I contacted a real estate agent that listed an annual rental property in Zionsville, Indiana. I was not in Indiana when I saw the ad and relied on the information provided by the listing and the agent. I proposed an agreement to pay a year in advance for a small cash discount. The proposal was accepted and I paid $2,400.00 in deposit money to the owner. Upon arrival in Indiana, I visited the rental and found it to be uninhabitable. It was uncleaned, junk and trash all around the property and behind the pole bard that is part of the property. The ceiling paint in the bath was peeling off, Trash in the closets, floors were unclean. The garage was unclean. There was damage to the screen door entrance to the garage. I refused to accept the rental as is. The deception and misrepresentation was appalling. When I ask that the house be cleaned, painted, all junk and trash be removed and repairs be made I was told it would not be resolved. That was when they decided to threaten me with legal action. I have video and pictures that prove that since my first visit, they have begun to repair, clean, and restore the property to present in deception that the property was in restored condition when I visited. The owner and real estate agent are both guilty of blatant misrepresentation and deception.
Desired outcome: I want my $2,400.00 deposit refunded
