Nov 4th I went into the Free Trial with Premier Whitening.com at an advertised cost of £2.95 & Premium Whitening (Premium White Ultra.com) at a cost of £7.40 which was not the cost that was advertised, the advertised cost was $4.95, however when the order was accepted the cost suddenly changed to $11.90. I thought the change was due to the fact that I requested the additional 4 day upgrade. However to my surprise the additional debits was made on my account: £30.47 which on speaking to Premium Whitening admitted to charging my account with [protected]@ $48.92 but not the other charges of 20minutesmiles.com @ £148.27 & ultifreshwell @ £54.25 which was also made to my account.
Premium White Ultra advised that the $48.92 was charged as I did not return the pen after the trial period ended and they deemed that I wanted to joind the prferred customer program, however this amount was debited the same date I signed up for the trial, therefore I had not received the item let alone had time to try it.
They claimed not to know anything about the other amounts of £148.27 & £54.25 so I tried calling Premiere Whitening.com on the number they had provided on their confirmation message and all I am getting is a voice message stating the office hours and that is on both the 888 and 0203 numbers.
I am now £243.34 down for something that should have cost me no more than £7.90, which as I was made redundant earlier this year I can ill afford this scam.
The thing about this scam is the product or description do not tie in with the companies placing the advertisment and the advertiser, product or confirmation mails do not link which is making it difficult to find the correct source of complaint in order to get a refund.
To date I have not received any items in relation to £148.27 & £54.25.
If you can suggest how I may be able to get recourse for this it will be greatly appreciated.
I have included my phone number & e-mail address in case you can provide me with some information on where I can proceed with this complaint.

Got caught by these scammers aswell. Cancel your card number immediately. That should get rid of them. Then ask to have a chargeback done. You're credit card company can tell you how to proceed then. It's a pain in the ### but a salutory lesson learnt.

Oh yeah thats just fantastic, the web address above doesnt work, it says they no longer have anything to do with the product!

Ive been through the exact same thing! my bank said there is nothing they can do to stop the payments going through except to cancel my card which i have done, but they say there is no guarantee that this will stop the payments. Everbright Smiles e-mailed me saying they have just dispatched my 2nd order(which i did not place) and are charging me £88.90 then they are going to charge me a further £152 odd.
I lost my job in April so obv cant afford this. Ive tried e-mailing them but have had no reply, apparently the e-mail address provided is fake. I am not willing to call the USA, cant afford the call charges. Ive been told to phone Consumer Direct and report it, which i will be doing shortly.
I am lost as to how im supposed to get my £88.90 back, im on JSA and its almost christmas. I think its disgusting that people can get away with this sort of thing.
If anyone has any advice i welcome it.

I feel so stupid and have been scamed exactly the same way. The product didn't arrive until after the 10 days meanwhile I tried phoning and emailing the company but could never get through. I returned the producted three days after it arrived but was debited £150. I now don't have my money or the product! I contacted my Credit card company and have cancelled my card and they are going to see what they can do. Has anyone got a refund from the credit card company? So angry.

I have been scammed in an identical manner. I responded to an MSN pop up - more fool me. they are clearly have some responsibility in this for allowing unethical trading on their site.
If anyone makes any progress I would appreciate any help.

I have never been scammed before and think I am quite safe in the manner I normally conduct my business but I have been scammed of this very company. There must be a way of getting the cash back and having the companie prosecuted. I have been told to close my account and reopen a new one in order to guarantee this not happening again. Has anyone managed to get a refund? I have submitted a claim to econsumer.gov, been to my bank and cancelled my card.

They took £158.27GBP, and I assumed it is highly unlikely that I will see it again.

I tried sending emails to all those @justthinkmedia.com emails given, none of them worked. My email is mcintosd@lsbu.ac.uk, could someone please contact me with what they did next?

OMG I have fallen for it too, i purchased for Everbright Smile on Friday and i received the product ths morning, i did think in the back of my mind this is too good to true! But thanks to you guys leaving these messages i have cancelled my card and details so they wont be getting a penny from me-I have recieved my product though! I know you guys havent been as lucky but i hope you have saved many more like us xx

The ### got me too. I'm in Australia and have called them 3 times. THey deny the product is even theirs even though their name is on my bank statement. I don't know who I can report them too. They must be stopped. They're absolute ###s.

They got me too! They also went into my other bank account (one that I gave no details of whatsoever) and took money from there. I've closed both of my bank accounts down and the Bank (barclays) seem to believe that there is some sort of fraud being committed. This is theft pure and simple. They may as well have come into my house and stolen my television while I stand there completely unable to do a damn thing about it! Times like these I pray for curses and karma!

I can't believe how stupid I was. I got caught as well in Ireland. This is fraud, pure and simple. I just cancelled my card and notified Visa of the fraud. Visa asked me to write to them with all correspondance. Its a complete pain.

Dear Sirs,

I reported the fraudulent use of my card this morning, Sunday 13th of December 2009. I have requested that the Card be blocked with immediate effect from approximately 11:20. I spoke with two agents on duty that morning, Liam and Eddie. Unfortunately I did not get either of their last surnames.

The fraud concerns the unauthorized use of my card to set up recurring charges debited against my Visa Account above. The company is based in Houston in Texas and attempted to charge my card Euro 166.60 on the 12th of December 2009. The reference number is [protected] PremWhite Huston Texas.

History

This company offer a sample of their product ( a toothpaste) whereby all I had to do was pay the nominal postage charges. If I liked the product I could order additional supplies. I never signed up for any recurring charge, direct debit or standing order of any kind. I did provide the company with my Credit Card Details to cover the nominal postage costs to be subsequently informed on the 12th of December that my card would be debited for the above amount. I never authorized this payment. I fully accept the liability for the nominal postage costs of Euro 8.33.

How they work is this:

Customers are invited to take a free sample of their product provided they pay the nominal shipping charges to Everbrightsmiles.com

Once they have captured your details and you confirm shipment of the sample there is a tiny box, (it is almost invisible) that is ticked by default by their system that then makes the user accept by default (unknown to you at the time) a host of onerous and horrendously expensive additional terms and conditions that are not displayed to the customer prior to completion. These additional terms and conditions are only notified to you when they e-mail you to tell you that they are taking the above amount out of your account on a continuous / regular basis. Had I been notified of these “terms and conditions” I would never have accepted their “free” product sample. In addition they have a countdown clock running in bold letters that gives you a few minutes to accept the offer otherwise the “Special Promotion” is withdrawn. Again the system is pressurizing the user to complete as quickly as possible. When your order confirmation arrives, copy attached, nowhere does it refer to terms and conditions. When your notification of billing arrives all of a sudden at the bottom of the form is a web link to their terms and condition that I have “accepted”. I attach a copy of this document as well. In addition, the original order confirmation never refers to a trial but the second document does.

I believe Visa has a responsibility to notify Visa International of this type of fraud and blacklist the vendor. For the record there are thousands of people like me that have been the subject of this particular fraud. Should you care to visit the merchant web site yourself, you will see just how deceptive it is.

To reiterate I never signed up for any recurring charges on my account and refute all charges bar the postage of Euro 8.33. I also attach my e-mail to his company of today’s date cancelling any further shipments of product to me. I want Visa to refute any and all charges from this merchant. If the merchant wishes to take legal action against me, I would welcome that.

I was also drawn in by an msn pop-up article, but this one contained two companies. everbight smiles but also premium white which is exactly the same deal. In total I have now lost almost £200 for two "free tials" as well as a random product that I have no idea what it is, that I never even recieved . I even contacted a columnist for msn beauty, a likely source of the pop-up article, and she can not find any trace of this pop-up atricle anywhere! I can completely sympathise with the redundant poeple who have been caught out by this scam. Unfortunatley there doesn't seem to be anyway of getting your money back as we all agreed to the terms and conditions. Completely scandalous behaviour I know, but nothing we can legally do about it.

I got charged about $ 500.00 on my credit card and when I cancelled my Visa I was told unless you have a cancellation number they still can charge you as long as they want and you can do nothing about it. I got 2 numbers maybe they help somebody to get a cancellation number [protected]
[protected]. I got nothing in the mail they charged me anyway but i hope it will stop now. The banks have no simpaty it is all about money and they will not stop Visa unless you provide a number so good luck everybody.

Yeah...I just fell for the scam this morning when I read about the mother who bought 2 whitening kits...I feel so stupid for not having thoroughly researched the product before ordering the too-good-to-be-true 99 cents Free Trial! I called them right after learning about some scams that happened. They told me that my subscription is cancelled and to return the product within 14 days after I receive it. I don't know why I would even receive it because I literally cancelled half an hour after ordering it. They did send me a cancellation e-mail though, but knowing them, they can always do and say whatever they want to. I e-mailed them back though, basically telling them I would sue if they do anything illegal, like charging my credit card without permission. Don't know if they're even going to care about that. WHY ISN'T ANYONE STOPPING THESE THIEVES?! Damn, I feel stupid...

p.s. I think people should use credit cards rather than debit, as with a credit card, you can read your monthly statement and know exactly what you're paying for. If something doesn't seem right (like overcharge or unauthorized charging), you have the right to not to pay. You can also talk to the card issuer as well for help and report the fraud...

I would never use a debit card when ordering online, or even do direct deposit. You don't even know when you're being ripped off!

I have just been ripped off too. I rang and got a cancelation number off the company who put me on hold and whilst having me on hold billed my credit card company, then offered me a half price refund which of course never happened. I rang mastercard to tell them of this fraudulent payment and stop it. they did nothing to stop it, said they would send me a form to fill in to dispute the payment. They sent me a new credit card and new number then never bothered sending me the disputes form. I told them not to allow any further payments to my credit card from this company or any other for any amount over 25 gbp and they said they could not do this. I told them that I was going to cancel my credit card altogether and they said even if I did I would still be charged by this bludy tooth company... How can the tooth company charge a cancelled credit card? I suppose now I have to ring and tell them that its stolen to make them do something. Anyone got any advice for me.

The people who are saying nothing can be done about the charges obviously have alterior motives.
Liklihood is they are working for the scam companies in question. This is blatant outright fraud and breach of contract.
Adamantly ask your CC company to chargeback all of the charges with the exception of the dilvery charge if you did infact receive the worthless product.

We are in New Zealand and have been debited almost $800. in six weeks from our card... I don't know where to start. Have stopped the card, tried all the obvious such as getting in touch with the company itself. SOMEONE needs to do something! Where do you go to lodge a formal complaint against this person when you are in another country! Any advice would be appreciated - a.bosch@xtra.co.nz

HELP.. we have the same story .. ordered a trial for $12.95usd delivery... NOTHING else was disclosed to us at the time of ordering. Our card has been debited eight times to the total of $800... and each debit shows a different teeth whitening type name! There must be someplace we can complain that will help us... don't know where to start when yr in a different country. Omfg! I have done this also! Ordered a trial from everbrightsmiles.com cost £2.90 shipping! I closed the page down coz it was taking too long to load! but that didnt stop them taking money out my bank account straight away with no authorization! Now i don't know what to do!? I have cancelled with them 3 times and they just keep charging and sending me stuff. Everbright Smiles will not even let me return it cause there is a no return policy. Everytime I call them they hang up on me and yell at me as if I have done something wrong when its them who won't cancell me. Tonight this operator told me if I can provide proof of cancellation back on Dec 18th he will refund me for only my 3rd shipment which arrived today shipped out on Dec 22 2009. Only I have no proof the last person I spoke with said she cancelled me for the second time and would send me a cancellation email back on Dec 18th only she never did so I have no proof. I am out so far $345.98 Canadain, but here is the address he gave me to return it with my "proof of cancellation" which I do not have. Not sure if it will help since they keep telling not to send it back. Also I have been on the manager call back list for a month now has anyone actually had a call back?

Premium white cancelled me the first time and sent me a cancellation email and told me how to return the product as they have a 30 day return policy. Here is the info they sent me. Their number is below I hope this helps...

I have just been caught by this also and only read the comments after i had ordered everbrights and cleamwhites trail packs, i can't contact everbrights it is the answering machine telling me that its out of hours! and cleanwhites i did get hold of someone and he told me to ring up in 2 days to cancel the membership or i wouldnt recive the product but still get charged the shipment charge which was £3.11. So i though i would ring back then. But then i found all these comments and felt sick so i have rung my bank and had my bank number changed so no payments are taken out only the shipment for both items which is £3.11 and £0.98. So i adive you to cancel your long stip card number if this is the one you have used to purchase these scams.

i as well got nabbed on this bait and switch... luckily i was able to cancel one of them in time, but have to pay the 150USD for the first. Visa advised i send it back, provide them with a tracking number, then they can help me from there.. hope that works.

As I view it just now, this very page has at least three items linking through to this scam! DISGRACEFUL!

See, for example, the Google adverts "Tricks to White Teeth".

This is a phoney "consumer tip" site which will lure you further into the trap. Scroll down to the end past the comments to see them admit that single mum "Cathy" does not exist nor does her "discovery". I am disappointed that the comment that I left has not been posted. I wonder why? Hmmmm.

Then also read the Terms and Conditions attached to this so called consumer tip which you elect to accept should you go on to make a request for a "free trial" on totally different sites.

The companies shown in Step 1 and Step 2 are constantly changing...Everbright Smiles, Ivory White, Clean Whites, Bella Bright...the list seems endless.

Stay well away, but if you have given them your bank or credit card details cancel these immediately.

Ring them up (try [protected] and you should get through to the USA at no extra charge than for a UK call). Make sure that you get a cancellation number and confirmation that no further payments will be debited by them or anyone connected with them. Tell them you have instructed your bank/ CC company accordingly. It’s a good idea to record the telephone conversation.

Send product back to USA (probably best to use Royal mail's "Airsure" to get parcel tracked as it may not be signed for if you choose that option). It will cost you about £6 but far cheaper than being hit by this scam.

Tell everyone you know about these crooks.

It appears to be a global scam. In the US I followed a similar pop up at CNN's website with appearance that the article was posted originally in Comsumer Reports. When I got hit with a $158.27 charge I contacted the company and basically got yelled at. They promised a call back and it has been 4 days and I have not heard from them. The product is not FDA approved and is entirely useless. You might as well spend $25 at those kiosks at your local Mall and get your teeth treated on the spot. As others mentioned product arrived right at or after 10 days trial period, so forget that return or cancellation as well. Like others on this forum I am upset with myself as well as at these scammers. They won't issue a refund even if I want to return the product. I am so upset that I am going to spend a lot more money to get my $158 back. If they don't accept I am going to launch a webpage to ensure entire World know about it and I am going to keep following them wherever they advertise. This will be one of my missions in life to raise awareness about these frauds.

Phoned the day I made the order to cancel the shipment for everbright smiles. The woman on the phone told me that I cant call this early to cancel unless I do not wish to have the free trial. Have to wait until product arrives then after 10 days call to cancel. I placed my order on Dec.17/09. I did not receive the pkg until Jan.13/10. I called immediatley upon receiving the pkg and asked the woman to cancel(her name is Claudia) she assured me that no payment has gone through except for the .99 trial charge and since cancellation no other charge will go through. On Jan.14/2010 I call back just to make sure. Kenya employee #7016 answers the phone. After interupting me several times before I even stated why I was calling, she said to bad you have already got a charge going through for over $200. Like she was gloating that I was on the cancellation line and she seen the charge. I asked for a supervisor and she said she cannot do that, there is no supervisor. So I procedded to explain to her that I cancelled the account yesterday and was assured no charge was going through. She said that package has already left the warehouse so I have to pay for it and I cannot send the product back when I receive it for a refund, even though I already cancelled the account. Since when can you send something to someones house that did not authorize it and then think you can legally bill them for it? Phoned CC companies, It will go to dispute department if they continue to try and charge the card. I am over my limit anyway and so far that seems to be my only saving grace.

PEOPLE! DON'T CALL COMPANY AT ALL. NEVER CALL THEM. THEY ARE NOT GOING TO REFUND ANYTHING. THEY ARE GOING TO CONTINUE CHARGING YOU UNTIL THEY CANT (AFTER YOUR CARD IS DEACTIVATED BY REPORTING IT LOST OR STOLEN). THEY SCAMMED YOU. Do you think they have your best interest in mine? No! First thing you do is cancel your debit or credit card by reporting it lost or stolen. DO NOT TELL YOUR CREDIT CARD OR DEBIT CARD COMPANY THAT YOU HAVE BEEN SCAMMED. IF YOU DO AND THEY REVIEW WEBSITE, THEY WILL RULE IN SCAMMERS FAVOR. WHY? Because of their fine print that clearly protects them. Yes, I didn't read it either. I was scammed. But, anyway, tell your debit or credit card company that you did not authorize the transaction with the (scam) company and you do not know how they charged you. That's it! Then fill out all dispute papers you get from your credit card or debit card fraud dept. After they receive your paperwork, they will reverse all charges and this fraud company will get a chargeback from Visa or MasterCard. They must comply with chargeback policy and resend fund back to card issuer or else they will be unable to have merchant account with Visa or Mastercard.

I did all of the above and I got all my money back in my account in 7 days. if you do the same, you will have your money as well. BY ALL MEANS: DO NOT CALL THE COMPANY. LEAVE THEM ALONE. THEY WANT YOU TO CALL THEM AND TRY TO GET THINGS STRAIGHT. THIS WAY THEY CAN LIE TO YOU WITH FALSE HOPE AND CHARGE YOUR ACTIVE CREDIT OR DEBIT CARD WHILE YOU ARE COMPLAINING TO THEM.

ALSO, IF YOU WANNA WASTE YOUR TIME REPORTING TO BBB, YOU CAN REPORT TO BBB, ETC. BUT DO THAT AFTER YOU DO THE ABOVE. HOWEVER, BBB IS NOT GOING TO GET YOUR MONEY BACK. YOUR CREDIT CARD ISSUER WILL!

The only company that has your best interest in mine is the credit or debit card issuer. Trust them. Don't trust a crook (the scammer).

For those who feel like they need to return the scammer's product to get refund: Don't worry about the product you receive from Everbright. It was delivered to you via "delivery confirmation." You never signed for anything. There is no proof that you physically received anything. The proof is that it was delivered by US courier to your address. They left mind on porch. For all I know, someone couldve stolen it off my porch. DO NOT WASTE YOUR HARD EARNED MONEY SENDING IT BACK. THEY WILL NOT REFUND YOU ANYTHING AND RETURN ADDRESS IS FAKE. KEEP PRODUCT OR THROW IT AWAY. I WOULD THROW IT AWAY. I dont trust putting this crap on my teeth. Yellow teeth is better than no teeth.

AT ANY RATE, if you adhere to my directions, Everybright will be angry because not only did your card company reverse charges, Everybright also sent you their product for free, plus they have to pay card issuer back, merchant fees to Visa and mastercard, and chargeback fees.

Revenge is sweet! If you provided your home phone number when you placed order, they will call and harass you about sending their product back, etc. Just change your phone number and make it unlisted.

You can then look at it this way: They just "borrowed" your money for about a week or two lol. Now they are gonna pay it back, give you their crappy product for free, and get charged up the butt from Visa and Mastercard!

FYSO IS NOT A PARENT COMPANY AND THEY ARE NOT A SCAMMER. THEY DO NOT SELL TO PUBLIC. THEY DEAL WITH BRAND ACCOUNTS ONLY. THIS MEANS THAT IF YOU WANTED TO SELL THEIR PRODUCTS UNDER YOUR BRAND NAME (EVER SPARKLE SMILES, CELEB SMILES ARE US, ETC.), ALL YOU HAVE TO DO IS SET UP AN ACCOUNT WITH THEM AND GIVE THEM YOUR LOGO TO PUT ON BOXES OF THEIR PRODUCT.

FURTHER INVESTIGATION SAYS THAT THE PEOPLE WHO RUN EVERBRIGHT, ETC., PAID LEGITIMATE FYSO (BASED IN HOUSTON, TEXAS, USA) A MINIMUM OF $2, 685 FOR EVERY 500 KITS (THEY ARE A MINIMUM OF $5.37 EACH FROM FYSO). FYSO PUTS WHOMEVER THAT RUN EVERBRIGHT, ETC. LOGOS ON THEIR PRODUCTS AND SHIPS THEM OUT TO WHOMEVER EVERBRIGHT TELLS THEM TO.

EVERBRIGHT, ETC., IN TERMS AUTHORIZES A SO-CALLED "TRIAL" FEE OF LESS THAN $2.00. ON SCAM VICTIMS CARDS. AFTER A CERTAIN AMOUNT OF TIME (5-10 DAYS), THEY SEND YOUR DEBIT OR CREDIT CARD COMPANY A BILL FOR AT LEAST $75 (NOT THE MEAGER AMOUNT THEY AUTHORIZED ON YOUR ACCOUNT). THIS MEANS THAT THIS SCAM COMPANY IS GETTING AT LEAST $37, 500 FOR EACH 500 KITS THEY ORDER FROM FYSO. YOU DO THE MATH ON THE MARKUP AND HOW MUCH MONEY THEY ARE MAKING OFF OF VICTIMS.

SINCE THEIR WEBSITE HAS ALL OF THEIR TERMS ON THERE (BUT THEY MAKE IT SO YOU WONT EVEN THINK ABOUT READING IT), THEY ARE POCKETING MOST OF THIS MONEY AND GETTING VERY LITTLE CHARGEBACKS.

Hi there I am from Northern Ireland and I have been caught out too with Everbrightsmiles.They have taken 3 payments of me-1 for £59.89, 2nd£16.53 and 3rd £155.36. I have contacted my Tescos credit card and they said to ring Customer Services on Monday but it looks like I have been ripped off to £200 and I will never get my money back.I thought when you bought something with credit card you were "safe" but the lady told me because I didn't read the advertisement fully that this company were "allowed" to debit my account with these charges. I am disabled so can't work so this money is too much to lose over a scam. This is the first time anything like this happened to me and I am annoyed that they are allowed to advertise on my email account. I will let you know what happens but I honestly think that I have just thrown £200 away.Jacqui

Hi i too jumped on the free trial train with everbright as everyone else here 14 days ago and as soon as i found out that it was a scam i cancelled my card phoned everbright and cancelled my so called free trial and subscription, a few hours later i received a cancellation email from everbright and as soon as received the product 2 days later i shipped it back via usps signature confirmation and til this day i have not been charged any money not even for shipping hope it stays that way and even if they manage to get my money i will dispute because i have all the proof that i did everything by the book i hope everyone here gets justice and that these companies get what's coming to them soon

The same thing happen to me! I canceled my card, but guys you have to make sure you get a brand new card, or they can link the new one to your old one with your pin number!

I'm from Belgium and was ripped off just like you all. Everbrightsmiles... Was charged an initial 4, 95€ and another 99€ after that. Never received my order. I called the States twice asking them to please ship my order. This was last December. Another phone call today and ended up in the UK? They'd never heard of Everbrightsmiles. I'm sorry to hear that all of you were a victim of the same scam but at least I know now that I shouldn't have any expectations or continue calling.

I too have been subject to Everbright Smiles Scam and also a company called Clean Whites. So far Everbright have billed me £153.61 and Clean Whites £78.51. I didn't read the terms and conditions as I believed the products to be a 'free' trial and thought i was receiving a trial size of the product. I did not realise I had suscribed too the Company and authorised monthly payments to be made. I have contacted my bank who have said they will dispute both transactions - however having now read the terms and conditions I do not expect my bank to recover either amounts. My bank have also advised me that in order to cancel each transaction i must contact the companies direct. I have managed to cancel my order with Clean Whites but so far attempts to cancel Everbright Whites order has proved futile. I have tried 7 different US telephone numbers all of which are either no longer in service or are just answering messages asking me to call back - at all times of the day and night i can not get through to any of these numbers. I have googled Everbright Smiles and looked for an address or email contact to no avail. Tonight I put the name Everbright Smiles in a search engine called, http//whoisdomain.com and was directed to a Company called, The Breton Group. I contacted The Breton Group who are an advertising agency in New York and who have never heard of Everbright Smiles. I thought maybe they owned the website and had sold it to Everbright and may have a contact. They did say to me they did have a web address called Smiles.com which had been stolen from them but i am unsure if this has any connection with Everbright Smiles. I am completely disheartened as there seems to be no way in contacting Everbright Smiles to cancel my order and therefore i will still be billed $89.97 monthly. I managed to put a stop on my account tonight so hopefully this will stop any more monies coming off my account. This has been a scam in terms of misleading advertising and also i have never been sent anymore products although Everbright Smiles have billed me 3 times for products they say would be sent. I wouldn't put the product near my teeth as I fear it would be harmful to do so. It is also very difficult to get support in trying to resolve this situation as the Company are not UK based so are outwith UK Trading Standards. If anyone has managed to find an address for Everbright Smiles I would be extremely grateful for you to post it here as I am keen to get to the bottom of this situation. Can't believe I was stupid enough to fall for such a scam. HUGE lesson learned.
