I got a Clout Financial card when I turned 18. (Which was 2000) I defaulted on it and then set up a payment plan with their debt collector, First Performance Recovery. I made all of my payments and completed the pay off in December of 2004. I have been getting calls since 2006 saying that I never paid it and now owe up to 6K with interest. Every time I ask for something in writing they never send it and I no longer hear from them. Until six months later when a new company calls me threatening that I must pay it or else. I have checked my credit report and this card is not on it. I also just bought a new car and house in 2009. How is this possible if I have a huge debt lingering that I am about to be sued over according to these companies? And in Ohio I'm pretty sure that the statute of limitations are up on a credit card over six years old. I am pretty sick of the harassment and I am quite pissed that I have to be threatened over something I already paid off. These "debt collectors" need to get real jobs and stop preying on innocent, hardworking people.
We just had the same thing happen! They're requesting $16, 495 and we filed bankruptcy on this card back in 2009, which only had a $500 limit and it's not on our credit report either
I had them call me today threatening
me to a civil suit. It is almost over 8years and it was paid off when the first lawyer called 5 years ago. Then another lawyer called wanting payment in which I sent proof. This other lawyer wants proof or else when I no longer have proof and it's past the statue of limitations over 5yrs.
I had the same thing happen to me and a couple of days ago... may I ask what has happened or if you responded... because they said they had been trying to serve me and haven't found me at my home... they say I have til Monday to agree to a settlement or they will proceed with the civil case...it's been over 10 yrs on my account and of course don't have proof... I also was told that when I signed my contract with clout I signed a waiver of statue of limitation... just trying to see if they are using the same tactic with you? Any feed back would be much appreciated...
I also got a call today stating a had signed a waiver of limitations with this card. I don't even remember it from 2004. Not sure what to do its not on my credit report for me to refer to and I don't know what steps to take on this..
I consulted with a attorney and they advised that in the state of Texas statue of limitation is 4 yrs, and there is no such thing as a waiver of statue of limitation... It may be different in your state... the advise I received was free and it really eased my mind and allowed me to ask the questions I had...
I'm in Texas too! That makes me feel better I did get some free consultation here and they told me to call their bluff and ask for a copy of my signature on a waiver of limitations. I called and asked for it and they sent me a typical letter from their office BA Associates with nothing stating I waived anything.
THats good to hear! I will keep u posted if anything changes...
