I have been approached by this company and am unsure as well. They said they will find the discrepancies in my loan (for 1% of original loan amount) and give to their law people who will then assign a lawyer at $1000 per month (for about 9 months). I have researched the lawyers, the Founders and everything I can. All seems OK...but they are a newbie company. Basically not enough data to determine. The Rep I talked to was knowledgeable and explained well and answered my questions. I would go for it for sure except for...I am afraid of the process where I am not supposed to talk to the lender once the TRO (temporary restraining order) is filed, which means I'm not supposed to be sending the lender money, correspondence, nothing. That is the only part of this whole thing I am holding back on because at this time, I have never been late in my payments. Problem is, everything is going to change and soon--so I have to do something. Also, 9 months (10 if you include the audit the first month) is a long time to wait to see if you are a winner...almost like having a baby! I was told things would get worse before they got better--but they cannot guarantee that we will win. So what to do...what to do.

Thank you everyone! I have been holding off becoming a customer of these guys and am glad I listened to my gut. They were too positive I would win my case, they kept lowering the cost of the audit and raising the cost of the legal services. George Pulvino keeps trying, but the next time he calls, I am just going to tell him we went with someone else (and I did... me!). I've figured out how to make it all work without losing my home or even being late on one payment. By the time trouble comes-a-knocking, when all is said and done, I will be paying less for my house than if I went with US Loan Auditors/My Legal Service.

My thoughts and prayers go out to all of you who did get scammed, I hope Karma bites them ALL on the behind!

YellowBoy AKA Mr. David Hood, I see you post was set at 6 hours 52 min. In accordance with me signing in you woke up at 11:00 a.m. Is this the time you wake up.? It is not slander or libel when you ask a question. My guess is you are David Hood under a new name, but then again, it's only a question not slander. Let me demonstrate libel...

First, the person must prove that the statement was false. Second, that person must prove that the statement caused harm. And, third, they must prove that the statement was made without adequate research into the truthfulness of the statement.

Adequate research would ask did the person opening up an auditing service, via the internet, to assist a person in foreclosure knowingly knew they were suppose to be licensed and registered in the State of California to assist anyone facing foreclosure.

Mr. Yellowboy, with your fake fraud young man statement, I'd like to see you attempt to find a lawyer and spend as much time as I have to find a lawyer to fight mortgage fraud. GOOD LUCK!

Gamblingbob99,

Can not thank you enough for all your efforts and video posts at
http://www.fightbackinsac.com

What I don't see is how your refund is going to resolve your loan problems. But it is your business to decide what is fair and just. Again thank you for all you have done.

Those ex-employees making threats to us about slander took a gamble to keep working for crooks or quit. The gamble got you a few extra checks, but don't cry since the only job you can get now is with Nationwide loan auditing. I spoke to many employees in June and July, and they heard it all about the scam, but refused to believe it. They were in your face and rude. In other words, they would have drank the kool-aid.

It is sad to say that most of those employees really did know what was going on. Most of them contacted the media after they were let go. Most people that were let go also claimed to the media they had left the company. I can honestly say there was probably a hand full of employees that had no clue about what was going on. Luckydog and Steve, I feel your anger trust me.. Being a former employee myself. I had no idea till I started to research more.. They tried to keep everyone apart and tried to get people to work against eachother... I hope to see you guys at court tomorrow. I pray that the victims get every last cent back and more.

Noooooooo not you Steve. I thought it'd be someone other than you would fall for that head fake. Well if I really was david hood it still wouldn't change the fact that what he did took balls and follow through. Now back to you "Steve". So what did YOU do after you found out you'd been conned the first time? Did you drive from "wherever' to stand in front of the lender that provided you the loan? Actaully let's back track a tad bit further. Were you one of those "cash out to pay off my credit cards and car" refinacers or one of those "zero percent down financed way more house than you couldn't afford" borrowers? Almost done with my coffee so I'm going to have to sum this up, by asking myself and any and all of you if the the only reason you're hear posting is because you really do care about what happened or is you're here because you're angry that the only contribution you made to this entire situation was to play the part of the fool? That probably was a run on or something not gramatically correct but you get my point. Gotta run.

YellowBoy, you spit the same ex-employee crap, now shift the blame to the person that got conned. Most of you [censor] holes were the ones selling the bad loans. Shame on us for trusting you [censor]s. But then when the [censor] lost their loan shark jobs, they moved on to Sandison and barker pulvino and the gang, and took advantage of people again, a lot of people scammed were those that don't speak English really good. You act like we deserved what we had coming for taking out these loans and buying a house we didn't belong. If we deserved it, then our punishment was losing our home, not you taking more of our money. And that justifies the con. Most of us here are angry because we lost money. So which a-hole are you? what was your part of the con? Is your money going away fast up you meth nose?

No, LuckyDog2009 not an ex employee and I don't feel good about what happened to the group of people who've been swindled. Over and over and over. Who and what I AM somone whos been sold a bag of goods for a product I've purchased in the past.(damm that slap chop) Here's the diff. I learend from it and pointed the finger at myself first then went on to know that it was NOT my place to judge. Karma took care it of it for me. If I was an ex, like ddinner or sixla and whoever esle is on here, why would I give credit to a protester or want people to show up at the court house? I'm not here to argue with anyone, but I do notice that very few of you here have mentioned real names of individuals listed in the declarations. I've only heard one of you mention "tony stercl" and that was it.(besides jim, jeff and his other brother jeff. Or was it jim, I forget.) There are employee, client and YES even "undercover" declarations that outline this CON from start to finish. I haven't heard Tereasa Hoffer's name or Renee neilsen or Emit Lucero. These and other EMPLOYEE names are inclueded in the "legal" docs. And yes I did use names. By the way Roland's my stage name, but only today. Tomorwo's post I think I'll be tish braizer and then the next day I'll be paul stein. It doesn't matter, what does matter is that in this world youre either predator or prey. Which one are you, because I refuse to be the latter.

LuckyDog2009. My intent has never been to fool you. If you feel disrepected or I offened you then my apologies. I have been following this post since the complaint was filed in Oct and only commented becasue I felt many of you were crossing the line. Posting employee names, emails and personal numbers isn't how this should be handled, in my opinion. You DO know that they were filing many of these cases with what they called cookie cutter complaint templates. What better way to keep your employees in the dark than to show filed cases. Maybe they did know and maybe they didn't know. WHAT i do know is that Jim sandison's facing both criminal and civil cases. I DO know the company filed BK which is pretty much adding insult to injury for clients. As far as reading what i write. That's funny seeing as how your post with "my meth nose" screams 8th grade reading level. You continue with your rants and I'll sign off and head to my daughter's recital. Good luck tomorow AM.

And to losthouse. The reason it was postponed was due to the BK. If you really want to follow this case then simply go to sac superior courts online and look up case#34-2010-[protected]. You'll find all the facts and get a better insite than this blog provides

Right, why would anyone just follow this case and then be concerned about employee names? Are you with "protect the liars club" ? Maybe if we post names address phone numbers and the works, they will think twice about hurting others. Most of the con artists walk free, move on to the next con and play dumb at the end.

Sixela, Foreclosure left me to move to San Diego living on floor in family spare bedroom. I wanted to keep it quiet because I can only imagine the look on USLA's faces when they go to court. I really would love to be there.

YellowBoy, Zero down? No I put $64, 000 down on a principal. Cash out equity to pay off cards? No refinance. I got nothing. Unlike you I trusted. You see, in 2006 I looked for a sweat equity project in which my girl friend and I busted [censor] nights and weekends for two years bringing to par. In fall of 2008 the media announced bad loans. Yes, I called and tried to work with my lender with no response. I hired a mortgage broker who also was a mortgage rescue company and yes he did nothing (I turned him over to the FBI mortgage fraud task force). I then hired an auditor who demonstrated the fraud was in the loan application. We sent a Qualified Written Request to the lender who stated they are the loan servicer and not the originator. We request copies of loan docs from the Title Company who has nothing on file of my loan. My auditor could do no more. I needed a lawyer so I called USLA for help. An employee at USLA told me to go back to my brokers office for a copy of the loan application which was missing from my closing docs. I did go. The loan application had my brokers signature on it and not mine. The income was doubled. This demonstrates how these loans were designed to fail. This is FRAUD. My taxes have always been done by my accountant firm for approx. eight years. My broker had my taxes. I relied on USLA to help. They did nothing but B.S. me past the auction date. I never once got the chance to speak to one of their attorneys. I went to my county D.A.s office and right away she noticed the loan app. was not signed. To date I'm told, she can not get the Title Company to release any documents but there are too many cases ahead of me involving rich people. So she says the state can not afford to deal with a poor boy like me. The Department of Real Estate is still looking into my broker. The Department of Corporations in still looking at my lender.
So if you really need to know me, this all ended badly. I lost my deposit, my savings, home, and the girl I intended to marry and have a child with. It's all gone. Due to financial greedy con artists out to seek a commission off the hard working service people of America-AKA "stupid borrowers". I've got nothing left, so I soon hope if you were a part of it that you'll someday you'll know what it feels like to have everything you wished and worked for be taken away and you to be called a stupid borrower liar.

My husband and I are also victims and lost our home to foreclosure in October. We are out $11, 000.00 and our home. I hope these crooks get what they deserve. I feel they owe full refunds and for those of us that actually lost our homes a refund on the worth of our homes. I am disgusted with this company. I made numerous efforts to contact them with nothing but BS on the other end. I even contacted the so called Director of Operations Laura Souter, she is just as guilty and worthless. Please direct me on who I need to contact to include ourselves in this complaint. We are from Bakersfield so they got further down the State than most realize.

All part of the scam
The best we can hope for now is an employee to find bankruptcy fraud and report it.

http://www.justice.gov/ust/eo/fraud/index.htm

US Loan Auditors filed for Chapter 11 bankruptcy reorganization on Dec. 2 in the Eastern District of California in Sacramento, listing less than $50, 000 in assets and between $50, 000 and $100, 000 in debt.

A negative in profit for pushing paper and lies. I don't believe it.

I thought the stay was granted too, but a later order seems to have lifted it. By my reading, the suit can continue, the injunction is ordered, and the bankruptcy has no effect on the proceedings.

ATTORNEY GENERALS OFFICE SHOULD BE FILING A LIFT OF STAY

The U.S. Supreme Court said in Cohen v. de la Cruz, The Bankruptcy Code has long prohibited debtors from discharging liabilities incurred on account of their fraud affording relief only to an honest but unfortunate debtor.

The burden of proof lies with the creditor of proving non-discharge ability by a preponderance of the evidence. Though, one need not prove a specific incident of misrepresentation.

The Seventh Circuit Court of Appeals, in McClelland v Cantrell, determined that actual fraud is broader than a false representation. The Court distinguished between the two types of fraud, as both were elements of Section 523, hence, one must have meaning different from the other, or only one phrase would have been used in the statute. The McClelland court adopted a broad concept of fraud rather than a specific definition. The Court stated Fraud is a generic term, which embraces all the multifarious means which human ingenuity can devise and which are resorted to by one individual to gain an advantage over another by false suggestions or by the suppression of truth. No definite and invariable rule can be laid down as a general proposition defining fraud, and it includes all surprise, trick, cunning, dissembling and any unfair way by which another is cheated.
When it comes to fraud, the Court knows it when it sees it.

B. Debts Not Dischargeable

198. See SEC. 86, supra.
Sec. 98. Debts Not Affected By A Discharge

A discharge in bankruptcy releases the debtor from all provable debts, except (1) taxes, (2) liabilities for obtaining money under false pretenses, or for willful and malicious injuries to person or property, or for alimony, or for maintenance or support of wife or child, or for seduction, or for criminal conversation, (3) those not duly scheduled where no notice to debtor, (4) those created by fraud, embezzlement, misappropriation and defalcation.

4) Debts not dis-chargeable if they are "liabilities for willful and malicious injuries to the person or property of another."

To come within this provision the injury must have been intentional, otherwise it is a dis-chargeable liability.206 Thus it was held that where a debtor built a fire in the street and after he had left it supposedly extinguished and a small boy's clothes caught fire, and he was burned, there was no willful or malicious injury and the liability (which had been reduced to judgment) was dis-chargeable.207 And where a person illegally drove a car while intoxicated, and in so doing injured another, the liability was discharged, unless he willfully or intentionally committed the injury.208

But if the injury is WILLFUL or MALICIOUS there is no discharge, as, for example, a judgment for assault and battery.209

So with the the above being said and the declarations filed. HOW IN THE WORLD DID THEY GET THE ACTIONS STAYED.

More proof that it's not what you know it's who you know.

Todays court date didn't really have much to do with the Bankruptcy and had everything to do with their assets and the accounts being frozen. I believe the judge was actually on the AG States side on this one. I went to court today and I don't think it was in favor of the defendents. This is not bankruptcy court, and the prosecuters did a great job calling the crooks out today.. Way to go! Why the owners didn't shoe up mmmmmm... Doesn't surprise me...
Attorneys for usla wanted the judge to unfreeze the assests but the judge didn't rule on it and wasn't going to at the moment.. How could she, she doesn't even have proof that bankruptcy court will take on usla's case it's just in process. It could be thrown out.
