Debt Collection
I broke a lease agreement with Alden Short, Inc. After some back and forth, they determined this to be an uncollectable debt and they issued a 1099. They originally sent a 1099-misc, indicating I had received a $17,095 payment from them. I notified them that they should have sent a 1099-c (notice of debt cancellation) and they assured me that they would send me the correct form to indicate they "gave" me over $17k. Of course, they didn't "give" me any money. They "gave" me this money in the form of debt forgiveness. Both my Experian and Equifax reports indicate I owe them the money that they "gave" me, which is now considered taxable income for 2022. Now this "law firm" has starting making harrassing calls to myself and my friends.
Desired outcome: No further contact on this uncollectable forgiven debt
Trying to settle a debt
Trying to settle a debt. The debt start with national credit systems. I had agreed to pay $700 June 27 with Felecia Clay. When i called a rep with NCS stated my account was noted i left a message for both ms clay and her supervisor no response. The placed it on my credit report and sent it to *** i sent *** a fax to settle and i received a call from a rep. I sent several letters stating I will make a payment but not for the full amount because the management company at Lawrence park apartments (kmg) prestige never notified me of a late that was tacked on while i still staying their and when i spoke to Lawrence park prior to moving it was supposed to be removed they didn't remove it which was 272.00 and a late fee of 37.00 for march . I spoke with ms wheeler and she said 780.00 i advised I would respond by letter. I faxed another letter agreeing to pay 780.00 only if i received a letter in return stating the account would be closed and it wouldn't be sold again i never received any follow up regarding the matter.

I had reached out to the lawyer's office about an item on my credit report from *** systems. I was told the lawyer's firm was the one handling it and the only ones I could talk to. After some back and forth, I reached an agreement with the law firm to have the $2800 amount settled in full for $***. I fulfilled my part and paid the ***. I have documentation from both the law firm and NCS proving this. However, they have decided to not uphold their side of the bargain. Rather than close the account as agreed, they are still reporting a balance. That is both a breach of our agreement and dishonest.
This business has been continuously calling me for private information (address, social, birthdate, etc) that I am not comfortable with providing without further information, which they refuse to give. I have no idea why they call, but its beginning to border on harassment as its become more and more frequent in recent months. It seems to me that it is entirely unprofessional for a law office to continuously call someone without explanation and request private information. Who knows what they want to do with said information, as they have never revealed the nature of the call.
Unfair debt collection act;my debt has been sold to this agency from National credit system without notifying me about the debt.this debt is collected is an scam like activity when the apartment I used to live sold my debt to a collection agency without even contacting *** want repair to my credit damage they made!
I moved out of an apartment with written notice to my leasing agent. A year later I was reported to a collection agency. There is no record of me living here other than my lease. It has been bought out by 3 companies since I lived in this apartment. The invoice shows I owe an extra month's rent, and a $600 cleaning fee. However there are no pictures, nor an invoice from the cleaning company that was used. I would like this matter dropped, and removed from my credit history. I asked the company for all the information backing this claim with no proof given other than an itemized *** without proof. This *** was made by a program that anyone could download, and use. I don't feel that after leaving a year prior to this *** showing up that I should have to pay. There is no solid evidence to said ***. The apartment complex came help me find any information on said *** due to no longer being owned by me original leasing agency. I've tried to resolve this matter numerous times to no help. I've contacted *** and *** square apartments on this matter several times. Neither place can help me due to no records of me living there. Both original companies I dealt with in renting the apartment no longer are affiliated with this matter, and have no files on this.
I emailed First Key Homes about a mistakenly opened account with a certain Systems company
I sent an email detailing an erroneous account that was opened with a certain Systems company from First Key Homes. They claimed I owed money upon move out. In November, I was expecting a refund check. I contacted NCS and was directed to Brett M. Borland. On February 4, I sent a dispute letter to their enigmatic account overseer. I was promised a response by mail. Later, I received a letter confirming my debt, mentioning the lack of supporting documents in my initial email. However, I was reviewing the attached documentation while the customer service rep was arguing with me. The debt they insist I owe is incorrect. I want it removed from my record. I request that the Law Office of Brett M Borland inform the Systems company that this account is a mistake. It's absurd to have to go through so many obstacles to dispute an invalid account.

National Credit System started reporting on my credit a couple of years back 2019 for an apartment which I never stayed. I have called the collection agency asking them for proof of this account to no avail. I have disputed this account several times yet when I called recently I was told they no longer had my account that the Law Office of Brett M Borland, P.C has my account. My complaint is if I don't have an account with you how can you continue to damage my credit by reporting on account that I never had with you guys or your client. Also my personal information was used in this matter. I have filed police reports they can verify they locked a MAN *** in this apartment. I had no clue about this until I got a call from Gwinnett county fraud unit. Please correct this
There was a court order saying what they received from the court was all that was due them, this is enclosed, I have contacted them multiple times to have this corrected; they refuse. I have sent them the proof and all the money order receipts and again they refuse. They have even inflated the move-out charges. Things that were routine corrections in the apartment, they did not do, they are trying to charge me for. All of this in an effort to get what monies the Court did not award them. Please review the attached thoroughly and you will see they are being dishonest and messing up my credit score.
STATING THAT I HAVE A CASED FILE, WHICH WONT TELL ME THE AMOUNT ,OR IF START AMKING PAYMENT I CAN GET N RECEIPTS OR ANY KIND JUST HAVE TO WAIT , AND I BEEN SEEING A LOT OF COMPLAINTS FILED STAING PAYMENT MADE AND NO RESOLUTION , THE CLAIMS BEING MADE ARE FALSE ANYWAY. BUT I WOULD LIKE SOME RESOLTION HOWEVER TO BE RESOLVED OF MY CREDIT REPORT
Rental Apartment., My elderly mother had to terminate her rental agreement early due to illness., We had no move out inspection( we gave them exact date). *** charged us for multiple things which were incorrect. We sent pictures to Borland Law., with a letter and proof that we bought new blinds etc.. They never contacted me again., and sent my info to credit bureau as a charge off! I was not even offered a adjusted amount, nor did they respond to my attempts to clear this matter.. Is this Legal? Now my credit is effected due to their lack of desire to settle this account. I was not even notified that they were going to send me to credit bureau as a CHARGE OFF!

Harassing, threatening, and rude Collections calls for debt that I dispute
Harassing, threatening, and rude Collections calls for debt that I dispute. I was a guarantor on a lease for my daughter's college apartment. Prior to moving in, she was informed that the apartment was not available and she would need to find housing elsewhere (which she did). Near the end of the lease I received notification that rent and penalties were 9 months past due and unless I paid in full the matter would be turned over to Collections. I refused to pay a debt I didn't owe and started receiving calls from Law Office of Brett M Borland, P.C. Calls were frequent and threatened to "ruin" my credit. I explained why I refused to pay, and that no amount of calls would change my mind. Now, over a year later, my daughter and I started to receive calls again, I spoke with "Ms *** and explained my position again and was told, "so, this is a refusal to pay, you're not going to like what happens". My credit score has already taken a hit for a debt I don't owe, and I'm not happy about continued harassment and further threats to my credit and reputation.

National Credit system had a debit for me for *** said if I settled the account with Brett *** (collection) they would send me a settled in full letter and remove the debt from my credit report spoke to *** on Friday Paid *** on January 7th 2023 could not access the web to recieve my settlement letter contact NCS as well as the collection agency to get my letter without success. I would like my account to be deleted per agreement with the company and a letter showing it has been Settled so that this can stop being reported on my credit report
An apartment complex I lived at filed an collection for not paying a final balance upon moving out, the managers were supposed to take care of this in August , once management changed I was told to contact the debt collector, this firm, and explained to them that the information they have is incorrect and I have receipts for payment made on the dates they are claiming there was no payment. The people I spoke to on the phone were extremely rude, asked that I send the receipt to their email so I did. This was months ago and I still have not heard from the firm, and the collection is still on my account. This has negatively impacted my credit score and is posing issues when trying to secure housing for myself. Because this company has failed to properly maintain their records I am currently without a place to stay so getting this resolved quickly and in the best manner possible is all I ask.

I am a victim of Identity theft and this company has continued to harass me and frequently file erroneous charges on my credit report I have been a victim of Identity theft since 2013 and I have submitted a police report to this company several months ago proving that I am a victim of Identity theft clearing me of this so called debt that has no relation to me and I have disputed these charges with the 3 credit agencies just to have this company that has been slandering my name and threatening me for a debt that does not belong to me. I have threatening messages saved to my phone that these people plan on destroying my credit profile if I do not pay the debt that does not belong to me and just today a woman spoke to me directly from a blocked number calling from this company that they are sending federal agents to my home to come arrest me and have me prosecuted. I am going to file legal charges against this company if this is not resolved asap. I have been patient enough but now I am being threatened and I feel the need to file legal charges against this bogus law firm.

I was contacted by this law firm about a mobile home I owed on. I wrote them a letter regarding the circumstances of not paying the ***. They kept calling me and sent me a letter with a cheaper payoff amount but I didn't have the money. My mom (with my permission) spoke with them and they agreed on a payoff amount.y mom paid them over the phone using a credit card. She was told we would receive paperwork stating it was closed. I am trying to purchase a home and they ran my credit report. The full amount is still showing on report as not paid.I completely forgot about the problem until recently. I gave birth to twin boys in 12 seven weeks early. I was in the hospital 3-4 times in early labor. The twins were diagnosed with a terminal illness's while I was still pregnnt. Their life expectancy is around 2-4 years. They are now 2 1/2 yrs old. 5hey are seen by doctors 3very week so I completely forgot about this problem. Please help me.
Creditor: *** Balance $2,325 Received a charge from Law office of Brett. Borland on August 2 from a previous apartment complex I lived on. Acct placed in collection w/NCS, by Brett Borland on 09.23.17 for $2,465 for breaking apt
Acct placed in collection w/NCS, by Brett Borland on 09.23.17 for $2,465 for breaking apt. lease. Per NV statute, I'm not liable for paying this $$. Positano apartments placed my acct in collection 09.23.17 for $2,465 for breaking an apt. lease. Per NV Revised Statute 118.175 , the landlord must make their "reasonable best efforts" to re-rent the unit as quickly as possible. I vacated the unit on 06.29.17 and it is my understanding that the unit was in fact re-rented and occupied in less than two weeks of the unit being vacated. Based on this information, the law has been violated and because of this, my credit score has been adversely affected. I disputed the collection with Experian; however, after the dispute was completed, nothing had changed on my credit report. I tried to contact NCS but you need to sign up for an account in order to be able to contact them and I was unable to create an account on their website. After filing an initial complaint with the Complaintsboard.com against NCS, I was informed that the account is being handled by the Law Office of Brett Borland (XXX-XXX-XXXX).

Nearly a year ago an account I had was turned over to Attorney Brett M. Borland's office and was ultimately settled shortly thereafter. However, due to the ineptitude of office personnel, my account was never closed. It has now been over a year and I've only been able to find one person in this office that had some level of customer concern enough to get the account closed. However, acquiring the necessary paperwork that states that the account is closed has been another journey into the abyss. I have made multiple phone calls and have gone to the website that this office has directed me to, only to embark upon more frustration. How hard is it to put on paper, or any digital means, a statement that simply identifies an account as closed and settled? I'm at the final stages of refinancing my house and this most unfortunate situation has me at a stand still. If I can honor my debt by paying what was agreed upon, why can't this office honor its responsibility by providing the necessary document(s) in a timely manner, and by removing the negative collection on my credit report? It has been over a year for goodness sake!

This company has taken my money to pay off debt i get a different story as to why i have not recived my payment letter each time i call. on friday 03/27 i made a payment to this law office in order to settle a balance from a previous apartment rent due to me not giving a full 60 day notice upon leaving. i paid my deb with this company and as soon as my payment posted the man that has been hlping me has not answered the phone it goes straight to voice mail. i have been told several different stories. 8/20 paid via phone $3,200 settlement & was promised PIF/clearance letter via e-mail in 5-7 business days
8/20 paid via phone $3,200 settlement & was promised PIF/clearance letter via e-mail in 5-7 business days. As of 9/12 still not received. Contacted firm on 8/20 in response to settlement offer letter I received via mail. Called and spoke with representative and reached an agreement of $3,200 as settlement-in-full. She stated that in exchange for such payment, I would receive a PAID-IN-FULL/Clearance letter via email within 5-7 business days and the debt/collection would be removed from all 3 credit bureaus within 45 days with me having no further liability. I asked for something in writing, in advance of payment, summarizing the terms of the agreement but she informed me that settlement offer letter I'd already received was "their" form of offer in writing. (There was NO SPECIFIED offer amount or terms in the letter.) I made the payment via phone with the representative and was not given any receipt but was advised to refer to the transaction on my bank statement as proof of payment. After making 12-15 phone calls, leaving several voice mails that were not returned and speaking with several unprofessional other representatives who have done nothing but give me the runaround and make excuses I still have not received my letter as of 9/12.

Providing no proof of business legitimacy
Providing no proof of business legitimacy. Falsely accused of debt with no proof of charges. They have called my cell phone with out permission. I was contacted from an account representative stating that she is from a debt collection agency. She called from an Oregon number. This company is located in Georgia. I asked to speak with the attorney she stated that I can't because I'm not an attorney. I asked the name of the law office that is suing me a guy got on the phone and gave me the name of the law office and disconnect the phone. I called the law office and then they forward me to random voicemails then forwarded me back to the account representative. I asked to have a print out and proof that I owe the debt. The account representative stated that they will sent it. ( which is the 5th time over a series of years requesting proof of debt and the responses from all if the representatives is that they will send it which never happens) The account representative gave me contradictory numbers when I asked for a break down of charges. For example: she stated the carpet cleaning fee was $50.00 then it was $75.00. Then it was $250.00. The account representative stated that I have until the 13th to send proof that I don't owe the debt, today is May 5th. If I do not send proof then they will move forward to take me to court. This debt has been recorded on my credit report before I was contacted. In addition when contact began they called me on my cellphone and had another collections agency do the same. They never asked permission. This is a violation bullish behavior.

Law Office of Brett M
Law Office of Brett M. Borland who represents *** regarding the collection account of $1301 from *** I have disputing the legitimacy of this account being on my credit profile. I have sent out three letters to this company asking for validation of this debt. The information that they sent me does not prove that I actually owe this amount of $1301.00. I spoke to one of the managing supervisors *** on December 1, during this phone conversation *** stated that there was a mistake made. He indicated that he researched my account and could not find any evidence that this debt was valid. He stated his operational manager *** was looking further into my account and was waiting on a response from Jetty. I told *** that it does not make any sense for them to keep the account open knowing it was reported in error. I also said that they were in violation for knowingly reporting false information. I told him the proof that I do not owe anything is in the documents they sent me justifying valid debt. I told him all they had to do was just read through the documents they sent me. Heres the story with this debt. Jetty *** had a surety bond. The summary of coverage for the surety bond states the premium is non-refundable and the bond is only owed if there is any physical damage to the apartment beyond normal wear and tear or any money owed to the landlord. There was no money owed to the landlord and there were no damages reported either. I have the court documents which list all money owed which was paid, of which, the documentation they sent me indicates this and no damages were ever reported. They have the document which indicated all money was sitting at the court house the whole time. It was clearly stated on the last page of invoice document. So, why is this debt still on my credit report.

On 3/1/22, I reached out to National Credit Systems (NCS) to settle a $8816 debt. I was told to call a different number for The Law Office of Brett M. Borland, P.C. After a callback and discussion with a representative claiming to be an attorney, we agreed on a $6000 Pay to Delete arrangement. I provided my ACH payment details but was then told by a 'supervisor' that they wouldn't accept this payment method and was asked to wire transfer the money. I declined, stating ACH check was my only option. The supervisor refused to discuss this with the client, NCS. I called NCS and was told I wasn't in their records. I called the law office back, and the person I spoke with was defensive and inconsistent, eventually saying I could send a check but it would take over 30 days to receive a payment receipt. I agreed, wanting to ensure the debt was settled. I sought confirmation of the Pay to Delete agreement, but was told they couldn't guarantee how it would be reported to credit bureaus. Unwilling to pay without a clear agreement, I was threatened with court action.

No response for invoice
No response for invoice. Damaging my credit without a chance to dispute or pay. Poor customer service. In April , I recieved a call from the Offices of Brett Borland in regards to a fee I apperently owe to an apartment complex in Greenville MS. I asked for an invoice, broken down per charge (Total around $1700). The employee stated she would email it to to me immediately. I called 3 more times that day with the same answer of , "Ill get this sent out immediately" or something similar to that. I never received that invoice. I assumed that they decided not to pursue me over it due to unrelated facts in regards to the apt complex. On July 28th, (yesterday); i was informed that, "Oh guess we didnt send that out", i ask for the invoice again. Was told it would be sent out ASAP. I received nothing once again. At the time in April I would have been able to pay this, however after the pandemic, i would need a payment plan. However, i never even had the opportunity to pay or dispute the charge. I never got the invoice, never a follow up call. I lost employment semi-recently due to the pandemic. I got accepted into a vocational school that i really was intent on; however i could not get the loan now because of these charges that i had no way of paying before and my credit score dropped dramatically. This company is unethical and or lazy. Ive never heard of a bill collecting company that the debtor has to keep contacting, and that wont send an invoice. Side note: im 99% sure they are the reason my credit score dropped dramatically. The the only loan (student) i had out plus the amount they said i owed added up. I cant afford the full creditkarma at the moment, to get the full details, but the debts (2) and the numbers add up. My credit score dropped dramatically over the last 6 months and this is the only possible reason why. I will send you a confirmation on Friday when i can afford to buy my full credit report. I have the call logs if they want to dispute my claims. I honestly dont even know if they are a real company sense i have received nothing except phone calls. I travel for work, so I asked for them to send me the invoices via email, with they have agreed to multiple times but never have. Call log availble upon request.

The Law Office refuses to provide adequate information to resolve the debt and provide confirmation of payments received by their office
The Law Office refuses to provide adequate information to resolve the debt and provide confirmation of payments received by their office. National Credit Systems received my account in their office for a debt that I owe to the Villas of Camelback Crossing. I did not resolve the debt with National Credit Systems who retained *** M. ***'s Law Office to further pursue the debt. I called the law office around the beginning of Jan. 2020 and spoke with my account rep Mrs.. At the time of my communication with Mrs. she advised that they were now collecting on the debt and in order for further collection efforts to be dismissed/stopped I would need to make a payment arrangement on my account. I set up an arrangement for $100 a week to begin January 10. After setting up the payment arrangement I asked Mrs. if I could get a receipt of some sort for my records, she advised that I could not get a receipt as they have had people in the past try and use their receipt for fraudulent reasons. She stated I would have to use my bank account records as confirmation to show I have been making my payments. I have never had any business that I have made payments tell me they could not give me some form of receipt of payment. Nonetheless, I have been making my payments on time since that date and keeping track of the payments with my bank records. Subsequently, around mid Feb. I called the office again and spoke with Mrs. to ask a general questions about whether or not they report my payments to the credit bureau. I inquired as $100 of the money I had paid had been reported to Transunion (I was a little excited as it was gonna help my credit). Per Mrs. she advised that they do not report to the credit bureaus and actually no one should be until the debt is completely paid. I advised that someone had reported at least $100 being paid as it is reflected on my credit report. She insisted that it wasn't their office and I should call National Credit Systems (which I did and they referred me right back to the law office). I also inquired about a settlement offer which Mrs. again shut down conversation very quickly and said no settlement was being offered and she didn't know if one would be. I ended my call with Mrs *** who in my couple of interactions was not pleasant to speak with. As I was unsettled about the conversation with Mrs. I called back and spoke with Mr. Jones and explained by situation. He and I had a lengthy conversation which resulted in him advising I call back in March to see if the "company" would consider a settlement offer. I called back on Feb. 18th and spoke with Mrs. the office Supervisor and she advised there has been a settlement offered for $2063.17, but it was only good for the month of February and she couldn't say if the "company" would offer another settlement for March. After a few more minutes the call ended. I called back Feb. 19th to get clarification on a couple of questions I had about the settlement offer and ended up speaking with Mrs.. I asked Mrs *** as a consumer how would i have known there was a settlement offer. She first stated "its not their obligation to advise the consumer that the "company" has offered a settlement as they have hundreds of people they deal with. She then stated "well didn't you get a letter of the offer?", I advised I had not and she said "well that's up to the "property" to advise you of the offer, we dont do that". I also asked how can you say it is only for February when I never even knew until 2 weeks into the month and thats because I called their office. My question to Mrs *** and it still remains, how would I know if I had a settlement offer? As I stated to her after I made my arrangement I have no viable reason to call their office after I made the arrangement. I only ended up calling their office because I had questions and National Credit systems refused to talk to me because the law office has my account. Their practices are not justified for a debt that I am willing and trying to resolve so that I can get a home for me and my family
