Unifund Garnished my social securiy benefits over a 2003 debt. I called and they couldn't tell who signed the summons to appear( supposedly a substitue). I never received a date to appear for judgement. Now 8 yrs later I'm without funds to live on. My $1800 debt is now $5, 772 without any answers from them. I called to ask about this but the woman I talked to was very rude and answered nothing to help. Agencys like this should be illegal. I plan on suing for unlawful practices. My atty says we have a good chance.Pray

This is ABSOLUTELY ILLEGAL! First, Social Security can NEVER be garnished unless it is the Government by itself (taxes, child support, etc.). ANY other debt - NEVER NEVER NEVER! It's an apparent "Trick" by these SOB's and your attorney is right - you do have a GREAT chance as if they HAD examined you properly (well, that means they would have actually had to SERVE you instead of let you find out years later when all the time has expired for YOU to challenge it/defend yourself), they would have been told NO. Furthermore, your bank SHOULD have known by the deposits that it's a GOVERNMENT BENEFIT. You can't really 'blame' the bank as it's hard to do all this with the amount of garbage they're up against, but the thing I did - since I became disabled that is - was I sent a copy of my SSA benefit letter along with a simple letter stating "ALL MONIES IN THIS ACCOUNT ARE EXEMPT FUNDS AND ARE SOCIAL SECURITY BENEFITS". This way, whenever the next one "standing in line" tries to get a dime, they're already told too bad, so sad, they're EXEMPT FUNDS & you get ZERO! You WILL win :):):)
