this email was sent after i ordered product. took 10 days to arrive. absolutely no mention of this upon ordering. very dishonest. beware!

how the offer works
for a low shipping and processing fee, you receive the following:

a free 10 day trial of easy white labs™, yours to try for free for 10 days from date of order, complete with professional quality 3ml dental syringe with 35% carbamide peroxide mint flavored solution, dental impression mouth piece tray, instruction booklet and shade whitening comparison chart.
if customer chooses to keep the product beyond the free trial period, customer does nothing. easywhite labs will bill customer's credit card $78.23 and customer's subscription will begin automatically once the free trial period has expired. as long as customer's subscription is active, about each month easywhite labs will send customer a new 30-day supply of easywhite teeth whitening product and will bill customer's credit card the same low monthly price plus $6.95 for shipping and processing. if at any time customer wishes to end customer's subscription and discontinue receiving additional 30-day supplies of easywhite teeth whitening product, customer must contact easywhite labs� customer service department as outlined below. in order to avoid being charged for any subsequent product, customer must contact easywhite labs before shipment of customer's next 30-day supply of easywhite teeth whitening product. easywhite labs is not responsible for
any overdraft fees or situations resulting from customers using a credit card with an insufficient balance to cover the above costs. it is the sole responsibility of the customer to ensure funds are available to cover all applicable fees and taxes.

this purchase agreement (the "contract"), effective immediately upon your submission of an order to the easywhite labs company site, (effective date), is made and entered into and digitally signed by and between easywhite labs, (hereinafter "company"), and you, (hereinafter "customer").

free trial period.

when customer orders the free trial of the easywhite teeth whitening kit and agrees to pay the shipping and processing fee described on the order page, easywhite labs will ship customer a 30-day supply of easywhite teeth whitening product (the "product"). customer will have about ten days from the date of order (the "free trial period") to review the product and decide whether customer would like to keep it and begin customer's subscription or contact easywhite labs to return the product as described below. if customer chooses to keep the product beyond the free trial period, customer does nothing. easywhite labs will bill customer's credit card $78.23 and customer's subscription will begin automatically once the free trial period has expired. as long as customer's subscription is active, about each month easywhite labs will send customer a new 30-day supply of easywhite teeth whitening product and will bill customer's credit card the same low monthly price plus $6.95 for shipping and processing. if at any time customer wishes to end customer's subscription and discontinue receiving additional 30-day supplies of easywhite teeth whitening product, customer must contact easywhite labs� customer service department as outlined below. in order to avoid being charged for any subsequent product, customer must contact easywhite labs before shipment of customer's next 30-day supply of easywhite teeth whitening product. easywhite labs is not responsible for any overdraft fees or situations resulting from customers using a credit card with an insufficient balance to cover the above costs. it is the sole responsibility of the customer to ensure funds are available to cover all applicable fees and taxes.

subscription.

if customer chooses to keep the product beyond the free trial period, customer does nothing. company will bill customer's credit card $78.23 and customer's subscription will begin automatically once the free trial period has expired. as long as customer's subscription is active, about each month company will send customer a new 30-day supply of easywhite teeth whitening product and will bill customer's credit card the same low monthly price plus $6.95 for shipping and processing. if at any time customer wishes to end customer's subscription and discontinue receiving additional 30-day supplies of easywhite teeth whitening product, customer must call the customer service number at [protected] or email our customer service at [protected]@easywhitelabs.com. in order to avoid being charged for any subsequent product, customer must contact easywhite labs before shipment of customer's next 30-day supply of easywhite teeth whitening product.

account cancellation (within free trial period).

if customer is not satisfied with the product, customer must contact easywhite labs' customer service department as outlined below to cancel customer's subscription before the free trial period expires. customer must return the unused portion of the product in order to cancel customer's account with no further obligation. customer service will issue a return merchandise authorization (rma) number, which must be prominently displayed on the outside of customer's return shipment. if customer cancels before the free trial period has expired and returns the unused portion of the product using a valid rma number, customer will not be billed further.

account cancellation (after free trial period).

if customer wishes to cancel customer's subscription after the free trial period has ended, customer must contact easywhite labs' customer service department as outlined below. customer's account will be cancelled immediately. no further shipments of the product will be sent and no further charges to customer's credit card will be applied.

dispute resolution and charge back procedure.

easywhite labs will make every effort to provide the product as specified in this contract. in the event customer feels that the handling of any operational issue or the handling of charges by easywhite labs has been unfair or unreasonable, customer agrees to notify easywhite labs by certified mail of the unresolved issue prior to filing a credit card charge back or complaint. customer agrees to give easywhite labs fourteen days from the date of receipt to resolve the dispute. if customer does not receive a response from easywhite labs within fourteen days of the date of receipt of the original request, then customer may pursue any action without penalty.

incentive offers.

if customer orders the product through a third party incentive website that qualifies customer for a free gift and customer cancels customer's subscription before the free trial period has expired, customer may be disqualified from receiving the free gift. any questions concerning incentive websites and/or associated free gifts should be directed to the website owner where the free gift offer was made.

refund policy.

all sales are final. easywhite labs will not refund shipping and processing fees. customer cannot return product shipped during the free trial for credit if the customer does not cancel during the free trial period. no refunds will be granted thirty days after the order date for subsequent shipments after the free trial. refunds are limited to the last product shipped only. any refunds within thirty days of the order date will be subject to a 25% processing and restocking fee.

return of the product.

if customer wishes to return the product to easywhite labs, customer must obtain a return merchandise authorization (rma) number from easywhite labs' customer service department as outlined below. the rma number must be prominently displayed on the outside of the returned package and the package must be returned within fifteen (15) days. only the most recent shipment is eligible for an rma. we do not accept items returned as "refused" or "return to sender".

sales taxes.

easywhite labs has offices in the state of colorado and collects colorado state sales tax whenever a product is delivered to a colorado address. easywhite labs is not obligated to determine whether sales tax applies to state or local taxes for any order shipped to any location other than the state of colorado.

warranty disclaimer.

easywhite labs hereby disclaims any and all express and implied warranties including the implied warranties of merchantability or fitness for a particular purpose.

limitation of liability.

in no event shall easywhite labs be liable for (1) any special, incidental or consequential damages arising out of or in connection with the product or customer's subscription, or (2) any damages in excess of the amounts paid by customer to easywhite labs.

miscellaneous.

these terms and conditions shall be governed by the laws of the state of colorado, without giving effect to any principles that may provide for the application of the law of another jurisdiction. any dispute between the parties arising out of these terms and conditions shall be settled in denver, colorado by arbitration utilizing the dispute resolution procedures of the american arbitration association (aaa). if any provision herein is held to be unenforceable, that provision will be removed and the remaining provisions will remain in full force. the failure of either party to require performance by the other party of any provision hereof shall not affect the full right to require such performance at any time thereafter; nor shall the waiver by either party of a breach of any provision hereof be taken or held to be a waiver of the provision itself. these terms and conditions are the complete and exclusive statement of the agreement between easywhite labs and customer.

I just called them to cancel the automatic sending and they stated the same thing to me. Either I pay almost $20.00 more for the trial which in fact I already paid for, or send the free (NOTE FREE) trial back at my own expense. Or, they will charge me $78.23 - I told them, well you don't know what I told them. But, they still insisted that I pay for this trial offer. What a load of bull! Someone has to stop this practice!

I didn't have a problem ordering from them. But I also know to read the terms and conditions before buying anything from the inernet. in the upper right hand corner of the website there is the link that says view details, and it tells you all this b4 buying.

My mom got it for me to try b4 prom i drink lots of coffee, i saw a shade whiter which was better then the crest stuff. we called 2 tell them we wanted 2 go ahead and send it back, i didn't mind the shipping and handling to return it cuz it's still cheaper then crest as wal-mart.

My mom wouldn't pay the 78 for it, or the 20 to keep it cuz one of my teeth is a cap and it didn't whiten with the others.

I STILL LOOKED GOOD FOR PROM ! GO UNION REDSKINS! BROKEN ARROW HIGH SCHOOL ROCKS!

but for real though, y would you buy something with out reading the terms and conditions b4 you buy? IT's the in 2 differant spots b4 you order even on the screen b4 u put your information in

The problem are their faux grassroots/viral ad campaigns grafting CNN and US News logos onto intentionally amateurish fake blogs to seem more trustworthy and homegrown. Most consumers informed enough to research to the point of ending up here won't be terribly affected by these, but the problem is that companies ARE actively targeting those *just* hopeful and overly trusting enough.

For consideration, the CNN and US News snippets featured in tandem with this product on the related blog (I won't mention it by name) have nothing to do with either product mentioned, nor are they represented in any legitmate manner (i.e. links to quoted stories, assuming they AREN'T fabricated).

Don't believe for a second that this is anything other than malicious business. Read about Enzyte's criminal practices if any illusions remain that companies need to be shy about their contempt for the very customers they earn a living from.

P.S., Don't listen to anybody that cheers for the Redskins AND the Tigers... It's bizarre that somebody from my area code would have posted here "b4 me, " but to say THAT of all things... Sheer blasphemy.

I've had the same experience as those above. Calling, etc. This is not a reputable company, and they have very unsavory business practices.

Easy White Labs have very deceptive and unsavory business practices. They should not be allowed to solicit on the Internet.

This company should be turned over to BBB and put out of buisness. I am lawyer looking on this one and contacting the news media that this company says promotes their promotions.

I had a problem similar to other complaints. My order took over 10 days to arrive, and there was no way I could try this product within 10 days and cancel. I called to cancel and told them it only arrived on May 14, 2009, and my 10 days were already up. I wanted to send product back, and pay shipping charges per their advertisement plus the cost of sending product back to them. They told me to just keep product, and use it this month. Then if I wanted to cancel, just call them back and let thm kn0w.

I told him that I wanted to cancel that day if he could accommodate me. He said we would still have to pay for this month th $78.23. We were send individual amounts on the shipping and the individual prices of whitening products which added up to around $50.00. After they showed total amount taken from our card, it was $78.23. Where did the other $28.83 come from. It was not on my bank printout, but there was a charge for $4.99, $6.99, $14.99 with another shipping charge from overseas for $3.12 and another shipping charge from overseas that I don't remember that amount., but it was around $1.83. There was another charge for the product for around $24.99. That still only added up to close to $57.00. Where was the other charge for $21.23? So I think I really got it stuck to me. I have already called to have it cancelled again because I DON'T TRUST THEM AT ALL! I still am going to try to get my money back because I didn't know how long it would take for product to get here, and thought the 10 days would begin after you received Easy White products. They informed me the 10 days began when you placed your order. So I was screwed for lack of information. Also, I didn't realize products would be coming from overseas and have 2 shipping charges on each of the 2 products. I am mad as HELL and intend to call to speak to a manager to try to resolve the mess I'm in. My husband has been taken off payroll, so we only have my Disability which is $720.00. We will have to get Food Stamps and any other assistance we can. His case is a Workman's Compensation which they are getting info from all his Dr.s and determine if it is a compensible injury. So we really could use that $78.23 to pay some of our bills.

Don't ever order from them or believe their ads on TV usually late at night. They are liars from the pit of HELL! I have said enough to get off a little steam out. It does good to read all these other complaints and voice your issue to someone else.

I ordered, was scammed and then they credited my account only to take another 85.00 and then I started getting debits on my account for 7 and 8 dollars froweight loss. HellooooI only weigh 95 lbs I don't need this crap!
Then I call and can't get through. Just be careful I had to order another bank card and now I have to fight to get back what was never theirs. Go to your dentist! You will only be charged for the services you recieve. I plan on taking legal action. They sold my account information. Need a list of those that were scammed. Class action law suit. njoparker1@yahoo.com If you are tired of them telling you it's your fault email me and we soon put them out of business.
