Dear Wendy’s Corporation,
My name is A. and I have encountered a problem with an employee at one of your Ohio franchise locations. Specifically, the franchise is located at 1372 Lexington Ave of Mansfield, Ohio (restaurant #00005396). An employee named B. has been repeatedly texting my friends when they come into Wendy's and explaining that she had spit in their drinks and was hoping they enjoyed their now contaminated drink. I called Wendy’s on Lexington Ave and spoke to the manager about the incidents and the manager assured me that she would talk to B. Soon after the manager spoke to B, B. proceeded to text my friend once again and explained that the manager thought the incident was comical and B. then proceeded to brag the fact that she would be receiving no disciplinary actions. This blatantly violates the ‘Manager responsibilities’ which include but are not limited to “Keep a close eye on what is happening in the workplace. If you become aware of any conduct that may violate the Code, other Company policies, or applicable laws, you must report such conduct immediately. Managers who do not report violations they either knew about or should have known about may be subject to disciplinary action, up to and including termination of employment.” This situation was handled in a manner that directly violated the responsibilities of the managers which is explained on the official Wendy’s website. Wendy’s website claims that “Respect, equality and fair treatment for our team members, franchisees and partners is a central part of our business. And so is giving something back.” I believe that this incident requires some sort of action. If this action will not take place on the management end, I believe that it should be handled by The Wendy’s Corporation itself, I have attached screenshots of the conversation as proof, I hope that you will take your time when reviewing this case as well as keeping me informed as much as legally and morally possible.
