Consumer Portfolio Services - Loan payment problems

I am having the same problems as everyone else! I have been let go from one job because of these ignorant peoples phone calls and on the verge of being let go from the current one! These people are very inconsiderate and need to be stopped of there foolish acts. Do these people think that others dont run into problems in their lives? I understand what it feels like to be owed money, but I would never be as rude as these people. I am going to let them take my vehicle because I am not going to put up with this anymore. They have called my mother, my father, my sister, and now my work at least 10 times a day! Even when im not there. If anyone has any info they can let me in on please let me know, it would be greatly appreciated! Thanks

Its funny how prior to getting the loan APPROVED and BOUGHT... you will give any information needed to get your car NOW, im sure if they asked for blood, you'd give it, just to be able to drive away in a car... apparantly they ask for references for a reason. And like any other business, if you fall behind or owe money you probably will get harrassed, bc its BUSINESS! businesses fall apart in the end most of the time bc of people like your self, who sign contracts, agreeing to pay for an auto that they usually CANT AFFORD (and they know it) but still do it, auto usually ends of defualting in the end... yea doesnt sound all that bad does it? think of everyone on here thats going through "THAT SITUATION" .. your not alone. You also need to rememeber, just bc your paystub says you can afford it, doesnt mean you can.. your sub-prime for a reason, and CPS is there to try and give you another chance. DONT ABUSE IT!

i live in michigan i have been with the company 2005 and it is the worst experience i have ever had my lhusband lost his job, and was behind on payments call them to make arrangments and i was told even if i will make the payments they will still take the car away from me i talked to the rudest person ever he was the higher up

Try paying your bills...you agreed to BORROW the money...you also agreed to pay them a specific amount every month. I have had my loan through them for over a year and have recieved no calls or harassment...maybe that is because I pay my bill every month. Nor have they taken any funds fraudulently from my account. In fact, I was able to delay my payment 2 weeks one month because I called them and explained that due to an emergency I was tight on money. They quickly and nicely arranged for me to make a payment when I would have the money.

Any creditor is going to call you to get their money if you fall behind, and yes they will call you at work...why do you think they ask for your work and family phone numbers? If you don't want to get harrassed by creditors: a. dont take out loans and b. pay them back

This company is a disgrace. To everyone's point, I bought a car in 07 from a local reputable dealership in my area. I had no idea of the drama this company tries to put you through. They are classless and must hire the lowest forms of humanity to do their customer service. Just recently this company fraudulently withdrew funds from my account without any authorization from me whatsoever. I found out thru my financial institution that they indicated this authorization was made via phone call. I have spoken with no representative from this company to authorize this. CPS tried to give me 3 different dates of when I gave this authorization, all of which are phony. So now I am taking all information, recorded phone calls, correspondences, etc to our state attorney, local media, BBB, state senators and congressman from my area and any other avenue I can to expose this fraud of a company for what it is and what they have tried to do. I have since found another finance company(CitiFinancialAuto) to take over this loan so that I will never ever have to deal with this company again. If any auto dealer in the future tries to give this company as financier to anyone, ask if they really want your business and walk away. This company should be under investigation from all authorities for it's sorry practices that undermine any sense of legality. They have not heard the last of me!

First of all my friend...I totally agree with 100%. I won't go into lengthy details about my experiences with CPS (I could pretty much copy and paste pieces of everyones story..and viola...there's mine). Before I give some useful tips, let me boil it down...CPS believes that just because people have poor credit, must mean that they aren't that bright (which we all know is wrong). Now don't necessarly blame the person you're talking to (they're playing a role...blame the higher ups). The job of the representative you're talking to is to get you rattled enough to find some way/some how to get them the money you owe. The methods they use are illegal...but because they know they most likely dealing with people who would have difficulty aquiring proof and to mount a proper legal defense, they feel they have carte' blanche.

Here is some simple yet effective tips to deal with these vultures:
1. Do not do post dated checks ever! It is illegal, and not only that, they have been known to wait an extra day or two to cash it so they can garner late fees.

2. Do not pay by credit card, direct deposit from your checking account, or check (gives them information to your account). Pay only by Money Order or Wire Transfer (Money Gram is the best one because they charge less than Western Union to process, receive code for CPS is 3155). By doing this you not only have a written record for yourself, but one that if necessary can be accessed from a neutral third party. Also the money is automtically sent to your account, no processing time.

3. If they do call you at work, hang up. They skirt very close to the edge of breaking the law by doing this. There is no law saying you have to accept there calls or talk to them. Politely inform them that you do not accept calls at work, and that should they wish to discuss this matter, to call you at your home anytime after you get out of work (make sure you do mention what time that would be, but also add in the time it takes to get home).

4. Make a record of every phone call they make to you (and if possible, to your references). In your record, list the date, time, length of call, name of representative, and what was said during the conversation. You could also record the phone call (now that would put the fear of God into them...lol), however if you do, make sure you inform them at the beginning of the call that you will be recording this call for your personal reference (you have to, otherwise the recording is useless according to Federal as well as State laws, depending on your state).

5. If you want to file a complaint, the best places are the Federal Trade Commission, Your state attorney generals office, and the California Attorney Generals Office (CPS is based in Irvine, CA). You could also try the Better Business Bureau...but in my experience, as well as what I have read of others...it's just a waste of time.

6. If you or they offer to make any arrangement, then make sure you talk to their supervisor before agreeing (the representative does not the final authority in any deal, if anything else remember that). Also state that before you make any payment, you want the deal sent to you in writing on their letter head, signed by the department head (whom I believe is Chris Terry..and also the one you need to talk to in regards to finalizing any deal made).

Consumer Portfolio Services - Harassing phone calls!

I recently had a tragic situation happen to my son where he is still fighting for his life and ultimately ended up a quadriplegic.He resides in a nursing home and do to the amount of stress involved in my job activities i could no longer,hold my job and i am now on unemployment and i am struggling to pay my bills and pay my car note,because after all i do need my vehicle to go to see my son. On a few occasions i have spoken to different people from this company to try to set up some kinds of arrangements, some people have worked with me,and as soon as i make a payment they began to call my references all of whom are not well my mom, my aunt, my son who is the quadriplegic! So when i go to visit him he tells me slowly mom the people said they are going to take your car, so he automatically starts to worry.

I'm going thru CPS this is my very first time getting financed for a vehicle they got me at 25% and $674 a month payments I just lost my job I made payments even over payment thinking it would or could apply to the next payment due question is can I refinance my loan thru another place and what can I do to get my car back can I trade it in if I refinance my auto loan thru another lender can I get my car back after repo

I have to agree with everyone about cps. I got so fedup about all the calls that I just told them to come to get the car.Because of CPS, they made me hate driving the car. I had a debt company helping me pay off my bills and they tried to tell me that they didnot have to work with. I will never get a car with them again.

These people should not be in business! they are the worst company to ever have a car loan through. i was behind in my payments and made a double payment in june, they still have that i owe for june. then my car was totaled and my insurance company is working on paying off the balance. these people called me at my place of employment the manager of the "legal" department told me that i was ignorant! and then she refused to give me her name, i asked her what kind of customer service is this and she said i lost my customer service when i did not pay my car payment. then she told me she will see me in court to garnish my wages, where she hung up on me. what kind of people do they have employed here. i then called back trying to get her name no one would give me her name and i was transferred to her where she once again hung up on me. i really just dont understand how these people can do this. they are violating so many FTC acts. I have told them over and over and sent letters to not call me at my place of employment and they still do! somehow legal action again this place needs to start they cant treat people that way even if you have bad credit the whole freaking country has bad credit! and i hope they do take me to court because i will have much evidence to prove they were wrong and i intend on getting the recorded conversations this poor excuse of a woman and employee had with me.

wow, I had trouble with them today. First of all they claim I'm two months behind, but I have the Western Union receipts showing I paid. So they called me threatening me with repo. They told me if the payment was over 30 days late there system automatically turns it over to their repo company? I tried to work out payments and keep getting hung up on and put off on different people. I will never do business with these people again.!

I can't stand these people. There is no way to talk to a person when you call, I have sent them numerous letters to the correspondence address they give you with no avail. So far they have called about every dept leaving messages for me. I don't call them back. When given the message at work, I tell them next time tell them I was fired because of numerous phone calls from the. I have told them if they don't like when I pay the bill, then change it! I can't even believe they even accepted me for a loan that was $12,000 more than what the car was worth. The dealer I bought it from took no refunds, told me to refinance ASAP or trade it in after two months. They knew they screwed me. So take my advice... never deal with Thrifty Car Sales, especially in Clearwater, Florida.

On a final note: The FDCA does not appy to CPS (only to third party lenders, CPS is the actual lender), and in dealing with them: KEEP YOUR COOL... don't lose your temper, remember they are only trying to get you riled up. If you send them any letters, make sure it sent delivery confirmation and as well as having them sign for it.

Consumer Portfolio Services - Harassing tactics

This company is a plain pain in the ? If I am more that 5 days late on a payment, they start calling 5-8 times a day on my home phone and cell phone. Then if I do not respond to their calls they start harassing anyone I listed on my original loan application as references. Currently I have had a financial setback but even so I have not been even 30 days late. usually the payment has been made long before the 30 days deadline for actually being considered late and reported to the credit bureaus. This should be considered harassment right? They call starting at 7:45am and continue up until 8:30-9:00pm and on Saturdays and Sundays. What can be done?

Where to begin? I purchased my truck back in September of '07, and knew from the get-go that I had some bad credit, but was motivated to pay on the vehicle, on time, and build my credit back up. Sounds like a good plan. I can state very clearly that from a financing point of view I knew exactly what I was getting into. High interest, bottom of the barrel lender. However, the following is an interesting development in poor business. I will keep it short as some is currently still developing.

#1. These idiots will in fact spam-call/harass anybody they figure is mildly associated with you. They will. Its true. Its a simple fact.

#2. They will continue to call people who were specific with them in return when telling them to not call said individual anymore, and to remove their name from the list.

#3. I had a major mechanical problem with the truck. These things happen. I even had a bit of cash stashed away just in case this occured. I was told initially that they offered deferred payments for mechanical issues. After spending massive amounts of cash (Three payments worth) on a repair, I was told that it was simply "Too Bad" and that their policy was not to allow for a deferment.

#4. Coincidentally I had the honor of partaking in a mass layoff at roughly the same time, and there is of course a window in which Unemployment Insurance takes time to kick in, not to mention my gross earnings fell to less than half of what I was making prior. No working with me here either.

So now we are in a state of economical turmoil rivaling the decay witnessed during the Great Depression, and we have a company that laughably will not work with its customers in the hope of getting their regular payments in on time, but furthmore harasses them and anyone they know/may know/might have known, to try and get a payment while said individual does important things on minor amounts of cash like, for example: Buying formula for their baby, buying diapers for their baby, feed their family, pay rent, pay power bills, pay water bills, pay trash bills, pay sewer bills, pay medical bills, and the list is endless. Then, the best part, if you voluntarily acknowledge your breach of contract, during these harsh and overbearing times and move to do a voluntary surrender, they will still threaten to sue you, and attach your wages. You know, if you can find a way to survive.

I am a US Combat Veteran and have been through ### more painful than a kick in the face with a golf shoe while simultaneously chewing glass, yet it never ceases to amaze me how absolutely selfish American Companies have become.

I'm thinking about simply voluntarily surrendering the vehicle, even with the impending lawsuit. I can only hope a figurehead of our American court system can equate the difference between "Justice" and "Law".

To Tom Even if a person is late they still do not have the right to harrass people in this manner. If you read through some of the complaints this company will not adjust due dates and they are simple interest loan. So they are collecting, late fees as well as daily interest fees so if a person wants to pay the late fees then let them but they should be able to do it without threats

I am having the same proble with them, Every time they do this go to the federa trade commision website and file an electrroinc commplaint and also go to your states attorney website and file a complaint. I am hoping that if the continue to recieve complaint each moth the numbers will grow and they will do something. These are direct violation of the federal trade commission law . maybe this can be a class action.

We recently traded in our car that was financed through CPS (the best thing we could have ever done).
But get this...they are still calling us to pay them even though we don"t have it anymore and they have spoken to the new company about the payoff. They want us to pay them and when they get the payoff they will refund us our payment. They are very rude...everyone I've ever spoke to is totally rude and unprofessional. I will never use this company again...NEVER! So everyones complaint does not have to do with paying their bills late, and even if it was that's what a grace period is for, everyone needs grace at one time or another...even you.

This is the same ### they do to me all the time. I even tryed calling them to see about extending the loan payment to 36 or 72 months. NO GO CARLO! They wont even budge. What if anything can be done?

This company has done nothing but lied and harrassed me. My truck was totaled in November 2007. Due to the accident I have a spinal injury which required surgery. While I was in the hospital they called my house 24 times in 2 days. I was told I would recieve an extention in December, to go find me another truck and they would refinance me. NOT ! They turned me down. I have been cussed out, threatened, they won't work with me at all. They even gave out personal information to my brother who was taking my calls. That is against the law ! Something has to be done. This is outrageous and ridiculous!

I have the same problem with these calls, in my case they also used to send faxes to my employer. The problem was that we got the faxes from a fax center.
