I purchased a mattress set from Sleepy's in Middletown, NY and I have had nothing but problems. I am now on my third mattress. The “Mattress Professionals” at Sleepy's will not let me exchange the defective mattress set or allow me to upgrade to a different mattress set without paying additional fees. I am now sleeping (uncomfortably) on the third mattress that they have sent me.
I currently have a S&F Plaza Terrace Room Firm King set. The first mattress that I received was extremely deformed with a huge lump near the head and a bent corner. They sent out another one the following day. The second mattress smelled like smoke (I am wondering if it was used) I thought the smell would go away but it didn’t. After a few days of sleeping on the second mattress a large depression formed and the mattress began to hammock. I laid a straight edge across the bed and measured a full inch of depression (inch and a half at the seems). My back was hurting and I could not sleep comfortably on the mattress.
I took my complaints to Sleepy’s and spoke with several people. I was given two options. I was told that I could have yet another mattress exchanged free of charge or I could pay for a comfort exchange. I reluctantly accepted the third mattress.
BEWARE: the newer type mattresses with their numerous layers of mystery foam WILL form depressions! Also watch out for all the not so obvious fees and the almost impossible NOT to violate warranty clauses. I have made several complaints with Sleepy's and one with the Better Business Bureau. I will be taking them to small claims court to get my dispute resolved. This whole industry is UNETHICAL. I felt like someone was trying to sell me a used car at every mattress store I went too.
The complaint has been investigated and resolved to the customer’s satisfaction.
i have the exact same problem! the mattress that got delivered seems "used"... and is already deform after one night of sleep, and when I ask for exchange the next day, they insisted to charge me with a ~$400 fee! what a rid off... i am still trying to find a way to get this resolve. the problem is - i don't have any confident that they will give me a good mattress even after i paid the fee!
by the way, i highly recommended to not use the financial option for purchase, it is better to use a name branded credit card, that way, it would be easier to just dispute it and let the credit card company deal with them!

I had a similar problem with sleepy's, they never offered the center support frame, i had no idea that without it would void the warrenty they sold me a 2000.00 defected foam mattress 2 weeks into it i called had an inspector come check it - then told me it was defected however now center support frame nulls the warranty.. you would think spending 2 grand they would make sure i know of the center support frame. but im sure they knew they were selling me a defected piece of crap. i made tons of calls at least 30 different calls, all the reps were illiterate and ignorant. They were rude as hell. i ended up having to pay another grand for a new mattress but have the other new (defected) mattress as well. my credit now is shot because i refuse to pay for the defected mattress until i figure out how i can not let them get away with this.. this is not fair.. never buy a mattress from sleepys most of thier mattresses are defected, you will not get a good mattress and you will be stuck with the defected mattress and out of a lot of money.
I agree regarding Sleepy return/exchange policy. My wife purchased a mattress and box spring from Sleepys 10 days ago. Unfortunately, it's way too firm. But, the set was a floor model and therefore no returns/exchanges are allowed. At the time of the purchase, the salesman did not explain this detail to my wife. Admittedly, it was written in the contract. But, my wife assumed returns/exchanges would be allowed, so she didn't read the contract. So, now we are stuck with a mattress we can't use. The customer service rep said it would be unfair to all the other people who purchased floor models. That's like saying, 'since we were unfair to all these other people, we think it's important to be unfair to you as well.' I simply don't understand this kind of customer service. Why are they so willing to alienate customers? Now I will never buy another mattress from Sleepys. And, I'll tell all my friends and family of the poor customer service. I'm in retail. Customers make mistakes all the time. I never make it their problem. I never say 'gotcha!'
I'm having the same problem with sleepy's, bad Sterns and Foster with acceptable body impression? who is it acceptable to? and now they say it has a stain on it I can even find it with out the camera lens. I'm just not going to accept this and I think there should be a class action suit to stop this ripoff.
I bought a Stern and Forster, believe it or not they have delievered 3 of the same with the same problem now they say they can't do anything about it. Funny they have not even sent their so called inspectors. Ibelieve these inspectors are part of sleepy's just to rip people off. Sleepy's need to face a class action lawsuit.

THEY HAD A CLASS ACTION SUIT. i'M GOING TO CALL THEM AND FIND OUT WHERE THE PAPER WORK AS TO BE SENT. I SUGGEST THAT EVERYONE DO THIS
Can anyone tell me where to sign up for the class action suit? We are having a similar problem with Sleepy's. After having the mattress for 3-4 months it deveoped a bulge on the right side only. And it feels like I'm sleeping in a hole. I developed a very bad case of sciatica froom sleeping on this mattress. I get very little sleep, because I spend most of my night tossing & turning. We have been fighting with them for about two months now. We made sure to always protect the mattress for any type of dirt or stains, so when they sent out their "inspector" he couldn't say anything about that. He took pictures and their "experts" determined that the reason the mattress was doing what it was doing was the fault of our platform bed. And that the bulge on the side was from sitting on the bed. First of all I never sit on the bed. except to get out of it and its so high ( I'm 5' 2" ) that I have to crawl in from the bottom to get in it. Also, I would like to know why this protrusion isn't on my husbands side of the bed since he weighs about 100 lbs more then me. Mind you he took no pictures of the platform supports and we had a mattress on this same platform for 17 years without a problem. We took our own pictures & emailed them to customer service. The only thing we got out of them was an agreement to have the same mattress delivered tomorrow. We have to pay $93.00 for delivery. I called and asked if we could get a different type of mattress because I was concerned that this might be a common problem with this mattress. When I mentioned that it was the most uncomfortable mattress I ever had I was told that that was a comfort issue and I could then exchange it for another as long as I paid another $300.00. What a racket! Be very careful how you word your complaint.
I went BALLISTIC in the store and they waived tbe delivery fee
THIS WILL BE A FOURTH MATTERESS FOR US ONLY HAD THIS ONE FOR A MONTH AND THREE DAYS BODY IMPRESSIONS, I ASKED FOR OUR MONEY BACK AND THEY SAID YOU WILL GET THE SAME ONE WHY WOULD I WANT THE SAME ONE WHEN I KNOW IT IS GOING TO DO THE SAME THING SO WE HAVE TO PAY EXTRA FOR AN UP GRADE I HAVE A BAD BACK AND SLEEPING IN A HOLE DOS'NT HELP WITH MY BACK.AND READING ALL THE COMPLAINTS I REALLY WANT MY MONEY BACK!
I'm on my SEVENTH bed. After a few months the bed would form a sinkhole..EVERY TIME.
Stuck with there awful policy I had a credit but not enough to get a decent bed. So i got a cheaper bed. .Yup...its sinking but with the credit I got a headboard . They settled a class action suit in New Jersey for defective beds.
