I signed a Four-month contract for Personal Training sessions on February 8, 2023. The contract called for $156 every two-weeks.

Near the end of April, I was diagnosed with two hernias that required surgery to repair. My doctor urged me to halt any further gym/ PT Sessions until the hernias were repaired by surgery.

I went to the EOS website and submitted the appropriate form to initiate a "Pause" for two months. I requested April 25th through June 25, 2024.

when no one contacted me to verify receipt of the request, I contacted the EOS facility where I signed up for PT sessions and spoke to the Supervisor for all the Personal Trainers, Prath Bruton. He assured me he had the authority to Pause my contract for two months and I had nothing to worry about.

None of the payments for May 2nd or May 16th were changed to my bank account. However, May 30th the $156 was changed to my Bank account. I immediately called and sent an email to Prath Burton as well as the EOS department that processes the request for Pause, requesting a refund for the error in charges.

When I did not hear back from Prath, I once again called the EOS Facility where my contract was initiated. I was told Prath was no longer in charge of that facility but his successor, Brandon, would call me back. He did.

When I spoke with Brandon, I requested a refund for the $156 charged on May 30th and requested a guarantee that the contract would be paused until I was able to return June 25th. He assured me he would "cancel" my contract and if the $156 was not refunded, I could tack that onto the PT sessions I was entitled to when I returned June 25th. I was not happy about that but agreed that would be satisfactory if no further charges were incurred.

Imagine my surprise when I discovered yet ANOTHER $156 charged to my bank account again this morning.

I immediately called EOS Facility where Brandon was located and left a message for him to call me ASAP and briefly explained why I was calling. Six hours later I still have not heard from him.

I left another message for Prath Burton since I understand he is now the District Manager over all EOS locations. I explained in my voice mail message that I wanted a refund and if that was not forth coming, I would be contacting my bank and filing a complaint about fraudulent changes against my bank account that I did not authorize.

Claimed loss: I would like a refund of $312 to date, could be more if the charges are not stopped

Desired outcome: Contract cancelled completely.
