In July, our company pulled a trailer (tractor trailer) for this company, TQL Logistics. The trailer was dropped at the location and photos provided of no damage to the trailer. Now, 3 months later, their "claims" department has sent us an invoice for over $800 stating we caused damage to two tires on the trailer. Our company has an impeccable safety record and the driver is former law enforcement with high integrity. We have asked for proof that our driver caused the damage and they have not provided it. We provided photos which clearly show the trailer tires (right rear) inflated and perfect condition. It is highly possible that the yard tractor that moved this trailer after it was dropped caused the damage, but they are billing us for the damage but cannot provide or WILL NOT provide the evidence that we caused this damage. Further, the invoice shows Rhode Island state tax added to the invoice, when we dropped the trailer on 7/19 in Georgia, so it was taken to RI for the work on 7/20, we did not have the trailer and they will not provide who moved it from Georgia to Rhode Island. We have asked for it and they refuse. It is not fair business practices, the burden of proof should be on them to show that we damaged this trailer. We did not drop this trailer with damaged tires. There is no way we could have pulled it from Virginia to Georgia with two tires flat and valve stems needing replacements. Photos of the trailer attached with the two tires in question shown, inflated and almost brand new in photo.
Desired outcome: The company needs to provide proof of our company causing the damage or write it off as the cost of doing business.
