America's Servicing Company [ASC] Lost my home

America's Servicing Company is not interested in re-financing, they service one's loan. They do not care whatsoever.

I went through the "so-called" pre-payment plan and they said I was about $350 short of what was needed to pay it. There really was not a repayment plan that HELPED.

Our payments were raised also and I could not find work at the time. We also even got National Foreclosure Relief to try and help save our home, to no avail. They had no luck and got the same result that I did. They have been getting the same feedback, I am sure. National Foreclosure Relief has offered to give back half of the money I paid them to try and save our home in a "good-faith" gesture, but asking me to sign a release form before I get it. I haven't signed it yet and am still asking them questions. Apparently, they foresee lawsuit and litigation concerns as well.

We had to file Chapter 7 Bankruptcy with the advice of a foreclosure specialist and the attorney and lost our home.

I was trying to write Lisa on the issue of a class action suit against this company. She said to e-mail her at an e-mail address, but there is not one.

America's Servicing Company [ASC] Mortgage RipOff

I have been reading al these complaints about ASC and somehow I may be missing the fact that the Federal Government is doing something about them! Doesn't the SEC or FTC have something to do with this? How can they arrogantly behave in this manner?

These people have lied, stonewalled, and cheated me as well. I won't go into the details but they refused a payment, and strung me along on the remodification scam in order to collect $15, 000 in interest fees. Join Richatd's class action suit and let's kick their criminal [censor]. Wells Fargo uses them as a front to avoid the law.

They get away with it because they are not a mortgage company. They are a servicing company for investors. Therefore they don't have to play by the rules that a mortgage company has to. They are arrogant and very rude. They solicit post dated checks past the 5 day mark which is illegal per the FDCPA rules of debt collecting. But as you can see with all the complaints, they can do whatever they like.

America's Servicing Company [ASC] Loan modification denied!

My wife and i have fallen on rough times like many others in this current economy. She is unemployed and has been since May of "08" and i have been curtailed off and on from about the middle of july. We have fallen behind on our payments for a few months now and applied for a loan modification with a.s.c. only to be denied after a month of review due to our expences were too high! Yes we would refi. if we had better credit than what we have now to get away from this heartless company. Oh b.t.w. our first mortgage company has already approved our modification with them and were very greatful for accredited home lenders helping americans out such as my wife and i in a time of crisis due to the economy we are in today! The reality is companies that perform customer no service business practices that Americas servicing co. adheres to, and not willing to work with their customers somehow manage to avoid going bankrupt during these times, yet they will be more than happy to throw you, your contract, and your dream home under the bus so you can join the forclosure dilema! We are now refiling for another modification, like the previous request so we can simply put some of the past payments due now toward the end of the loan. In my opinion we not asking for a.s.c. to meet us more than half way, just the middle this one time only! I also would like to thank Aames home loan for selling our loan to this customer no service mafia!

ASC is a sad, sick, merceless company. The company is sub ### of Wells Fargo. Like father like son. ASC should bet shutdown. Report them to FTC, FBI, SEC & IRS.

ASC has/is doing so many illigeal things, Congress must invetigate ASC.

America's Servicing Company [ASC] Money Hungry Crooks

How could a company be allowed to scam hard working people out of their homes. They post payments late in order to charge late fees. We have been harrassed with foreclosure several times which forced us to file bankruptcy. With all the charges of late fee, we can't take out a second mortage to get a lower payment. They also say that they don't do refinancing. They bought our mortage from Chase without us knowing until the last minute. We have had problems with this company after the first month. Someone should really look into all the scams about this company. We are tryting everything we know how in order to get out from under them.

I am in my first home and my initial loan was with Equifirst. This company has to be the worst there is. Hurricane Gustav caused me to need a new roof. The check given by the insurance company was in my name and ASC. I sent it in and they sent it back for me to sign first. I was hesitant but I did. When I called they told me to send it in signed. I did. So when I call to see when I would get it, they said I didn't complete the contractors packet. I told them that no one told me about one. So I completed one and sent it back via fax. I faxed around three times and they kept saying that they didn't get it. So I faxed it again and sent a copy certified. When I called back they said that they received it and they would send a request for the check to be cut. A week later no check. I called back and they said they needed me to fax a paper in. So I faxed it today and I called and they said it would be 48 hours before the paperwork would be posted.
This company has to be the worse it shouldn't take all of this to get money that is not theirs. I am going to refinance as soon as I get the money back for my roof and try to find a company that doesn't sell their loans.

I asked ASC if I could skip a payment and make it up over 6 months. They said sure and then come to find out they where reporting that I was 30 and 60 days late to the credit bureau and destroyed my credit. They never told me about this and I found out 6 months later that this was happening when I went to buy a car. Nice mortgage firm! They then jacked up my interest rate and I went to refinance with someone else and no one will even look at me because of late payments that I acquired over the six months it took to repay the one month I skipped.

The real issue with this - is the fact that they are allowed to do this - if you make an alternate arrangement with a servicer - and you keep it - that agreement should be considered paid as agreed and on time. They should not be allowed to continue to drag your score down while you are doing what you were told. I do know they do it, because it also happened to me. I even completed my catch up early - and that counts for nothing - nothing else I had was late - but my scores are trashed because of the repayment plan. The system is messed up - 5 minutes to ruin your score - 7 years to repair it.

America's Servicing Company [ASC] Update on my lawsuit

In January 2008 Americas Servicing Company said they would refinance my $85, 000 first mortgage from a 10.625% ARM to a 6.200% fixed rate effective March 1, 2008 with my next payment scheduled for April 1, 2008, and they instructed me to make no further payments on my loan or they would withdraw their offer.

It is now the end of September, and I have made no payments since December 2007. Although Peoples Choice Home Loan made my loan and assigned ASC to service it soon thereafter, HSBC has filed a foreclosure action against me...however they admit to the court they have NO interest in my loan and have absolutely no paperwork regarding it. Meanwhile, ASC changed my loan payment schedule and increased my $825 payment to over $3, 200.

Based on their behavior, I rescinded my loan, the results of which is now there is NO security interest in my real estate any longer and therefore NO ONE may foreclose on my property, and I have filed a 17.15 million lawsuit against ASC and a host of banks for financial fraud and racketeering. I sued the lawfirm
that brought the foreclosure action, and the attorney assigned to defend them has asked me to make a settlement offer to them. The firm routinely files foreclosure actions in the name of institutions which have NO right to foreclose - commiting fraud upon the court/borrowers and violating State Bar Rules of Professional Conduct. I will probably soon ask for a default judgment against ASC ( which is Wells Fargo Bank ) since they have not answered my complaint against them. I have caught them red handed in acts of larceny...they make maybe $30-$40 a month for servicing my loan, and they have defrauded me to raise money for themselves...leaving the true investor in my loan without security or a right to foreclose, and now holding an unenforceable loan since no court can order me to make payments larger than the payments set forth in my loan agreement. My investor needs to sue ASC as well in my opinion.

I have a second mortgage Line of Credit with Bank of America, but even though I have made every payment on the due date by direct deposit, they added $625.oo in junk fees to my loan, and by doing so I have rescinded that loan as well and demanded return of all my payments, plus damages, as part of my 17.15 mil lawsuit...by law, there is no longer ANY loan against my home whatsoever, and these banking giants owe me substantial damages for the damages they have heaped upon me, which includes lowering my property value and the tax base by their widespread fraud.

The financial fraud going on in this country has brought the country to its knees.. EVERYONE being foreclosed on should CONTEST THE FORECLOSURE ACTION and sue for damages to make the lenders and investors prove they have a right to order the property sold in a quick cash desperation sale for way below market value and force them to negotiate an equitable resolution for everyone, as I believe there are probably NO mortgages in this country that do not have some degree of lender/investor/servicer/foreclosure agent and attorney non-compliance or outright fraud or misconduct that is actionable...I urge you to consult with several consumer defense attorneys to review your individual circumstances and options open to you and BECOME VERY AGGRESSIVE LEGALLY with servicers, lenders, and investors, as well as MERS - who hides the true parties involved and skirts paying fees to county recorders to make changes and assignments public record.

In my case, I believe a court will award me substantial recovery for the fraud I have been subjected to. If you or/and your attorney would like to speak with me, I welcome your calls...[protected].

ASC has agreed to not report any derogatory information on my credit report, which I ..and you..are entitled to under law. YOU MUST DISCOVER AND EXERCISE YOUR LEGAL RIGHTS..this is NO time to be passive and think there is nothing you can do. I believe ASC and Wells Fargo are engaged in criminal racketeering...if you think they have done wrongs to you, I want to know about it !..please call me.

What a bunch of crap. ASC would not ever have offered to refinance your loan. They are a loan servicing company an as such are not in a position to refinance. They are not a bsnk nor a lender and do not fund loans. At best they can offer a loan modification. Also, they would never suggest to stop making payments. The idea of continuing payments is to keep the current delinquency from escalating. Rescission of a loan is probably THE most difficult of proceedures to prove and be successful at. You have to prove fraud at the ORIGINATION level; not on a servicing issue and most important, even if your loan were rescinded, part of that process is that you have to repay thee lender EVERY DIME YOU WERE FUNDED TO PURCHASE THE HOME. Rescisson does not mean y0u are given your property lock stoci and barrel . I seriously doubt that someone who does not make their mortgage payments can afford to repay the lender the full amount of funds borrowed. Rescission basically means that the transaction never happened and both you and the lender are back at the beginning. Under the Fair Credit Reporting Act, a creditor is required to submit accurate activity for any creditor listed. There is no law that states they must report every month, but, it must be accurate. I seriously doubt ASC is not reporting. Should you be successful in whatever daydream you're engaged in, ASC would have to retroactively correct any inforation that inaccurately reflected the loan status.

So. Bottom line. I find nothing in your ranting that holds even a droplet of water. If you want to appear as if y0u know something, at least do your research properly and make your story at least SOUND plausible.

America's Servicing Company (ASC) (Wells Fargo letterhead )said they had a mortgage modification program with a 2-3% interest rate. They told us later on that they had other programs they could switch us to. It's the old classic bait and switch. We were current on our mortgage until ASC began the process. They had us lower the amount we were paying monthly, and sent us a letter stating that we were almost $3, 000 behind on our payments. Their company is set up to minipulate people that call in and ask for help in difficult times. They set up the program as if it's going to help the home owner, when in fact they are looking for ways to get us into a forclosure senario so that they can make money or count us as a loss on their taxes.

Hey,

Wow I just googled ASC for my parents because they are facing foreclore and I am SO much in shock by all these stories. My parents mortgage was $1200 monthly and since the past 4 months the mortgage have been almost $3000. They have called thousands of times since Frebruary 2008 because they knew that interest rate will go up.

They called ASC first and they were told to call Wells Fargo because there was nothing they could do. Then they called Wells Fargo and they said to call back ASC because they were the ones who had the loan. Then they called Fargo again and were told that they could refinance but they have to wait 45 days prior to interest rate changes in July.
They had us going back and forth.
They asked us to wait 45 days prior to changes of rate and send out all the documents Wells Fargo needed several times. (suposedely they never received NOTHING).
Finally, by the time they gave us results to be able to refinance they said there was nothing they could do. And the new rate kicked in.
Even though they asked us to wait 45 days prior, we kept calling and we were always told different stories.

The rate went up the roof and they just denied us any help! (they said they could and would but we had to wait).
KEEP IN MIND my parents would call twice a week since the month of February 2008 to get this resolved. We got different answer each time.

ASC and Wells Fargo kept saying that we had to call next week. EACH TIME. Call us back next week. Call us back next week. Call us back next week.

They send enormous amounts of letters requesting payments and to also call to discuss alternatives plans to help. ?
WE TRIED SINCE FEBRUARY 2008!
We are now October 2008 and this is not resolved.

Wells Fargo says they will foreclosure the house in 3 months.

America's Servicing Company [ASC] Their loan modification terms are worse than original loan

I lost my job and fell behind for a while. We did everything ASC asked of us, made all our payments so we could modify our loan. During this time, we received a letter stating ASC would freeze our interest rate to 7% because of the economy. We finally get our loan modification paperwork, and the interest rate is higher than our original fixed rate, plus our loan balance jumped 100k. In addition, we have a prepay for LIFE, have to ask their permission to SELL (not just short sale, we actually have a lot of equity), and our payment has increased by over $1, 000 a month. I asked how are you helping us? The rep said WE REPRESENT THE INVESTOR, not YOU. I asked how she could justify the increase? She (Erma) replied because you have an excess of $2, 000/month according to your financial statement so you can pay more. So basically, because ASC got ripped off by ARM debtors, it thinks it can screw us because we can actually afford our payments? I have contacted an attorney who told me he is representing 10 other clients with ASC and they are the worse and corrupt and it goes all the way to the top. He said I should save money and sue. He said ASC needs to be sued big time. This company ***.

My story is identical to yours except I told them to get lost. Here was their solution for me; I was currently in default at a mortgage payment of $5200 per month. I took the income / expense questionnaire with an ASC rep and she responded with a glorious rejoice, “You’re approved". I said perfect what are the new terms? She told me I needed to fund my escrow account with $10, 000 and my new payment would be ...get this...$7, 400 per month. I immediately replied with such a sarcastic tone, "Wow you guys over there at ASC are fabulous can you fax it to me right now so i can sign it and put this to bed." I'm unsure which part bothered me the most, was it the fact that she offered a homeowner currently in default an increase payment of $2, 200 per month and a capital contribution of $10K when obviously i couldn't afford a $5, 200 payment because I was already in default and if I had $10, 000 wouldn’t I be paying my mortgage with it? Or, was it the fact that she truly didn't get the sarcasm and responded like I really wanted to sign.
In short I have acquired in what equates to a 25-30 hour part time job. The horrible part is I’m not getting paid for it, I trying to save my house. I have been battling with ASC for over 1 year. I have documented everything because I want to pursue exactly what you are doing. What state is your attorney located in? I have been slowly putting together everything I need to legally pursue them between my fulltime job and my new part-time job dealing with them. I wish you the best of luck…ASC is absolutely the most unscrupulous and scandalous company I’ve ever dealt with.

America's Servicing Company [ASC] Fraud

Americas servicing Company (ASC) lost two of my mortgage payment checks AFTER CASHING THEM and claimed for months that I did not make the payments even though my bank sent them copies of the checks showing them paid. ASC threatened to foreclose unless I accepted a forebearance agreement and paid those same checks again. I accepted and paid the agreement off several months early. They are still claiming that they were not paid on the original two checks. I complained to the Texas Attorney General and filed criminal charges against them. I won and got some money back. Now ASC hates me! Yeah for me!

ASC then deposited into my bank account three payments without my knowledge or concent and is attemptin to foreclose based on me now being three payments behind. They have refused to take thier money back. This is bank wire fraud according to my bank manager. I will again file criminal charges against them this week.

I asked ASC over the phone to point out where on my note it allowed them to do this. I was told that notes are complicated and that I would not understand it even if they pointed it out to me. I explained to them that I am a mortgage banker and an expert in notes so go ahead and point it out. They promptly hung up. They are nothing but an organized crime racket.

The Texas Attorney General wants all information on this company! Those of you in Texas start documenting everthing, especially ASC's illegal activity regarding thier 'drive-by fee' if you are late. ASC was ordered by the Texas Attorney General to cease and desist collecting this fee and to return it to Texas customers. Document everything. This company must be put out of business and it's corporate officers must go to jail!

People in other states: Check with your Attorney General. 37 of 50 state Attorney Generals have criminal investigations currently underway against ASC. Get involved and help your AG by documenting everything and offer evidence to your AG against ASC! Take these scums to the mat!

Lets get a class action lawsuit going! This company breaks every law that there is and must be stopped. A multi-million dollar lawsuit ought to get thier attention.

Anybody have a lawyer already doing this?

Americas servicing Company is wholly owned by Wells Fargo. Stop doing business with Wells Fargo and make them feel the pain. Wells Fargo goes to great lengths to hide it's 100% ownership of this criminal cash-cow company.

Make Wells Fargo pay!

Close your Wells Fargo bank accounts. Payoff Wells Fargo credit cards with other cards and close the Wells fargo account. Refinance away from them if you have a mortgage with them. Do not apply at Wells fargo for any credit and do not do anykind of business with them. Do anything and everything to put Wells fargo out of business.

The blame for the endless crimes committed by ASC rests squarely, and knowingly on Wells Fargo's shoulders. Let them know that you know.

In May of 2000 Americas Servicing Company was to have paid off my mortgage loan from Washington Mutual for me. I have just recently learned this past April 2008, through looking at a copy of my credit report, that the Washington Mutual Loan was not paid off as promised by Americas Servicing Company and Washington Mutual now has a court claim against me for the outstanding balance of the loan. I have made an effort to contact Americas Servicing Company at the bogus address listed on my credit report and I was unable to locate the company in all of my searches on the internet.

They did foreclose on our house, and we were completely blindsided by the whole ordeal. We had moved to East Texas, but were still making payments on the home with the mortgage through ASC. They 'lost' checks (Jan, Feb, March) that we never knew about being lost because the funds were withdrawn from our account and we received no collection calls...we kept paying the mortgage as usual. Then whammy...a foreclosure notice in the mail. The shock of our lives. This was the middle of June. Our house was going to be foreclosed on August 5 of '08 if we didn't cough up $14K. We are both educators and have four kids. We don't have that kind of money floating around. They did not care about our bank records. They said we must have sent the checks to the wrong department or the wrong address and someone else must have cashed them. But they were not credited to our account. No sympathy. We lost our house and $40K of equity because they reported 'foreclosure proceedings started' on our credit report, no bank would touch us to help us.

I was also charged a "drive-by " fee. When I questioned what that was, no one would answer. I live in Delaware and I will be contacting AG Monday morning. We have had to deal with ASC for over 4 years and it has been a battle since day one when our mortgage was sold to them. I NEVER would have given them my business. They lose payments, misapproriate funds, charge fees that are not documented. We now record every phone call and tell them we are taping the calls. When they lose a payment I call and tell them we Western Union'd the payment and the day and time. When they say they never received it I play the recording of the CS person who we called to confirm & that they had the payment ON TIME. They usually stop talking and apologize and hang up. The next's month's statement reflects where they have refunded the late charges. Don't let them get away with anything.

I absolutely agree with you. They did the same thing to me. There should be a class action suit against them. I am willing to join it. They should be shut down. Would it help to forward all these complaints to the morgage companies they represent?

I agree with everyone on this comment board and I am so sorry to hear about all the trouble that you are all having. This is the reason I started my company. I have helped several people that have mortgages with ASC, Countrywide, and other mortgage companies that don't seem to care if they harass people or suck them dry. The comments I have heard are along the lines of trying to get blood from a stone or turnip, or something like that.

Contrary to what some people have said on here, I am not trying to be one of those people I mentioned above. My company is a nationwide company that provides services for people that are at the end of their rope. One of the helpful things that we provide is letting you know, before payment for service, if we can assist you and if we can not. If we can not, we tell you why not and what can be done to allow our company to assist you. Most companies won't do that, but we will also give you the reasons why exactly so that, if you should choose a different service, they will not be able to scam you. Now that's a way of saving money too.

I have a service that actually will take you out of the loop of contact with ASC, or Countrywide or whomever you have servicing your loan. All you have to do is tell me how we can help you. By that I mean, tell us what you are looking for us to do for you and we will pursue the help that you want, no matter what. We have all aspects of the mortgage business covered from being a mortgage mediation company, a title company, a real estate company, all the way to having access to attorneys for litigation or help to avoid foreclosure. No aspect of help is turned away.

Let me tell you, most of the customers that I deal with have told me about the fear and the frustration of working with mortgage companies that don't seem to care or give them the runaround. To be totally fair, mortgage companies have their ways of dealing with people. Some are good, some are horrible. But one thing all mortgage companies love is being vague. When they are vague, they don't have to give you information until you ASK for it. How does that help you? How can you try to save your home if you don't know how to ask the right questions?

That’s another reason why I created this company. I take your number out of their "system". When they mail you something, it goes to me. I take the burden away from you so you can live your life without the phone calls and the letters. And the rudeness! Oh, man, if I told you some of the stories I have heard...let's just say, it’s not pretty.

I know that some people are going to look at this comment and go, this guy is trying to drum up business. Well, you're right. But here's the kicker. I used to work in mortgage collections. I used to make the phone calls and send the letters. I used to work around the people that make your lives hell. And I kept asking myself, why? Why are these people not being told about the help that’s readily available? Why are these people not being helped to make payment arrangements that are realistic? Why does this company care more about the money than about customer service when that is supposed to be their primary objective?

That's why I got out. I can not stand collections. Just because they are hiding behind a company name they think that they can say anything or act anyway they like with the customers, being friendly with one and the next 40-50 they can treat like crap. Where is the customer service?

I take all that frustration away from you and create solutions that work. I know that it may be hard to swallow, but I do. I have done it for several people. And I can do it for you too. America's Servicing Company [ASC] loan servicing

after reading these and other complaints on related websites, I can say that none of you understand the commitment you made when you borrowed the money to purchase your home. you are all under the belief that the loan servicing company and/or mortgage lender is required to accept late payments and provide you with options to bring your loan current through payment plans and loan modifications. you need to sit down and read the terms and conditions of your deed of trust. an escrow account can be established if you do not respond to the servicer when they ask for proof of tax payments made or current hazard insurance. they are required by the deed of trust to ensure the integrity of the property. you need to remember, until you make that last payment on the note, you do not own the property. the lender has a right to protect their interest. also, if you are being serviced by ASC, it's because you are considered a high risk, subprime borrower. your credit scores are in the high 500s to low 600s. this is considered poor credit. the bank or lender has every right to protect themselves from default by charging higher interest rates because you have proven in the past that you will default on your obligations. your note states your payments are due (usually) on the 1st day of the month. there is no grace period (again, read your documents) on a mortgage payment. technically, you are in default on the 2nd day of each month if you have not made your payment. the servicer is not required to accept short payments, interest payments, payments of principle and interest if you have an escrow account. you agreed to the terms of the contract when you wanted funding for your home; but once it became inconvenient to make your payments, you start blaming your servicer for all your troubles. I will agree that any large corporation can and does make mistakes, but certainly not at the level these complaints would have you believe. read these complaints, these people admit they are in default, admit they missed payments and admit they wanted ASC to fix their problems. banks do not want your house. it costs more to foreclosure on a property and have to refurbish it and make all payments for taxes and insurance and maintenance while waiting for the property to sell. the bank makes its money when people perform their loans. that is what the interest is for. I'm sure the majority of you chose to take vacations or buy Christmas presents rather than make your mortgage payments on time. or you lost your jobs and expect the servicer to feel sorry for you. banks are not charitable organizations, they're not your mother. if you can't continue to afford your home, sell it or work two jobs or whatever you have to do to satisfy your obligation. stop whining and grow up. and by the way, ASC is a 'doing business as' of Wells Fargo. Wells Fargo did not purchase ASC; ASC is not a division of Wells Fargo; ASC services all subprime loans, not just Wells Fargo originated loans. if you're going to whine and complain about a company, you should at least know what you're talking about.

I agree with Irate In Florida…Sam just hasn’t been there, obviously has not had to deal with ASC like most of the rest who have complained here. However, I DO agree with Sam’s basic statements that we all made commitments so we could have a home. What Sam doesn’t understand, since he apparently hasn’t had to deal with these idiots, is they operate on a left-hand/right-hand basis—that is the left hand doesn’t seem to know what the right hand is doing and THIS is why many of us have had so many of the same and similar problems with ASC. Low credit scores non-withstanding, these people DO seem to be out to take advantage of whomever they can and do so in whatever way they can. Here’s our story…

We bought our house in December, 2003. Admittedly, our credit was not quite IN the toilet, but circling the bowl after the events of 9/11 trickled down and caused me to be laid off my job of over 20 years. Our mortgage was sold twice within the first two years, probably because of TWO late payments—late, but only by a couple of weeks, never over the 30 days that gets you in REAL trouble. We ended up on the rolls of ASC and an A.R.M. We chugged away at the payments making them on time with only a couple that actually incurred a late charge over 4 years. Then, we were notified that our payment was going up again, this time with a monthly payment scheduled to be over $1000/month on a 50-something year old house and at a time when the economy was beginning to nose-dive. Our September 2008 monthly statement from ASC included a paragraph toting their “Loan Modification Program” that MAY allow us to get on a fixed rate and invited us to call the toll-free number to get started. We did. We sent in the reams of paperwork confirming income, bills, etc. and waited for over a month. No reply from ASC. Finally, I called and asked what the status was and was told we were being denied since we didn’t seem to be “in trouble” having NOT been over 30 days late since day one. I asked the customer non-service representative if we had been late once or twice would it have made a difference. She told me they only made modifications for those who were “in trouble”. The inference from this is that if we had missed a payment or two, we might be approved for a loan modification—so I asked her this point blank, “If we had missed a payment or two, we may have been approved?” She replied that yes, this was true. So…we “missed” two payments and reapplied for a loan modification. And we were approved! We entered into a forbearance agreement wherein we made three payments at the NEW rate for our FIXED rate loan, and the new modified loan would then go into affect when the fourth payment was due, all past due amounts rolled in and we would happily be on our way with a decent house payment, amen. Only….no one from ASC called when it was time to let us know what happens next. So, I called them. I was told our modification was in “final review” and they were so busy with all the modification requests they were “a little behind”. But don’t worry! We were under a loan modification program and nothing would happen as long as it was still under review and no, you don’t have to make additional payments, foreclosure would not begin unless we were denied the modification. We followed these guidelines, provided by ASC’s representatives, for three more months. I called about every two weeks to find out the status and was told, “it’s still under review”...then we spotted a guy stopped in front of our house taking pictures of it. When asked, he stated he had been contracted by ASC to take pictures prior to foreclosure proceedings… Numerous calls to ASC resulted in the same old song, “No, foreclosure will not take place unless you are denied the modification” and we had faith in that statement until we received a letter from their attorneys stating that foreclosure had begun—all the while being continuously reassured by ASC’s reps that foreclosure would NOT start and oh…the modification was still under review. So…we filed for Chapter 13 (bankruptcy) protection. Now, ASC has sent us TWO more forbearance agreements, both with payments HIGHER than the original agreement and apparently won’t take NO for an answer. The “original” agreement seems to have been a figment of our imagination (although I DO have a copy of it). Their claim on our bankruptcy is highly inflated and they just keep saying it’s right…even though their OWN records indicate they never credited us with at least one of the three payments made in early 2009 under the original agreement. We’re still fighting them…one day at a time. Does anyone know a good attorney that will fight “the good fight” against the kind of unfair trade practices these people perpetuate? I agree with all on here who say these imbeciles don’t deserve the name “America” in their title. Can you say, “Class Action Suit”?

I am dealing with ASC with a loan that was sold to them a year after I closed. My credit score is above 700 and I have never made a late payment. They tried that escrow crap with me and the taxes. Fortunately, I pay once a year and had my receipt to send to them. It took them a long time to respond but it ended up that they saw it my way. I believe they do it to make money. They sent me a letter stating they received info that my property taxes were past due. If they had taken the time to look on the county page or contact the county they would have known this to be a lie. I know they made this up.

While I agree that when you take out a loan, you have made a promise to pay. I also understand that it is not the servicers obligation to help me when I have come into a financial hardship. What I do take issue with is when a person has had an illness and a divorce and calls the company in good faith to attempt to see what can be done so that they can fulful their obligation to the mortgager, they are treated and spoken to as if they are somehow a 2nd class citizen. I have had positions in collections for years and there is a way to collect a debt without having to speak to a person as if they were trash. Yes, it is ultimately the individuals obligation to pay a debt, but we are all human and have situations happen that we can not avoid. You speak as if having a "sub prime" credit rating is who you are as a person. The only reason for these "ratings" is for creditors to take advantage of people who have had difficulties by charging them more. Maybe if the opposite happened and people who actually needed the better interest rates were given them, there wouldn't be so many people in this situation. My husband is a police officer and I work in a school system. My husband risks his life everyday for people, but his paycheck doesn't reflect the sacrifice he and others make. they have cut all overtime pay and there will be no raises. so no, we don't go on fancy vacations and my kids don't have the best of everything. we are honest, hardworking people who have been put in a situation where our mortgage literally doubled and our income went down. and yes, we are working "extra" jobs to help make ends meet. So don't just assume because someone has a "subprime" loan that we are deadbeat, trash who just want someone else to foot the bill for us. We mostly are honest, hardworking individuals who want to do the right thing, but with a company such as ASC, you don't have a chance. I recently decided to let them take my house and suddenly, after MONTHS of trying to get them to work with me, out of the blue, they sent me a modification agreement which was still ridiculously high. Had they allowed me to do this 6 months ago, I'd still be able to be in my house and they wouldn't be stuck with a house worth half of what the mortgage is worth.

Sam, you should be more familiar with what you are talking about. Read more posts from others about there credit. I have ASC and have never been late on a payment of any kind, my mortgage was sold a few months after closing. My credit and my wife's is over 700 so no problem there. I don't have an ARM, just a 30 year fixed. I have had the same problem with my escrow account and never put things together until now and will be looking at the last two years worth of statements comparing my taxes and what I put in. It sounds like I may have been a victim on that as well.

Also, Sam, there are two keys on the keyboard, one on either side called the shift key. Make a note of it and check them out. Your English teachers would be much happier if you did.

You sir are one pitiful pathetic piece of S'''t. ASC is not even a real company. And you think that putting someone on escrow when they've already made their insurance and tax payment arrangements is ethical...this is the kind of bulls''t this company is known for...it's not just foreclosures...it's just one headache after another. And you think that people with a certain level of credit score deserve to be treated like that. You sir know very little about REAL economics/real life situations. I don't see anywhere close in the number of complaints with any other mortgager. There's even a legal firm that specializes in dealing with ASC...that should tell you something.

I agree with you totally. When rates began to change on arm loans, it was all ASC's fault! The people didn't read their notes that said when the rates would change and how the change would be figured, so of course in their minds, ASC was wrong to change the rates. I think it is a sad state when people are no longer responsible for what they agreed to. They just complain and blame instead of doing what they agreed to and paying their loans.

America's Servicing Company [ASC] The worst mortgage company ever

I have resolved my problems with ASC, although they should still be shot for their fraudulent practices. Right after they purchased my loan, my check that I mailed on time was not credited until after the late payment day. Then, they increased my mortgage payment by $700 per month for an escrow shortage of $900! I reported them to the FTC, to no avail, but somehow I paid the extra $700 until I could convince them that I was serious about suing, and I now pay ALWAYS through the online banking from my bank so they can never hold my check again! This company has no integrity and they are ###, oh, and their customer service people are rude and STUPID!

America's Servicing Company [ASC] Now suing them for 7 million

I refinanced my principal residence in 2004 with Peoples Choice Home Loan, Inc, who promptly turned the servicing over to America's Servicing Company, a division of Wells Fargo Bank. In January 2008, I contacted ASC and requested a loan modification refinance. On January 31, 2008 I was approved. I was to have my $85, 500 ARM rewritten to a 6.2% 30 year fixed starting March 1, 2008, with no payments for January, February and March - until my first payment April 1, 2008, with the interest for the 3 months without payments added to the loan balance.

Now it is the end of June, they have supplied no loan documents, and their attorney (who was supposed to handle the closing on the new loan) now having filed a foreclosure action on behalf of HSBC which has NOTHING to do with my loan, and ASC has added nearly seven thousand dollars to the balance of my old loan!

I have rescinded the loan and declared it void and unenforceable, and sued for over 7 million for the racketeering these people are engaging in. I welcome anyone with problems with ASC to contact me and possibly join my lawsuit and seek recovery and damages for their unconscionable fraudulent conduct. I will be glad to furnish you a copy of my lawsuit. I have been in the mortgage business since 1965 and know what they have done wrong and what the remedies are.

Their conduct is an outrage and everyone should seek to recover the injury they have done to you.

Oh my god. You are stupid. If u r in the mortgage business no wonder why the industry is in such a crisis. It is because of idiots like you that think u know everything. There is no such thing as a loan modification refinance. A loan mod and a refi a 2 different things. The reason why they added seven grand to ur balance was because u were delinquent. I'm sure you got the billing statements asking for the pmts but you just ignored those didn't u.

I agree with everyone on this comment board and I am so sorry to hear about all the trouble that you are all having. This is the reason I started my company. I have helped several people that have mortgages with ASC, Countrywide, and other mortgage companies that don't seem to care if they harass people or suck them dry. The comments I have heard are along the lines of trying to get blood from a stone or turnip, or something like that.

Contrary to what some people have said on here, I am not trying to be one of those people I mentioned above. My company is a nationwide company that provides services for people that are at the end of their rope. One of the helpful things that we provide is letting you know, before payment for service, if we can assist you and if we can not. If we can not, we tell you why not and what can be done to allow our company to assist you. Most companies won't do that, but we will also give you the reasons why exactly so that, if you should choose a different service, they will not be able to scam you. Now that's a way of saving money too.

I have a service that actually will take you out of the loop of contact with ASC, or Countrywide or whomever you have servicing your loan. All you have to do is tell me how we can help you. By that I mean, tell us what you are looking for us to do for you and we will pursue the help that you want, no matter what. We have all aspects of the mortgage business covered from being a mortgage mediation company, a title company, a real estate company, all the way to having access to attorneys for litigation or help to avoid foreclosure. No aspect of help is turned away.

Let me tell you, most of the customers that I deal with have told me about the fear and the frustration of working with mortgage companies that don't seem to care or give them the runaround. To be totally fair, mortgage companies have their ways of dealing with people. Some are good, some are horrible. But one thing all mortgage companies love is being vague. When they are vague, they don't have to give you information until you ASK for it. How does that help you? How can you try to save your home if you don't know how to ask the right questions?

That’s another reason why I created this company. I take your number out of their "system". When they mail you something, it goes to me. I take the burden away from you so you can live your life without the phone calls and the letters. And the rudeness! America's Servicing Company [ASC] No one to contact re: foreclosure

We have been trying to get someone to talk to us regarding getting our mortgage back on track after they TRIPLED our payments with the adjustable rate mortgage - more than my husband and I even make each month! I have ONE contact who pretty much lies to me every time I talk to her, claims she's working on something for us and then never calls us back.
The last time I asked her, she said that it wasn't possible for them to bring our 260K mortgage payments down below the 2800 a month it is at. I work for a bank and had a mortgage analyst do a amortization for us... she said that means they are are looking a rate of about 10% - way to work with consumers! What do they think we are stupid?

AND in answer to the collections rep for ASC saying that all mortgages with them are for Horrible Credit?!... not so, we had a 680 score when we were financed with Option One... we got sold to ASC about a year later... nothing but problems since then... all of the above complaints are early familiar!

America's Servicing Company [ASC] Beware

I used to work for ASC (Wells Fargo) in the Loss Mit department. I worked for them for about 8 months. In that time I watched and heard many stories of how people are losing their homes. In all honesty most of the time the people that you are talking to don't care if you lose your home or not. Most of the time the phone reps are making fun of the caller or calling them names under their voice. People with asc loans lose their house because the company itself could care less about the people they claim to be serving. The company itself is nothing more than a front for Wells Fargo, the call centres and offices are all in Wells Fargo buildings and the people work for WF and are paid by WF. Another thing about the company is how badly organized it is. You can talk to one person an hour and get a totally different story than the last one told you. So all in all if you have a mortgage with ASC best of luck to you, you will need it more than ever before.

This is exactly the experience I have had, except I do not think ASC is guilty of bad management, I think they are doing their "we don't know what we're doing" act to frustrate and vexate people into giving up !

It's not an accident. It's a deliberate FRAUD in my book. One person tells you one thing, another something different, and NOTHINGS in writing. Well my lawsuit is in writing...Heinrich vs. America's Servicing Company, Wells Fargo et. al., and a number of other related institutions, (Broward Circuit Court, Ft Lauderdale Florida) in which I have alleged they are engaging in racketeering and theft by endeavor..and suing for 17.1 million for the damage they have done to me.

I would LOVE to hear from past or even present employees, as well as the rest of you that have run into one of their scams.

I got caught in their " sure we'll switch your ARM to a fixed" routine where they told me I had to STOP MAKING PAYMENTS UNTIL THEY SET MY NEW FIRST PAYMENT on my 6.200% fixed rate loan, which never got done, then they filed a bogus foreclosure against me and UNILATERALLY CHANGED THE TERMS OF MY EXISTING LOAN, eliminating my grace period and placing two huge balloon payments on my loan for July 2008 and September 2008.

Well, guess what, they voided my loan and made it unenforceable by what they did, NOW I'm trying to find who actually OWNS my loan...so far four different competing companies have claimed ownership, so one of my Causes of Action is to Quiet Title...it appears the company that owns my loan is bankrupt !

Anyway, my case goes like this...my home is worth about $220, 000 and I owe about $85, 000. They are trying to foreclose in the name of a company that has NO ownership rights in my loan and post a bond to indemnify whoever else makes claim for the money later, so this "non-party" gets my property FREE and CLEAR, and the real owner of the loan collects their $85, 000 from the surety company...I meanwhile am out on the street owing them the $85, 000 in the form of a "deficiency judgment".

Why would they do this ?..massive losses make them desperate to raise money any way they can, even by sophisticated scams like the one they tried to pull on me...except I'm in the industry too, and know where the smoking guns are.

While I have to prove all this in court, my case could be a basis for you to take them to task for their Bad Faith games, and hopefully wind up with criminal prosecutions...because I believe they are committing criminal acts of fraud and theft.

I believe a LOT of people may be entitled to have their foreclosures stopped in its tracks, or even have their foreclosed property returned to them and collect other damages as well. YOU WILL NOT ACCOMPLISH THIS BY BEING PASSIVE - which they count on !

I have helped several people that have mortgages with ASC, Countrywide, and other mortgage companies that don't seem to care if they harass people or suck them dry. The comments I have heard are along the lines of trying to get blood from a stone or turnip, or something like that.

Contrary to what some people have said on here, I am not trying to be one of those people I mentioned above. My company is a nationwide company that provides services for people that are at the end of their rope. One of the helpful things that we provide is letting you know, before payment for service, if we can assist you and if we can not. If we can not, we tell you why not and what can be done to allow our company to assist you. Most companies won't do that, but we will also give you the reasons why exactly so that, if you should choose a different service, they will not be able to scam you. Now that's a way of saving money too.

I have a service that actually will take you out of the loop of contact with ASC, or Countrywide or whomever you have servicing your loan. All you have to do is tell me how we can help you. By that I mean, tell us what you are looking for us to do for you and we will pursue the help that you want, no matter what. We have all aspects of the mortgage business covered from being a mortgage mediation company, a title company, a real estate company, all the way to having access to attorneys for litigation or help to avoid foreclosure. No aspect of help is turned away.

Let me tell you, most of the customers that I deal with have told me about the fear and the frustration of working with mortgage companies that don't seem to care or give them the runaround. To be totally fair, mortgage companies have their ways of dealing with people. Some are good, some are horrible. But one thing all mortgage companies love is being vague. When they are vague, they don't have to give you information until you ASK for it. How does that help you? How can you try to save your home if you don't know how to ask the right questions?

That’s another reason why I created this company. I take your number out of their "system". When they mail you something, it goes to me. I take the burden away from you so you can live your life without the phone calls and the letters. And the rudeness! Oh, man, if I told you some of the stories I have heard...let's just say, it’s not pretty.

I know that some people are going to look at this comment and go, this guy is trying to drum up business. Well, you're right. But here's the kicker. I used to work in mortgage collections. I used to make the phone calls and send the letters. I used to work around the people that make your lives hell. And I kept asking myself, why? Why are these people not being told about the help that’s readily available? Why are these people not being helped to make payment arrangements that are realistic? Why does this company care more about the money than about customer service when that is supposed to be their primary objective?

That's why I got out. I can not stand collections. Just because they are hiding behind a company name they think that they can say anything or act anyway they like with the customers, being friendly with one and the next 40-50 they can treat like crap. Where is the customer service?

I take all that frustration away from you and create solutions that work. I know that it may be hard to swallow, but I do. I have done it for several people. And I can do it for you too. I AGREE TOTALLY, IHAD TO RETAIN A REAL ESTATE ATTORNEY TO HANDLE ASC, THE CUSTOMER SERVICE DEPARTMENT IS UNORGANIZED/UNPROFESSIONAL WAS UNABLE TO ANSWER QUESTIONS PERTAINING TO MY PHONE CALL. WE NEED TO GET A CLASS ACTION SUIT GOING ON THEM.

I just want to say that the mortgage company has to send you an act91 before foreclosure and after default. Find out about it from any government mortgage fha or other agency to see if they are doing illeagle business. Act 91 is all over the internet just google act 91. I am in default now and started working with the councellor to file for the loan help. The mortgage companys are obligated to send Act91 to the borrower after 60days default, and you only have 30 days after to go to one of the addresses listed in the list included with the Act91 packet.

America's Servicing Company [ASC] Who owns my loan

Shortly after my loan was made to me in 2004 by People's Choice Home Loan, the transferring of my servicing was made to Americas Servicing Company.

They have a pattern and practice of forcing you into paying them extra fees, by either posting your payments late or charging you to make your payment electronically. I WANT MY MONEY BACK, and so should you.

MERS, the Mortgage Electronic Registration Systems, Inc., a company founded in co-operation with major lenders to electronically change ownership of your loan in an instant, is my Mortgagee (owner) of my loan and holds legal title to all interests in the mortgage.

I called ASC in January 08 and asked for a modification, as I was probably going to miss several payments do to a period without the same income I had been making, and was told "You have to be 30 days late before we will consider a modification, but you meet the requirements of modifying your loan." I had a perfect payment history and asked if they would erase any 30 day late on my credit report and I was told they can do that.

In February they told me I was approved for converting my ARM to a 6.2% 30 year fixed, they just needed two pieces of documentation, one of which I sent to them immediately, the other took me several weeks to obtain and send to them.

My rate at 6.2% was to start March 1st, and my payments start April 1st.

I waited and waited and finally the first week on April they told me I had been DECLINED on March 24th and put into active foreclosure on March 30th.

In our state we use judicial foreclosure thank goodness so this can go into major litigation without it as much as costing me a penny and that is where we are now, with some unknown loan company claiming they own the loan, MERS saying they do and ASC is servicing it. Meanwhile People's Choice is out of business and WHO KNOWS where my original note and mortgage are or who really owns it...SO I'm asking the court that in the event no one produces the originals within five years, all payments are returned to me and the security interest be re-leased... Although I have now rescinded this loan for failure to supply ANY disclosures required by law (ASC will only do things verbally - in defiance of federal law that says they MUST respond IN WRITING within 30 days).

My damages include the loss of my credit standing and future lost income and standard of living. MANY times more than the amount of my mortgage.

Through these intentionally Unfair and Deceptive Practices I have suffered a huge injury, and I expect in the end I will get an award sufficient to more than payoff my first with Peoples Choice and a Line of Credit I took out in an amount about equal to my first and to compensate me for the Bad Faith they undertake in oppressing people and the shocking things they have done...the lawyer wont even talk to me because I have filed complaints against them for violating state bar rules for filing a foreclosure action using fraudulent allegations.

You only stand a chance if you AGGRESSIVELY stand up to them and hold them AS accountable as they hold YOU accountable.

ASC is an alter ego of Wells Fargo, to do the things they don’t want Wells Fargo's reputation to suffer for, but the people and offices and phone lines are Wells Fargo

Has anyone considered class action against ASC. Are there 5 others in Missouri that have suffered from the actions and activities of ASC. I am not an attorney, but suffered to and feel that I have been scammed for legal and late fees. I can think of no other way, than class action to bring attention to this problem.

America's Servicing Company [ASC] They ruined my credit

ASC has had me fax paperwork 3 times for a short sale, and almost 2 months later, we still don't have any information. I can call every 15 minutes, and get a different answer every time.

Before this, I applied for a modification. One representative told me we made too much money, and the next time, a different representative told us we didn't make enough money.

I know we put ourselves in the situation that we are in with the ARM, but that is still no excuse for them not to do their jobs. We are hearing all over the news about how mortgage companies are going out of their way to help consumers and keep people out of foreclosure. Apparently, that doesn't apply to them.

America's Servicing Company [ASC] Americas Servicing Company (complaint)

I've submitted to this board before. I want to let you all know something that is riveting. I was too going to get away from ASC so I started a re-fi. Trouble was they had my credit so screwed up that I was getting taken by this new finance broker called: TopDot Mortgage a division of Premium Capital Funding LLC). Well they were totally trying to take advantage from me by ripping me off on this re-fi for rolling in $18, 000 into my mortgage with would have left me with hardly any equity in my home. They lied to me twice, I bounced the offer and they came back with a offer that was $4, 000.00 lower than the first one and then lied to me again. So I decided to call ASC and have a talk with them. I actually got a human on the phone who was very very nice, her name was Tammy I believe. Anyway, I started mentioning to her that I was planning on a re-fi and asked should I call Wells Fargo their parent. She said, sure you should, so she gave the number to their loan division. I called them and got this great person named (Christopher) who I explained my situations, re-fi woes and disasters in dealing with ASC in general and how they tried to take my home 2 years ago this June and he was very sympathedic to all. He asked me for my original loan numbers with ASC, looked at my history and within 1 1/2 hours called me back and approved me for a re-fi (recast) of my loan directly with them, with all my Taxes, Insurance etc.. rolled in. And it was only going to cost me less than a percent to do this deal with them. The weight was off my shoulders I tell you!
I'm awaiting my new loan docs and paid them in advance for the home inspection which someone is to call me this week. I'll keep you all posted on the outcome of this. But do yourself a favor and call Wells Fargo directly and put yourself behind in dealing with ASC for ever more. I can't believe I didn't think of this sooner. Wells Fargo knows there are issues with ASC being the servicing company to some loans out there. From what I'm hearing Wells is going to be done with that division soon. I hope for all of you that is true.

America's Servicing Company [ASC] Collection practices/procedures

Attempting to catch up on mortgage. Payments fell behind when I lost my job. Made payment 3/24/08. They applied it to my account, the cut a check dated 4/3/08 and sent it back. I then fedexed 2 payments, one on 4/9/08 and one on 4/16/08 totalling over $2, 400.00 Called and called, was told they would note my account. Finally spoke to someone on 4/21 who said I was in foreclosure, they were going to send my 2 checks back, I was on a "short sale" list. Never served with paperwork for foreclosure, never sent certified mail. Am attempting to get mortgage reinstated with some type of repayment plan. Sending them multiple documents twice, calling. Seem to be getting the run around. They are trying to push me towards the short sale. Advised I do not want that - I want my mortgage reinstated. Turning me over to a negotiator but, after doing some research, am finding out that their neogiation process is a scam, they tell you to wait a couple months and they'll work on it. Also, I worked wiith a woman who went through this exact same. They never called her after telling her that he account was with a negotiator and they were going to foreclose.
They will not accept any payments from me and I don't want a short sale or a forecosure - I'm working very hard to catch up. They need to be stopped from stealing people's homes right out from under them. They are crooks.

Im going through the same thing they have lost 3 payments applied money to another account and the list goes on now im in foreclosure every one ther has a different story hell why not file bankrupt?

America's Servicing Company [ASC] Home Mortgage Loan

My home loan was sold to America's Servicing Company (ASC) about 2 years ago. From day one I have had nothing but problems with them. It all started 3 months after they took over my loan... they changed my escrow amount and did not notify me, when I was making my payments they were about 30.00 short every month. Because they typed in my phone number wrong, they were calling a phone number I used to have 18 years ago. Anyway, they were holding my payment in suspension untill they got the next payment, they would take part of the second payment and apply it to the first payment, after a few months they would take what was left charge late fee's and then put it to principal without contacting me. What this did, every 3 months it would make me fall behind by 30 days. Once it hit my credit I contacted them (since they never contacted me), to find out what was going on. Bottom line they blamed me and refuse to remove the mark from my credit. Less then 30 days after this mess started, the adjusted my rate to 10% from my 5.7% rate. So I contacted them again and they offered me the possability to lock in a 30 year rate, but I needed to give them personal financial information. After playing cat and mouse with them for 6 weeks (giving them the same information 4 times), the sent me a letter saying "It is not in our best interest to lower your rate at this time." WTF! I cannot refinance because they hurt my credit score... so I am being forced to put my home on the market so that I do not have to forclose on it. They have completly done everything wrong to me... and have no desire to help me in any way shape or form. :-(

I hope that something is done about this horrible company soon!

America's Servicing Company [ASC] class action lawsuit due to fraud

Due to serious neglegence on the part of america's service company (hereby refered to as asc) I am preparing to file a lawsuit based on the following facts.

1. Fraudulant notorization of mortgage signature. I was informed that because my wife was 2000 miles away at time of signing I should sign her name and they would get it notorized and it was totally legal.in fact this is concidered a fraudulant act by the state on michigan thereby null and voiding legal contract. This fraudulent act has been just found out and will be forwarded to the michigan attorney general.

2. Failure to pay insurance out of escrow and getting mine cancelled after 2 months of phone calls. Then placing their own in and charging me $800.00 for it. Per my mortgage escrow shall be in place to provide funds for taxes and insurance. Another fraudulent act per mortgage agreement

3. Provided false apr information. Was told that I would have a 7.5% and got stuck with a 9.6% rate. Also I was suppose to be in a frm and was put into an arm. Fraudulently showing one intrest rate on initial proposal and installing a higher one on the actual mortgage note. Was not shown at closing just told to initial everything.

4. Mortgage broker informed at signing not to worry about anything that we would be refinanced in 12-18 months. Completely untrue. Your ability to refinance is completely up to the lender not the broker.

These are just a few of the many documented fraudulant practices they have done to my family. We have tried three times to get refi'd only to have huge fee's involved to do it. $15000.00 by countrywide, well fargo sent paperwork recieved no answer. (wonder why?) last company refused till we were in the home for two years.

I am looking for anyone with proof of negligence to join us and bring this to a class action level. I feel that it is time to take a stand against the practices of this company and their parent company.

Bought my house in 2005, lost my job in 2007, I too thought I was getting a fixed rate. got an arm. Tried to refinance, short sell, anything. No one would work with me. Lost my home in a matter of a few months. Tried to talk to the realty company that sold me the house; they would not even talk to me. I wish I had known what to do back then, but I do wish all of you success. Wrong place at wrong time.

I was given a loan modification by asc made 11 payments and was still foreclosed because I was told obama's order expired! altisource promised $13, 500 to move early which we did and never received that either. my husband lost his job so I used all my retirement money to make the doubled mortgage payments when asc bought my loan from gmac. so I was screwed by asc, altisource, then ocwen which bought out gmac and asc. I filed class action lawsuits against all of them but to date have received nothing. all of this has made my illnesses worse, lost my house and all my retirement can someone help?

I would like to be in on this - unfortunately what they did to me isn't in the books as it was on the phone, "losing" paperwork and repeatedly asking for the same stuff over and over again when trying to get a modification after my husband left and the house was signed over to me, we could well afford it but since I was a disabled female, they denied, stalled and continued this through 2 lawyers trying I wish there was something I could do

It is so sad to see that america's servicing is still screwing people. they did the same thing back to us in [protected]. kept jacking our interest up, would offer a modification but would make payments ridiculously high then would bill us even higher. they made it virtually impossible for us to catch up. it got to the point were we ended up agreeing to give up our home for short sale... which is basically foreclosure. we lost thousands of dollars to them we didn't owe in a period of about 7-8 months, then lost our home.

I have been searching and waiting for someone to start a class action lawsuit but no luck so far.

In 2007 I was on the brink of forclosure because of this same thing. they raised my payment by 25% and it caused me to become behind on payments. t wasn't until I read all these posts that I felt like the company did this intentionally. it turned into to a financial nightmare for me for months. luckily I was fortunate enough to climb my way out just in time. the financial stress however ripped my marriage apart. two months later I was divorced and I signed a quit claim over to my ex wife. now 4 1/2 years later I wake up to find out my credit score just tanked after years of rebuilding. my name wasn't taken off of the mortgage and my ex is 30 days late on the payment. it's funny because on the credit file it shows asc as the creditor but the negative report is from wells fargo? I called asc first and they have no record of my account on file yet they have reported on my credit for like 6 years. now i'm being hounded for $1000 for something I had no knowledge I was even responsible for anymore. however they did say if I pay the $1000 they will remove the negative from my report and get my name off the loan. I don't know what legal grounds I have but I would be happy to help if I can.
