Sealy Mattress Defective Mattress

Save your self the agony of purchasing defective items at an over priced rate. I purchased a king sized mattress in June of 2014 which cost me well over 1000 dollars. From the very first night that I laid on this mattress, I noticed that I was sleeping on a decline. The top middle of the bed had a large dent. It felt really awkward and I woke up with sever back pains. I immediately called their claim center to address this problem. This company knowingly sold me a defective item that causes me unnecessary pain and suffering!

Since 2014, I’ve filed THREE claims and all of them got decline. The company claimed that the indent was not severe enough to be fixed. Essentially, they acknowledged the fact that they delivered me a defective item but refuse to do anything about it because they felt it wasn’t broken enough to need fixing. Well they are not the ones sleeping on this spine damaging bed so how can they properly say what is deemed “broken enough”.

On the first inspection 07/07/14, (1) the report claimed that the indent was only 1 ¼ inches deep and they only repair mattress that are more than 2 inches deep. They advised me to wait a few months and call back when the indent gets worst. At the second inspection 10/31/14, (2) they claimed that the indent was now 1 ¾ inches deep. Great so in a few months they would have to honor their warranty when it reaches 2 inches deep right? Wrong! After the third inspection 11/07/14, (3) they stated the indent was now less than 1 inch deep and now they only cover for indents over 2 ½ inches deep.

So after sleeping uncomfortably on this mattress for months, it had somehow defied gravity and un-indented itself AND they decided to increase the inches of regression that qualities for the repair by another half an inch! I asked for a copy of the inspection but that also was denied. They claimed that it was against their policy to send the reports to their customers. Fine, then I asked them to fax over a copy of the terms and conditions for the warranty of that mattress on 11/07, 11/13 and 11/21. I’ve asked them to fax it over three times and every time they state that they will fax it over by the end of the day and still nothing! It is now June of 2015 and I haven’t heard or received anything back from them since Mid November. I will not put this to rest until they have found a resolution for my concern. If they cannot, I have no other recourse, but to file a civil lawsuit.

It is unlawful to knowingly sell someone a defective item claiming that it is in new condition regardless of what their warranty states.

Sealy’s Mattress Warranty appears as a Farse

J.C. Penney’s sells and advertises Sealy and the Warranty
and then plays “cat and mouse” with its patrons.

Penney’s investigates, Sealy determines, and then Penney’s washes their hands

The end result, …. You and I Loose.!

The Case: 5 years into a 10 year warranty on a one sided King Size Mattress, both sides are sagged, (indented), the middle on the other hand developed a hump difficult to climb over.

Sealy checks the mattress through a Penney’s sent “expert”, his report, was based on a string run across the top of the mattress without weight so there was no “active test” just a look see under an “unloaded” condition. No manual check on the soft deepness at the two sides nor the bulk of the center section, were performed. a great test!
I guess my wife and I must be as light as a cloud… then I would not need a mattress!; The test verdict, reported to me, unilaterally determines a rea1 sag.

Out of the blue Penney’s declared it is within “in tolerance”, this according to the expert, he does not study any thing else and it is determined that it is not in excess to be covered under warranty.

When we purchased the mattress at Penney’s we were not notified or warned that the mattress would sag, just bragging about the 10 year Sealy Warranty, and Penney’s proudly presented it as such...

Since I was unsatisfied with the response, I complained… they sent another “expert”. He tells us Oh! Yes that is quite a sag!, but there is a stain here on the side. The stain was not there on pthe previous test one just three months prior and nowhere near the sagging area.. Now the report is blames the warranty being void because there is a small stain on the edge!... “well there is a stain, that voids the warranty”!

The attitude that has become evident is to try desperately to find a reason to void the warranty… rather than to try and see what can be done. Great attitude to keep any customer happy. I have little doubt that somewhere in the 7pt. warranty form there is something that covers just about every contingency.

As a side note, I called Sealy, and the receptionist wanting to direct the call to the right person asked me what was the issue, I did not get past the word sag and hump and she said Ahh! that must be the King size model such and such!, I was amazed.

Fascinating excuses, greatly written, bottom line Penney’s responds scantily, it is NOT OUR problem, Sealy denied it and there is nothing we can do because it is now conveniently “Sealy’s Warranty”

Well, my wife of 46 years and I, weigh145 lbs for her and I 194 lbs for me, we now sleep separately on the same bed! Standard seduction now has to either be in a hotel or in guest room! Heck of a solution!

And with no recourse, we are glad we had our children in time, and in those days, collapsing mattresses were not yet on the market!

In frustration I reached the “Head of Customer Service” a Mr.D…. who claims his job is to report directly to the Chairman, I wonder what this guy’s yearly corporate bonus is! I do not wish to slander this highly polite, correct and righteous functionary.

He was clearly uptight, hid behind the story and when I requested a copy of the reports, correspondence and file on this matter and to please enclose a copy of the applicable Warranty and the fine print, he politely suggested I should get it on the Internet. I suggested that since he new about it being on the internet he could easily find it and downloaded and added it to the Package I was requesting.

Begrudgingly he agreed to my request, BUT it has been over 2 months and surprise surprise, nothing from Penney’s.

The conclusion I have reached is that Penney’s with whom my family has done business since 1964, has fallen to the levels of others who have since disappeared. I guess it is the New American Business Standards.

It is a disgrace, and in essence I was told to get lost!

Of course I wish to reciprocate and hope I can help them to get lost by my helping the public and in my lifetime see both Sealy and Penney’s precede me… in getting lost!.

A $2, 000.00 squabble that has cost them probably $400 so far, and that could have been split between Sealy and Penney’s, will now be reported, will be known, will cost both Sealy and Penney’s our family’s business and at least ½ of our friends who will take undoubtedly their future business elsewhere.

Ex purveyors to my friends and family Stand behind Principles and their products, to both of you Sealy and Penney’s, have a successful future, , , without us.

Per Wikipedia:
US Mattress has among the highest complaints in the industry, as it doesn't really permit refunds. As they rely on 3rd party delivery people, the quality & timeliness of the delivery can vary greatly.

WARNING: Do not buy from these people. We purchased a King Sealy Posturepedic 60th Anniversary Edition for $1169.00 on Dec 28, 2010. After using this mattress for only a few nights we realized that it too has serious problems with body cavities. After a phone call to their sales dept we were told that this is a normal condition and not to worry. This IS NOT NORMAL, we are in our late 60's and this is the first time in all our lives we have had these problems with a mattress, such as back pains after sleeping on this mattress. After much discussion with the sales person I was told that the only remedy was a less padded model and that the price would be approx $400 less. Since they have a 100 night warranty I thought fine ship it to us, however she said they would not reimburse us the difference in cost. WTF? PLEASE USE OUR BAD EXPERIENCE TO YOUR ADVANTAGE, STAY AWAY FROM THESE PEOPLE.

REVISION - Neither of us can sleep on this mattress, individually or together! It is that bad. PERIOD. It is new and defective or such poor quality that they should quit making mattresses.

By the way -- we had a 30 yr old mattress that would run circles aound this one after all those years. And my husband first noticed the sides sagged but found a way around that hazard - just sleep inward further; but alas that made the middle sink!

Being as I am going through the exact same thing on a brand New Sealy Posturpedic, I know exactly what he is talking about. They want a NOTICEABLE 1 1/2 inch sag to call it defective. They are saying you should UNevenly sink and slant in this bed. My husband and I both cannot sleep on this mattress -- neither of us heavy in the least -- and it is brand new. We noticed this the first night. I thought it was defective as there was damage to the boxsprings and marks on the mattress too -- upon delivery. I thought maybe somewhere in shipping or delivery they bent the mattress, cause this is where the sagging is most noticeable -- towards the middle. and you sink and slant downward putting your body in a very awkward positioning that no orthopedic would say was good for your body or normal -- as Sealy is claiming!

And yes -- they are supposed to measure, the person sent from the store. Our boy did not - cause we told him this was something you could only FEEL when you were on it not visible see. Remember this is a bed that has only been slept in a couple of times and then not all night as it was so nasty! Who would expect a mattress to take on a Sag immediately that was visible. Even a bad mattress does not normally show what you feel -- it is just when you are on it that this is noticeable.

And like the guy wrote -- mattresses of old did not have this lack of quality. These mattresses of today are "throwaway" on delivery!

We are completely dissatisfied with this Mattress, the Company SEALY, and the store we bought it from -- a local store I never expected would do this to a Local Customer. I will be naming them everywhere if this does not get settled to my satisfaction ( still pending ), but to date they are washing their hands of any "responsiblity." Basically saying -- you bought it, it is yours! Too bad you dont like the comfort level of it but that is a preference thing. This is NOT a preference thing, this is an inferior quality mattress that is not defective should not be on the market - cause it is unsleepable on - which is the use for which it was intended, and NO reputable doctor would say sinking into a mattress with no solid support was good for a body - PERIOD!

So I would highly recommend you bouycott SEAL and all their products, and any store that does not back their sale when you receive a defective, unacceptable product!

Sealy Mattress exchange waranty

for any sales man for mattress giant store i cant believe the crab and the hard time that you people are giving to us like measure the mattress with a broom and a rule right on the middle of the mattress bla bla bla i think this is qay to rediculous in othe for us to exchange this crab instead of taking the word for it and exchange at least one time with no question ask i guest is the american way to change things i garanty you that i will not buy no more furniture from mattress giant stores and i will publish the notice to the public and consummer

Sealy Mattress defective mattress and boxspring

Bought original mattress in 2002 (Kingsdown) from Sleepys, within a short time it sagged, they replaced mattress five times, each time I had to pay $50 delivery fee. the last time I insisted they replace the boxspring also, they tried to charge $100 for delivery, I fought it and paid $50. Anyway, $250 wasted dollars on top of a defective mattress. I contacted Kingsdown but they wouldn't talk to me, said I had to go through Sleepy. Finally they agreed to provide a pro-rated credit for a new purchase but I had to buy from Sleepys (ugh). This time purchased a Sealy and had to pay twice the amount of the credit. Salesman was like a vulture when we walked in the door, swooping down on his prey. Never would have bought there if didn't have the credit. Anyway, the Sealy is worse then the Kingsdown, called Sleepys, they said deal with Sealy! I'm sick of dealing with these people that constantly give the runaround. I gave up and told my husband to suffer with the sagging. He weighs 170 pounds, hardly someone that would ruin a mattress, I'm lighter yet. this morning his back hurt so badly he had to sit with a heating pad all morning.
Is Sleepys passing inferior products off to customers? What happens to all the returned mattresses, hey, we returned six! Is it even possible to purchase a good, reliable mattress at a fair price? Comparison shopping for mattresses is impossible due to the model names being different at different stores. A Sealy Glistening is not a Sealy Glistening at Noname dept. store, it would be a Sealy whatever. So the 30 day price guarantee is nonsense also. BOTTOM LINE-MATTRESSES ARE THE WORST POSSIBLE PRODUCT MADE AND CUSTOMER SERVICE IS NIL.

Whats up with New Jersey mattress scammers. C&C Mattress from NewJersey sold us what was supposed to be new Sealy Latex mattress. The day it arrived they delivery men refused to allow us to inspect mattress. After they left it we opened the box and discovered the split down the side of the mattress. We immediately called the merchant and
E-mailed pictures to Peter Cancelli, dba C&C Mattress whereupon he E-mailed his reply stating it was defective. We requested a replacement, but C&C Mattress has refused. Now we are out over $2100.00 and stuck with a mattress that has split down the side.
They charged my account for a defective mattress even though we phoned them and advised them of the defect on the day it was delivered.
I have contacted C&C Mattress by telephone and by e-mail in order to try to resolve the dispute. C&C Mattress told us to get it sewn. C&C Mattress told us our request for a replacement was not reasonable because replacing it would cut into his profit. Sealy told us they don't warranty defective stitching and directed us back to C&C Mattress. C&C mattress has continued to refuse to our requests and as recently as Tuesday, 2-10-09, advised us to make no further attempts to contact them.
