Peroutka & Peroutka Debt Collection

They are very dishonest. When they first started calling me, they told me they represented Capital One in a collection matter. I had 2 accounts and they held both. They first wanted me to pay, up front, half the outstanding balance to settle. When I tried to explain that I would not be in this spot if I could afford that, they practically called me a liar. When trying to set up a payment plan, they told me Capital One would not accept the amount I could afford to pay. Finally, they accepted the amount I could pay, and I made a good faith payment over the phone. They were to send me a receipt and instructions for future payments. I never heard from them again for over 6 months. No mail, no phone calls. Then I get served a lawsuit. I call to complain and they tell me I was ignoring their calls and letters, so they sued me. Told me the amount I wanted to pay 6 months earlier was no longer enough. They asked for half again to settle. Could not do it. Finally I had to agree to a Consent Judgment and now make monthly payments, in the exact amount, which was not enough and not acceptable before the lawsuit and judgment.

NoThankQ: Your assessment of the situation is totally wrong. Screwed did try to repay the debt. But P&P failed to send him statements or bills for six months, as promised, then suddenly sued him. You have very poor reading comprehension skills. Go back and reread the letter.

Peroutka & Peroutka Credit Card Debt

They were handling my credit card account. I decided to go with a Debt management program. I did this because I had several other debts that I wanted to consolidate. After enrolling in the program I was advised to call and let them know that this company would be taking care of these debts for me. Peroutka and Peroutka, after being told on two occasions the name of the company and phone number, that they could check with. They instead put a writ in the courts to Garnish my wages. The judge signed the writ of Garnishment. I went to file a motion for a hearing and sent them a copy. They do not want to work with us in any way.

Peroutka & Peroutka Illegal Practices

This is the type of firm that gives lawyers a bad name. They have filed false information to the District Court of Maryland. They claim that they served me with a Writ of Summons on a day that I was out town. The firm positions itself to look as though they are representing credit card companies and they are NOT. They purchase debts and then try to collect using the Maryland Courts as their partner. They file false claims in court! In my opinion, this guy, Michael Peroutka is a real ###!

Please read about this guy at http://www.citypaper.com/news/story.asp?id=5324.

What a great guy huh?

Didn't Capital One receive bailout funding in 2009?

It is interesting that I have more than one company sending me demand letters saying that they have been assigned by Capital One to collect an alleged debt. I sent VOD letters to both, one never replied. The other one, Peroutka, sent some information back, but nothing that legally binds me to pay them. They did not send any document legally proving that Capital One has assigned them to collect this debt. They said all they need to do is send a letter from their office saying that this debt has been assigned to them. Well anyone can send that. All this is really confusing. Peroutka is taking me to court and right now I am thinking that I should go and get the facts about what is going on here.

Thank you for your reply.
What constutes that the collection agency validated my request. I sent the validation letter certified. I received the green card back and also a letter from the collection agency stating:
my name, acct number, my address, the original creditor name, oc address and the amount owed.
IS that all they have to provide? Do I have to wait to go to court to have them pull specific info to prove it's my debt?

The summons will be served before the garnishment, sometimes years before. My advice to you is check your credit report every year or as often as you can to check up on any debts or collections you might find.

The problem is really with these 'private process servers' who fail to serve the right person or serve papers the legal and correct way. Sometimes a family member or friend will accept the papers that are supposed to be served to you and the private process server is supposed to write down their physical description. See if you can't find a copy of the summons.
Other than that see if you can't get your garnishment lowered, I did, because I didn't have enough money to pay my bills and they worked w/ me

Perkins
Contrary to Maggie's suggestion I would not advise you contact a lawyer. I had one of the most qualified lawyers in the field of debt collection screw up my case. She prepared a motion that failed to even meet the legal standards. The motion ended up being denied because she failed to advise us that we needed a meritorious defense in order to get the motion vacated. Most lawyers only advise you to settle because it is in their own best interest. If you do go to a lawyer do not hire Sonia Valentine. We will be suing her for malpractice as soon as we deal with P&P. I will be happy to share my situation with you if you email me at kevinzurrin@beatthedebtcollector.com. I can send you copies of my motions to give you an idea of how to file your own pro se.

I'm having the same issues. I was never notifed. I have not received any paperwork from Peroutka & Peroutka, P.A. in regards to how much I owe, the judgment from the courts, and I of the paperwork still have my old address on it. I haven’t lived there an over 20yers. I had my job send me copies of everything because I was so much in the dark. I notice that the courts granted $6014.23 org. amount, $37.89 interest at 10% from 8/19/2008 to 9/11/2008, $85.00 court cost, $902.13 attorney' fee and the total $7039.25. I'm looking at the letter that Peroutka & Peroutka, P.A. send to my employer and the amount is not correct. $7299.70 is the orig. amount, $47.67 interest, $6014.23 principal, $902.13 attorney fees, $95.00 Court cost. They're charging me an interest on payment allocation as well as the balance, so basically they're charging me interest twice on my balance every 2 weeks. I don't know what to do or who to contact in regards to this situation. Every time I tried to call the number on the letter that was send to my employer the lines are busy. Need Help!

Peroutka & Peroutka garnishment of wages

I'm complaining about Peroutka & Peroutka. They are attempting to garnish my wages for a 16 yr old Sears credit card. What about the statutes of limitations?I have made 2 payments to them, but they didn't subtract out the 2 payments that were previously made. The are ruthless and don't care about consumers trying to do the best that they can to make payments during this time of recession in the United States.

Look up state laws for statue of limitations. For most states it's usually around 8 years. Only two things that have NO statue of limitations, Murder and Treason. That's the law.
