eat the $60.00 in stop payment fees as it was far less than NSF fees we would have got.
I looked at the account and noted one of the stop payments was in "processing" like the bank was going to pay it. I called customer service and I was told, don't worry that "processing" is only the first step and overnight the bill would not go through due to stop payment. The following morning we have a negative balance. I call and asked why. It was the the amount of the stop payment $119.42 was not the amount that came in from the creditor. It was 114.29. I can clearly see where the banking service rep. made the error in transposing numbers. There was also a stop payment for 112.94. It looked like rather than confirming the correct amount with me, she guessed. This cost $60.00 on top of the other stop payment of $100.00 which the bank did not do also. So here I was overdrawn, with NSF fees, $90.00 in stop payment fees. None of my stop payments went trough. BOA, for now, has reversed all fees and did ate the $114.29 as it was paid.
My wife and I stayed the course with BOA through fraud in March, 2015. I live in MA and someone from Colorado Springs, CO wrote a check against my checking account. The name signed on the check is not a authorized user of my checking account so how is it that BOA allowed the check to be cashed? We thought that we did not turn the into the FTC or the Banking Commission that when this issue came up, they would take care of it. I am waiting for 45 days when all the fees and payments are reversed and throws our account negative. Lord knows a multi-billion dollar corp. like BOA will be affected by $300.00

I am on SSDI. Ever since I started collecting it seemed to me that money kept "disappearing" and couldn't figure it out. By disappearing I mean a few hundred dollars a month. They have contiuningly assured me that money cannot be taken out without a record of it (which I have disputed, but until recently found it can come out with no record). I checked my account on line 1 week ago. I had $479 in the bank (this was at 1 am ) at 9am I had $122. I called BOA and was told that even though all money had been posted it had not been callulated? Now all of a sudden I am getting $35 NSF fee everyday and more $35 daily fees for low balance? BTW-I have not written any checks or used ATM for 2 weeks.
Our renter and us have accounts at the same B 0f A. 6/1/11 $1K was transferred from renter acct. to our acct. 6/2 wife went to the bank, they confirmed funds and that they were cleared and that she could withdraw. She explained in detail what happened the month prior. We are presently evicting the renter. The month prior 5/2 B of A took the $1K out of our acct. She writes a check for $950. Dated 6/6 we get a notice that they again withdrew the funds back out of our acct. and that we owe them $1K. They confirmed that the electronic transfer does not take place unless the funds are in the acct. coming out of. Our renter has a B of A retired Marines deposit each month going in, about $3, 200. B of A says that our renter had more fund transfers out of his account after funds were put in our acct. They admit that it was a bank error, but since they filed a claim already on our acct. that they cannot go back on the renter. Today I spoke with their customer service at [protected], [protected]. People I spoke with are Gene Brown, Richelle Zonvarzs and Alena Burcham just getting a runaround from one person to the next saying that they cannot do anything for us. Our option is to go to the bank tomorrow, replace the funds, or B of A turns it over to a collection agency and there goes our credit. B of A admits it was a bank error allowing other funds to go out of renter acct. and then coming back on us for the funds. As I told them IF you had put an extra $100k in my acct., caught it a month later you most certainly would have come after me. They refuse to go after the renter acct. when his next $3K plus goes in on 7/1.
People cardservice/first data/ humdoldt/umpqua bank is all one fraudulent scam company. It is run by criminals. They have stolen my identity and placed my name on match list. I have filed complaints with police, banks and banking commission. There is very little effect. How does our US government allow or tolerate first data/cardservice/humboldt bank/ umpqua is a mistery to me. First Data/Umpqua bank is a dishonest criminal and corrupt company. It needs to remove anyone who it placed on the match list( in order to extort money from small businesses) and provide a confirmation letter along with a huge compensation as a result of these damages. They then should not be able to be bought or sold and allowed to open up under some xyz name. They should be permanently shut. Their operating licence should be permanently confiscated. They should pay 10 times compensation to anyone who they brought even slight damage by these fraudulent practices. The lawyers that defend crooks such as First Data/ Cardservice/Umpqua bank should have their licences revoked and prohibited from practicing law.

Countrywide Home Loan's Full Spectrum Lending division is a disgrace to an increasingly disgusting mortgage business.
Last April, my wife and I decided to refinance our home. So, we made a few calls and settled on Countrywide's Full Spectrum Lending because we liked the agent we dealt with. His name was John Donaghue, and he suggested getting an interest only loan because we were only staying in our house another year or two and we wouldn't be paying off much principal balance anyway. This way we could save more money. I checked into it, and he was right - the money we could save by paying off an interest only payment was dramatically higher than the money we could save paying off a 30-year fixed.
So, we went with it. John Donaghue was able to lower our monthly payment by an astonishing $500 a month! We were so happy! So, we signed the paper work.
Imagine my surprise four months later when we looked at our principal balance and it was FOUR THOUSAND DOLLARS MORE than what it was after refinancing.
Now, I admit, we did not thoroughly examine the contracts. And that is a mistake we will NEVER make again. Because if we had thoroughly read the contract, we would have seen that the reason our payment was so low was because John Donaghue roped us into a negative amoritization loan. Which basically means that we pay only PARTIAL interest and the rest of the interest is getting added to our principal balance every month.
So, we were saving $500 a month in payments, but $600 a month was being added to our principal balance! I admit, we should have picked that up when signing the contract, but shouldn't Mr. Donaghue have TOLD US THAT WHEN HE WAS TELLING US ABOUT THE DAMN CONTRACT?!?!?!? What kind of company allows their sales force to do that kind of crap?
So, we had to refinance again. We're back to where we started and have had to pay closing costs twice in the past year. Not good times.
I wish the story ended there. But, on Christmas Eve we found out that our new mortgage company (Allied Home Mortgage) had sold our mortgage to another firm. Take a wild guess who they sold it to!
You guessed it - COUNTRYWIDE!
So, now we're dealing with this deceitful company again and we have no recourse, but to bend over and take it from them. (Not unless we want to refinance yet again)
To make a long story short, Countrywide Home Loans and Full Spectrum Lending are two companies that you should avoid at all costs.

Bank of America uses incorrect dates for transactions. Here is the scenerio...on the evening of August 14 I went to bed, knowing that my paycheck from work would be direct deposited at midnight on August 15th. I told my husband that if he was up later that he could go ahead and pay our cell phone bill online when he saw that my paycheck was direct deposited. He kept checking the online account to see when my paycheck was deposited. He finally saw it deposited into my account at 1:45am (Eastern Time). So he then pays our cell phone bill right after he saw that my paycheck had been credited to my account. Well the following day, the 16th of August I noticed an overdraft fee of 35.00. I immediately called the bank to find out why this incorrect fee was posted to my account. The customer service person said that I payed my cell phone bill on the 14th, BEFORE my paycheck was deposited. I told him that my husband stayed up and payed it at 1:45 am right after he saw my paycheck was deposited. I even offered to prove it by taking my cell phone statement into a Bank of America branch to prove that the bill was paid online on the 15th. The customer service rep told me that this would only prove when my cell phone company RECEIVED the payment. He just kept saying over and over that the debit was made on the 14th when in fact it was made on the 15th. I have given up trying to get them to credit the fee back to my account after four emails to customer service and just canned responses received in response to my emails. If anyone is starting a class action lawsuit then I am in!

How is it that Bank of America can charge overdraft fees to my account when I have not overdrafted? They have charged me 9 overdraft fees this month and not once was I overdrafted.I was in the negative however when they took the first 5 overdrafts out.they credited me back only 4 of those witch was 140.00. the next day they charged me 3 more 105.00 they did credit that back and today 35.00 more out I am still not in the negative.I guess they are trying to figure out how to get all that keep the change money back.I plan on switching banks and do not recomend this bank.
Same as all the rest here, this 'Bank' has apparantly resorted to theft to fix their economic woes. BofA hit me 6 times for almost $200.00 in fees in 2 days. I saw there were a couple small charges pending (NOT POSTED) the evening prior, so I online transferred $ to more than cover them. Got hit with (2) $25.00 fees on the next day anyway. Those 2 fees pulled my account down so 2 more went NSF. They then charged me $35.00 each for those 2. Total of $140.00 overnight. I called the 1-800 number and plead my case - got $60.00 refunded. I was still pissed, but at least I got some $ back. This gets better, though. Knowing that I had 2 new charges on the way, I immediately went to the local branch and deposited cash in that account and added more cash still to the account that covers overdrafts. The teller saw two more charges coming, and said nothing. Logged on today to find 2 more $35.00 charges for those 2. AND THE MONEY WAS THERE! They said 'those charges were from the day before, and the money you deposited wasn't there then, even though it didn't post until today'. WHAT?! I called 1-800 and lost it - got nowhere. I called back and tried with another rep - got nowhere again. Tried a third time, and viola, got my $70.00 back. Folks, just keep calling them until you get success. Also, call the business number for customer assistance, there is no cue line to wait in, and the business account reps will help you with your personal accounts if you have a business account. This is a total scam - We have absolutely no proof as to when a charge is going to be posted to our accounts from a check card. The bank is in total control as to when these hit, and and they 'claim' that they have no control over when the vendors submit the charges. When they see a situation where their pulling money to cover NSF fees will result in a chain reaction of NSF's and more fees, they do it. This is a recent thing - I used to transfer money online to cover these issues, and was never charged NSF's before as long as I transferred money to cover them while they showed PENDING. I see the reports just like mine coming from everywhere, and it looks ripe for a class-action lawsuit to me. Better yet, spread the word that BofA will steal your money to every friend and relative you have, close your accounts and move your money to a local bank that does not take government bailout money. And call Clark Howard! I just did, maybe if enough people call him, he'll air their dirty laundry NATIONWIDE. They deserve it.
I have been banking with bank of America for the past 10 years. The customer service has steadily declined over the past year. The reps on the phone are very rude. This week, I found out they sent out a notice with statements a few months ago, regarding changes to their over draft and pending transaction policies. However, I had chosen their "paperless" option and do all my banking online. Since I did not receive this notice, I have $315.00 of over draft fees. I still am not sure how this new policy works and why I have all those fees. When I ask them to explain it, they act like i am stupid and are rude. I have completely lost their trust. My assistant at work, did not get the notice either and she accrued $245.00 in over draft fees. They act like we should have known about the change despite not receiving the memo.
I have read all over the internet about similar complaints to the one I have. I had money in my account and used my debit card, come to find out three days later and four overdrafts that "supposedly" there was no funds available. I know in my mind and heart that there was money because there had been a direct deposit and two cash deposits so there was enough for all the transactions to clear and still be very little wiggle room left over. I have tried to close my account, I was lied to several times by many associates that they would refund the fees. However, I have yet to see the refunds and the fees keep climbing. I HATE this bank, I regret the day I ever gave them my business. The problem here is not that I cannot manage my money, but that the online statements are decieving. It shows money in your account and even if you personally keep a running tally of what you know you have and have used they somehow to their profit make it so it isn't so. The problem is, they keep getting bigger and bigger and they will eventually get so big they won't care about the bottom line which is supposed to be their customers. To all my fellow "overdrafters without recourse" I feel your pain as do many others.
Bank of America's overdraft fees are completely deceiving and unfair. $35 dollar charges for spending ONE dollar more than I have when the bank displays your information making it appear as if I actually DO have the money is just EVIL.
I have a checking account with this bank and sometimes have a small balance before my paycheck is automatically deposited. This week, I was charges an overdraft fee of $35.00 for a $6.38 check card transaction even though my balance was more than the transaction. Another check was coming through their system at the same time as the $6.38. Rather than pay the $6.38, they took the larger amount knowing full well that by doing this, both transactions would bounce. I contacted the bank via internet and the lady said that "they had found that their customers would prefer the larger items to clear first". This is absolute crap and not a policy. It is merely what "they have discovered". THIS BANK WILL RIP YOU OFF! DO NOT BANK WITH THEM! THEY ARE THE WORST BANK EVER!

Bank of America and how they work by trying to overdraft your account so they can make money off of you.And have the balls to tell me over the phone that they dont care.
BOA cheats you by arranging you debit and atms so it looks like you overdrew your account. I had used my debit card from a Friday afternoon till Monday afternoon for various things. Monday I checked my available money and had a positive amount. We used the debit card that afternoon and overdrew our account by $26. This was done at 4PM. At 10PM I put $100 into my account, cash. I then had a reciept showing I had like $74 in the positive. The next day I was charged $175 in overdraft fees and then without using the account since Monday night, I was then charged another $35 fee! They manipulate the numbers in such a way, it makes you look like you over extended your self all weekend! I confronted the manager at my local bank and even called the main office, they argued with me over the account. You cant beat them, so I suggest you bank with a Credit Union or a bank that wont cheat you!
BANK OF AMERICA STEALS 1/2 MY UNEMPLOYMENT CHECK
Am unemployed. Have auto deposit unemployment which would be been deposited to my Bank of America checking account at 0001 hours on 7 July 2009. Woke up this morning to find that Bank of America had processed payments PRIOR to crediting the deposit, taking $280.00 (8 overdraft fees @ $35.00 each) from my account, leaving only $6.09 for me to live on. I request that the $280.00 be credited to my account immediately.
My father keeps getting overdraft fees from Bank Of America, which he has noticed is at the end of every month (also when they approve ALL the pendings in order to screw you with overdraft fees).. I mean it's kind of odd that they have purchases pending for OVER A WEEK and then when they know you have low funds they screw you with all the pendings at once to get an overdraft fee out of you.
Anyone else have this problem? Also whenever he goes to the gas station and uses his card at the pump a $1 fee always is shown on his statement but then when it isn't pending anymore it mysteriously disappears.. HMM.. could it be another attempt to overdraft?
My father is seriously considering going to Blumenthal about this problem with Bank Of America, and after a show talking about how this guy made a program for Bank Of America that they paid millions of dollars to have so they can screw the american people, I can't believe nobody thinks this is illegal when it clearly is the ULTIMATE SCAM..

First, let me say that Countrywide's criminal and unethical practices need to be stopped and all of us that have mortgages with them need to be compensated for damages. We also, have been financially damaged by them. To name a few, they did a classic bait and switch to our refinance loan; we were promised in writing a credit come back loan, yet we found out after the fact that they locked us into a sub prime 2 year hybrid libor adjustable rate loan, they falsified information on documents, did not provide us with a copy of a good faith estimate and truth in lending prior to closing, several inconsistencies between the loan application and the final documents, dragging the refinance over a 4 month period despite me providing all the documentation that they require at the first visit, pulling 4 "hard" credit reports as a result of their dragging their feet, lost payment. They also verbally promised us that we could refinance to a better loan at a fixed rate 6 months from refinancing. We received harassing phone calls several times during the day and night, even on Sunday mornings saying that we were late on payments despite me holding copies of my receipts and canceled checks written out to them. And the list goes on...
I refused to tolerate their abuse and took matters into my own hands when customer service started to give me the run around. I filed complaints and sent in all the required documents with the Office of the President (Countrywide), Federal Trade Commission, New Mexico State Attorney General Office, and the New Mexico State Licensing and Regulation for Financial Institution's departments. I also went personally to see CEO of my local credit union and also with the mortgage specialist at my local bank with all my documents to see about refinancing with them and bring my loan local.
Something that is not made public is that magical number [protected]/[protected] ext. 6441 to the office of the president. I raised hell and demanded to speak to the CEO. Of course he's always busy, so I was passed off to one of the first vice-presidents. He told me that either he would try to get help for me through the Work-Out program, or try to refinance. Because this process is taking too long to resolve, it prompted me to file complaints with the other agencies.
I have not heard back from the FTC to date. When I spoke with the NMAg, they were very interested in my complaint and stated that they have received several complaints against several lending institutions regarding predatory practices. I was dissatisfied with the response from the regulations department and was advised from the NMAg's office to send in an amended complaint to the licensing department with additional documents. I was referred to a couple of law firms in Santa Fe from a friend that is a prosecutor. Both law firms wanted to take the case, however, they required a $4500.00 retainer. I had to pass it up since I cannot provide the retainer due to financial setbacks recently.
The CEO and mortgage specialist at my credit union and bank both reviewed all my documents. They advised me that they are not lawyers and cannot give legal advise. However, they showed me several inconsistencies and evidence of predatory lending that are violations of lending laws on my documents. I am forever grateful for these two individuals that are helping me out of this mess.
If I were you, do the following:
1. Go to your bank and/or credit union and let a mortgage specialist review your documents to look for inconsistencies and violations.
2. File a complaints with the following: your state AG's office; your state regulation licensing office; Countrywide's Office of the President, Janis Allen, 6400 Legacy Drive PTX-320, Plano, TX 75024; the FTC; and other pertinent agencies.
3. If you type in the Google search engine "Countrywide complaints, lawsuits, " etc, you will see that there are several states such as California, Florida, New York, Illinois, Virginia, that their AG has filed class action lawsuits. See if there is one in your state and if so, get in contact with the law firm that is doing it.

I was also the victim of one of those LIBOR loans but not from Bank of America, but Indy Mac on a refinance of my home in Arizona when the costs of ownership kept soaring due to both the open borders in insurance rates, and that bubble. Lost the house, or gave it up actually and although I did get some money out of it, have been burned and will never purchase a home again as I see until those LIBOR loans are stopped and we get back to fixed low interest financing at reasonable closing costs, a home is now more of a liability than an asset.
Those LIBORs are patently illegal under our Constitution, for banks to be selling loans based on a foreign currency or index. And they are based on the Euro index of London banks, and as such clearly illegal in this country to be so offering such bogus loans to Americans.
And Obama is feeding them, as Bush did. Now they are offering those loans to kids for student loans under the Sallie Mae entity (which in very small prints states that it is not an arm of the U.S. government, although it would appear that the name itself is intended to give such an impression).
What a bunch of banking and morgage crooks - and with the feds in bed with them, and the states which is why you are getting no action. I reported this to the FBI and was blown off also. And then left Arizona to the crimnals.
We've had very negative experiences with CountryWide as well. A year into our HELOC, they milked us $1500 for home insurance, claiming they couldn't find evidence we had any (of course the application and approval process for the loan required us to provide this information and was checked off as received in the loan package). When we proved that we had the same insurance as when we originally applied for the loan, they refunded the money--but two months late, which cost us over $500 in amortization. When I complained that the money should have been refunded as of the date it was deducted--I was told that "it is impossible for us to do that retroactively." So I complained by email to the Comptroller, Treasury and cc'd Countrywide. The next day, Countrywide coughed up the $500+. You wonder how many millions they make from people who don't catch their crooked schemes or who don't have the time to follow-up with letters and emails to higher authority.
I'll never deal with them again.
Countrywide has no credibility in my eyes. I was involved in an accident and called customer service who began to rework my loan so I was told I followed their ever changing instructions and after months of phone calls and mailings was told the board had changed the criteria and if i wanted to keep my home I would have to agree to a payback plan thatr raised my payments to about 80% of my income at the same time the reported me late and destroyed my credit so now i qualify for no fed. help DO NOT USE COUNTRYWIDE AS THEY ARE CROOKS.
The comments concerning Countrywide are right on point. My primary grievance at this point is the unmitigated fraud and deception practiced on consumers -- myself included -- in the midst of this foreclosure crisis. I received numerous urgent notices from Countrywide to refinance at a better rate and also exploit the existing equity in my property. I spoke with a representative who assured me that the refinancing was a done deal, but I need to pay a $435 "processing" fee, which included an appraisal fee. I did so only on the rep's repeated assurance that there was no issue, no problem, I qualified for the loan, but they needed to do the paperwork to finalize. They took my money, sent out an appraiser who spent 10 mins at the house, then refused to furnish me a copy of the appraisal (actually hung up the phone a week later when I contacted the creep). Countrywide similarly refused to give me a copy of the appraisal.
I received a "Loan Application" by Fed Ex after this, which contained numerous misstatements -- overstated my income, falsely stated that I had a huge savings account, misrepresented the length of my employment. I refused to sign it without preparing an addendum listing all of the lies on the document. Countrywide thereafter refused to communicate with me.
After waiting on this refinancing process to conclude, I'd developed a "delinquency", thinking that we were going to get this straightened out when the refinancing loan finalized. Not so. A letter from Countrywide notified me that I was in "default" and needed to contact a particular number. That number led me to a guy with the so-called "HOPE" Department (which I guess means, they hope they can cheat you out of yet more money). His very first statement to me was "DON'T LISTEN TO ANYTHING THEY SAY AT THE REFINANCING DEPARTMENT" -- and this, ladies and gents, coming from a COUNTRYWIDE EMPLOYEE! What does that tell you?
Turns out, in order to cure this "delinquency" caused by the fraudulent refinancing scam, I would have to sign a document that released any claims that I had against CW for fraud. No way I was going to do that.
Thereafter, nothing but deathly silence. I even contacted my Senator, who in turn contacted Bank of America -- and that has been over a month now, with not a word from anyone.
What a den of thieves... Somebody ought to be in jail.
By the way, I am not soliciting business (I'm a lawyer) but simply making known what happened to me, and apparently to many others who got scammed on the refinancing offers. I'm an Arkansas consumer but unquestionably, this is happening (or has happened) around the United States. My next step -- the only one left available to me -- is to file a lawsuit. Apparently, it will be just one of dozens now pending against this company...

I am very trouble that I have done busness with countrywide bank they good for nothing. Since march of this year someone suppost to call me back, but not such a thing. This countrywide is doing nothing to help its costumers. at the beguining when I try to talk with them, I was talking with someone from Bombay India. I live in Panorama City Calif. This people make not sence.
Fraud Dept.
The fraud dept. at FIA Card Services aka Bank Of America is crazy. They closed an account over a year and a half ago due to fraudulent activity and opened me a new account. They said all the fraud charges were taken care of and I signed an affidavit. The newer account was closed in Nov 2007 due to divorce and was paid in full in the settlement. In Feb. 2008 I received a statement for $218 owed due to charges that had been found on the original account. It was from a Best Western in Europe and I have never even been to Europe. I have signed affidavits, talked on the phone for hours (mostly to people with an accent from another country) only to be told the issue is resolved then a month later the nightmare comes back in the mail. Today I faxed them 15 pages of items i had received, filled out, etc... from them. I sent it 2 times and sent the affidavit 5 times plus I am mailing it. This has been one of the worse experiences ever! They are sooooo screwed up. I wish I had never heard of them! Beware, stay away, close your account while you can!
My family has been a victom of Idenity theft! Two diffrent accounts were opened up in mine and my husbands names. We followed all the protacals to resolve this problem and FIA services denied our claim saying we profited form it. The person's investagating our complaints has NEVER EVER talked to me or my husband! My husband is a Chief ADA and has been for 27 years and if they are doing this to us, then they will do it to ANYONE! My husband is the LAW and these people WILL NOT CALL US BACK TO EXPLAIN IN DETAIL WHY WE WERE DENIED! We got a letter and I've called my husband has called and nothing! Then yesterday I opened my mail-box and there was the BILL man I was pissed and then on top of that the interest rate was 27%!

I paid my credit card bill on saturday the 2nd. It was due on sunday the 3rd. I got hit with a late fee which then put me over the limit and and then the over the limit fee kicked in. That cost a total of 70.00 dollars for a bill that was paid on time. This is a pretty nice scam they have going here. Payments made on a weekend don't count but billing is ok...

I have had a Savingslink savings account with Countrywide Bank for two years. Bank of America has now taken over since purchasing Countrywide. For most of this time, the money just sat there earning a decent interest rate.
Recently, I have found better deals and decided to withdraw my money. Since this is a virtual bank, one way to do so is to link this account to an existing checking account at a bricks and mortar bank. I set up the link to my Wamu account and confirmed the small test deposits in my Wamu account. I even tried transferring a small amount first to confirm everything is working fine.
I decided to withdraw the bulk of my funds and initiated the transfer all according to the bank’s rules. One screen even confirmed that my transfer was within the daily maximum limit allowed.
Couple of days later, I received an email stating my transfer was declined and my transfer ability was suspended. I should contact customer service for more assistance.
Knowing that there is no documentation of a phone call, I like to test their customer service by email. I logged into my account and sent them a pointed inquiry as to why they had taken this action of declining my transfer and revoking my transfer ability.
I received a response two days later. The response was rather cryptic and did not answer both of my questions. Their response was “when this happens, transfer is suspended.” I sent them another email asking why “this happens, ” referring to the declined transfer. I am waiting for a response.
One of the phone numbers left in the email is to their Loss Prevention department. Undoubtedly, they believe I am a thief who has stolen my account access information and am trying to steal my money. When I transferred the smaller amount, they apparently didn’t care about a ‘thief’ taking that little amount.
In actuality, I believe this is their way of preventing large sums of deposits from leaving the bank. They will just say that they trying to prevent theft. They don’t care about inconveniencing their customers. They don’t want their customers to get access to their money. They only care about their own needs. As far as I am concerned, my money is being held hostage until I can prove I am not a thief.
My whole purpose with electronic banking is for convenience and funds accessibility. Their policies are contrary to my purpose even though they appear to provide the means to serve my purpose.
They took my money
Well like other people, this company its nothing but lies! They took $415 from my credit card they tell me that with that money i was going to lock teh rate .etc etc... I tell the them that if in case i didn't get approve would they refund my money and they tell me YES! Well they didn't approve my loan and guess what; now either Sergio Lopez or his manager Will Cervantes have give me a call.
PLEASE BE CAREFUL WHEN YOU DEAL WITH THIS COMPANY. If someone knows what can i do, i really appreciate if you can send me an email.
I have a mortgage with Countrywide. I always pay my mortgage on time before the 16th of the month grace period. In November I paid my mortgage online 3 days before the 16th and was charged $6.00. I wrote to them and received no reply. In December I paid my mortgage 5 days before the 16th and was charged $3 extra. I wrote to them again and their excuse was that I choose to pay online and that because I choose to pay online I will be charged these fees. I am paid bi-weekly and for that reason cannot always pay by the 1st. I have called them to pay by phone and there is a significant fee for that. If i pay by snail mail the payment would probably be late and I would be charged a late fee. The internet is the only way for me. I feel this is very unfair and would like other people to know this before doing businesswith them. It is a small fee but does add up over time. In this time of financial hardship for alot of people, it's too bad that banks choose to gouge people

This is now the fifth company I have listed my timeshare with and been scammed. I know, why did I do it again. I was contacted on 5/20/08 by a man named Frank Johnson who told me he had a overseas buyer for my Bonnet Creek timeshare that was generated from test offer ad that had been placed in Nov 2007 by a Jason Rivera. The offer was for $52, 360. They told me I needed to pay them a fee to actually get me into their system so the sale could go through. I asked tons of questions about the buyer, I wanted proof that there really was a sale in progress. I asked to speak with Franks supervisor and I got Richard Burton who again assured me that everything was ggod to go. I refused to verify the first time with Maria Rayes and thats when I got the call from the "manager" Brian Cole who once again assured me and convinced me to give them my money for the "for sure" sale. They said it would take 2-4 weeks and that the money I was paying them would cover the closing costs and the broker fee. I would not have any more out of pocket costs. I have been calling every 2 weeks since May and for a while I could get ahold of one of these people. Then they referred me to a Dave Falzone who said they had title work completed and that they were just waiting for the buyer to send paperwork. He said I should call back in 2 weeks if I didn't receive the paperwork. I started calling back on Monday [protected] and would get a receptionist that would transfer me to an operator. I called 2 times every day since and would get the same answer - They are not in yet, they have gone home for the day(mind you this was at 11a.m. in the morning, they would have someone call me.
Up until this week I still had faith (like an idiot) that the sale would really go through. I know I just wanted and needed it to go through. Today [protected] is when I actually got on line and started to read the familiar stories. I want these people stopped!

they called me saying that they had a buyer for my timeshare in orlando, fl. they kept bumping the price up untill i could not say no.they ask me to fax them a sales type agreement and my credit card number for closing costs. they were to send me a cashiers check for 30, 000. after two weeks and a couple of phone calls i could no longer reach anybody but the secretary. i fould a 1, 500 charge on my card and they claimed that it was for advertiseing. unless you have money too throw away, stay away from them.
Charles..Keep fighting this SCAM company. You are not the first and will not be the last. Keep writing every complaint site and get the word out so everyone knows about this scam they have going. I still get calls thanking me about my warnings about this company. I have to keep getting back here more often to warn people. FIA Cardservices (Bank of America) offered me a settlement agreement for my past due credit account, but failed to mention that in order to secure this agreement they would be autodrafting a payment. I made my monthly payment as instructed and 2 weeks later, they tried to take more money out of my account. (They had my banking information from when I setup a draft months prior.) The payment cleared, so I had at that point made 2 payments for the month, and this created a chain reaction of bouncing in my account ending up in fees over $600+. The account rep agreed that I should not have been set up on a draft, and that I had not been properly informed. So she put in a request for a refund to my bank account. I was eventually told that I could not get any reimbursement for their abuse of my banking information, basically because of the settlement - since they were giving me a break, I wasn't entitled to any money back. If they did process the refund, it would cancel my settlement. That was the last thing I heard. Then today, I see that they went ahead and gave me a partial refund. When I call in to find out why I received a refund at all, when I was just told that I could not - the manager then tells me that they processed the refund but now they have canceled my settlement! These reps are NOT TRAINED TO UNDERSTAND WHAT THEY ARE OFFERING TO CONSUMERS. The first rep that offered me a settlement, DID NOT TELL ME that every single settlement agreement MUST have be paid with autodraft. Then the next rep that is "helping" me did not tell me that a refund to my account would result in cancellation of the settlement. How the hell am I supposed to make decisions to remedy this account, when these people do not know how to do their job and do not provide accurate information?
I have been told that they will offer me another settlement later this week... I guess that is their way of making up for their series of effing my account up! We shall see.
