Covey Creek Builders Builder who defrauds clients

Complaint against Covey Creek Builders
• Breach of contract, conversion, fraud and theft
• No contractor's license in GA; did not register with the state nor disclose to owners.
• Construction Agreement includes General Contractor Group, LLC which wasn't registered with the Secretary of State in GA; did not register nor disclose to owners.
• Lied and misled owners by making promises and intentionally failed to perform
• Admitted to Denise Jones he routinely put all funds from clients into a credit union account vs individual escrow accounts and admitted using Jones' funds on other projects
• Failed to perform by not substantially completing construction within 180 days as per Construction Agreement
• Failed to pay foundation subcontractor. Check was returned to CCB for NSF (owner paid this $16, 000 invoice to avoid construction lien).
• Failed to pay general subcontractor $8, 000, requiring owner to pay this amount to ensure progress
• Unreasonably delayed providing receipts for money spent, and falsified a subcontractor receipt for $6, 000 as justification for monies spent
• Charged owners $16, 000 in builder's fees when on-site supervision/planning was not provided and work not performed
• Lied about limits of insurance coverage $10, 000, 000 vs $1, 000, 000 and job performance bond
• Refused to answer the demand letter sent by Attorney

He is still scamming people? Wow! seriously if there is any justice in the judicial system this person should be in Jail right now.

Covey Creek Builders contractor

Re: “Covey Creek Builders” located in Conroe Texas and/or Tim W. Wilson; the owner of “Covey Creek Builders”, please DO YOUR RESEARCH BEFORE DOING BUSINESS WITH THIS COMPANY.
Our cabin in the Smoky Mountains burned down during the wildfires in Gatlinburg, TN on 11/28/2016. Based upon the strong recommendation of the person from whom we purchased our log cabin package, we contracted with Covey Creek Builders and Tim Wilson on 12/28/2016 to be the general contractor for the rebuild.
By the end of March when no significant progress had been made despite reasonably good weather, we became suspicious that all was not as it should be and began to do our own, deeper research into Mr. Wilson’s past and our job in particular. At this time we were able to determine that Mr. Wilson did not even have the requisite contractor’s license to do business in the state of Tennessee. We also discovered, through speaking with county officials, that the permit to clear the lot (which was required) had not been obtained, nor had the required post-clearing inspection been done. According to the county officials, both of these activities were illegal. Additionally, according to the supplier of the log cabin package, when pressed for a license Mr. Wilson supplied a Tennessee license with “Tim Wilson” located in the last name field. However, when we pulled that license number from the state’s website, the verbiage in the Last Name field was “Tim Wilson Companies LLC”. Hence the one supplied to the log cabin company had been altered. We researched “Tim Wilson Companies LLC” and were able to locate a company in Memphis Tennessee by that name. A subsequent phone call to the owner of Tim Wilson Companies LLC confirmed this to be a different company and a different Tim Wilson.

Given predominately to Mr. Wilson’s lack of a license to act as a general contractor in the state of TN as well as many other factors, we terminated the contract with Covey Creek Builders on April 5th. This was done via e-mail (as provided within the contract for providing notice) with a subsequent Federal Express package delivered the next day, with signed receipt confirming delivery. Mr. Wilson responded immediately to the e-mail attempting to continue the “contract”. We then provided an immediate and final response that our decision was final. He was instructed to refund our money and wiring instructions were sent. As of today, August 6th, we have received -0- funds returned to us, despite his promise in a signed settlement agreement, negotiated by our attorney to return in excess of $94, 000. Thus we have been forced to file a lawsuit in an effort to recover our funds.

We have also been contact by some of his sub-contractors and other customers who have stated they have also not received payments and/or appropriate refunds, though we, as individuals cannot verify this information. Should you wish to speak with them, we can contact them to see if they are willing to share their information.
