We arrived at King's Creek on Friday, November 25 for a 2 day stay using a reservation we booked with II points. On Sunday, November 27, 2022, we met with Anthony for our "owner's update" as we were Legacy owners with KC. Our goal in coming in for the meeting was to find out how being part of Spinnaker affects our ownership. We had absolutely no intention of changing our ownership.

During the meeting, Anthony outlined the "benefits" of being points based instead of continuing with being a Legacy owner.

- We were told that points are more flexible to use - you don't have to use the whole week - you can just come for a few days here and there.

Right away, this caught our attention because we were still smarting from having lost the majority of a Legacy week because of scheduling conflicts arising from Hurricane Ian. We were only able to use part of the week. Consequently, the unit remained vacant Sunday-Thursday night which was upsetting for us.

So, the idea of being able to use partial weeks was appealing. However, NEVER was it said that in order to use partial weeks, you have to wait until 29 days before you want to go, OR that there was a 3 night minimum, OR that to circumvent these stipulations, you would have to deposit points into II and pay $219 to use. Knowing this would have DEFINITELY turned us off to switching to points. Further, I specifically asked several times about the approximate number of points required to book units so that I could get an idea of how much "vacation" a certain number of points would get. I even asked to do a hypothetical: if we wanted to come down on this date, stay this many nights in a 2 bedroom unit, about how many points would it require? Every time I asked for specifics and clarification on the number of points needed, I was told the number varies by week and unit, and they could not give me any idea. Come to find out, there are fixed numbers. Had we been told that it takes 40,000 for 1 bedroom, 80,000 for 2 bedroom, and 120,000 for 3 bedroom again we would have DEFINITELY not proceeded because for the 120,000 points basically we would be getting a 3 bedroom unit for a week - which was already what we had in the Estates which we prefer over the Cottages. We didn't NEED every year as we were happy with every other year. We wanted the flexibility of points to do partial weeks which was totally misrepresented as we would have to book a week (which is what we had to do with Legacy) or wait 29 days out when there is not likely any availability over the summer.

- When asked if we owned other timeshares, we said that we also owned 2 other properties. He asked about our yearly maintenance fees and proceeded to tell us that with this new program, we could rent out a week with Endless Resort Options for a $99 fee, make enough money to pay for ALL our maintenance fees, AND still have points left over for our own vacation at KC. Several times he showed us on paper how this would work: Use the points to secure a week, pay $99 to ERO, they rent the week, we get the income, pay all the maintenance fees, and still have points left over for vacation. Several times he said words to the effect of I'm not telling you what to do, but if you can pay all your maintenance fees and still have time to vacation, it doesn't make sense not to. He actually made us feel stupid for even considering not moving forward. We even asked if we could do this program with the Legacy week we already owned and were told that we had to be Club Explore members to avail ourselves to this program. Again, come to find out now this is totally not the case. We definitely will not make enough to pay all the maintenance fees, and we could very well have just done the rental with the Legacy week we had.

We feel that we have been intentionally misled and outright lied to by both commission and omission. Had all this information been fully disclosed, provided to us in writing, and explained thoroughly and honestly, we would not have "upgraded" as this is not an upgrade for us. Ideally, we would like to be able to cancel this contract and return to the Legacy week we previously owned in the Estates as this new program is not at all what it was portrayed.

Since December 2022, we have been trying to address these issues with the resort and have been stonewalled. Our emails and phone calls are not returned.

Desired outcome: Cancel contract and return money paid

I had a very similar experience... There are so many hoops to jump through and the keep changing the rules.. its impossible to book..if you do it gonna cost you a lot!
