A class action suit should be levied against Chase Mortgage for loan modification fraud. I started the process of modifying my loan after my income fell by more than 50%. I started this process in Feb. '09 and it is now 17 months later and still no answer. I was essentially guaranteed it would only take 3 months but still no answer. I had an excellent credit rating when I started but they were sure it would be 3 months so I agreed. Otherwise, I could have sold the home and moved on. During the first 5 months, they lost all or part of my paperwork so I had to keep starting over. They also put me in the wrong program to start with and did not realize it for 5 months and only after I insisted they check (I was supposed to be in the Obama plan but they said I didn't qualify and moved me to some other program without my permission). I submitted a 4506T form 3 times yet they continue to tell me it doesn't exist or was filled out improperly and I would never have found out if I did not call constantly to get answers. If there is anybody interested in a class action suit and knows of a good attorney, please post. I have filed complaints with the Federal Trade Commission, the Mortgage Finance Authority, my state attorney general, and my congressional representative and still nothing. PLEASE HELP!

There should MANY of us ready for a Class Action suit against Chase. My story is simular in that they said it would be 3 months but they kept telling me they didn't have all the paperwork in. I sent most of the paperwork in several times because they had no record of it. They asked for the tax form 4506T many times.

Wow, Chase has got to be the worst mortgage company ever! First of all, back in April I was told by a "representative", if thats what you want to call these operators, that i had to pay 4 payments by April 30th to avoid foreclosure which i did. I called Chase minutes after wiring the money and was told that they had received it, and to disregard any letters concerning foreclosure that may have been sent. The following week I called on my own because I just had this feeling that I should, call it a gut instinct or intuition. I did and was informed at that time that my house was going up for auction June 2 this was May 7 or so. My god! If i hadn't called would i have woken up on June 2 to a knock on the door by sheriffs and thrown out into the street. How can a mortgage company get away with such tactics. I called and asked Chase what happened to my payment of 4435.00 which i had wired and was informed that it was not received then i called western union to try to track and was informed by them that it was accepted by Chase and western union did not have the money anymore. I called back to Chase and was told by a loan mitigation rep (who had an attitude) that yes it was received but not accepted nor declined and was floating around in limbo at chase. What?! I was on the phone with Western Union and Chase the entire week not to mention I have to work and almost too much stress to deal with, but I did. I also spoke to the loan mitigation rep about my options. I don't want to lose my home. After speaking with my husband and figuring our finances and trying to decide loan mod, Bankruptcy or Reinstatement we chose to reinstate our loan. I had to go through the lawyer Barrett Burke Frappier to apply for the quote which I did back on May 18th applied for a reinstatement quote to be emailed to me which i was told could take several days. I am still waiting for the quote! I have been on the phone with several Chase representatives and every time a different story. I don't think these people know what they are talking about. I seriously have no faith in Chase and have let them know that. I called the Chase lawyers and I asked them legally how long does Chase have to get this quote to me so that i can pay. I mean don't they have to provide this in a timely manner? I was told that they could not answer that question. I asked "well then who can?" their reply "call Chase" I guess they cannot answer that question for me as they are representing Chase and not ME. I have requested the reinstatement quote atleast 3 different times first on May 18th then again on the 24th and was informed by the lawyers at that time that they had sent it through to a supervisor who was attempting to get it rushed, at that time i was informed by them that the sale date of my house was changed to July 6. I called on June 1 as I have no faith in Chase or it's lawyers I was afraid that on June 2 I would be thrown out. I spoke with the Chase rep who told me that the lawyers have already received the quote back on the 18th when it was initially requested. What?! Oh yeah, I also found out at that time that 4435.00 had finally posted and is sitting in my suspense account it cannot go toward my mortgage until i pay everything i owe plus attorneys fees and whatever other fees they will be adding all this is what will be on the reinstatement quote. I need to get that quote so that I can get my 401k out to pay in full what i owe. July 6th is nearing and I fear i am running out of time. Another month will be added come July it almost feels like they are stringing me along allowing more fees and mortgage payments to accrue. Anyway, I don't believe anything these "representatives" tell me so I called again on that same day June 1 and spoke to someone else who said whatever the last rep told me was wrong the attorneys were not sent the quote and that she would send another request on a "rush" I said, "oh yeah a rush huh? yeah i was told that same thing on the 24th and yet still here i am. This rep told me to call Chase back on June 3 that the lawyers should receive it by then. Well I called today the 4th and ...nothing, its the same bull. I called Chase today and was told that this "rush" can take a week. I said, "oh really then why did the girl who ordered the "rush" tell me the lawyers should have it by the 3rd." I cannot believe that Chase is allowed to conduct business this way it is shameful and cruel to treat people this way. I just don't know what to believe anymore I really can't afford a lawyer but i feel like this is gonna be my only option. Where is the government? What happened to Obama's help? These people are despicable!

I received Harp which is the Obama program. Look them up and you also might want to contact NACA they have helped many people to modify there mortgage payments.

If anyone knows of any attorneys that would be willing to start a class action, Im in. It has been almost 2 years. They did the same thing to me. I kept calling, they had everything then a year later they needed more and more paper work. First they told me they had everything. I would be receivng a packet and i was preapproved. Then they needed that tax form. I have every fax conformation. I call and they have all the records of what i sent. They said they needed current info. I faxed that. They called me on May 25 and needed updated income. I faxed it on the 26th. But on the 24th they denied me. Now im 9 months behind. I reapplied but god only knows. They sent my check back and wont cash anymore checks. i paid on time for almost 2 years then they send my check back saying its not a payment processing center. They said i was denied due to not getting info in to them in a tiemly mannor. 1 to 3 days isn't timely. They sat on this for almost 2 years. Im just frustrated. Now they want almost 6 months worth of payments to stop foreclusure. Any info on lawyers please send me info Joejoe1815@yahoo.com.

reading these comments is like reading about our life for the past 17 months lost paperwork resending that damn tax form, we had a trial payment for about eight months now and they kept saying wait until it gets permanantly modified then they said they pulled it for some reason. had to reapply again (about the fourth time) today we received a fed ex wow we got our modification yea oh no wait its more than we were paying originally. this company has no idea what its doing or they do and there making money off of us somehow. what can we do? does anyone have an idea

My lawyer is requesting EVERYONES lawyers information to save him some footwork (and us some money) as we have an EVICTION court date the 23rd of June and were in the MIDDLE OF A MODIFICATION when we were FORECLOSED ON!

We are in Van Zandt County in TEXAS but it is possible a Dallas lawyer will take on a a huge case!

THIS is exactly what happened to US! We have been in our home 5 years and they foreclosed after having filed a modification August 2009. Their attorneys NEVER returned ANY calls and the house went to Fannie Mae and we are told we have NO recourse. We kept hoping we would have time to get current with a lump sum amount we would have the middle of May but they foreclosed May 4th! AND they told us not to make payments while we were in the midst of the modification so that we would stay qualified and the amount we were behind would be added to the loan when the load was rewritten!

Where do I find names of the people this happened to for contact so we can have our attorney contact their attorney?

I have been going through this same ordeal for 3 years. I was initially only 3 months behind in mortage and when I sent in the full amount due they sent it back saying I could not make a payment because it had gone to foreclosure. I didn't even want a loan modification but that was my only option according to Chase..here I am 3 years later still making payments by certified check of which is never credited to my account. Every 3 months I get an acceleration warning which " I should ignore, because my file didn't update yet" and then they yet again start the whole damn modification thing again. I have two file boxes full of paperwork, I have one notebook completely full of every date, time, person I spoke with and what I was told. Yesterday I counted 26 times I faxed the same documents to them. At this point I would gladly give up the home I have lived in for 20 years if it meant I would never have to deal with these ###s again, unfortunately they have screwed my credit beyond compare so I have no alternative but to stay here in this nightmare limbo.

Chase declined my mortgage loan modification application after 9 months. In May 2009, Chase stated that my home value had gone down to $620, 000 and mere 12 months later in the middle of this great recession, Chase told me in June 2010 that my home appraisal had zoomed up to over $800, 000. As a result, I had too much equity in the home and therefore, I did not qualify for the loan modification. The mere reason for applying was my inability to continue to pay since I haven't had a job since July 2008. There is no one regulating and supervising these banks.

I used another service and am very please with the paperwork. Now the mortgage companies attorney is not pleased, instead of pushing to finish the foreclosure he is pushing for a continuance till the end of the year.

The Same exact thing appears to be happening to me. I applied for a modification back in early 2008 since then they first claimed I neglected to furnish required documentation within the allotted amount of time (30 days) even though I would phone their customer service once or twice a week to make sure that they had everything they needed and I faxed them all the documents they requested. Their customer service kept on assuring me that all the documentation was up to date right up until the day I was first turned down and all records of the modification attempt disappeared. I reapplied and some other mix up started me over. This last time I finally reached the work out stage and made it to the point where I was just waiting for final approval and I just received a letter today informing me that I am being turned down again for not furnishing some undisclosed required document.
Chase is most definitely a fraudulent organization and a class action suit needs to filed. I see there are people here that agree and we need to get together.

The person who said "no" to class action lawsuits is right. Only the lawyers come out on top in those cases. Get your own lawyer and go after these liars, thieves, and scam artists! My story is right in there with the rest of you - talk to a different person, in a different state every time you call, no phone calls returned, misinformation, trickery even, lost papers, and decisions made without giving you what information the "underwriters" considered before rejecting your modification. I hope someone in congress has the balls to go after these leaches who took our money, the government bailout (also our money) and now thumb their noses at giving the mortgage holders a break. The government should have given everyone in trouble with their loan the money and not the evil ### who run and own the banks.

I have the same problem it started last November tried doing a loan modifcation with Chase since my husband passed away & one salary coming in to reduce my mortgage payment. I went & hire da lawyer in Florida even though Ilive in NJ, the ycalled me made me a deal for $ 1500 the ywould get my payment reduce almost 800- 900 dollare per month. I did all the necessary paper work, harship letter, financial statments, bank statements, pay stubs. & whatever else Chase required. Well after 3 months I got my payment reduced about 300.00 for three months then was to get final package, it never came, called lawyer & Chase they said give me another month. needless to say a 16 months later still nothing, back to my noraml payments. Sent in paper work to Chase 5 times, after the first time, they keep saying they need up dating evrey three months. We are now in the beginning of March 2011 & still nothing from Chase. I made my payments faithfully the first of every month never late, now this month they refuse to take my payment. This is getting ridiculous how can they let Chase get away with this. We all need to stick together & do something to make someone listen. Why should we lose our homes we worked so hard to get. What is wrong here. If anyone has any idea please let me know. Let's stand together & get Chase to listen to us.

Suze Orman is now telling people to stay away from mortgage modifications, because in some cases, the mortgage holders give you a modification that isn't permanent, and after a period of time, they come back and tell you you owe the amounts you were excused from paying during what was in reality a temporary modification, plus all kinds of fees. Why isn't our cowardly Attorney General going after these criminals? For the same reason that he's not going after the bankers and Wall Street thieves and war criminals Bush, Cheney and Rumsfelt who will never face prosecution by the good 'ole USA. Yet, attacks on the rights of the middle class are coming from all sides - and people still support the Republicans who got us in this mess and aren't willing to help us get out - and Obama is playing right along with these perps. I learned yesterday that Mississippi (the poorest state in the union) is the number one conservative state. Think about it.

Chase has been hard to deal with. I have gotten the run around, asked to re-fax pages, told that I faxed the wrong forms, dealt with multiple people, had money put into suspense instead of applied, been passed around repeatedly...been told many different things...and now my loan has gone to foreclosure with my payments rejected. There are lot of people willing to "help" for a fee...this is about hopeless. Are the banks getting kickbacks for taking people to foreclosure? It seems like that is what they would rather do...After 3 weeks of having my ppw reviwied I am told it is out dated and have to resubmit...only to be told in 3 wks it is out dated and have to resubmit. I have letters saying please continue to make your payments, but then they are rejected...

Chase is the worst and they lie. I have been fighting with them since last February when one of their "customer care" reps said I qualified for a "special program" This program suddenly makes you 2months late and then when you ask for some help to get current, they make the payments so high, that I can't afford it. When I try to talk to the same persons handling my loan, suddenly their extension doesn't work and no one knows who they area. They didn't have the guts to contact me before an ïntent to forclose" notice showed up in the mail. They are now offering me a forbearance for 4400 for 6 months! This is extortion by a major bank.

yep, going through the same damn thing, just got another request for all my paperwork again, they said my paperwork was waiting for approval or disapproval. then they sent me another letter demanding paperwork all over again, meanwhile the foreclosure process is still taking place. People contact me from non-profit companies saying $600.00 per month to see if your loan you have with chase is on the up and up . Dont know who the American people are to trust anymore. Its feels like a really bad joke. Here you got a president that puts words on a paper and no one oversees what is really going on with the modification program. Have you contacted your congressional representatives? We should all begin bugging the hell out of them to do something about these bank thieves. Hearings were recently held, chaired by Sen Richard Shelby of Alabama. which I watched on CSPAN. He is ranking member of the Committee on Banking, Housing, and Urban Affairs. While I am not a fan of his, he did have access to a lot of information about the unfair treatment mortgagees were getting from the banks. Let's start calling his office with questions about when he is going to do something about this? No class-action lawsuits - only lawyers make money from those. These disreputable people need jail time, and we need to be made whole for the lies, misinformation, and intentional misleading we have suffered. When is this nation going to hold the rich guys accountable again? Never? You can find members of the committee by googling u s senate committees. Call them, too. Let's make ourselves such a nuisance they can't ignore us any more. Remember "the squeaky wheel gets the grease." Let's post here again after we've made calls.

Ditto Ditto Ditto! What a nightmare. Instead of calling them back for the 50th time I am going to spend my time finding a class action lawyer. I did not have time to read thru all the posts here but from what I can tell no attorney has been found.
What did you guys do after the would not modify? I am not sure of my next step. I am not in foreclosure but it is looming.

Good News to all victims of loan mod fraud by Chase. No one was listening to us until service men and women serving OUR country were victims too. Now the right people are listening! So JUST hang on.I am a researcher and have survived 9 illegal foreclosure attempts and want to help everyone else do the same. First of all no matter what...don't stop making your payments even if they won't accept them. (You want them to be the ones to breach the contract) You have to go in court with clean hands. TODAY send a certified written request.(bad people are trying to sale you this when it's FREE!) In the request demand within 30 days for a response to . A forensic audit. .Proof of the Document . A MERS report showing who services your mortgage. I am here to tell you don't let them bully you with scare tactics. NO matter what their attys try to use to make you think to sign your rights away DONT YOU DARE! Everytime Chase postpones the monthly foreclosure sales I say "BRING IT!" If they had a legal right to foreclose they would have done it the first time.

Does anyone know of a class action lawsuit againstt JP Morgan Chase in Texas?!

They completely screwed us on our modification, out of money and our house. It was a two year long process of nothing but a joke! My husband lost his job in September 2008 and in May 2009 we started our modification process. We made our forbearance payments every month, sent all the documents they required every three months. Then discovered that they had two loan modifications opened under our account, but they didn't seem to be concerned every time I advised them of this. Not one person we called could tell us the same thing. I felt like none of them had a clue as to what they were doing, but all I wanted to do was to save our house. Move ahead a year later, so now it's April 2010 and almost $20.000 later in forbearance payments that were NEVER applied to our loan, we receive a letter stating that our modification has been approved and we are required to sign all the documents agreeing to the terms and send it back. Of course we did this immediately. Turns our they never received them so they sent us a second set, again we signed them and Fed Ex'ed them back right away. This time we got confirmation that they documents were received and we can start making our regular mortgage payments in July 2010. We were relieved, until December of 2010 we receive a letter from them stating that we owe them $15, 000 by the end of the month in order to avoid foreclosure. We called them and were advised that they never received our documents agreeing to the modification terms...interesting. You would thing that the 5 months that I made my payments and never received statements but yet would call every month to see why weren't getting them they would have mentioned this to us! No, because they are incompetent idiots that don't know what they are doing. Every Time I called I was told that our account was current and they weren't sure why we were getting our monthly statements but to continue to make our monthly payments. Needless to say in December we were told that the modification was void because they didn't have the signed documents, oh but they offered to let us apply for another modification! Problem is we no longer qualify because we make "too much money". We just stopped paying our mortgage all together, stayed in our home as long as possible and eventually moved into a rental and left the house for the bank to deal with. We are about to file for bankruptcy. JP Morgan Chase are crooks and completely screwed us out of our house that was ours for 6 years and our money! I want in on a lawsuit against them but can't seem to find one in Texas! Any help would be appreciated!

I have been through everything that everyone above has been through plus a little more. I'm a widowed single female in my upper 50's and had perfect credit at the time of my husband's death and for the following year and a half after. I had to sell the house we were living in because the mortgage was too high for me to continue. I proceeded to find and buy another house within my budget. I got a loan through CTX mortage with payments of $1013.00 per month and was told my payment would not change. Within a year and a half my loan was turned over to Chase Mortgage and within that year and a half time frame my payments went from $1013.00 to $1100 to $1200 to $1314 to $1430 to the final payment of $1618.00 per month. I tried everything possible to continue making the payments including having roommates move in which did not go well. In Nov of 2008 I lost my job due to the economy. I kept finding temporary work along with unemployment and even found a couple of permanent jobs in 2009 and 2010 which resulted in getting laid off again due to cutbacks. Back on unemployment again, after two months of trying to get approved with Chase Mortgage for the unemployment program, I was finally approved for 6 months and my payments were $500 per month but I always paid $100 more to show my committment. I finally got employment which is where I have been for almost two years now. After receiving my permanent job I tried for a loan modification to get my payment lowered back to around $1000 a month and submitted all the paperwork several times as they never seemed to receive it. I was also told they didn't see a problem and everything looked like it was perfect...all the t's crossed and the i's dotted. Then I get an email telling me that they are trying to get a loan modification through Fannie Mae and I should know something in the next 30 days. Fannie Mae declined me and said that my case was NOT A HARDSHIP! I had other reps tell me they don't know why my case wasn't a hardship case. The next thing I know they are telling me that I can turn the house back over or sell it or put it up for a short sale. I did all the necessary paperwork to get my realtor authoization to set up for a short sale, got it listed and even had a buyer for them but the bank wouldn't accept their offer because it wasn't enough to cover the ADDITIONAL $12000.00 the bank tacked on the account for late fees and interest and so on...I tried calling for the payoff several times and was told that it would take two weeks to be mailed to me or 3-5 days to be faxed to me. The next time I called asking where the payoff information was they transferred me to their attorneys who informed me that they were foreclosing on the the property in the next 21 days and were very RUDE people to talk to. I moved all my things out when it was put up for a short sale but still continued paying the utilities and maintenance on the property. I went over to check on the property only to find that they had changed my locks, disconnected the chain from the garage door and had it hanging on the outside of the garage door and there was a note on the front door stating that the property was now owned by no other than "FANNIE MAE" the ones who wouldn't/couldn't do a loan modification for me. I never received anything in the mail about foreclosure and a sherriff never tried to locate me. As someone said above, if anyone is interested in starting a class action against these crooks count me in as well. If anyone gets any info on how or where we can try to get something done about this please contact me at ladydintx@verizon.net. HELP! We really need someone who cares and doesn't want this to continue happening.

I am facing the same situation in New Mexico. I submitted all requested documents to Chase in October 2015, and over the past five months have been told three times my application for mortgage assistance is complete and will be sent to underwriting and I would receive modification options within 30 days. Now 2/17/16 I receive a request for additional documents - showing nothing has been done! I would like to be a part of a class action law suit against Chase for it's failure to offer homeowners timely and proper mortgage modification.

Ditto! I was dealing with the same "We need additional Documents so that we can send it to the underwriter" game for way too long. They drug that on for several months. In the very beginning I was instructed not to pay my monthly note as we do not know the new modified amount. And stupid me listened to the "Loan Modification Specialist". The next thing I know I am being informed that my home is being placed into foreclosure. FANTASTIC! This was after months of hearing "Sorry sir we don't have all the required paperwork. We need blah blah. Even after providing required documents the day they requested it...It still wasn't good enough. ... I contacted my "Modification Specialist" and asked why this was happening. The answer was epic "Well Sir, We have attempted to help you with this for too long. We will be proceeding with foreclosure." SO I uprooted my family and relocated. Then found out that CHASE JP MORGAN bought back the house in Sheriff Sale for less than I owed. Then turned around and sold it for more than what I owed. (If that isn't money hungry, I don't know what is!) I need HELP! This has destroyed my credit amongst other things. CLASS ACTION or Federal Suit I'm open for. I just need guidance.
