Mercy College Discrimination

1. What happened?
- A professor inappropriately marked me absent when I was in Class.
- Same professor Gave me an 'F' when I passed both Midterms & Final Exams. (Due to the professor inappropriately marking me absent and not accepting the vast majority of  my homework assignment is what led to my failure of this class).
- Emails were created by either the school administration or the Professor to ban me from the College.

- Spring of 2015 - September of 2018
- Mercy College, Dobbs Ferry NY
- Professor Christopher Geraghty
- Kevin Joyce, dean of student affairs
- Nick Canzona, Assistant Dean to student affairs
- Alena Kush
- Karol Dean
- Donna Rebain
- Mary Cuadrado And others at the Mercy College administration. 

3. What explanation, if any, was given for what happened?
- Nothing, I was called many disparaging names.

4. Why do you think this happened to you?
- I am a young black African American man. This was all about race. I was Discriminated by this institution.

5. What steps, if any, have you taken (filed a complaint or appeal with the parties involved, any public agency or official, or any other organization)?
- I have followed every guideline, procedure set by the college. I met with the dean of Student Affair and Nothing really happened. I was still called disparaging names, such as being a hostile threat to society which is completely & utterly false and wrong in every way.

6. To whom did you complain and what is the status of the complaint?
- I had filed a discrimination suit from the Division of Human Rights(DHR) from NY. Only to have my case mishandled by the Division of Human Rights(DHR).

7. What documentation do you have on the matter?
- I have the emails the college allege I sent to a professor.
- I have documentation of the entire incident from September of 2018 and etc! 

ADDITIONAL INFORMATION:

This incident took place back in 2015 - 2018 of September.

I filed a civil rights complaint against the institution of Mercy College. I was discriminated against by this institution. And the institution may have created emails that they alleged I sent to a professor.
The office of civil rights; according to them, they could not take the case because the statute of limitation has been reached.

So I had filed a discrimination suit from the Division of Human Rights(DHR) in NY. Only to have my case mishandled by the Division of Human Rights(DHR). For example, Kevin Lynch(Human Rts Spec) has asked me to give him a rebuttal.

When I ask what is a rebuttal? I didn't get any reply for the entire day. I had to research the meaning of the word 'rebuttal.' When Kevin Lynch saw my first rebuttal, he called me by phone & told me that this is out of their jurisdiction. And they couldn't do anything about it. As I continue speaking on the phone with Kevin Lynch, he then decided to take the case when he a few minutes ago considered this type of matter to be out of DHR jurisdiction.

However, during this time, I was in Virginia on vacation with my relatives who just moved into their new four bedroom house in the State of Virginia. I didn't have access to my laptop since my laptop was left in New York. This was between late June to early July of 2019. Because I did not have access to my laptop, DHR sent me emails; the college alleges that I sent to a professor. I did not look at the emails because the phone I had wasn't working accordingly. And none of my relatives had a Laptop to use.

There were attachments on the email Kevin Lynch had provided me & I could not open the attachments due to how my phone is set up. So by the time they ask for my second rebuttal. I gave them my second rebuttal. And by the time I came back to New York, I received an email from the Division of Human Rights(DHR) stating that I sent hostel emails to a professor, which is false. And then they decided to dismiss my case.

When I got back to New York, I was able to get access to my laptop. That when I have seen the email the college alleged I sent. And I immediately realized these emails were entirely made up and fabricated by the administration.

I tried to have the Department of Education Office for Civil Rights to reconsider my case. They refused and basically said the statute of limitations had been reached, and there's nothing they could do about it.
I have followed every guideline, procedure & legal steps.

I spoke to multiple lawyers back in 2019. These lawyers are very expensive; I am not able to afford a costly lawyer. And now, I am stuck with a student loan debt that I will never be able to pay off. What happened to me in 2019 was no fault of my own. What happened to me back in 2015 & 2018 of September Was no fault of my own. This doesn't seem right, And this needs to be handled accordingly. Can somebody please help?

Mercy College banned from college for life

I had attending Mercy College since 2015 & the events that happen last year 2018 in September, I would like to explain my concerned. I have been kicked out of Mercy College because of my honesty toward a professor. This Professor had treated me with unfairness. I will explain in detail. For whatever the reason, this Professor would never accept my homework assignment. And not give me a reason why he would not accept any of assignment. Asking him for explanation Only to be ignored. Seeing other students come in an hour late to class, he accepts their homework assignments but not mines? When I do put my homework assignment on his desk, only to have him say "don't put anything on my desk again & no I will not take your homework assignment". I truly do not understand what happened? And why I was treated in this way. I barely email my professors, I don't bother people. I come into class, I participate, I pay attention, I always do my work in a timely manner, and I always have good attendance. However, although that I had explained this to the administration at Mercy College, including my pact office adviser, only to be no help at all!
I followed the chain of command, only to be ignored - nobody responding. And when this professor, did not accept the majority of my homework, he would not give me a reason. And me not knowing the homework weighs heavier than the finals, which resulted in me getting an unfair grade "(F)" - despite the facts that I pass the final with 72 %. This was extremely frustrating. And as I had complained to Mercy college officials, only to be ignored. Which led me to email this professor and calling him an "[censored] PROFESSOR & I WILL ALWAYS REMEMBER YOU AS A [censored] PROFESSOR". Which had resulted in me getting banned from the college. As a student, I'm aware that I violated the code of student conduct. But the question is, when a student has done everything, & report unfairness within an institution. Only to have that student(me) be ignored, and then blamed on for failing the class & wasting taxpayer's money to put me through college. Where are the limitations for negligence within an institution that does not recognize their own problem? I do suffer from Autism Spectrum, so maybe that was the reason why I was treated so poorly.
However; I'm asking for help - This is my first time contacting your department. I would like to know my legal options. Please, if possible. Can someone in your department assist me? Please do not dismiss this letter. I truly do not know the Ins-&Outs of the Education system and laws and its procedures. I only had 3 semesters left to graduate with my bachelor's degree.
I truly would like to finish off where I left off. I'm so close of finishing off the Final chapter of my life. I would truly like to know my options & I would like to know if someone in your department can help!

Please take note:
The incident that happens a few months back in September of 2018, is the first incident ever to happen in a learning institution like Mercy College. I’ve been to Monroe College & obtain my Associates Degree. I never had a problem because I never dealt with the kind of professor.
I had email Kevin Joyce Dean of Student Affair. I had Explained My sorrows in a Emailed document that I had written was to blame on myself. I had written a statement to show sorrow in order to have hope of returning onto the campus to complete the three semesters I had left to complete!

Although, they will use that email I sent them on January 7th to use against me. Please be reminded, that email was only to show my sorrow and only to ask for forgiveness. I was begging them and pleading with them. (although they will use this against me) Please be aware, that email was only meant to ask for forgiveness. Even if I must blame on myself even though it was not entirely my fault. ----- Email in paragraph is below

I’m not sure if I'm supposed to be reporting to you or to whoever. As I had just finished reading part of the Student Conduct Handbook. It was not clear on how I am supposed to appeal my sanction. As I am now a student at Seton Hall University. I had noticed I would have to spend another 2 years in order to finish off my Bachelor’s Degree. I also must depend on Scholarships in order to finish of My Degree in Criminal Justice & Laws.
I just wanted to say; as I had analyzed my mistakes. I am Truly deeply sorry of the conduct I had done a couple of months back.
Since, I obviously wasn’t clear in the Conversation I had with Kevin Joyce a couple of months back. I wanted to explain again in details of my misconduct.
The Vulgar language I had used against a professor was due to Stress, loss-of-hope, anxiety, frustration, worry, and doubt in oneself. With those combination will in truth impair any students Judgment. Director of Student Affairs Kevin Joyce wanted an answer to why I would send a Vulgar Email to a Professor, I did not explain myself correctly. As I sat around and think about what I had done. I came to realize why I sent a Vulgar Email to a Professor.
But first I just got to say
The incident that happens a few months back in September of 2018, is the first incident ever to happen in a learning institution like Mercy College. I’ve been to Monroe College & obtain my Associates Degree. I never had a problem because I never dealt with the kind of stress, & anxiety, & doubt in oneself. I had been to Clark Academy High school in Dobbs Ferry. I never acted out against a teacher/professor in anyway.
Yes, I did speak to an Attorney, but I decided it was not worth me spending $4, 500 for an Attorney. I decide to Go to a better institution. Sometime in November I was accepted into Seton Hall University, in which I was very happy & Proud!
So, why did I send a Vulgar Email to a Professor?
My reasoning: After finding out from my pact office adviser, I was told I only have 3 semesters left to Graduate. But, the Federal Grant from NY will not pay for my Final Semester which causes me to be frustrated. I ask the financial aid for help and for more options. They seem to be referring me to Parental Student Loans. My parent will not sign any parental Student Loans, because they are paying for their own loans. My biggest worry was “not finishing off my Last semester” which had caused me to get anxiety, stress, worrying and doubt in oneself. Which had caused me to send that Vulgar Email out to a Professor in which I remember getting a 72 on the Finals but got an (F) due to the missing homework assignment! That alone had caused me to single that one Professor out. Because I felt that I deserve to pass that class! I also had sent out other tasteless Email due to my impaired Judgment. I do apologize!
If I had passed that class, chances are; the Federal Grant would have been able to pay the last final Semester for me to obtain a Bachelor Degree. However; I have no accused of my action. And I am Truly Sorry!
However; I am a Student Of Seton Hall University. But I do not want to spend another 2 years working towards my Bachelor Degree. I had attended Mercy College since 2015. I never had this problem before, & I am truly sorry for my action. I hope whoever may read this can arrange another meeting with me whoever I need to speak too, so that I can by Forgiving and pay a possible fine if needed. “If allowed back on campus.”

Please be aware, I was not under no stress nor anxiety. I had to put that in the email only to plea for forgiveness!
I dealt with stress and anxiety at Monroe College in the Bronx...
However, I had professors who were decent enough to work with all their students! And I did very well.

However, when it comes down to a professor, I had at Mercy College. For some reason Professor Geraghty would never accept my homework assignment. And not give me a reason why he would not accept my homework assignment.

Which led me into emailing this professor and calling him a “[censored] PROFESSOR & I WILL ALWAYS REMEMBER YOU AS A [censored] PROFESSOR”.

which had resulted in me getting banned from the college and kicked out of college because the professor & the Dean's of Student affairs label me to be a threat, and a menace to society. And the fact of the matter is, this professor Christopher Geraghty had Emailed every Dean in Mercy College, including the president and the vice president of Mercy College(Timothy Hall) including the dean's Students affairs Kevin Joyce. This professor had even gone all the way in contacting the mayor of Dobbs ferry, Dobbs ferry Police department and the district attorney office in Dobbs ferry!

As a student “yes”, I'm aware that I violated the code of student conduct. But the question is, when a student has done everything, & report unfairness within an institution. Only to have that student(me) be ignored, and then blamed on for failing the class. Wasting taxpayer’s money (department of education) to put me in college.
Where is the limitations for negligence within an institution that does not recognize their own problems?

That is the question I have towards the department of education.

So, I truly hope, that something can be done. I am now a student of Seton Hall University. However, my financial aid is reaching its limitations. And since Mercy College will not allow me to finish off the three semesters I have left. I'm asking whom may read this at the department of education to look deeply in this case and see the problems of the Mercy College administration.
