TD Bank home equity loan

I have a home equity loan with Commerce Bank. When TD Bank bought Commerce, my nightmare began.

I had my loan set up for biweekly automatic payments. This was fine under Commerce but shortly after TD Bank took over, I started getting late notices. I couldn't figure this out since the payments were being deducted from my account every two weeks.

I contacted TD Bank and was told that my payments had been incorrectly posted as principle only, showing as no intereste paid. They admitted this was their mistake, but had not explantion for how it happened. They said they would fix it but by the time they did, they had reported me as delinquent to the credit bureau.

I called back to tell them they needed to rectify this and they said they would turn it over to the person who handles errors with the credit bureau. Imagine, they have an employee assigned full-time to fix information they've erroneously reported on their customer's credit bureau file.

I was supposed to receive a call back in a few days but never did. Of course they would not give me the contact info for the person who handles rectifying the erroneous info being sent. After speaking to several more people at TD Bank over several months, I got nowwhere.

The next thing that happened was they just stopped deducting my loan payment from my account. When I called to ask why they said TD cannot process biweekly payments, only monthly automatic payments. I said it would have been nice if I had been told this. They said they had mailed notices out but I read every piece of mail from my bank and I never received this notification.

When I spoke to someone in the loan dept she said that it was because in the computer switch over (remember when the bank couldn't process anything for 3 days?) from Commerce to TD, several loans were just "dropped off" and mine was one of them. So the whole "we notified you" was a load of crap.

At this point I cancelled my automatic payments and said I would just make the payment myself each month. So each month I go online and pay my loan electronically. However I suddenly start getting notices that I'm a month behind. I look at all my payments which are current, call TD again, and they can't explain it. So in order to not have my loan looking like it's behind, I make an extra payment.

For 6 months I have been doing this. Each month I go online and my loan shows "no payment due" for the current month and the next payment due the following month. But I make a payment anyway, just to be safe.

Then in October, I suddenly see almost $800 deducted from my savings account. Under the column that describes what it's for it just says my name. I immediately call TD Bank and no one can figure out why this money was deducted from my account. The CSR gets her supervisor and they still can't figure it out. So they call my local branch.

The local brank says it's for my home equity loan! I tell them I am not set up for automatic payments, the amount they deducted isn't my loan amount, and my next payment isn't even due until November! Their answer is they will "research" it and it will take 10-15 days. In the meantime, they won't put my money back in my account. I am freaking out at this point.

So they transfer me to the loan dept and I speak to Matthew. He promises to expedite the research and have the money back in my account in 2-3 days but says I should call on Wednesday to make sure it's there.

I check online on Wednesday and the money isn't there. I call the loan dept and speak to Kelly who is rude, condescending and totally unhelpful. She says all she can do is put it in for researach and it will take 10-15 days. I reiterate that TD has taken my money with no authorization and I want it back. Kelly said no. I told her that Matthew said I would have the money back that day and she didn't even want to look up the notes on my account to verify this. She finally did and said Matthew only put in the notes that he would expedite the research process.

So I said "then Matthew basically lied to me." She refused to comment and just kept repeating that she would put it in for reserach and it would take 10-15 days. I was ready to scream. But instead I asked to speak to a manager. She just keep repeating her mantra "I'll put this in for research. It will take 10-15 days." She said this about 5 times ignoring everything I was saying. What a ###!

I kept insisting on talking to a manager and she finally put me on hold. After a very long wait a manager, Nick, came on the line, apologized and said I would have the money back in my account that afternoon. Amazing! However, he said I would need to write a letter saying I no longer wanted automatic payments deducted from my account, and I would have to fax or drop it off since they needed my signature.

I repeated several times that I did not have automatic payments and hadn't for almost a year. He said he understood but said it was showing in their records that I was set up for automatic payment since January 2010. I then asked why, if that was the case, in 10 months, a payment had never before been deducted from my account. I also asked why they would deduct a totally different amount that my loan payment amount, and take it out a month before it was due. He couldn't explain but said I would need to drop the letter off in order to prevent this from happening again.

I replied that it was amazing that they hadn't needed my signature to set me up for automatic payments that I never requested, and could take random amounts of money out of my account with no explaination, but they needed my signature to stop doing something they did without my authorization in the first place!

I also told him that my very next step would be to transfer this loan to another lender and close all of my TD Bank accounts.

But the story doesn't end here.

The money wasn't in my account that afternoon, or the next morning. I called TD Bank again and was told that it had to be in the "overnight run" and it hadn't been submitted in time the previous day. Funny, since I spoke to them at 10:30 am!

The woman I spoke to, Marie, was very nice, helpful and professional. She is an anomaly in the TD Bank world but I am grateful for her help. The money finally went back into my account. I gave them the letter with my signature. Even though it aggravated me to have to write a letter to ask them to stop something I never asked them to do, it was easier to just write the letter and (hopefully) avoid another problem.

And by the way, now they're telling me my Oct loan payment is due, even though their online system says a payment isn't due until November.

Do the Three Stooges own this bank? Commerce was bad, but TD is ridiculous.

I too am a former Riverside client. I took out a commercial mortgage in 2005 with Riverside that TD Bank took over in 2009. Since that time my mortgage has been restructured to renew every 3 to 5 years. I noticed back in the summer that I was getting a bill for a late payment that was in error. I have my current bank (Chase) send TD Bank $400 every week - my payment is due on the 18th with a 5 day grace period - so I'm paid ahead. When I called to question the late fee the guy could not pull up information because it was originally a Riverside loan. He basically could not answer where the fee was coming from. This continued for months until I put together a spreadsheet outlining my payments, dates of payments to show that not only were my payments current, they were overpaid! About a week later I get a notification (FINALLY) from the actual commercial loan guy about it. He explained that they had my spreadsheet and that it didn't agree with their records so he was going to send me his data so that I COULD FIGURE OUT THE DISCREPANCY! A few days after I received it, he called to 'check on my progress'. I told him that I was still working on it but didn't have anything definitive. (I have a business to run) He then told me that in 2018 TD bank was no longer going to renew any Riverside loans. My loan terminates in February 2018 giving me less than 90 days to find alternate financing!

You have our sincere sympathies. The three stooges (TD Bank) also took over the troubled Riverside Bank here in Florida. The mess they made of a auto debit loans was impressive but what was truly amazing was the depth of ignorance exhibited by bank employees. We were treated more like hostages than customers. The Feds enjoyed hearing all about it too -- considering they keep a keen eye on takeovers. They saw to it all the mistakes were corrected and now the three stooges are very careful with us.

At one time we had recommended many to this bank so when folks heard what was happening to us, there was a stampede for the exit. We've moved all except that which would cost too much to start over -- loans that are close to maturity. In the meantime, we enjoy the absence of any lines at a branch that was once very busy! LOL

TD Bank downloading bank transactions

This bank is infuriating! The only thing they do very well is collect fees!

I have just spent about 8 hours over several days to get this bank to fix whatever "hiccup" they have in their system to allow me to download my transactions onto my new, standard financial software. First I went to the vendor and tried every permutation to correct the problem. (I've used Quicken and Quickbooks in the past without incident). Quicken said it was a problem with TD bank. So, I spent 50 minutes with their people. Nothing accomplished. How difficult is it to let me download my transactions?! They are incompetent and arrogant. They spend all their time figuring out new ways to rip off the customer when they should be concentrating on fixing these common mistakes.

And..."not-so-stealth-pilot", "tired of stupid---ha" and "maggie the maggot"...don't start with "you're all so stupid"----it doesn't cut it anymore. Nobody wants to hear your misguided babblings.

As for my prior complaint, the OCC compelled them to reimburse the money they had stolen. As much as I detest lawyers, I wish I was an independently wealthy one so I could devote all my time to bring this house of cards and crap to it's knees. Instead I will continue to slowly disassociate myself from TD.

I don't care if they have 50, 75 or even 100 million customers. They will eventually lose them all. Maggots!

Way to go SVH! Getting the OCC involved was an excellent idea. I have asked for their assistance as well many times and have had positive results. Banks need to learn to stop ripping us consumers off.

TD Bank hiring process

Hello,

My name is Manivone Xaiyavong and I have applied to your bank and basically got the job. I know there is a 48 hours period to have your drug screen, and finger print done. I was told by Human Resources to take my drug screening test last Friday Sept 17th at 5pm. I have everything written down, and did everything I was told to. Human Resources admitted that it was her mistake that she mixed up the time, and so she stated that she will extend the 48 hours (monday and today) to do so. As I am on my way to take the drug screen and finger print, she has cancelled my application within 48 hours. I dont think that was right, and I deserve this job. I have also reported this to the BBB.

TD Bank td bank fraud protection policy - it's all on the customer!

This past summer, someone got ahold of my debit card number and used it to make 500 or so dollars in purchases, overdrafting me well into -300 dollars. (Keep in mind that never once have I overdrafted before this) Here's where it first starts to go downhill. After calling the fraud protection, I had to speak to no less than three different people (Oh, let me get you my supervisor) to report it properly. Now I found out about the fraud because I received a package at my home that I didn't order. I told every single person I spoke to about this and that I was in the process of returning the package, but for some reason none of them decided to write this down anywhere. After reporting this, it took them well over two months to refund all 500 dollars.

Now, three months later, I'm finding out that the bank decided the big 300 dollar charge was my responsibility to pay because I received it. This is for the package that I sent back already! Nobody wrote down that I sent it back, but for some reason they all knew I received it at my home.

Oh, and here's the best part. Never once did they plan to tell me that it's my responsibility to pay that 300 dollars back. The only reason I found out was because I happened to deposit a paycheck on the day the 300 dollar charge was reversed. I called the fraud hotline again today, and they tell me that I should be receiving a letter about that on saturday, over a week and a half after they took 300 dollars out of my account. Now call me old fashioned, but I feel like a bank should give you advance notice when they take 300 dollars out of your account, putting you into negative balance. Oh, and I can't even dispute the charge until the letter comes, so I probably won't get my money back for another two months. Now this part is just venting - I'm a college student, but what if they did this to a family who had nothing but 300 dollars to live on for two more weeks? Nope. They have to wait until almost two weeks later to find out why they can't eat.

Long story short, if your debit card number gets stolen, TD bank simply doesn't care.

TD Bank fraudulent fees

Opened an account in July 2009. Last transaction was posted Aug 2009. Called in March 2010 to close account while still in free promotional period with a positive balance of approximately $3. No correspondence until today, 9/23/10, when I get a letter stating they are sending my account to a collection agency for $46.83 due to under-balance fees and overdraft charges. The overdraft charges for the under-balance fees which should never have been levied in the first place. Called Customer Service to discuss the issue and alert them to their system error. Was informed that I should have visited a branch and spoken to a manager to confirm that a $3 account was closed. Are you kidding me? They "forgave" the $20 overdraft charge because I was upset but are still sending the account to collections for $26.83 unless I bring the account to a zero balance within the next 10 days. So basically they're threatening to hurt my credit rating unless I give them $30 they never had any right to. I will NEVER do business with them again and will strongly advise everyone I know not to either.

I received a collection notice for fees added to the account after the account was closed. It is hard to find someone in the most "Convenient Bank" customer service area to do anything but see the error... but they can not correct the error. They suggested going to the branch were the account was close 11 months ago and see if they can help. This is just another example about how sloppy TD Bank is and how they will run up fees and not be responsive to the customer.

TD Bank what a scam!!!

Read all of the reviews! THOUSANDS of people can not be wrong! TD Bank is by far the most underhanded, thieving, crooked bank in this country! What this crooked organization likes to do is not only back date checks but also it seems, they handle transactions TWICE each night. My bank rep told me that they ALWAYS enter all deposits before the debits. On more than one occassion I made a deposit whie my account was still in the positive. The following days I would check my balance and it should everything ok. Then a few days down the road I would get a notice showing insuf. funds. When I check my account, it shows that the day after my deposit, i am usually hot with insuf funds fees. When I spoke to cust. service, I was told that the chrcks came through at night, but my deposit was not registered until the morning and therefore, checks were bounced.
I also can not understand how whether you use the debit or credit transaction on your debit card, TD Bank will post it, but not deduct it from your balance for 4, 5 or six days. Debits even float around in their system for days on end, when they should be automatically deducted.
In short, if you have millions of dollars in your account, go ahead and stick with these crooks. But if you sometimes go from paycheck to paycheck, stay away from these people. they will screw you evry chance they get. And then they will remake their own rules to find new ways of screwing you. CROOKS!

Td bank for the second time in as little as three weeks has taken hundreds of dollars from our family. This time I had used my debit card thid ladt weekend and they somehow held those transactions til wed on wed my rent money csme out. Now mind you there was still enough in there for everything. On top of it all my pay was direct deposited the same day. So there should really have been enough when I checked my balance after work I found a 175 dollar overdraft fee. According to the they take money out the night befor however when I checked my balance the night befor I wss still good . There justification is the order they use to take money and the fact that they do not deposit til all deductions have come out first . I am so mad what can I do.

For those of you inquiring about a lawsuit and are interested in becoming a class member, there is a lawfirm working on putting a class action lawsuit together. The more complaints and proof the attorneys have, the better the chances are at winning a substantial amount. Substantial enough for TD Bank to improve their business practices. I just finished sending in my information to the Trief & Olk Law Firm.
There is also a website where the firm is retrieving complaints from Go to http://www.bank-overdraft.com/cases/td.htm

Here is what you should do:

1. Keep all receipts for your debit card transactions to support your actual date and time of transaction.

2. Print the daily transactions reports off of the website DAILY, EVERY SINGLE DAY (This REALLY shows how they are re-ordering transactions, if you could see mine you would shake your head! BIG TIME... I got these thieves GOOD).

3. Print the pending transactions as well.

4. When complaining to TD Bank, rather than calling them - email them through the website for documentation and proof.

TD Bank out of control fees and horrible customer service

I have a pretty funny story about how awful TD Bank is. I'm an old Commerce Bank customer who became a TD Bank customer by default. One unforeseen EZ Pass payment sent my account into the red and, of course, withing a 24 hour period I was charged with upwards of $300 in overdraft fees. That in of itself is enough to make me leave, but I was amazed with how horrible the Customer Service is. I have had people talk down to me, hang up the phone and flat out lie. The basic problem is that TD Bank's system of taking in, categorizing and clearing transactions is so convoluted that even the CS Reps cannot explain it... so they get aggravated and take it out on the customers.

But that's not new to anyone, the FUNNY part is when I decided it was time to leave. I went with an online bank so I had to get my money transfered out of TD Bank and into my new bank. I called up a rep and asked if there was a way to do that electronically. "Sure", she said, "I'll just transfer the money to the other bank. Once it clears your pending transactions, call us up and we'll close out the account." "Wait a minute, " I asked, "If you transfer out all my money, won't I get hit was a under $100 service charge and then a overdraft fee from the service charge?" And you know what... she had no idea.

It doesn't end there! I decided to go to the branch to close out my account. I had successful transfered all but about $200 to my other bank so I was going to get the cash and close it out. I spoke with one of the managers who asked for my account number and drivers license. I gave her my account number but I forgot my license at home! Guess what! They gave me the money anyhow - WITH NO PROOF OF ID!

I am so glad to be out of this horrible bank!

For those of you inquiring about a lawsuit and are interested in becoming a class member, there is a lawfirm working on putting a class action lawsuit together. TD Bank ach fraud

We were trying to startup a small business in Alexandria, VA and opened up a business account with TD Bank in Centreville, VA. On July 14, We got a call from TD Bank asking us if we have authorized ACH transfer of $48, 500 to Wachovia Bank. We told them defintely not. They assured me that the money had not left the bank. A long story short, they told me that the money had already been transferred and can not be recovered and they are not taking any responsibility for this. ACH transfer was initiated on 7/13 and they called us 7/14, so why could they not stop the transfer ? Our dream of opening a business is shattered and dont know what to do. We have filed a police report with City of Alexandria. TD Bank just dont care about keeping trust and confidence of customers, especially small business. TD Bank has history of online ACH fraud and Questionable Bank incidents. One recent examples
(a) 2/9/2010: Town of Poughkeepsie, NY lost $378K in ACH Fraud transfer from TD Bank Account
(b) 3/11/2010: NJ TD Bank employee charged with bank fraud and identity theft (FBI release 3/11/10)

I opened an account last week, online. The initial deposit was done by typing my userid and password from my other bank. After I selected $100 and agreed, I received NO confirmation. I thought, oh well, I'll try it again with cash or an ACH transfer, which I use a LOT with other banks. So I setup my Citibank to transfer $2, 000 to TDBank. After 2 business days the amount transferred from Citibank finally showed "cleared". So I check TDBank, and it still shows $0! (nothing being transferred or being processed). I call them up and after 40 minutes of crap and being transferred to an ACH department, to leave a VM? WOW! The Rep seemed to have done this before and new the end result, it seems. I went to the bank and the cust service rep when on to do the same thing (calling ACH and waiting!). I told him, I'm not going to wait another 40 minutes, here! To my knowledge/experience it never takes more time than when it shows "CLEARED" from the other bank (which means the other guys have it in their hands). Not sure what the final result of this will be, but I will SURELY be closing my account with these crooks!

i just recently opened a acct.( over 1 month ago) with TD bank and am already having problems with them holding my deposits for up to ten days, one employee told me it was only for 30 days and another told me it can be for up to 90 days! I have never ever heard of a bank that operates like this! They claim they do this to "get to know you and see what kind of customer you are". BS!
As a result of this mess, I have already had a four overdraft fees, one was refunded and have gotten behind on paying some bills because they are holding MY money hostage! How can they do this? Is there anything that can be done?
I am seriously considering closing this acct. once my pending transactions go through.
I am so disgusted with them over this.

TD Bank exhorbitants fees!! hipocritical

Good Afternoon Mr. Ed Clark CEO,

I enjoyed hearing you talk the other morning on the CBC radio show about your volunteer work with Habitat for Humanity and other charities and the substantial monies that you and your family donate to charities in the City of Toronto. I also heard you talk about your concern for and help specifically to single mothers. In addition, you spoke about the work that TD Bank was doing in the community. I have also seen your photo and articles about you and the TD Bank in various community news-type papers about the work you do with housing developments.

That radio show and TD Bank and your personal philanthropic work assertions is, in part, why I am writing to you. I am a single mother presently working at the Ontario Government as a legal assistant who regrettably has been saddled with debt from an ex-husband with a variety of mental health/substance abuse issues. If you are truly a philanthropist and concerned about helping single mothers I am asking for your help as the TD's CEO and spokesperson and personally.

I am very hard working and honest and my two children, Liam and Kaitlyn Murray, are 10 and 9 respectively and are wonderful children. I enrol them regularly in tap/ballet, Aikido, soccer, baseball, piano lessons, and more recently, Scouts of Canada. I worked until mid 2009 with a wonderful lawyer in Scarborough, Mr. John William Vaillancourt, who lost the battle for his life to a cancer treatment related heart attack. I experienced further terrific financial obstacles thereafter trying to keep a roof over my children's head, food on the table, a car on the road so I could find work and yet present a valiant face in order that my children didn't worry or know the extent of our situation.

I am a strong, proud, woman who needs a break. Granted TD Bank only made just over $1Billion in the 4th quarter in 2009, but I am writing to implore your assistance in obtaining a compassionate, reconsideration of the almost $10K in an 'interest rate differential charge' as well as a $5, 261.10 'repayment amount' in the re-finance of my mortgage . Not to be dramatic but this is quite literally food out of my children's mouths and money out of their education! Surely, TD Bank doesn't need the money at this personal cost to a struggling single-parent family. Ought not people assist those who are attempting to assist themselves rather than crippling them or crippling them to say 'we're helping others'!?!

In 2007, I had to take out a second mortgage which a personal friend was happy to advance at an 8% interest rate for $45, 000.00 Evidently, my ex-husband had defaulted on a Scotiabank line of credit which I had guaranteed and, in addition, he had not paid any realty taxes which had to be brought up to date. I was left footing the bill.

Now that I am working again (and commuting almost 2 hours each way) for the last number of months, I am finally refinancing my mortgages at a more manageable interest rate and, as a result, am being penalized exorbitantly! This is how a long time customer of TD Bank is treated?!

I had tried to refinance earlier in the year with TD Bank, however, they would not re-finance the mortgage they held, blend or otherwise reduce the 7.65% interest rate or re-configure the two mortgages together to make payments more manageable. It was looking for those early months as if I would lose the house. I have my own business and therefore was not eligible to receive E.I. I owned a home and was not eligible for regular social assistance! It was incredibly frightening! On top of that I now need to replace my roof - apparently my property insurance depends on it and the estimate was $6, 500! How can you reconcile knowing that your salary (which you said on the show was incredible) and your lifestyle and those of your colleagues is because of penalty amounts of more that $15, 000 out of the pockets of single hard working struggling parents like myself?

My business account, RRSP mutual funds, TFSA, student loans, chequing account, savings account, td insurance, mortgage and Visa were with TD Bank. In the early 80's, I worked at the TD Bank and that was when I opened my first account with them. I would not like to admit that TD Bank earns its profits off the backs of hardworking lower income working families like myself. I put myself through school. I paid my student loans back in full. Does the average person on the street know that these kinds of ridiculous fees could be there's - they are almost prohibitive and make the re-finance a mute point!

I have calls in to the 55 King Street West, Main Floor branch regarding this payout (M#8087619) and have implored with them to take a look at this matter and see their way clear to re-consider such debilitating "prepayment charge".

Please consider this matter further Mr. Clark and I would ask that you do the right thing for (single parent) families who are hard working, honest people and intervene on our behalf with your colleagues.

TD Bank I closed the account with 0 balance, they re-opened 4 months later and added fees!!!

I closed my account with a 0 (zero) balance. Four months later, they started calling me every day, telling them I owe them $111 for some charge that they said was "disputed" at the time when the account was closed, and therefore did not show on the statement at that time. I NEVER DISPUTED ANYTHING - they simply made the whole thing up, and I ended paying for the $111 twice (the second time after they forcefully re-opened my account).

I am still not very sure I got rid of them though - they ABSOLUTELY REFUSE TO SEND YOU ANY STATEMENTS or anything showing balances, transactions, etc, "because you no longer have an account with us." They call you on Saturdays and Sunday, in the middle of the night, etc.

Oh, I forgot to mention - the reason I closed the account is because you MUST have a balance of $100 or more at all times, otherwise they charge exorbitant fees. If you have any respect for your money, find ANY OTHER BANK. They are the devil!

TD Bank heloc contract

I have an existing HELOC loan with Hudson United Bank which was taken over by TD Bank. Everything is spelled out in my existing HUD Note including the rate of the late fees which should only be $20.00. After speaking with loan officers in person and over the phone, I was told that the contract terms remain the same as they are one and the same bank. I am very confused as to why I am being charged an additional $50.00 on top of the contracted HUD $20.00 late fee (which, I am proud to say, in five years only had 3 late payments) and no one can explain why the increase as well as TD Bank never came to me with a revised contract or even a notice in the mail informing me that the terms of the contract has been edited. I have been to two different bank locations, spoken with three different over-the-phone representatives and still am told "We have to look into this further with a supervisor." I feel that this bank is trying to find some niche to crawl into to make this fee stick. But I am determined to prove that there is an illegal practice going on here and will fight tooth and nail to expose it. Shame on this Bank!

TD Bank overdraft fees, false readouts at deposit atms and online

The ATM readout will tell you that you have x for available balance, and then one minute later- after taking out some cash, it will scare the pants off you by completely messing up the balance with something that does not indicate the amount you just withdrew! I have had this happen and had it cause my account to overdraw. When you do this on a Sunday afternoon, and you've already deposited more then $100 into the ATM, and there is nothing to transfer from you savings to checking- then you are STUCK.
I have also seen the balance in my online account page show one thing one hour, and another an hour later... in a way that proves that it doesn't work corectly. For example, you get up in the AM- you check your balance, etc. There are no items pending in the "pending" area... you knew there were pending items the night before, and now it appears they have "gone through". NOPE! One hour later, a few of the pending items show up again! BE very Careful people!
When you ask the bank people about this they will admit the machines don't work correctly. WHAT! ? Yes- they admit it! They tell you to "use the online and the ATM onscreen systems only as REFERENCE" and that the "only way you can tell what you have in your account is to keep a running hand written roster/register". ! ! !
I thought that if a bank teller hands you a reciept it was as good as gold! As good as the word of a Judge telling you what your balance is! ? Now we see that when the ATM teller machine "hands" you a slip with the same information from the same bank, you can't trust it? ! Trust me- you CAN NOT trust the balances on those BankNorth ATM machines!

The other day, I woke up to find my "available balance" had dipped to about $12 or so in the negative. The "balance" was still around $7 or $8... in the possitive. (figure that one out!). If you looked at the night before- the "balance" had ended at midnight being $26 ( a possitive balance!). I ran to the ATM and put in $20 thinking I was making things "safe" . Not so! later in the day I put in another $20 to make things "safer yet" and Bingo! they had charged me three overdraft fees totalling $105 ! Yet- the balance in my account had never dropped into the negative! (again- figure that one out! ) I had been told on the phone and perhaps in person many times by bank employees that "as long as the account is possitive at the end of the day you will not be charged overdraft fees".

Not so! Buyer beware!

TD Banknorth is a very, very greedy bank like most others I suppose. Thank goodness that we were able to find a few understanding employees who refunded the fees. If I did not need the account, I would never have it. In this day and age we are pretty much bound to have checking accounts etc. in order to cash checks, and make many transactions. It almost makes you wonder if we've sold our souls somehow already, and these credit/debit cards we carry around really are the mark of the Beast that Revelations speaks of. I certainly hope not, but without them- it is almost impossible to "buy and sell".

TD Bank credit score

I went online at TD BANK to submit application for refinancing the home mortgage. On Page 3 it required to enter SSN# and there was a consent to allow TD Bank to pull credit scores. Later I decided to abondon the application and removed all the info. But TD Bank still did a credit check without me submitting my application.

Later i spoke to the customer care and they were not ready to accept the mistake and remove the credit check.

TD Bank worst ever

TD Bank is the worst ever, they delayed my mortgage for 1 month and I eventually lost the house. I tried to contact the load processor via emails/phone calls/voice mails, unbelievably she wouldn't get back to me day after day, and even week after week. I tried calling her suppervisor, customer service, they are not helping!(all the BS like send her email, she will get back to you in 1 business day..blala..) and now I have to deal with them for the fees they charging me.

Stay away from this bank!

I am so tired of td banks overdraft fees. they charge you $35 for every single overdraft regardless of amount, time or date. it is criminal.

TD Bank company policy on deposits

On Sunday (8/9/10) I paid persons who had done services rendered to me by checks drawn on my account at TD Bank. As it was a Sun and the banks were then closed they asked if I could pay them cash which I then did after they endorsed the checks to me and again signed the back with my signature to deposit them in my bank. On Monday (8/10/10) I attempted to deposit these checks into the same account they were drawn on and was told by the teller that the bank policy now was to require authorization on a notarized paper from the person to whom check was made out to or they must be physically there with an ID in order for me to deposit my own checks drawn on my own account back into my own account. This is insane as I know no large chain WalMart or food chains who routinely cash payroll checks from unknown sources are required to have an authorization in order for them to deposit checks. If there were something wrong with a check the bank could always come back against the last signature on the endorsements.

This practice is flagrantly discriminatory toward seniors, small business persons, and minorities. If this were allowed to remain in effect a simple thing like paying your rent would be complicated needlessly and made more expensive since you no longer could you pay the landlord with your social security check and he in turn return to you the difference. If you had a thirteen year old walk your dog and you paid them by a check to monitor your expenses you now would have to get the cash first, have it on hand, and hopefully not forget what you paid and to whom. This is discrimination of the worst order and I believe this practice would complicate normal commerce.

This is further proof that the taxpayers who have paid to save the crooked banks are being abused by the same crooked banks. TD Bank should be reprimanded for this atrocious policy and further a national bank should not be allowed to be owned by any foreign banks as their best interests and our citizens will not be the same.

TD Bank change of address

over the past month i have tried 3 times to change my address over the phone. today my new checks come in so i call to see if my address change has gone through and it has not. adding this to putting 1 teller at the 3 driveup windows at 4 pm on fridays makes me think about going back to bank of america (JK) but i am closing my account (already moved my business account) and getting another sun bank account.

TD Bank stolen debit card numbers

I checked my account online Friday Aug 6, 2010 because I was expecting a refund from enterprise rent a car that was taking awhile, I noticed my account was negative $46.27. So I called the 1800 number and was informed that my husband just used his card in the store in our town. I told them that's impossible because he is school right now taking a state licensing test. So, I called him and asked if he had his card on him he said yes. BTW, his school is over 10 miles away from the store it was used in. So I called the bank back and told them it wasn't him. So they advised me to go the police and report it, so we did. The police told me to go the bank and fill out the REG E form, to have the investigation begin, so I went across the street and did that. While I was there, the girl I was working with advised me that my card was also used a minute apart. ( why couldn't the rep on the phone tell me that, I have no idea) I'm like how is that possible I have my card and I pulled it out of my wallet to show her. So I told her to cancel our cards and don't give us new ones until we figure this out. She did that, and put stolen cards in the system. But we couldn't go any further until it posted to the account because it was still in the pending transactions. Okay I leave. The detective calls me Tuesday and I explain to him what happened and he says well we can't investigate until it posts to the account, so I call the bank and see it's overdrawn $107, So you know now I'm pissed! Me and my husband run to the bank to find out they tried it again on Sunday morning 8/8/10, both our cards again this time a hour apart. So I asked what happened? The rep told me the charge was rejected. I said rejected like there was no money in the account, he said yes. I said but I was in here Friday and let you know the card numbers were stolen to cancel the cards, and he said yes it was. So I asked why when this thief went to use the cards why didn't the card come up stolen call police? He couldn't answer me. why wasn't I notified? his answer was if we called you you would go to the store and that could be dangerous, I asked him what is that your business, if I went to the store caught the thief and beat the crap out of him? No answer again. So now I'm on fire, because 1) the police station is a half a block away from the store and maybe if it came up stolen card we would of had a chance of catching this creep. 2) it happened twice an hour apart from one another and they were able to walk right out the door. So I called the fraud dept of the bank, because I want answers! I was told when you report your card stolen it takes 2 days to post that message to your account. ARE YOU KIDDING ME? So now I'm waiting for the detective to call me because they have to go the store to view the tapes to prove we weren't there. Also, it seems that our cards were duplicated. Because they were scanned at checkout. The store does not enter card numbers, they are not allowed. Why is my security? 2 days to post to the account that our cards have been stolen. Come on, in this day in age with technology the way it is, why does it take 2 days? So, I'm taking my money else where and letting every paper, every web-site and consumer affairs and anyone else you can think of know about this. SCREW YOU TD Crooks! At this point I'm more mad at the bank for letting them walk out the door twice!

The same thing happend to me, I filed the Reg E form and was denied stating it was a PIN based transaction, they base their decision on the fact that we are not supposed to give out our PIN #'s which I did not but they do not put into account that obviously the crooks out there have more modern technology then our banks, my debit card and pin were dubbed at a gas station and $ was withdrawn at another bank, TD does not want to give me my money back unless an arrest is made! it's horrible.

TD Bank manipulating debits

After basically calling me a liar when I told TD Bank my wallet with my debit card had been pickpocketed and refusing to pay me..they have now added a new wrinkle. Previously they told me that somehow the card must have come back into my possession because there were charges made by me AFTER the thieves racked up $500 in purchases at Macys. I pointed out to them THEIR practice of posting the LARGEST debits FIRST so obviously purchases I made earlier that day would show up after the $500 which was made after 3pm in the afternoon. Their new wrinkle is that..the purchases I made after my card was stolen were made a day after my card was stolen and why hadn't I reported those as fraudulent?. Well..how could that be? Within an hour of having my card stolen I had been to their bank..stopped the card..received a new one..froze my old bank account and opened a new one. How could ANY new purchases have been made on my card by ANYONE since they had said the card was dead. And how could any purchases have been made on my old account when they froze it? As for me not reporting fraudulent charges supposedly made the day after the card was stolen. How could I know what charges were being debited? The bank had only shown me the debits from July 1st..I had no idea what charges they debited July 2nd.
This bank stinks to high heaven . I've sent in police reports..notified letters from people with me all that day as to what purchases I made and when..and even e-mails from reps at their bank as to how they post the largest debits first. What else can I do..or do I just have to sit here and let them screw me..which they obviously are doing.

For those of you inquiring about a lawsuit and are interested in becoming a class member, there is a lawfirm working on putting a class action lawsuit together. The more complaints and proof the attorneys have, the better the chances are at winning a substantial amount. Substantial enough for TD Bank to improve their business practices. I just finished sending in my information to the Trief & Olk Law Firm.
There is also a website where the firm is retrieving complaints from Go to http://www.bank-overdraft.com/cases/td.htm

Here is what you should do:

1. Keep all receipts for your debit card transactions to support your actual date and time of transaction.

2. Print the daily transactions reports off of the website DAILY, EVERY SINGLE DAY (This REALLY shows how they are re-ordering transactions, if you could see mine you would shake your head! BIG TIME... I got these thieves GOOD).

3. Print the pending transactions as well.

4. When complaining to TD Bank, rather than calling them - email them through the website for documentation and proof.

Hope this helps.

This is exactly what they do...so if you know you have a balance...and let's say you make two small debits...then somehow...something you were not expecting to clear comes through...they show all three as over drafts so they can charge you $35 each...I have had this happen more than once with this bank...I too am seeking a new bank but am checking out their policies first...I think a small local bank is the new idea of how to really bank and keep my money in my account and in the community. TD Bank post dated checks

TD BANK HAS RIPPED ME OFF!

I wrote out a post dated check dated July 30th in the amount of $1200. TD decided to pay out the check hitting me with $280 of overdraft fees. In addition leaving me with a zero balance in my account.

I called the [protected] customer service line and spoke to Amanda who advised that due to the fact that I'm enrolled in the TD DEBIT CARD Advance THEY DO NOT HAVE TO REFUND THAT AMOUNT.

I then asked to speak to the supervisor. The Vp of the call center named Ryan who was so SMUG and sarcastic. He advised that TD does not allow post dated checks and that I will not be refunded any of the overdraft fees that left me with NO money in my account.

Let me add that Ive been a LOYAL customer with Hudson United, then Commerce now TD, and this is the way they treat their customers?

I have 3 children and 7 days till my next pay check becomes available! What do I do now? Ryan didn't care nor was he apologetic at ALL.

He actually told me that I shouldn't write a check if I dont have the funds to cover the check. I advised him "THAT'S WHY IT WAS POST DATED!" If TD doesn't accept post dated checks then why did they honor it instead of sending it back with that notation. HAD I KNOWN..I would not have written that check with a future date on it.

I asked for his supervisor and he said her name was ANGEL who is currently on vacation and wouldn't be back till Next Tuesday. What do I do till then. Today is Friday July 23rd and I don't get paid till July 30th.

If anyone has any means of getting this type of situation resolved..PLEASE email the information to [protected]@gmail.com. SUBJECT; TD SCAM.

The "re-ordering" and changing the date of transactions by TD Bank has NOTHING to do with a consumer using a postdated check to pay for goods and services, knowing full well that there are not funds to cover that check.

And the link that you have provided for this so-called class-action suit: It is a website being used to harvest email address' and personal information for identity fraud attempts and mass marketing (SPAM) campaigns. So thanks for doing your part in helping people get their personal information used against them.

I realize I am completely new to this website but I was under the impression the purpose of this forum was to warn others of shady business practices, offer advice and to help each other find answers.

I couldn't help but notice your tone was judgmental, your response was misinformed and you accused her of purposely writing a bad check...i.e. that she knew she wouldn't have the funds to cover the check on the date indicated on the instrument. She explained that the whole reason she postdated the check was because she knew she did not have the funds available the day the check was written. What she did was not wrong or illegal...she was simply ignorant of the necessity to alert her bank.

Judgment, opinion and assumption and are not synonymous with fact, no matter how much we believe in what we are saying.

This site could be an extremely powerful consumer tool if used correctly.

Actually, it is a common misperception that issuing a post dated check is illegal, but in fact it is not. On the contrary, the practice is quite often the cornerstone of operations for predatory businesses such as advance payday loan and car title loan centers. To obtain a payday loan, a borrower writes a post-dated check or authorizes the lender to make an electronic withdrawal from his or her bank account on that date. The check (or authorized withdrawal) is for the amount of the loan, plus the lenders fees.

Delivering postdated checks is not wise, however. That's because it is perfectly legal for your bank to pay a check even when it's postdated, unless you've taken the extra step to contact the bank and put it on notice about the postdated check, and requested the bank not to pay it until its date.

In resposne to your question, I am sorry, but in your specific situation, you have no right to a refund of the overdraft fees because you did not advise the bank of the post dated check. If you had, and they cashed it anyway, then you could have gotten back the overdraft fees.

It is addressed in Article 4, section 4-401 of the Uniform Commercial Code.

c) A bank may charge against the account of a customer a check that is otherwise properly payable from the account, even though payment was made before the date of the check, ...here's the important part...

unless the customer has given notice to the bank of the postdating describing the check with reasonable certainty. The notice is effective for the period stated in Section 4-403(b) for stop-payment orders, and must be received at such time and in such manner as to afford the bank a reasonable opportunity to act on it before the bank takes any action with respect to the check described in Section 4-303.

If a bank charges against the account of a customer a check before the date stated in the notice of postdating, the bank is liable for damages for the loss resulting from its act. The loss may include damages for dishonor of subsequent items under Section 4-402.

Your only recourse at this point is to ask politely of the person or business that presented the check for payment prior to the date agreed upon if they would refund the money back since they didn't follow your verbal agreement to hold the check. This is presuming you did in fact have an agreement and not that you simply gave the check to them assuming they would not be ABLE to cash it until on/after the date on the check.

Even if you did not have this agreement, however, it is still not illegal ...it just means you really have no recourse for getting the overdraft fees back from anyone.

Since you live in NJ, the statute that applies is Bad checks Statute N.J.S.A 2C:21-5. .

The only way possible a post dated check could be prosecutable under the bad check statute is if it can be PROVEN that the issuer knew that the check would not be honored at that later date.

In order to be prosecuted under the bad check statute, certain presumptions must apply:

First, if the issuer wrote a check, but did not have a checking account with the institution, the judge or jury can make the permissive inference that the issuer knew it was a bad check at the time it was passed.

Secondly, if the issuer has an account, and the payee tries to draw on the check but is unable to do so, and puts the issuer on notice, who in turn does nothing, then the judge may infer that the issuer knew it was a bad check at the time of passing.

These presumptions do not apply to post dated checks.
