improper Judgement
My wife was served on 2/10/11 for Capital One Bank (USA) N.A.
I the Husband called to try and settle the claim and they turned me down
saying my wife had to call and set everything up. She called and set up a PAYMENT PLAN
with them and told them i would (husband) would call in the first payment on 3/11/10 they said
it would stop all judgements, and court dates. I called and made a payment over the phone
on 3/11/11 as we said. That night when i got home from work there was a letter for my wife from
Farrell &Seldin saying that my wife didn't show up to court and comply, so they put a Judgement
against her and upped the fee another $450.00. She was told to pay 85.00 by the 11th of every month. we kept
up on are end. the money came out of my own personal acct.. any help would be great thanks [protected]@hotmail.com
The complaint has been investigated and resolved to the customer’s satisfaction.
Debt collection
I had an account with Capital One which was charged --off in may of last year. On December 29 2008 I was hand delivered by an unidentified man a "summons" . I had no idea what he was even handing me, I think he called it paperwork, but I am not sure if he said anything at all besides that I didn't have to go to court to just call the number. Are you a debt collector? I find it ASTONISHING that you would speak this way to someone. Everyone has reasons that they can't pay and it isn't always because they decided to ignore it. I suggest that you not pass judgment on someone based solely on what you THINK they did. In case you haven't noticed, this is a consumer COMPLAINT board. People come here to air their grievances, not to be harrassed by others!
