This is the service agreement number B81685F, reference number 2748545. I had purchased a service agreement with Famous Tate when I purchased a refrigerator on 07/03/2019 with an expiration date of 07/03/2022. In May of 2022 I called to have the refrigerator serviced as it wasn't working properly. I'm still within the service agreement period at this time. Famous Tate sent Quality appliance repair to evaluate my refrigerator, the tech said he would need to order parts and return. The technician returned a week later and replaced some parts, he told me to give the unit 24 hours for the unit to reach temperature. After 24 hours I called Famous Tate and informed them that the unit still wasn't working, they contacted Quality and they returned that same day. The technician ran some test and said he needed to order additional parts which he then returned two weeks later to install the parts. Again I waited 24 hours and informed Famous Tate that the refrigerator still wasn't working. Famous Tate said they would (dispatch) the service to Whirlpool and that Whirlpool would contact me. Whirlpool sent over R&R appliance repair, the technician ran some test and said he would need to order parts, should take about a week to come in then we'll schedule an appointment to install the parts. After a month of waiting I contacted R&R and they said they hadn't received the parts yet. So another month goes by and finally I get a call from R&R to schedule an appointment, 2.5 months later. When the technician comes he replaced the same part that Quality appliance already replaced, I told him that part you're replacing is brand new. He just replaced it and was out door as fast as he came in, no testing no nothing. After 24 hours I called R&R told them the unit wasn't working, they said to call the warranty company they already sent a report to Whirlpool. So I called Famous Tate again, they again (dispatched) the repair to Whirlpool who now sends over Flamingo appliance repair. The technician runs some test and says he needs to order parts. The parts come in but they're damaged, the parts again come in three weeks later now and the technician installs the parts. I wait 24 hours again and call Famous Tate to inform them the refrigerator isn't working.

Famous Tate rep tells me that I'm out of warranty at this time and there's nothing they can do for me. I told him that I was within the warranty period when all of this started and every rep I spoke with after 07/03/2022 told me I'm still within the warranty because this action started while I was covered.

The service agreement states - If we determine, at our discretion, that we cannot repair your product due to the unavailability of functional replacement parts, technical information or it is not cost effective. We have the option to replace your product with a new or reconditioned product of like kind and similar features, capacity and/or efficiency or we may elect to pay you a cash settlement.

So why is it I'm now out of warranty after months of delays and failed attempts to get this unit up and running. I feel Famous Tate has not held up to their end of this agreement. I have been very patient throughout this whole process more so than most people would have. I believe this is very unfair to me and my family.

Desired outcome: I would like Famous Tate to hold up to their agreement and replace the unit with a new or reconditioned unit of like kind.
