We are BMI Holding SA /BMI Engineering Conakry from Guinea. I would like to tell you about the serious breach by the Chinese company Dongte Industry Co., Ltd (Chinese name: 东特钢铁（山东）集团有限公司) and Shandong Meidi Steel Co. , Ltd (Chinese name: 山东瑞耀金属制品有限公司).
In January 2023, Dongte Company issued a proforma invoice numbered DT20230111 to our company (hereinafter referred to as ‘Contract 1’). The main content of Contract 1 includes: our company would buy 300 tons of S355 steel plates in seven different sizes from Dongte Company (hereinafter referred to as ‘Goods 1’). Contract 1 follows CIF trade terms, with Tianjin as the port of shipment and Lebanon as the port of destination. The total contract price is $187,607.24. The payment terms agreed upon in the contract stipulate that our company will pay a 50% advance payment first, with the remaining 50% to be paid upon receiving a copy of the bill of lading. Dongte company is required to complete the delivery within 15 working days after receiving the deposit.
On January 8, 2023, Dongte Company issued another proforma invoice numbered DT20230108 to our company (hereinafter referred to as 'Contract 2'). The main content of Contract 2 includes: our company would purchase 2,855 tons of S355 steel plates in various specifications from Dongte Company (hereinafter referred to as 'Goods 2'). The contract follows CIF trade terms, with Tianjin as the port of shipment and Conakry as the port of destination. The total contract price is $1,585,348.04. The payment terms stipulated in the contract require our company to pay a 50% advance payment first, and Dongte Company is required to complete the delivery within 15 working days after receiving the advance payment.
After signing the contracts, our company made full payment for Contract 1 and 50% of the advance payment for Contract 2 to the bank account designated by Dongte Company. In other words, our company has fulfilled its payment obligations under the contracts as agreed. However, after receiving the payments, Dongte Company failed to deliver the goods within the agreed timeframe as stipulated in the contracts. They only delivered 130 tons of Goods 1 under Contract 1, and none of the goods under Contract 2 were shipped. Moreover, the 130 tons of Goods 1 that our company received were completely inconsistent with the quality standards specified in Contract 1.
After thorough investigation, we discovered that Dongte Company and Shandong Meidi Steel Co., Ltd. are actually controlled by the same owner (MR. Zou); these two companies are, in fact, sister companies.
At present, Dongte Company has refused to engage in any form of communication with us, completely deceiving us and causing our company to be unable to operate normally. We are reaching out to you to warn you against continuing any business dealings with this company in the future. Our Chinese lawyer has verified that this company is a complete fraud. We do not want to see more people fall victim to their deceit.
Furthermore, if you have also been defrauded by this company, please contact us immediately. We have already filed a criminal complaint with the local police in China and are actively pursuing legal action. We need to unite all victims to bring these fraudsters to justice and recover our losses as much as possible.
