Cheated, lied and misrepresented
Last year we purchased a property in myrtle point oregon from a local realtor, whom were selling for one of many newly created LLC. After contacting real estate broker and agent we were told to go out and look at property to see if we were interested in it. When we went to the home to look at it, the sellers were there doing the last bit of clean up on property and took us thru the home and described to us property lines, and work they had done to the home. They claimed they had not lived in the home but had a friend that lived here for a year while remodeling the interior of the home.
The ambiance of the home was what we were looking for and we after several months of looking decided to make an offer on the home. We immediately called the real estate agent and told her we were interested in making an offer providing it passed a pest and dryrot, and the property was large enough to build a small garage to store our belongings, in which she backed the seller in what he had told us. At that time the realtor insisted that if we wanted to purchase the home we needed to put down 1, 000 earnest money and make an offer as there were several people interested in the home. Thinking that the real estate agent and our friendship of 30+ years we truly believed that she had our best interest in mind. The next day the sellers accepted the offer.
We went thru all the necessary paperwork to finance the home. We found that the home was in a flood plain and were assured that the home never flooded, but the bank wanted us to purchase flood insurance irregardless. The bank came out and appraised the home and property at the asking price. The pest and dry rot people came out and did the inspection. We were still waiting on the dry rot report to come thru and then got a call from the agent stating that it had passed with flying colors, and that we would be sent a copy to review. Again believing that she had our best interest in mind we proceeded with the purchase of the home.
After living in the home for 1 month we started having electrical problems. The fuse box was overloaded to the point where you couldn't use the dryer and computer with out the whole house going dark.
We contacted a licensed electrician whom came out to inspect and upgrade the box. He told us it was a fire waiting to happen. Apon going under the house to find a ground wire we discovered that the whole underneath of the home was severely compromised. The post and pier was not in contact with the main load bearing beams and no ground wire connection in place under the home. 40% Of posts and beams were rotten, full of post and pillar beatles, and had earth to wood contact and some fallen over. The framing that held the siding up was rotten and caulked and painted over to discuss flaws that were obvious to the naked eye. Upon further investigation things under the home began to be a nightmare.
Not only under the home the rest of the house began telling what was really going on. The roof leaked into the walls, the gutters were split and leaking into the soffets, a huge hole in the floor next to the enclosed furnace which was hidden by a closed vent on the floor, a painted over bathtub and an open well under the house! We were then told by the neighbors that the fella whom lived here died in our bedroom less than a year before. The huge window in front of the home is full of carpenter ants, the wall in the den is full of post and pillar beatles, the list goes on and on.
As things rolled on we demanded to see the pest and dry rot report from this agent, whom didn't even have a copy, and was calling the pest and dry rot people the same time we were trying to get her copy 2 months later after telling us it passed with flying colors.
Then we found that the property we were represented as being ours does not in fact belong to us. The back yard goes only 46 inches from the foundation of the home and the southern side of property line runs right thru the center of the home.. Apon discussion with the agent, her response was to" get busy and do our homework and make fiends with the neighbors whom own the back yard to the east and thru the center of the house on the south".
After "doing our homework", we have discovered the house was purchased 3 months prior to our purchase by the sellers, no one lived here for over 9 months before our purchase and they had made 4 times what they paid for it by using a paint brush and many tubes of caulk and then flipped it onto us unsuspecting buyers.
To date we have over 75, 000 in bids, 40, 000 in out of pocket expense to bring this house up to standard where it should have been when we purchased it.
The complaint has been investigated and resolved to the customer’s satisfaction.
Rejection of their own offer
My wife and I were trying to purchase a home in which Fannie Mae was listed as the owner. We placed a bid, Fannie Mae countered, we accepted, then they rejected their own counter offer! I would really like and explanation to a rejection of your own counter offer. I have never heard of such a thing! Now, my agent states that Fannie Mae won't tell him how much they are asking for the home. I am really looking for answers to this stituation. If possible, I would like a response.
