The complaint has been investigated and resolved to the customer’s satisfaction.

Living Well Lady Fitness Centers is taking advantage of it's members. They conveniently sent a letter dated November 19th notifying members of a charge of $25 for 'enhancements' to the fitness center. The letter was not received until December 12th, after the fee was debited from my checking account. Their membership contract does not disclose that there may be other charges during your membership, other than those you would expect for services like a fitness coach.

The enhancements are made at their discretion and they should not be charged to the members. This fee is their way of getting around the membership contract since it very clearly states the amount of payments and how many payments you have to make during the term of the contract. How can they be allowed to charge everyone like this? What if they decide they wanted to buy additional property and build tennis courts, would we also have to pay the fee for their expansion?

This is grossly unfair and they know we have no option on canceling membership for poor service at the club or because it is no longer needed and they take advantage because of this.

I filed a complaint with the Florida Department of Agriculture and Consumer Services, who administers the Health Studio Law. I hope they can look into this situation for those of us who cannot afford to hire an attorney.

I was also charged the $25 fee. I see no changes to the gym it looks the same as when i started working out there in 1998. I spoke with there manager and they told me they would not be refunding our money, and i know wemen who were not expecting the charges and have over draft fees on there accounts.
I belive we should have been given the choice to pay the extra amount on top of our monthly membership charges. When my contract ends am going to Porkys Gym by La Carreta, The membership is only 191 per year versus the 30 a month i pay at Living Well and now adding on the 25 per year if u pro rated am actually paying 32 per month.

I totally agree with everyone else that has made a post in regards to this situation. Not only is this absolutely unfair, in addition, Living Well Lady Fitness Center is not abiding by the terms of the membership contract. There is no disclosure as far as any future fees for fitness center enhancements. I, for one, never even received a notice about the $25 enhancement fee. I found out when I checked my bank statement and realized that I had been charged an extra $25 for membership and an overdraft fee. I called the manager, which by the way, lacks customer service skills and told her that I would like to dispute this with her superiors. She told me that someone would get back to me as soon as possible. It has been a month now, and I am still waiting for a response. I have also filed a complaint with Florida Department of Agriculture and Consumer Services and I will file as many as possible until my money is refunded in full for the $25 enhancement fee and bank overdraft fee. The state shows a great record for this company. Go to www.livingwellandfit.com and click on site in order to contact whoever you may need to contact. They have helped members who are due but some are not since it is stated on the contract.
They only service women so Im not sure how a man
"Carlos" could be hindered in any situation in this club. This must be a Porkys guy.
I do know they had a problems but the new ownership has been doing stuff for the clubs.

They have been ripping off people for sometime now. The manager in the Living Well Lady in Hialeah, Cynthia Alonso, is extremely rude and does not care about the clients but for her pocket . She is extremely disrespectful to her employees because I have witnessed it myself. She has broken many laws that I hope will be investigated because they have been reported. Beware and do not sign any contracts with this gym.

By Maria. They did it also to me. They ask for your credit card number to make the automatic charges but use it to make a lot of tricks like charging you twice or charging unexpected fees . They are not honest. This company needs to be thoroughly investigated because they are abusing and ripping off people. Please, be aware of this and complain to the Florida department of Agriculture and Consumer Service.

Livingwell Lady at first to me was a fitness experience, in which I now realize the price paid in dollar amounts, I have been with this Hialeah club for fifthteen years currently, along with investing much of my hard earned money in which I could have saved or put into a bond etc. After my first contract rendered/expired, at a later time I renewed my current contract, in which this lady by the name of Irene sold me this dream; "She stated that I would be able to cancel when I choose to and that there was no extended contract I had to fulfill." The actual contract was a three year contract with a monthly fee of $32.00 a month, not to mention the $25.00 all the other woman have discussed in their statements on this page, what a rip off. Last of the changes they did was two yellow hanging lights in the front and s0me paint. The $25.00 were a fee that was implemented without further notice to any member and without any contract clause notification. At a later time, months later, I signed another paper for personal training (Fitsource) in which I drove from Downtown to North Miami Beach Livingwell location, another mistake and a lesson learned in which I was informed that there would be a charge of $20.00 a session, average $200.00 monthly. Currently, we are in the month of March 2010 and when I decided to relocate to another city and cancel my contract, this is where all the headaches commenced. First of all, I decided to close my previous bank account from Bank of Amercia in which I contacted Fitsource customer service number initially to inform them. When I received a letter from the bank stating that I owed them a total of $ 180.00 between overdraft fees and Fitsource monthly fees, I immediately contatced both the bank and Fitsource. The bank, at when I attempted to file a claim required a letter from the merchant ( Fitsource) for them to explain as to why they charged these monthly fees to this account when they received specific information about my new bank account information per telephone conversation with customer service representative. To make a very long story short, they told me that they would not be able to help me because when I called they only changed the information for one agreement contract and not the other personal training agreement number, I informed them that it is not my fault and that it is the cust serv rep responsibility to change both agreement numbers, not mine. Fitsource did not help me at all and I got stuck with all those bank fees in which I have the paid paperwork for, I had to completely close that Bank of America acct to not get more overdraft fees. Not to say that the district manager contacted me to pressure me into paying the monthly fees and an additional forty dollars if I did not pay that same day. Prior to his phone call, I had already spoken to a serv rep to inform her that my debit card information had changed, therefore; she waived the late fees and acknowledged that I would call back with the new card information. Whenever an associate at Livingwell attempted to help me, they would get fired, it's almost as if this company changes personnel regularly enough so relationships cannot be established. At the end of it all, they charge you a 20% at cancellation time for the remaining balance of your contract, it seems like the nightmare lasted forever.

I have only one thing to say about LivingWell Lady. To all you ladies out there DO NOT JOIN THIS GYM because once you join and sign that contract there is noway to get out of it, not even if you become disable which is excatly what happen to me. I've placed complaints with B.B.B and also with Fl Dept of Agriculture,
hoping they can help me and my credit doesn't get ruined because I've cancelled the overdrafting from my account, is just not right. THIS PEOPLE ARE THIEFS. There are plenty of gyms out there offering no contract look into it.

This place is a scam... i signed a two year contact for $38.00 a month. I attended this GYM five times because thier lace of equipment, help and classes. After the two years was up they told me my contract was for three years. I called ABC Financial and sent them my contract and they told me they only go by what's on record from the club. The Club refused to take my contract saying a fixed it! I paid an extra year. This August 15th I called to make sure this was my last payment. They said the club placed me on auto renewed and I already owed another $38.00. I went to the club and was treated so badly by Cindy the owner. She has no sense of customer service, or respect for customers. She treats everyone including her staff like peasants. I dont know who she think she is but owing a gym is not having a forbes 500 company. I am a professional women with a great career and treat everyone with respect. I have not felt so angry at someone as i have with this women... She has no customer service, social skills, and looks like you as if you just a dollar.

Simmilar situation at the Kendall location. I declined to renew my membership was told that all paperwork had been processed and i would not be automatically renewed. Checked my billing statement three months later and saw that i had been charged for three months and that my contract had been renewed. When i called to clear this up no one new what to do. After 2 months of back and forth i was told i would be refunded my money. Yet another lie as i have never been refunded my my money till this day. It's been over 2 years.

total rip off... they suck! My crdit got messed up because the gym didn't want to cancel after I sumitted proof from the doctor saying that I couldn't do any physical activity. Im sooooooo mad! :(

I have a similar situation going with this company, the Kendall location in
Town and Country closed and moved out overnight, and I was never notified of the change of location. However, they are still withdrawing the membership fee from my checking account. I called to cancel my membership, since the new location, was not convenient for me, and the person over the phone in a very rude manner told me that I must pay 80% of the contract in order to cancel the membership.
So, I will delegate this matter to my attorney.
It is a Living "Hell" Lady Fitness Center.

This gym is the biggest scam ever! The lady sure lied and didn't mention the 3 day rule. Which means that you are able to cancel your member ship in 3 days. This was in 2008! I just got a call that they are going to forward me to collections for 1, 500. I only went 3 times. Then my doctor had told me that I wasn't able to work out anymore. I sent them a letter with proof and they did nothing about it. The sales person was extremely rude and not clear about the information. This was in the Hialeah location. Horrible customer service.
