January 30 2023. On Thursday Jan 26, I met with Gary regarding pool construction. The process was discussed as to what I should expect There was a sidewalk that we marked a 6 ft area that needed the pavers taken up and I was shown the area the Bobcat would come threw in the front and what landscape would be affected. I was told to contact the paver company and landscapers so we could get things moving. This was a Thursday. On Friday I called the paver co. and my landscapers so they could come move the sprinklers and the paving co. could take out the 6 ft area of pavers to prepare for the Bobcat. at 12:18 a.m. I was plugging my phone in to charge and there was a message that someone was coming at 7 am to start excavating. I immediately sent a text to Gary letting him know it was too soon as the paver co. nor the landscapers had been out yet to fix what needed done. I also set my alarm to get up at 7 to stop anything from happening. I was awoken at 6:55 am with a loud bang, and my house was shaking. I jumped up to get a robe, to see what was going on. I checked my phone and Gary had sent a text to me at 5:36 am that he would call them and stop them from coming. I contacted Gary and he said he will call them again and tell them I was not ready. I went outside myself and by the time I got out there, they had already knocked down the brick wall, and was in my back yard digging. Since the pavers were not taken up as planned, the Bobcat ran over them and it caused them to lift up and pull 5 rows from my gazebo floor, up out of the ground, since the floor where the gazebo was, was connected to that sidewalk that needed taken up. Had the 6 foot area been removed it would not have affected the gazebo floor at all.

On Feb 12th I was leaving my house through the front door and noticed all my landscape in the front yard was dying. I was unsure what was wrong. I never thought about what damage was caused out front as I had expected a certain area to be disturbed, but was unsure why the rest of my yard was affected. When I went to look I discovered that the sprinkler lines had all been torn up and frayed when they ran over the area by the block wall. They then shut the water off to my sprinkler system so for those 12 days my plants got no water. If the landscapers had the time before the Bob cat came, they planned to pull the sprinklers back and cap them off so they were not damaged during excavation. I email Gary to let him know what happened to my front yard. Gary never responded. I called and left him a couple messages and he did not call me back. On Feb 15 I received a text from him that his wife had been sick and he would look into it and get back to me. He never got back to me. I called him several times in March and beginning of April, and he did not respond to my messages.

On 04-26-23 I emailed Monica Diaz and let her know what the problem was and she asked me to send her photos, which I did. I had to pay 300.00 to fix the pavers, and 350.00 to fix the sprinklers, and replace a few plants.

On 04-27-23 I followed up with Monica and she said she was looking into it and was going to meet with Gary later that day, and would get back to me.

On 05-15 I emailed Monica again and asked what the status was, she said she reached out to Gary, and she would include him in on this return email, which she did.

On 05-23 I notified Monica that I still had not heard anything and she said she will follow up.

On 06-03-23 I notified Monica that I still have not heard back from Gary.

On 06-05-23 I emailed Monica and she did not respond.

06-07-23 I emailed Gary directly and got no response.

07-12-23 I emailed Monica to follow up, and got no response.

I feel that I would have been responsible to pay the paver company something for moving up the 6 feet that I was told to move. Since they messed up the gazebo floor the excavating company should have to pay 1/2 the cost. I paid 300 so they should pay 150 of it. I would have also been responsible to have the sprinklers pulled back and capped off. They should pay for the damage to the sprinklers that needed replaced. I paid 350.00 for the damage and repair, so they should pay 1/2 which is 175.00. Total compensation should be 325.00.
