I have booked a Flat at Dahisar, in a project of M/s Nahalchand Laloochand group known as NL builders, in February,2006. The builder had given me payments schedule and I was ready to pay as per the same. I had deposited a sum of Rs.65000/- towards earnest/token money in cheque and further a sum of Rs.78000/- towards stamp duty and registration etc. Then after builder has sent a demanding letter for Service Tax which was not mentioned anywhere in their earlier payment schedule. On the first instance, I had denied to pay the same because it was not mentioned in the total payment schedule and was out of my capacity to pay. Then after, many telephonic and written correspondences done with them. Finally I agreed to pay the same and asked them to generate bill mentioning Service Tax registration number/date etc. but no reply received from the builder. However I went to builder's office to deposit remaining margin money with them but they denied to sale me the flat. I asked for the refund but they refused on the pretext that they were waiting for the lapse of the date mentioned in the payment schedule and then after, they would forfeit all my money as per terms and condition in the letter. I had sent a request notice through my lawyer but they have replied that we have forfeited the money according to the terms and condition of the earnest money letter. I had went to Dahisar East Police Station but they denied to lodge an FIR and asked me to give all details and document then they will take necessary action against the builder. I did the same but no reply received from the Police Authorities.

I am sure that builder had not registered with the Service Tax authority on the date of their demand of the same. However, Service Tax applied to construction Industries since June, 2005 then why builder had not mentioned for recovery of S.Tax in their payment schedule?. S.Tax is a statutory compliance like payment of Registration and Stamp Duty which they have hided purposely while entering into an agreement of Sale of flats with customers. This was a hidden policy of the builder.

Inspite of my payment of Rs.78000/- separately in cash towards Registration and Stamp duty and other charges, they have not made Sale Agreement with me and not registered the same. It shows the intension of the builder to acquire more and more money from the buyers and forfeit their money by lapsing of their time limits in correspondences and demanding money by way of Service Tax. The another possibility of cancellation of the deal by the builder was not having registration of S.Tax with them and they might have sold flats without levy of Service Tax since June,2005 OR they have obtained the Service Tax amount but not deposited with the Government Treasury and they had fear of complaint of the same by me.

It has come to my notice that the builder had sold same flat to more people and they were fighting in their site office.

Mr. Kothari is 100% correct. NL builders are the biggest cheats on earth. I have purchased a flat which was under construction at dahisar (east) and I was told that I will get posession latest by september 2007. Till date i havent received the posession.

The worst part is there is no responsible person to talk to...and if the media supports, I would like to bring their scam to light.

If any one from the media can help me to bring this to light, please do let me know.

Mr. Kothari and Mr. Ganesh is 100% Correct. NL Builder (Nahalchand Laluchand - Rajesh Bhai) is the biggest biggest Cheater on Earth. I am Tenant of Irani Chawl Rahiwashi Sangh. Delisle Road, N. M. Joshi Marg, Mumbai - 400 013. The NL Builder is misguiding to all Irani Chwal Rahiwashi's, he told will give us 325 sq. ft. carpet area wearas in plan is showing 291 sq. ft. carpet. We all Tenants disagreed to NL Builders Plan. Also NL Builder has a case WITH OUR SOCIETY and also with MHADA.

Today without any once concern or without telling anyone he has started a basic work in our society like, putting up materials in the compound.

N L Buldier is a cheat. Would recoment not to deal with him or file as many cases against him as possible. He is definately a big cheater... He has cheated and forcefully applied his laws for many transactions...

construction quality of NL Builder is not good. In short time you can notice cracks in your structure. There big problem of water, which is unsolved. Many buildings of NL complex has not getting water for 30 minutes a day also which is very worst. While going to NL buiders office he is showing fake amenities of their project like 24 hours water, good construction quality etc.

He is not good builder.

Totally agree. I would discourage everyone investing in NL properties. Stay away.

There is no reason to disagree with the above comments. NL is the biggest cheater in the industry in Mumbai. The Director sweet talks at the time of sales and then, after receiving all the payments, he forces flat purchaser to sign undertaking with clauses loaded in his favour which is used against the flat purchasers. Recently, the honourable Supreme Court dismissed his appeal and totally agreed with Mumbai HC judgement strongly criticising his modus operandi). He is notorious tacts - not to allow coop. society to be formed, forcefully impose maintenance services and recover high charges, not to pay municipal taxes ever after recovering through advance maintenance, exploiting common car parking facility by recovering exhorbitant illegal payments, taking exhorbitant transfer fee for selling / leasing flat by flat owners. He enforces his cruel sadistc ides through strong arm tactis of his security staff, who behave like underworld goons. Buying flat in NL complex will be committing "HARAKIRI"

Rajesh himatlal is not only a cheater but big time cheat forget customers he has even the tendency to eat hus own employees salaries. Beware of such a cheap cheat in the market

i want to buy apartment in nl garden atladra, vadodara. after reading reviews i confused weather this builder is right or not? because on their website 2bhk super is listed 1150 and the brochure they give its mentioned 1050 and if i calculate carpet as per room dimension its not 700sqft as the mentioned on brochure. on its online brochure its 1025, on website its 1150 and on brochure they give me has 1050 which should i consider?
