ASF Payment Solutions awful experience

I signed a contract to participate in Ju-jitsu with local gym. My knee became tender after exercise and then I suffered a separated shoulder a month later while rolling. The shoulder took 16 weeks to heal. I visited the doctor to find out why the minor separation was slow to heal; I was diagnosed with hypermobility (frequent knee dislocation, winged scapula, double-jointed). He recommended that I cease further strenuous activity on my knees to avoid any long-term debilitating complications due to my genetic hyperelasticity. The doctor wrote a note on official letterhead listing that the patient has 'chronic knee problem' and further stated explicitly that this prevents engagement in martial arts (among other activities). ASF rejected the doctor's note on the grounds that 'chronic' is not the same as 'permanent disability'.

The contract that I signed with my local gym does not stipulate that 'permanent disability' needs to be explicitly stated on the note, but rather any injury that bars the student from fulfilling his/her contractual obligation to use the facility to his/her fullest extent during the length of the contract. I am quoting the terms of the contract, because ASF is known for its quick “read the contract" remark on complaintsboard:

'In the event student becomes permanently disabled and/or injured during the membership term, he/she may cancel the contract upon notice to the school of such disability and/or injury. For the purposes of this agreement, 'PERMANENT DISABILITY AND/OR INJURY' shall be DEFINED as any disability and/or injury that PREVENTS the student from utilizing the school's services to the SAME EXTENT as was possible PRIOR TO THE ONSET of the disability and/or injury for the entire duration of the contractual term herein. Student must provide notice from a licensed [sic] medical doctor confirming that the disability or injury is permanent for purposes [sic] of this agreement.'

The doctor I spoke with informed me that writing 'PERMANENTLY DISABLED' carries severe implications with regards to insurance premiums. This is probably why ASF requests this to cancel any contract as a result of a long-term injury (although, again, this requirement is not stated explicitly on the contract). I am in my mid 20s and besides the soft knees and highly flexible scapula, am in excellent shape, at least internally. I don't know many people who are aware of future consequences that continue to practice an activity that will worsen the problem later on down the road.

I called ASF and spoke with two managers, the first of whom was quite curt and unhelpful. The second manager whom I spoke with, Danielle V., was slightly more understanding but unwavering of ASF's 'policies' (which again aren't even stated verbatim on the contract). She further insulted me by stating that my condition is like her type I diabetes, which she noted as 'chronic', but categorized it as a 'disease'. Unfortunately a chronic knee condition, whose symptoms cannot be cured, mitigated, or even deferred, but only worsen, is not the same as diabetes, which is treatable by an insulin shot. This condition forced me to stop playing high school football at the age of 16 as it was awful during puberty (unprovoked knee dislocations every few days). Honestly, I have no intention of living through that hell of random knee dislocations and several days of swelling just for a little bit of exercise. I would prefer to stick with a low-impact elliptical machine for exercise, which does not elicit similar symptoms that I began to see gradually evolve through my short stint with the gym.

Chris Peterson... you DO get around. I just read your excuses and spin on [redacted]s.com

Isn't it funny how on every single website designed for exposing dirty businesses, there are dozens of complaints about your beloved company and there's YOU defending the trash you guys do?

You don't even attempts to be polite or apologetic. You just turn the blame around or make an excuse... everywhere you go.

I guess these hundreds and hundreds of people complaining about your company's practices are ALL wrong, huh?

Chris... you are ###, and you work for a scummy company. I am going to do my dead-level best to educate everyone about ASF's practices and let them know they shouldn't do business with your clients and why. I will encourage them to write letters to the gym owners and tell them the reason why.

ASF International does not author the agreements that a member signs with a specific facility. The agreements are generally based on that stattes "Health Club Code". We simply process cancellations based on the terms and coditions of the agreement the member signed. We cannot deviate from those terms.

ASF Payment Solutions billing continues after cancellaing the membership

Hi,
I have a complaint.
My account number is 291130
On june 4th or 5th, 2008 I phoned the customer sevice to pay off the total amount due including the cancellation fee. Sum of amount 210.94( this includes everything cancellation fee and amount due). Ireceived a letter that my account is canceled already no dues from last.
Then now they come back saying you have amount due of 300 dolalrs last week and again when i phoned today they say 140 is due.
Whats happening i am confused. from where this balance coming from.
On June 5 th when i spoke to customer service representative she clerarly confirmed me that i am done with all payemnts due and there si nothing on my bill.
My intension was to clear all dues on that day before going on vacation then why i would leave any balance. I paid 210.94 towards clearing all dues.
When i report any issue they say they will call me but never call me.

I don't know whats happening.

This company is one of the worst company in term of cancelling account. I try to cancel my account and i did all the canceling form just to get a paper back saying "We find that reason stated in your application cannot be found in the terms and conditions of your Retail Sales Contract." All in all dont deal with this company. I going to try to cancel again.

This company will go to any lengths to collect a bill, whether the amount on the bill is legitimate or not. On several occasions, I have received two separate bills within a week showing amounts due differing by $100s of dollars. As the bills are not itemized, there is no way to determine if either is even correct. Furthermore, these bills say to call or write with questions promptly, but not to send correspondence to the address listed, only payments. A correspondence address is never listed...because they don't want you to correspond with them. It is much easier to deny the contents of a telephone conversation (or the fact that the conversation ever existed) than receipt of a certified letter.

I would encourage everyone to avoid doing business with any organization that uses ASF International as a third-party service provider. For example, I will never go to a Gold's Gym because I know that they use ASF as a third-party service provider. Determining this will take some additional due diligence prior to signing a contract, but it is well worth it if you ever have billing issues. Besides, hurting the bottom line of their customers (who will realize the issues when you refuse to sign a contract because they use ASF) is the only way to force them to change their billing practices.

Mohammed's membership remained open because he did not fulfill all of his obligations regarding the cancellation. He did eventually fulfill all requirements and his membership is cancelled.

ASF Payment Solutions fraudelent billing

I complained to asf international about over-billing me and that I requested cancellation of my membership contract months ago. Chris peterson, customer relations manager at asf international responded to my better business complaint stating that he disagreed with my overall complaint although he agreed that they were billing me more than the membership contract amount.in his words, "the cancellation procedures require mr. Pauls to be current on his payments before we can cancel his membership. Based on that, he will not be receiving a refund and is actually due for july and august. Once we receive payment, we can finalize his cancellation." upon receiving this response, I immediately paid the amount that they said was due as a good faith effort towards resolving this matter. The amount was minimal and I thought it best to stop their flow of income from my wallet before I move my complaint to the next legal punitive tier. Of course, cancellation was not finalized and I received another bill for september membership, along with $49.00 in 'fees' which are unfounded. It never ends. There is nothing ethical or reasonable about this company.

Same as me, I was a member in Fit 1, LLC 1426 Lexington Avenue, Mansfield, OH. I cancelled my membership with them, gave them my change of address confirmation letter in October 2010, and thought the company already took care of the cancellation. When I called ASF, my account still active and there was no record of cancellation. And now they are going to renew my contract for another year. We moved to our new location in September 2010. And ASF still withdrawing my account until now. It's really frustrating, its the gym that didn't do the proper procedures. I would rather use that money for Charity. The Fit1 gym staffs are very rude and THEY ARE LIARS with the contract. JUST A WARNING! Please dont sign any contract with them!

They charge a fee that is the same amount of your membership fee during your 3rd month to insure "that your fee is locked in". How ridiculous is that? You're paying a fee to make sure that they don't increase your fee. Why can't they just factor that "fee" into your normal membership fee and add it to the charge that comes out every month rather than making it a separate charge. It's a $30 scam that they impose on every member. They can't just be honest and extend a courtesy to their customers (like locking their fee in for joining their gym in the first place) that doesn't involve charging more money for a completely dumb reason if you actually think about it.

I received fradulent charges this month. We quit attending our Gym last July. It was a small gym that we joined. We cancelled our debit cards and the bank is trying to get the money back. Beware if you sign with them.

I cancelled my health club membership via email to my gym and thought the matter was resolved over a month and a half ago. I called ASF today and they told me that to cancel I needed to give 30 days so they are withdrawing again, so that is two extra months I had to pay because my gym didn't respond to my request. This company has ridiculous customer service, they wouldn't budge and were very rude. Not the kind of place I would want my membership dealing with if I owned a health club.

I am in the same situation. Not only did Gold's Gym fail to cancel my membership like they told me that they had once I processed the cancellation paperwork, but for the past two years they have also been double charging me through ASF. There are many, many similar stories if you do a Google search for ASF. Buyer be warned---ASF is engages in unethical predatory business practice.

Actually, Mr. Pauls' membership was cancelled. He did meet the requirements necessary to cancel. Also. Mr. Pauls' was issued a refund as well.

HELP! I just noticed a with draw from my checking account from ASF International. Previous withdraws were from Health Club Dues Club Dues and Golds Gym, two separate dates. I joined Golds Gym in MD for 1 yr back in 2004. So, I am being billed twice a month for 1 membership. Anyone ever have with draws show on there bank statement from Health Club Dues Club Dues? I think I've been scammed and I'm screwed. HELP!

ASF Payment Solutions harassing billing

In march of 2008 I joined a self-defense class (krav maga). I loved the class but was injured while mountain biking and injured my ribs. The injury was severe enough to keep from the gym so I cancelled my membership over the phone with asf. I was assured there was no problem at this time. Then in may of 2008 I started receiving threatening letters from asf claiming my injury was not reason enough, according to the contract, to discontinue my membership. On 5/19/08 I sent asf a letter in response to their claim and then followed it up with a phone call to asf on 5/20 but got transferred around to so many people I gave up.
Since then I have received at least four more threatening and harassing letters, each time I respond it is ignored, now
Asf is threatening me with collections and other legal action.

At this point I feel like I am banging my head against a wall! No one at asf seems able to understand that I will not pay for a service which I physically cannot use! If you can help, great, if not, please don't waste my time.

This company is a fraud and there a a million people with the same thing to say. I signed up for a free 30 day membership to be cancelled at anytime. I cancelled via email hours after I joined. Then I received a letter in the mail stating I was past due. I followed up with a letter in writing that I had cancelled my membership within the 30 day period. Now I receive a bill for $226.oo. I tried calling customer service and they gave me the run around and even tried to get more information from me. Agravation not needed. I agree with you about seeking legal action. Why not a civil suit?

Personally I feel that these retorts from ASF employees are as valid as their contracts. I was put into a year contract with my local gym, Fitworks, with the understanding that I could get a few cheap months out of it before I moved away to college some 25-30 miles away. At the time, the contract stated that anything more than 20 miles was a reason to cancel, in which case, it seems as if these people at ASF have been bleeding my already declining bank account dry. I've had to open up a credit card account simply to pay for books and clost of living because they're taking 25$ a month out of my bank account. I know that doesn't seem like much, but for a college student that gets paid 100$ every 2 weeks, trying to live off of the little money he has, thats my lifeblood! I agree that this is completely and utterly unacceptable, and to add, unconscionable. To take money from an already poor client is disgusting to me. I would really like to see this company with their foot in their own mouth, and I plan on seeking legal action if it comes down to it.

This is sick and unacceptable

First and foremost, ASF International does not simply cancel a membership over the phone. A written request is required by the member's agreement that they signed with the specific facility they attend. Also, this sounds as though Mr. Allen did not meet the requirements outlined in the agreement he signed with the martial arts facility to cancel.

I'm trying to cancel my membership with ASF at this very moment- I'm on hold :) Every time I call, I am on hold for at least 20-30 minutes. I signed up at LA Boxing in Carlsbad, CA and the "terms of the contract" were verbally explained to me at the time of signing. Of course, there is a severe detachment as I was told if you moved more than 15 miles away from a location, became unable to particiapte in boxing or just wanted to cancel the membership and pay $50 I would be able to do so. HA!

I provided documentation stating I would be more than 15 miles from a location as I was moving and they denied my request for cancelation because my "reasons stated in [my] application cannot be found in the terms and conditions of your Retail Sales Contract." Of course when I called, they don't have a copy of my contract and I was never given one at the time of signing- yes I should've asked for a copy but that's water under the bridge at this point.

So I called LA Boxing and had a copy faxed to me. You have to become PERMANENTLY DISABLED, OR MOVED 25 MILES AWAY FROM A LOCATION! I noticed the Club Representative never signed the contract so if they want to get technical, the contract was never officially executed.

I feel as you do. No one can help me! ASF said they aren't responsible for what was verbally explained to me and LA Boxing says they can't do anything in terms of cancellation- I have to discuss this with ASF. My credit card company, Chase, is now saying they can't help me and this whole thing is unconscionable! It's not right how ASF runs their business and someone needs to put them in the corner!

ASF Payment Solutions refusal to cancel automatic debits!

I had a 2 yr contract with la boxing in california which was supposed to end dec 2007. When the jan 2008 debit came out of my checking acct-I went to la boxing and they told me it was in error and that they would put through the cancellation with their 3rd party agency "asf intl".in feb 2008, another debit was charged for my gym membership and again when visiting la boxing, he assured me that it should have been canceled and we watched as he again went to his asf intl software and put through the cancellation. Based on the complaints i've read on the internet, i'm handing this over to my bank to handle because asf intl is apparently notorious for this kind of business practice.

Does not want to cancel the payments I apparently owe, Ron did not document the payments I've made with physical money, other people do it in class all the time and had not gotten trouble. I'm not paying 300 bucks for MMA that I paid for IRL, not good business over all.

Dear Sir/Madam, I purchased a company in April 2005. I was told by the seller that the company has $70,000 in accounts receivable. A company called ASF INTERNATIONAL was being used by the company known as Healthy Inspirations to do automatic debits from the clients, accounts. ASF International was to collect money 4 times a month, pay Mr Griffith the man I purchased the company from and put the balance in a bank account for me. Within a few months ASF INTERNATIONAL said there was no more money in the account and that they had already paid out $20,000 to Mr Griffith. I was very disappointed and told them to end this club number and start me with a new club number for my new clients that I had generated. In 2006 ASF INTERNATIONAL told me that I owed them $1000 dollars. I asked them how could I owe you money when our only arrangement is for you to collect money from my clients and deposit the money into my account after first taking out your fees. They told me that this money was money they had paid to Mr Griffith. The man I bought the company from. I told them I owe no money to Mr Griffith because he had already ripped me off and I owe no money to them. In November 2007, ASF INTERNATIONAL held onto $392 which should have been deposited into my account, and informed me that I owe them $1700 from two years ago. I said it is impossible for me to owe you any money based on our agreement. They informed me that Mr Griffith owes them that money and that they cannot find him to retrieve their money, so they will collect it from me because I took over the company, and that if I do not pay them $1700 they will send me to the credit bureau. This is unjust and unfair. I have had to cancel the automatic deductions they do for me, and I am losing money while I try to setup the automatic debit with a reputable bank. I AM DEALING WITH LA BOXING AND ASF NOW. I HAD A MONTH TO MONTH WITH THEM. I SENT THEM A CERTIFIED LETTER ON 07/14/10. THEY SAID I HAD TO COME IN TO CANCEL. I CAME IN ON 07/16/10 TO CANCEL. THE MANAGER (JUSTIN) WILL NOT GIVE ME A COPY OF THE CANCELLATION LETER I SIGNED. THEY COLLECTED 158. X 2 ON 05/17/10 TWO MONTHS. THEY KEPT THE THIRD MONTH. I WENT THERE ONE MONTH AND THREE WEEKS. THEY ARE TRYING TO COLLECT A FORTH MONTH. DOES ANYONE HAVE ANY ADVISE TO HELP ME WITH THIS MATTER. I WILL BE GOING TO CHANNEL 13 WITH THIS TO BRING THEM TO THE THE LIGHT. THEY ARE DISHONESTY. ASF International just recently took money out of my checking account on Feb. 1 without my authorization, claiming that my 2 year health club membership (to Lifestyles for Ladies Only in Toledo, Ohio) which expired in January had a rollover clause. After dealing with a rude customer service agent, in frustration I contacted the health club, only to get another runaround. Lifestyles could not even produce a copy of the contract with the rollover clause. It appears that both companies are of questionable integrity. I have contacted my bank and filed a complaint. I will be closing out this checking account so they no longer have access.

We didn't have the member's bank information. We only had her name and address as it is file that is maintained by us for LA boxing for membership tracking purposes.

I had never heard of ASF Int'l until I started seeing them charging my checking acct. All they needed was my checking acct number, which anyone I have ever written a check to would have. I called my bank after the second charge took place. My bank credited my acct after Googling them and seeing that this is a fly-by-night outfit.

Why would you need her banking information in order to "track her attendance"? Your twisted explanation tells the world everything it needs to know about your unscrupulous business practices.

This company has been withdrawing money out of my account even though I have canceled the account over a year ago. I noticed that I was being billed and notified them immediately. Their "records" never indicated that I canceled. The cancellation was done over the phone and in person with the agency that asf was with holding for. I have tried multiple time...
