We got a new house on *** Drive from S & A Construction. We gave them $19,000 for a fence around our house. But they put the fence on our neighbor's property without telling us. We went to our neighbor's house to tell her about it and she said she didn't know. We got a lawyer to make sure the fence stays if our neighbor moves. We want to know how much we paid for the fence materials, but we only got one price. We also paid for movie theater sets but we haven't got them yet.

S&A Construction knocked down asbestos-containing material all over my home without properly protecting their employees or myself, violating their duties and putting not only myself and their employees, but also potentially future property owners, in danger. When we discussed taking down a damaged portion of the popcorn ceiling in a hallway of my 1964-built house and they then called back to suggest doing every ceiling in the house (which I did agree to), I stopped by to find that the material was lying over uncovered air vents, in cracks in the hallway, streaking the walls and on basically every surface in the home. Fortunately I had done a test and learned this material contained asbestos--which, according to research I had to do afterward, the contractor is obligated to assume for any house built before 1980! So when I saw this in the house I called the company to ask what was going on and whether this was how asbestos-containing material was supposed to be removed. S&A did not handle this well. They called me in the middle of my workday and proceeded to yell at me for twenty minutes, accusing me of lying for having done something that he was obligated to do. When I reminded him that houses built before 1980 were supposed to be presumed to contain certain asbestos-containing materials, like popcorn ceiling, he claimed not to know how old my house was! This is disturbing for two reasons: first, it was a lie. During my first meeting with ***, we had looked up the listing for the house and I had specifically pointed out the age, saying that I'd been wrong, the house was built in '64 and not '67. Second, it is never acceptable for a contractor to be ignorant of the age of a house they are working on, specifically for this reason. They then called up an asbestos company to properly remediate the issue. They repeatedly instructed me not to call this company, as I would probably annoy them (his words) and if I annoyed them, they would purposely delay their work on my house, pushing my move-in even later. I have no reason to believe this is true; obviously, I did call them once they were done with their work, and they were extremely pleasant. When I gave them my address the first thing they said in response was that they had been shocked at how poorly the work removing the popcorn ceiling had been done in the first place--even when removing a "safe" popcorn, the walls and vents should have been covered, and the asbestos removal company said it was ridiculous that S&A had done none of this. To clarify, the asbestos remediators (different company) did a fine job, but I was obviously unable to move in on schedule, costing me five hundred dollars in storage expenses and leaving me homeless for ten days. My ceilings were also left unfinished; they did help sand them down but would have charged me another five hundred dollars to paint them, which I did not have at the time--so every ceiling in my home is still unfinished to this day. The remediation also damaged the paint on nearly every wall in my home, all of which must now be repainted or repaired. The remediation cost over six thousand dollars, plus my delayed move-in expenses, The cost of repairing and repainting the walls, and the cost of repainting the ceilings, not to mention a lot of head and heartaches. His workers were in this house with no protection, in violation of OSHA regulations. And if I had not done the test, I would have moved into a house with asbestos dust in the air and been exposed for years, as would any subsequent owners of the property. On top of this, I am pregnant, so my child would have been exposed at a very vulnerable age as well. It is extremely worrisome to me that S&A Construction may have worked on other older homes whose owners were not aware that asbestos may be in the home, and that there may be former customers and their families living with daily exposure to asbestos dust to this day.
