America's Servicing Company [ASC] Bad credit loan company!

First of all i am a collections rep for asc out bound collections... and first let me tell everyone do you know what asc is... its a NON-PRIME Loan servicer for everyone who doesn't know what that means it services bad credit loans, wait let me rephrase that horrible credit loans, and it makes me laugh when i am talking to you and your there talking about how perfect your credit is and i see when i am calling you and i see your true double digit credit scores... Also your payments are due on the 1st not the 16th people who have bad credit seem to find this confusing thinking the 16th is your due date because thats when you get your late fee... also have you ever wondered why you get stuff from wells fargo with your mort. payment stuff , because asc is affiliated with wells fargo but wells fargo just doesn't want to be labeled the company with all the bad credit loans... how does asc end up with your loans... companies suck as freemont, countrywide, emc... etc companies originate loans the, prime loans (excellent credit) sub-prime (mediocre credit) and non-prime (bad credit)... the originating company keep your loan for 2 months if your lucky, then thats where the fun starts the prime loans get sold to a company the non prime loans get sold to a company and then asc get all the non-prime loans get sold to asc... so i hope all this info answers your questions to why you have this horrible company servicing your loan... all because you all have horrible credit no one to blame but yourself!

Oh yeah i know asc is a screwed up company but i also find it funny when i hear people talking about sewing asc... and winning... yeah right when you walk in the court room with your bootleg lawyer and then asc/wells fargo comes in with its all-star team of lawyers who get paid more in 1 day then your lawyer will make in a year... do you really think your going to win your lawsuit.

That last little phrase of your Mr. Jean is the mentality of a SUB-PRIME borrower. And is exactly why that mortgage is with ASC because it is a SUB-PRIME loan meaning the investor of the property (investor=company that lent you the money for the home) considers the person to they lent the money to a HIGH RISK borrower meaning more likely to default then some with good credit . Therefore people like you causing the subprime mortgage meltdown! END OF STORY! Have a wonderful holiday season!

Interesting reading material for all you poor choice makers! I really hope George Bush's plan doesnt follow through or banks dont "volunteer" to follow thought with this. It would be STUPID waste my and everyone else who lives within their means tax dollars to bail out you people. What kind of message would that show everyone make poor choices and someone will bail you out, if you think thats ok i would HATE to see the morals and standards you raise your children with. You people are pitiful!

Ms thomas you called in because you cant make you mortgage payments anymore because its time for the ARM adjustment but I thought you said you have good credit and you probably would have swore on the bible that you have a fixed rate. If you have such great credit why do you have an ARM loan?

Well unfortunately you are wrong I will NEVER have my self in your situation and i will say NEVER, I know how to manage my money i made a few mistakes early in life and actually learned from unlike the sub-prime market. Also im sorry to inform you, you do have one of those wonderful ARM Loans not a fixed like you stated, yeah it was "fixed" for 2 years and now it adjustes every 6 months there after but you would have not known that because your neither on the loan or have expierenced for first arm change man thats pitiful and you were already forclosed on within the first 2 years of owning your home , sorry to say maam but id rather rent then purchase a home i cant afford and loose it within the first two years of owning it. Lastly just an F.Y.I the reason homes are values are going down is because of people like you, Everytime a home starts forclosure and is forclosed on the property value goes down. So you have no one to blame but people like yourselfs. America wouldnt be having this mortgage problem if things just stayed the same as they used to be , A down payment and good credit to buy a home. And now look what happens when people with bad credit start to get homes it causes a freakin epidemic making it harder for newer generations to purchase homes.

I really dont know why all you people are talking all this crap to me, your acting like i DONT do my job i do what ASC pays me to do collect payments, set up plans (repayment and modifications) and run financials (im sure something that all you complainers are familiar with. Income and expenses ring a bell). You get mad cuz i dont feel bad or sympathize for the situation you put your self in. No ASC doesnt pay me for that or to do that. All you people were asking why do i have ASC as a mort. company all i did was answer your question because the majority of you has credit that is sub-par just like you loan(sub-prime..ha LOL some mortgage humor), yeah were the largest SUB-PRIME lender the the good ol' U.S of A. And yes we have a few PRIME loans (good credit with fixed rates)but a majority of them have nothing to complain about because they get their payments in on the first and dont get hasseled with calls.

Correct i have no compassion for people who are in mortgage default situations who live paycheck to paycheck,who bought houses they cant afford, pay for your mistakes and stop complaining! I will not be reposting anymore i am not going to argue with you knit whits. I said what i needed to say... What is that. Everyone here asked why they have ASC as their mortgage company? Because you have bad credit. Thats why... Thats why they do what they do to you people. You cant fight them. Your word in court is just about as good as your credit. NOT WORTH A DAMN THING.

Thats why no one is following though with a law suit. Because who gonna believe someone is making their payments on time when your credit report obviously shows you ve had trouble doing that in the past.

Dr. Moore now that was mean about the cancer, but as for me getting cancer its a possibility because i smoke cigarettes but i am will to suffer the consequences of my actions. Something the SUB PRIME market is not and more than likely will never do, And if what you say is true i am very very sorry about your issue but when i am saying is the truth (why people are with ASC-bad credit, choices and decisions) and people are mad because i am telling them what they don't want to hear THE TRUTH and they are getting angry. they need to take responsibility for their actions. The real word doesn't always sugar coat things(Ms Heather). As for my pity bill collector job. Its gotten me where i needed to get, Its paid my rent through college as well as my tuition, books and everything else i needed and finally after 5 years graduating with a degree in sociology (Study of Humans-as you can see i am interested why why people make the choices they do) from Cal State this winter. 5 years? Your probably asking yourself because i couldn't afford to take full time semesters because it cost to much so i had to wait it out.

I'm no way whatsoever trying to defend ASC what so ever I'm just saying the people who we have loans with have made mistakes in the past i know that thats why you have bad credit and thats why you have asc as your mortgage company, I'm not calling you a bad person, you've just obviously made some bad decisions in the past, but what do you expect when you borrow 400,000 to buy a house that you cant afford, one that you had to lie about your income oh wait let me rephrase that, you couldn't prove how much you made to get the loan so you ended up buying a home with one of the terrific adjustable rate loans not to mention you pulled out all the equity at the time of purchase planning to pay off the debt that has caused you the bad credit then when you re fi you cant because your homes not worth what you bought it for and ms. heather i am very familiar with the real word, i know when you don't pay your bills and you don't pay them on they're scheduled due dates you get phone calls and your due dates the 1st not the 16th like i said before thats something people with bad credit often get very confused about... and ms. heather i have 1 question for you... Why is it that the companies who service good loans (fixed rate loans-in case you did know what good loan means) are not all over websites like this one... because its a characteristic trait only with sub-prime loans... People with bad credit...

i am fully aware of when we signed papers, to have a laon, it needs to be paid back. but the way the economy has been going its really bad. do you really think people dont want to pay their bills. i have been trying to get them to work with us for ayear. i work 3 jobs and my husband works a 50 hour a week job on salary. neither one of us has had a raise in 2 years. i called them even before we were late to let them know, we awere having hard times. they said we cannot help you until your 3 months behind, so we got 3 months behind and they set us up on forbearence plan that was more than our house payment to begin with. i have called and called and tried to work something out, we are just about ready to walk away from our house and let them deal with it. i dont understand, why they would rather have our house instead of working with us. we dont have any money to fight them and they know it.

I am so sick of hearing about people complaining that America's Servicing Company is screwing them, an yet they do nothing about it... Let me tell u something, I live in the state of Pa. an i have wrote to every an all Attorney General's... yes... an they have all responded... So stop sitting on your ### an do something about this company. 1 Person can not do all the work for you dead beats that sit back an complain.

We paid our mortgage on time for over 2 years. Our loan was due to adjust. We applied for a modification in 11/07. Heard nothing, called and called. Finally in March of 08 after months of nothing, we were told we were approved for a loan modification. When we received the paperwork in April of '08 it was totally different than the verbal approval. There terms are something we cannot do. We did not agree to those terms. Our home is being sold May 22. Please do not trust these people. They lie, lie, lie. Be careful when you enter into an agreement with this company.

I am writing today because this is the 3rd time I have problems with this loan company. My original Loan Company was bought out by Americas Servicing Co. and this is when the problems begun. Not to mention the other problems I've had with this Loan company, I just received a call 10 minutes ago stating they have not yet received my January monthly loan payment. btw- ASLC's representative who called me was completely rood. Anyway, I just checked my bank account and of course it shows that the checks have been cleared? What is wrong with this company? They're making me send them copies of the cleared checks. I am a full time working mother of 2, I DON'T HAVE TIME to do this AGAIN! They need to get their #$@% together! Sorry just a little ticked off. Really do not recommend this loan company to anyone.

Without authorization from me they paid my balance due on my taxes on a piece of property that isn't included in my mortgage. Now they are trying to claim the additional land that I own separate from my house as part of my house! After giving their legal department copies of the deed(s) and tax information from my town that I indeed pay my own taxes and that I own 5 parcels of land that aren't included with the mortgage they still are trying to "claim" my land. Now I have to pay an attorney and fight them to keep what is mine and has been mine free and clear for over 20 years! My best advise is to stay away from America's Servicing Company!

I have been reading all of the complaints for America's Servicing Company, and as I (unfortunately) have wasted many a hour stressing over my mortgage through them, I REFUSE to pay them another red cent let alone continue to waste my valuable time typing. Those ### need to be put into their places!
Enough is enough!

We all need to join together to file a CLASS ACTION LAWSUIT AGAINST ASC!

We fell behind on our mortgage and they kept saying that will modify the loan terms after 12 months but meanwhile kept me on payment arrangement plan for many hundreds of dollars more per month and in the end when it came to loan modification they said that, I am not qualified to get the loan modified and now they want to foreclose my home and sent me foreclosure notice.

I have 4 children here living in this primary family home and they do not want to work with me at all.

I had complained already about this so called company... I just finished writing a letter to the Attorney General of Missouri... Ive experienced all of what i have been reading on here for 3 years and enough is enough already... they have taken everything they can from us already but our home which they tried... I am asking that all who have the same complaints against this place to please email or call the attorney general for starters... if he gets enough complaints it will surely start to open up some eyes i would think... sure have nothing to loose so please..we have to start somewhere... I want away from these people! If you are in Missouri or even if not... look him up... Jay Nixon the Attorney General in Jefferson City Missouri... and send an email like i did... I am tired of stressing over this every month... people who pay and do what they are supposed to shouldn't have to worry about what else is going to go wrong this month from this place... its crazy! Thank so much and good luck to us all who is with this company.

My boyfriend has a home loan through this company. We have called for the past two years to find out whether he would qualify for a remodification. Finally this Dec. they led him to believe that he may qualify. He would fill out paperwork, they would tell him what more they needed. This happened at least 8 times. The rep that he was assigned has an answering machine that always says it's full. One rep tells him to sign something one way, then weeks later, he is told he has to sign it in another place and resend. Absolute run-around. If you have the sense to check into a company, heed this warning and stay away from this company. He had to call them to find out after all this time and work that he wasn't approved. Then the rep had the audacity to ask him if he wanted to make a payment.

I have tried my best to meet my mortgage payment. The customer service representative gave me specific instructions to send money by Western Union and that ASC will accept the payment and apply that amount to my mortgage. Sent the exact amount and on the same day I was informed by ASC that they will no longer accept and apply the payment because it was too late. Every time I call I get a variety of answers. ASC has a very unusual way of computing your income. The extra two paychecks you receive in a year if you get a bi-weekly paycheck, that amount is divided into 12 and added to your monthly income. This makes it appear that you have more money that you actually have in a month and therefore they can say you have more than enough money that they can increase your monthly payments from $200 to $500 monthly. The company state it does not want your house but they apply such incredible attorney fees, appraisal fees etc. I am sure I am not the only one experiencing this issue. Please express your concerns regarding this company so maybe they will take a better approach to their lending practices and educate most of their customer service reps.

America's Servicing Company [ASC] Not sending payoff quotes

I have been trying to refinance my home, and was supposed to close a week ago, but America's Servicing Company refuses to send the payoff quote. They claim to have sent it to the fax numbers given, but no one has received it. I called yesterday to have it expedited and was promised it would be at the office by close of business... as of this morning, it still had not been sent. I have talked to the manager AGAIN and have been promised that it will get there in no more than three hours this time. Each time, they want the payoff quote to go through a couple days later than I want. This company is a gluttonous inhaler of premiums and interest payments... STAY AWAY FROM THEM UNLESS YOU LOVE CONFRONTATIONS!

We had two loans with ASC. In december 2006, we couldn't make our payment. We called on january 2nd to see if we could regularize the situation with a couple of payments. The schedule offered by ASC was impossible, crazy. So we immediately had our house for a short sale. After 3 months the dep of loss mitigation send a letter to our agent, for the amounts required for the pay offs. It would be less than the original amounts and it would be accepted. Now, after the escrow, we discover that for the minor loan we are still delinquent and that they sold the loan WHILE we were in escrow (they call it full reconveyance) without warranty back to the lender. And that we have an amount pending, though we complied with the letter... Isn't it a fraud?

Same song and dance! They drug their feet all the way and I couldn't get this done on the day I told them they'd get a pay off so I put my property on the market and a few weeks later I find out they are foreclosing on me.

America's Servicing Company [ASC] Illegal distribution of escrow account

Apparently sending a homeowners insurance certificate twice is still not enough for this company. Even after my insurance company sent proof of insurance, ASC still insisted upon paying their own insurance company to cover my mortgage out of my escrow account. I have tried via numerous phone calls to get them to acknowledge my chosen insurance only to be told I've reached the wrong number. When I finally reach someone at the "correct" phone number, I'm told that they "never received proof of insurance" from me or my ins. co. Now, thanks to them, my ins. is cancelled for non-payment, and I have to reinstate it. Meanwhile, their fly-by-night ins. co. is reaping the benefit of my hard work and ASC's shady dealings!

Anyone who had private insurance on their home and yet was force insured by ASC through their own insurance company known as "American Security Insurance Company", please contact us, we are organizing the parties to a class action lawsuit against ASC. Also, will: daklaw@voyager please contact us, we would like to coordinate with you and the NACA the principles forthis class action.

I have never had any problems with ASC... so far anyway. We usually pay by the 15th of the month for a loan that is due on the 1st and we have NEVER received any reminder calls.

As far as verification of occupancy the mortgage company does have a right to do that and almost all other companies charge an "express payment" fee. Our old mortgage company charged $20.

I also paid my owe insurance and taxes, when last June ASC decided to add an escrow to my existing account, they doubled my payment and charged me all kinds of fees like inspection and investigation, etc... when i argued with them,that I pay my own taxes and insurance and they never placed any moneys in escrow, they finally refunded back to my loan part of the money but they did not adjust my payment, I have called them on this numerous times because I can not make the nearly 1,500. new payment, which was a bogus amount. They still had it termed escrow, but only put 180.00 in escrow over 8 months. Everytime I called them they would say they would look in to the situation, then I got a letter with a loan history and a new charge to my loan of 15 dollar investigation fee. Two weeks ago they sent us a foreclosure letter, we made several attempts to contact them and the attorney but no one would help us or return our call. Last week they foreclosed on my home I have lived in for 26 years and no one will look at the problems. I can not afford an attorney. How can America let this happen to its citizens, they have ruined my credit because i could not pay the double amount so I can not get a loan to refinance.

The same thing happened to me. What is really stupid is that I have a condo and the insurance is provided through the homeowners association which the mortgage company should have known before buying the mortgage from the previous lender. It definitely sounds like a scam to me.

Additionally, they were bugging me about the first months payment via phone after they had bought the mortgage and I hadn't even received any notice from them or the previous lender (I had already sent payment to the previous lender). When I told them this, they said I had to pay them (also) anyway. Needless to say, I didn't. But it took a couple of weeks to straighten out. What a bunch of incompetent fools.

I am forwarding a complaint to the Federal Reserve. Feel free to do the same.

ASC is still charging my parents insurance, even after they have faxed their policy and America Family faxed it to ASC it is going on two years now. Also they are trying to foreclose for the second time saying they have not received payments since 03/06/06. When they just went through this in 10/2006 of ASC saying they have not got any payments in 22 months. I have found so many complaints on ASC it amazes me, I am doing research on ASC and making copies of all complaints, and forwarding to the Attorney General and the News to see if it helps.

I sent copies of proof of insurance and USAA Insurance Company (my insurance) called them. The Company still purchased Harrican Insurance there for purchased insurance for me. The cost over $10,000. Again USAA and I called them that I was fully covered. I was told upon receiving reimbursement from their insurance company they will place the money back into my escrow account. Over three months, still pending reimbursement.

My Loan was transfered to this bogus company in November from Option One and i never got their mailing address and neither did they bother to send me any information about the transfer of 1 of the loans to there company. I ended up sending payments for 1 of the loans to option one for 2 months and the other loan payments to ASC. They apparently reported...

In October of 2006, I fell behind on my mortgage payments and contacted ASC. They sent me a package to fill out for a repayment plan for the 2 months I missed. I have never heard from them! I called every month and got the same answer, your file is with the "Negotiator" (is that Arnold Schwartzneager?) and that there are a lot of people in front of me...

America's Servicing Company [ASC] Not posting checks

1. 01/02/07 my mortgage loan was sold to America's Servicing Company.

2. 01/023/07 I sent - a week ahead of due date - my my first regular payment with their printed coupon and envelope to their Los Angeles P.O.Box number.

3. 01/30/07 (mind you : payment is due on 02/01/07) after calling their [protected] number (printed on the payment coupon) a dozen times over a few days to check if the payment has been posted, I talked a live person in Pennsylvanis she told me to let them have about 10 days to post my check.

4. 02/05/07 Not seeing the posting of my first check, I sent by certified mail a second check with a note stating if the first check is posted by the time the 2nd check arrives, please post the 2nd check to the 03/01/07 payment.

5. Mind you again here: My loan has a 15-day grace period. And also because of the recent change of "servicing" agent, a 60-day period is tacked on to the change itself.

6. 02/09/07 I received a call that my mortgage payment is late. Then I explained the above steps #1 to #5 to the caller who said she sees the notes on her computer concerning my earlier call with some ASC person to PA. I ask her: is America's Servicing Company out there deliberately to squeeze some "late" payment fees. I told her I hope that she let her supervisors hear the phone conversation recording, because I may have to contact California Attorney General, or BBB, concerning "fraudulent business practices" in non-posting or late posting of mortgage payments as a way to squeeze "late fees" from borrowers. In my case here, after sending two checks, I am still within my grace period of 15-days at least. Why is ASC calling me that my mortgage is late? Hello?

7. I hope I never have any more problems with ASC again!

This company is really starting to make me angry. The bought my mortgage note from my previous lender and when they did, they didn't send me any contact info for over 2 months. The very first contact I received from them was a notification that I was 2 months behind on my payments. I explained to them the situation and ended up paying for those two months with included late fees tacked on... as well as having them report to the credit companies, which needless to say didn't do anything to help out my credit score... Now my newest issue with ASC is that I sent my mortgage check by mail. I had expected a wire transfer to hit my bank the next day to make sure funds would be available to pay mortgage. There was an error with the wire transfer and had to be re-sent. I called the mortgage company to see if the check had cleared or if they needed me to do an electronic funds transfer to make the payment. They stated that the check did NOT clear, so I did the Electronic Funds Transfer to make sure my mortgage got paid.

The next month I receive a statement saying that last months payment was never received and a late fee will be attached an I will need to pay the late fee, last months payment, as well as this months payment. This struck me as very odd so I went and got an activity statement for my checking account from my bank. On the statement it shows the check written as cleared, followed by the next day the Electronic Funds Transfer clearing. So my understanding is that they expect to charge me twice and claim not to receive two payments and charge me a late fee on top of it.

I am planning on contacting them regarding this and will have my bank fax them the statements as proof of both charges being made. I will ask that the late fees be waived as well as being credited for this months payment, either that or they can send back the amount of the check so that I can turn right around and write them a check for this months payment...

Simply ridiculous, I am seriously considering refinancing just to get away from this company, I will have to pay the prepayment penalty but I am beginning to think $2k might be worth it to get away from this company and their seemingly ineptness.

We have had very similar issues with ASC. Does anyone know who regulates this company. I have tried to file a complaint within there company but the customer service gets "disconnected" or they try to divert the conversation. Thank you for anyone who can help in this matter. We need to get this company from making thousands of dollars a month on this.

America's Servicing Company [ASC] Unlawful charge of prepayment penalty

I sent this to the Attorney General:

My mortgage loan was recently bought from Countrywide Home Loans by America’s Servicing Company. This coincidentally happened in the same month in which I sold my home and closed on it. There was some hassle with transferring my January payment over, but the biggest complaint is in regards to a prepayment penalty showing up on my payoff statement. I live in the state of MN where these penalties do not apply, so I contacted them, let them know that this needed to be removed, and explained why. This request was DENIED even after the requested purchase information & HUD was given to them (I have the denial letter from them). There were several long frustrating phone calls I went through to fight for this before, and well after my closing. I ended up having to fax them the portion of the law before finally waiving this fee.

If I didn’t know about this, I would have most definitely been erroneously charged this percentage for the prepayment penalty. Not only did I point this out to them that this was a mistake, but I was blatantly denied the request to waive this fee.
After faxing the statute of the MN law to their legal department that states I should not be charged, I finally talked with a representative this morning who told me I would indeed be refunded this money and the waiver was granted.

All requested information was faxed with of the appropriate documentation stating that this was a purchase in Minnesota and included my HUD.
They had told me that this original request to waive the penalty was reviewed and denied by their legal department.
I, the customer, had to fax the portion of the law to ACS after the 1st denial to show them that they cannot charge me for this.
My title company mentioned that this was the most difficult company they have ever worked with and they were very uncooperative. I had given my permission to ASC for someone at the title company to speak on my behalf and ASC would not speak with her about my loan.
It was always very difficult to get a straight answer and had to re-explain my story every time I called, and there were even cases where the representative would not tell me their name and/or would ignore my questions. One representative told me he would call me back, which never happened (and he was EXTREMELY rude to me).

Despite the fact ASC has told me I will be refunded shortly, I want to bring this to your attention. I think it’s very safe to assume that others have been inaccurately charged this and will most likely continue to get charged. I feel this is a significant amount of money (2% of the total loan amount I believe), and I feel this is unjust.

here's the rub
America's Servicing Company is an alias or DBA of Wells Fargo Bank, N.A.
Wells Fargo being a National Bank is not controlled by state law as long as they are the originating lender / creditor
state laws are not instructive to national banks
HOWEVER if ASC is acting as a loan servicer for some other non-national bank lender, then they have to pay attention and follow state laws. Look this up in "Cuomo v Clearing House" a US Supreme court decision
Cuomo has displaced "Waters v Wachovia" as precedent per the Frank-Dodd act
that's why the Republicans hate the Frank-Dodd act

America's Servicing Company [ASC] Incompetent, harassment, overcharges & under delivers!

This company bought my loan from GMAC (to whom I was never late). GMAC doesn't charge for pay by Internet, ASC does. GMAC's website always works, ASC's is often down. GMAC never called unless there was a real problem. ASC begins harassing phone calls on the due date and the payment isn't late for 15 days after the due date of the 1st. When I call, there is always an aire of incompetence. I am going to refinance as soon as I can to get away from them. When I do an Internet search on them, I see several complaint sites. With this level of complaint, one wonders if there may be reason for class action. This is the first company I've complained about, stay away from them if you can.

we were behind on our mortgage payments due to husbands unemployment. We agreed on a set amt to be paid by a certain date in order to prevent foreclosure./ I followed through on that agreement and sent 5000 dollars . When I called to make sure the money was received I was told my money was being returned to me because it was not the full amt. owed and that I was in foreclosure status. I was shocked. They lied to me and then to make matters worse lied about a letter of accelaration that I never received Now I am dealing with their attorneys and being made to pay legal fees added onto back payments in order to reinstate our loan. When I contacted the attys. office I was told it would be another 7 to 10 days before I received a final payoff amt. These people are worse than loan sharks and need to be stopped.I am all for a class action law suit. I am also looking for a good attorney who is willing to take these people to court and take up for people like me who are being victimized by a company who refuses to work with people like us who are going through a financial crises due to layoffs and bad health. I really have tried and tried with ASC to rectify the matter before all of these foreclosure status began but they are determined it seems to me to try to take our house Anyone out there willing and able to help me?

Everyone has a lot of good points. Is there anyway we can seek legal action? ASC bought my loan and told me to send my payments to VA when it actually needed to go to LA. Just like everyone, there are lost payments, can't pay online, they received payment and did not put it towards the account.

My mortgage has been sold from Freemont Investing to ASC and although I have a grace period to submit my monthly mortgage payment, if the funds are not received on the 1st of the month, the company starts to harass me at work and home indicating that my payment is overdue and they are trying to collect a debt and threatening me. My payments are always received on time and always processed before the my grace period ends. I think there should be some laws against that type of harassment. I think the US attorney's office should fine this company and demand that they stop harassing people or loose their business license.

As much as I would like to stay awasy and not deal with ASC, I did not select to get a mortgage with them. My mortgage was sold to them by Freemont Investing.

Without authorization from me they paid my balance due on my taxes on a piece of property that isn't included in my mortgage. Now they are trying to claim the additional land that I own separate from my house as part of my house! After giving their legal department copies of the deed(s) and tax information from my town that I indeed pay my own taxes and that I own 5 parcels of land that aren't included with the mortgage they still are trying to "claim" my land. Now I have to pay an attorney and fight them to keep what is mine and has been mine free and clear for over 20 years! My best advise is to stay away from America's Servicing Company!

America's Servicing Company [ASC] Trying to get amount to catch up loan

I have been trying to call this company to get the amount to stop foreclosure on a home that we purchase in October. Well as of today i finally got the amount that i need and it was stated that it need to be in their office by feb. 2 07. Or it would be null and void remember i just got the amount you call the phone they give you it does not work i had to threaten with attorney. They charged me prepayment penalties for just trying to save my home what a great company.

I had been having problems with Altegra Credit Company not applying my mortgage payments in a timely manner. I decided to send my future mortgage payments via Western Union Quick Collect after trying to get them to post my account
on time.

Despite sending in the payments via Western Union Quick Collect, I was still receiving form letters stating my account was in default.

I telephoned the Altegra Credit company numerous times and was never given a clear answer to any of my direct questions. The last time I telephoned this company I was threatened with foreclosure, the sale of my personal property and jail time if I didn't clear up the problem.

After that telephone call I decided to only deal with them in writing because I knew I was going to need proof that I was trying to take care of the problem and was not getting any cooperation.

A few months later after sending numerous letters to the mortgage company and not receiving a response, I decided to send them a RESPA Letter. Still I did not receive a response from Altegra Credit Company.

I was angry and frustrated that I kept getting these form letters stating my account was in default and decided to call the mortgage company one LAST time asking for information on the alleged default.

I was told Altegra Credit Company no longer handled my account and that my account was transferred/sold to America's Servicing Company in November of 2003 and that I should contact the new company.

I was given a telephone number and told to speak to someone there who would be able to help me clarify the problem. I called America's Servicing Company and talked to a female representative who denied receiving any paperwork
from me.

When I informed her I was not notified of the sale/transfer to America's Servicing Company and didn't know that I was supposed to send the payments to them, I was chastized for not sending the payments to the proper place and was told I was shirking my financial responsibilities.

I was given the name and address of where to send a letter and copies of the Western Union Quick Collect receipts explaining my reasons for not sending the payments to America's Servicing Company. I sent the information as instructed and never received a reply to my request for information on the alleged default.

I sent America's Servicing Company a RESPA Letter and did not receive a reply to the RESPA Letter.

I contacted America's Servicing Company on the telephone and asked for account information only to find their records from Altegra Credit Company were incomplete. I was told they would have to request a payment history from Altegra Credit Company.

I tried to be patient and finally decided to contact America's Servicing Company about the payment history. I spoke to yet another female representative who stated that I was sent a copy of the payment history and they were waiting for me to contact them.

I asked if they had received a copy of the Western Union receipts and my letter, and she said there was no record of the letter or receipts in her file.

I decided to telephone them again after hanging up from this individual within 10 mins after talking to her. This time I spoke to a male individual who stated they had received the letter and copies of the receipts and that a copy of
my payment history had not been sent from Altegra Credit Company to America's Servicing Company as requested according to the notes on my account.

Each time I telephoned America's Servicing Company I got the run-around.I spoke to several different people and can only say they leave a less than desired opinion of themselves upon contact.

Out of total frustration, I filed a complaint at the
Office of the Attorney General and the Federal Trade Commission againstboth Altegra Credit Company and America's Servicing Company.

I was assigned an investigator from the Office of the Attorney General. The investigator sent America's Servicing Company a letter and they actually responded. The only reason they responded was because the Office of the Attorney General contacted them on my behalf.

The response was they would get back to the investigator within a certain amount of time, and when that time period lapsed, they would send another letter stating they would respond within a certain time period. This went on for months.

When America's Servicing Company finally responded to the investigators letter they stated that I was in default of two (2) mortgage payments from over 5 years ago, but did not provide any specific information.

While waiting for the information on the specific time period it was alleged I was in default, I continued to send in my payments via Western Union Quick Collect. They accepted the payments and I didn't receive any default notices or any other correspondence from them other than their replies to the investigators letters.

Approximately, 3 months later America's Servicing Company finally responded by saying that my payments have been consistently late 2 months for the last 5 years, and that the payments received after that specific time period were
always applied to the payments in default.

When asked why I wasn't notified, they didn't provide a clear answer, they only repeated that the account was in default of two (2) payments and how the money was applied to my account after the default dates over the last 5 years.

I sent my next payment via Western Union Quick Collect. I didn't receive any correspondence from America's Servicing Company and we were still communicating via the Office of the Attorney General.

In October 2004, I was served with Foreclosure papers by the Sheriff's Office.

I immediately called Western Union Quick Collect to ascertain the dates the payments were acknowledged. I found the payments were acknowledged but the last payment I had sent was rejected due to Non-Sufficient Funds.

I immediately called America's Servicing Company and was told that the payment was rejected because it was not the full amount demanded in a September letter.

When I talked to their numerous represenatatives, I was told I received a letter stating I was in default, followed by a Demand letter and an Acceleration Letter When I said I hadn't received anything from them except the response letters to the Attorney General Investigators requests for information, I was told that I got the letters and she had proof I received the letters.

After trying unsuccessfully to state I had not received anything from them other than the responses to the Investigators inquiries, I resolved to fight these people to the very end no matter what happens.

I only had 20 days to respond to the Foreclosure papers and had problems finding a lawyer who was willing to defend against the foreclosure. I was advised to file a Bankruptcy to stop the foreclosure.

Bankruptcy is something I can not consider, especially since it is only 2 payments. Had I been given the information there were two (2) payments in default, those payments could have been made at anytime, including now.

Instead, I am now faced with not only the two payments in default, but I am now being forced to pay for the attorney's, service of the foreclosure papers, their added fees along with over 5 years of accumulated late fees.

I contacted the investigator from the Attorney General's Office and explained the entire situation and provided him with the proof he requested. I have not heard anything from the investigator for weeks.

I have contacted the Federal Trade Commission, The Office of the Attorney General, the Office of Thrift Supervision, as well as many other organizations about both of these companies.I have been informed there are others who have also filed complaints about America's Servicing Company.

During my last conversation with America's Servicing Company, they offered me a repayment plan that includes me paying over $5,00.00 in extra fees and costs.

Now they want me to sign a paper that says that I am agreeing to their terms of my own FREE WILL and VOLITION.

I need to find someone who will look these papers over before I sign them. Given my situation this is going to be virtually impossible to do because the lawyers I keep talking to advise me to file for bankruptcy.

I can not find other financing because of my credit history behind Altegra Credit Companies inaction, and since they never provided me with the information I requested, they sold/transferred my account to America's Servicing Company with the defaults listed, I am being forced into a repayment plan that includes extra fees that could have been avoided.

The stress of this situation is more than one can bare without some kind of assistance, the duress of being coerced into signing papers that say I am signing of my own FREE WILL and VOILITION are just too much to handle on my own.

I just received a reply from America's Servicing Company in the mail today that states they are looking into my situation and state that my foreclosure is suspended for 30 days. This is after I made the arrangements for a repaymnet plan on the telephone over 2 weeks ago.

This still does not negate the impending foreclosure unless I sign the repayment plan papers that say I am doing so of my own FREE WILL and VOLITION.

So.. PLEASE, if you have any complaints about America's Servicing Company, PLEASE file a complaint with the Federal Trade Commission, your local Office of the Attorney General and send a RESPA Letter to your mortgage company and send a copy of this letter to the Office of Thrift Supervision.

I know there are a lot more of you who are being victimized by America's Servicing Company, please don't suffer in silence like I did, file your complaints with the proper authorities and post your complaints hereat the Rip-Off.

The more complaints against America's Servicing Company, the more the authorities will be compelled to investigate their activities.

they am in foreclosure and that i old them 8,375.27 and all i old them is 2,220.00
this is a insult and all this time am thinking that asc is my mortgage but it's not it's
wells fargo so why is the customer sending payments to a asc somebody needs to do
something about this so i it will be me when i get my lawyer. and by the money
i sent them they are trying to keep it saying it's for a escrow advances what's up
with that. i pay my own taxes.

I would like to find a Lawyer who has the balls to file a class action lawsuit against Americas Servicing Corporation...is there any one out there who does? Also I would like to get a list of everyone who has been screwed over by this comapny that I can attach to this lawsuit...maybe you can recover some of your money this way...I would like to sue them in execess of over a 100 million dollars...the more the better...the only way you can fight corporations like this is to sue them.I have been screwed over by them for years and get no where when I try to even get in touch with them.Who will join me?...and are there any Lawyers out there who have the guts to take this on...I mean look at all the pages of complaints on Google when you type in Americas Servicing Company...these guys are out right crooks and must be held accountable for what they do.They have ruined countless peoples credit and foreclosed on countless numbers of homes,and have been paid millions in false fees.Who will join me on fighting them? We refinanced last April and we were very happy with our new mortgage company. Then they sold our mortgage to America's Servicing Company and now we are living in hell. They never post our payments on time and are constantly charging us late fees for on time payments. Now we have been fighting with them since March because they keep saying that we didn't make a February payment even though we have faxed them proof from our bank and their bank that they received the payment and cashed it. I am going to filing a complaint with the Department of Banking in our State and hopefully they can do something about this ASC. They owe us late charge fees, damaging our credit rating and all the aggravation they have caused us. If you can give me some info, tell me what I can do about this. I am in the process of hiring a lawyer.

Interesting. I am in the process of refinancing my mortgage. Wells Fargo is to be the new lender. ASC currently services the mortgage. My mortgage was also sold to ASC from GMAC in December 2006. Three weeks ago ASC gave Wells Fargo a current pay-off, which showed all payments up to date and current, with the exception of March, which hadn't yet posted. After we went in to sign docs at closing last Monday, March 26, title called ASC for a final pay-off, and ASC then told them that I hadn't made a payment since October '06, and that I owed over $9,000 to bring the account current! ASC didn't begin servicing the loan till December '06. After about three hours on the phone and numerous different transfers between different agents, none of which has a phone extension, making call backs and follow-ups with the same person impossible, it was "discovered" that there were misapplied funds on October (their mistake) and that they had to back all the payments out of my account and put them in a suspense account in order to fix the problem. They did this on March 26, the day of our signing/closing. They initially said that they would only credit the account back one month's payment per night, then they said they would allow two months payments per night to post, then they said that they would expedite it and that it would all clear. That was three days ago, and NOTHING has been returned to my account. These people are either crooks, or they are completely incompetent. AT one point I called and was transferred and the person on the other end of the line pretended to be an answering machine, but was stupid enough to say "hello" after a did not hang up or try to leave a message. ! I suspect that the initial pay-off request was a signal for them to screw with my account so that I couldn't get a pay-off and therefore would not be able to refinance out of the mortgage, so that they would then be able to keep my mortgage longer, charge me more interest, assess bogus late fees, and eventually get me to pay them just to get it done with. I also suspect that they will be hitting me with 30, 60, 90, 120, 180 days late on credit reports, since they backed the money out of my account and now it shows payments not being made since October.

Good Luck. I will file a law suit if this is not completely resolved by tomorrow...

America's Servicing Company [ASC] Damaged credit report due to misinformation given repeatedly to this company

I bought a house in June 2006. My first payment was due July 1, 2007. Since that time, the loan was sold to GMAC and one month later, it was sold to ASC. All of my payments are current however, ASC claims I am behind one payment. Since October, I have called and sent ASC copies of my cancelled checks verifying my payments- no correction was made. I talked to supervisors, managers, reps begging them to correct my account. I have the names of the people I talked to and they agreed I was right. I asked them if their error would affect my credit and they indicated "no" - in fact, I had to beg to get a letter from them to get this in writing. According to ASC policy, they do not send out any letters involving their accounts - so I was happy about receiving my letter. This week, I applied to refi and found out ASC reported this to the credit bureaus and my score dropped dramatically - I am so frustrated with them. My main account is held at Wells Fargo and I am shocked to find a subsidiary of theirs is allowed to get away with these tactics that ruin people's credit. Let's stop this rip-off.

I had the exact same problem. I resolved it by writing to RESPA and copying the CEO at America's Service Company and at my previous servicer. Office of RESPA at HUD in Washington DC can give you the fax and address info for the CEOs.

America's Servicing Company [ASC] Problems from the get go with ASC!

My mortgage company sold my mortgage to ASC. I had been warned that my mortgage was going to be sold after two months, but then they sold it after one month. I sent payment into the company that refinanced my loan, and they cashed my check and then forwarded payment to ASC. The problem is that they mailed it to an overnight post office box that no longer existed. I flipped out about my missing money and was promised by ASC (owner of the no longer in use P O Box) that there would not be a late fee charged. I had explained that I received a letter they mailed the last day of October telling me my loan had been transferred but I had already mailed payment to the old lender.

This month, my payment was due before the 16th, I am already being barraged by phone calls from these people. I just called one of their customer service numbers and listened to the computer generated message regarding my account and was just "informed" that they DO have late fees on my account. My monthly statements have not reflected a late payment.

When I went online to make payment to them, I have run across these complaints.

I will say that they did not use my mailing address as requested. I have been charged a late charge after being told I would not be charged. When I realized my payment had been LOST, I had to make more than a dozen calls to try to get the information from the old lender correlated with the new lender, ASC. They evidently did not feel they should be involved with their own contribution to my lost payment (a no longer in use P O Box) (note that it was not no longer in use to the extent that my payment was returned to the old lender... it was just no longer in use in terms of them checking it). What a total pain in the butt.

I will be following up with a complaint to the appropriate authorities on this.

Maybe our collective voices will have an impact. I certainly hope someone is paying attention.

Wow! I thought I was the only one that had this happen! I think I had both situations, the transfer from one company to the other where I paid the company and was somehow behind with the other that took 4 to 6 months to clear up and then the tax problem where I paid the home taxes and then ASC did without my knowledge and then set up an escrow and I ended up paying double taxes that nearly sent me in to foreclosure. That episode took 8 months to clear up. I periodically check my credit rating and demand that they clear up my credit because it is false and it HAS to be corrected. It is sad how we are taken advantage of. I will definately take down your website, Mr. Lewis, for future reference.

Asc has no clue. my wife and i bought our homein March of 06 we were pressed to geta mortgage andmoveas we had sold our home we were living in. Our credit was not great but by no means bad or terrible, mid 600's our mortgage borker said that the sub prime loan that the sub prime loan would wokr perfect as long as I refied in two years. We signed the papers and all was good. in two months our loanwas sold tolitton loan svc great people. they sent me a letter and called to make sure that I understood they had bought my loan. I mad three payments to them. a few days after the 3rd payment cleard I got a phone call from ASC stating i was late. . I did not know who they were. i immediatley sent them another payment. when i bought my home the survey was certified as a non specail hazard flood zone. Meaning I did not need flood insurance. Asc sent me aletter stating I was ina flood zone and was required to purchase flood or they would force flood. I refused. in april of 07 they forced flood at a rate of over 1500 a year. Opened an escrow account and raised my payment to cover past curent and future insurance. We sent asc the information backing our claim of not needing flood they didnt respond. We sent it again they said we sent it to the wrong dept we sent it again its alomst a year later andstill no response we are still being charged flood that i am not paying due to not paying the flood ASC has defaulted my mortgage. We have taken legal action against ASC adn they have since stoped cashing my mortgage payments. its been two years that i have had this loan. instead of refinancing. Im sueing , my credit is ruined they want to froclose. and the worst part. The bank that wants to froclose is not Wells fargo., I dont even know who holds my mortgage. I have filed complaints with the federal tradecommision adn the flroida trade commision these people cannot be alowed to continue buisness.

ASC must be stopped! I read all your letters & all has happened to me w/ in 6 months w/them! I no longer have credit, they,ASC, wants $22,000.00 for escrow, and $7500.00 for flood insurance! When ASC bought my old mortgage, I had flood insurance, and still do, and what happened to my escrow account? When I call ASC, no one can tell me where my monies are being applied! I write " for principle payment only" on the checks, but it does not go there! I am afraid to send in another's month payment! I contacted the FTC & DCCA regarding these thieves! I am so pissed off, how can our government allow these modern day "Robin Hoods " to continue raping us?

I totally agree with all of you except for the jerk that says he works for ASC.
I had refinanced my load in early 06 to get away from ASC, everything was great until I received a letter from ASC in may of 06 saying that I was behind and owed them almost 4000.00, and it has been nothing but a nightmare with them, I send my payments in the mail at even got out of my way to drop them right at the post office but the still never receive then "ontime" Now I get another letter stating that my property taxes are going up in Oct and my payment will be another 300.00 What are these people crackheads or something.

I have not had a chance to call my town to find out about this... but I also only live in a very small condo about 795 sq ft. I had fairly decent credit until this company came along and now when I try to refinance I have no equity because the sales are down and I have already filed a complaint with the BBB of Maryland but that still doesn't do anything. I am at my wits end... single mom of 3 kids and working my ### off just to pay them... let alone have any money left over for food, gas, school, etc...

DOES ANYONE HAVE ANY IDEAS?
I think I am gonna have to foreclose :(

ASC says i didn't send them my June payment, so i sent the copy of my CASHED check, front and back. They are now researching it. they said they have to "find the $" and my cashed check doesn't mean a lot. WHAT? How is that my problem? Do they not believe me or my bank? Basically, this is the second time this has been in "research" the first research file was closed for no reason and not researched. I call customer service but no one will talk to me, they said they will only communicate via US mail. What some jerks, meanwhile here i sit.

What are you waiting for? Contact the Federal Trade Commision. Use their website to file a complaint. It works. If everyone compains, FTC will be jammed with complaints.

I strongly agree with the comments! This company brought my loan after a company who had it for a month sold it off. I got a phone call with a canned message. to call my mortgage servicing company. I then asked for a letter from the company on company letter head signed in ink. 1year after i have not received this simple letter. I have nothing that states that they are my company! If they are the loan holder then they should send a letter ON COMPANY LETTERHEAD SIGNED IN INK! Not a unreadable print copy.

Is there any help for people? Do more people have to loose homes before we as American do what it takes to stop this crap! If we all only pay enough to take care of the sale price of the home the cannot kick the entire country out of their homes and companies like this will be gone from this earth! Also is their any way to contact this company by email or is your only option to fight it out by telephone.

ASC is run by a bunch of incompetent people. I refinanced my mortgage back in December 2005. I made one payment to my new mortgage company. It was getting close to the first of the month before my next payment was due so I called the mortgage company to see if I could do a phone transaction. However, they said they no longer have my mortgage. They sold it to ASC. I knew this could happen so I was not surprised. They told me since they no longer have my mortgage I do not owe them anything. They gave me the phone number to ASC. I called ASC and the representative welcomed me to ASC, but told me I was all set since they received the mortgage before payment was and I was up to date. Then the nightmare began. Approximately two months later I received a letter from ASC informing me that I did in fact owe the money. By now the money was gone. I paid other bills with it. I explained what happened, but they did not seem to care. The set me up on a repayment plan. We went over all my finances and expenses. They could not think outside the box. Only they computer she was using told her what I could afford to repay monthly. Forget about the extras like food, school activities and other unforeseen expenses. The only wanted their money and refused to hear what I know I could repay. Then the kicker. I finally got caught up. But, since I was struggling to pay my higher mortgage payment I got behind in my property tax. I pay this directly to the city. I received a letter from the city regarding the taxes. They must have sent ASC this letter, but I did not know this. I made an agreement with the city to Pay smaller monthly installments instead of the large quarterly until it was caught up. ASC took it upon themselves, without my knowledge, to pay the taxes up in full with one of my mortgage payments. Again, about a month and a half went be before I was informed of this. I received a phone call from ASC telling me I was behind once again. Now they have included my taxes and the repayment of the money I owe from them paying my taxes in monthly installments. Needless to say my monthly payment has jumped considerably. Working with ASC is worse than getting your tooth pulled. Nobody from ASC was upfront about anything from the beginning. Now I am trying to put all the pieces back together so I can try to refinance out of ASC and repair my credit. Up until I had ASC I had good credit. Now I'm afraid it is in the toilet. Stay away from ASC if you can.

I am having a problem right now with ASC. I made my April Payment on 4/30/06 via a check number. I had a problem with my account and called them back immediately stating that I needed to cancel that check number and make the payment again. She said it would be ok. I cancelled the appropriate check number ($25 fee from my bank) and they took the payment over the phone. I come to find out that the check that I stopped payment on went through because they put it in as an automatic debit without the check number and then tried to put the 2nd payment through also. They did it 3 times before I noticed. I do not understand why they ask you for 2 check numbers to do the transaction and they don't even use them. I am not out $100 in stop payment fees and bounced fees. Thank God I didn't have it in there or they would have destroyed my entire account.

America's Servicing Company [ASC] Threat of foreclosure

This company had foreclosed on my house not even 60 days past due. When trying to make payment by phone or contact them, I could not. They foreclosed on my property requesting $7,000 to rectify. This payment was made on 11/28/06. In December, 2006 a letter was sent to me indicating that my payment due on 1/1/07 was past due by one payment. I had not received notice since my 11/28/06 payment when payments would begin let alone fall behind by one payment again. I am having problems with homeowner's insurance through them, as well as harassing calls. I have just now received a letter indicating they are going to proceed with foreclosure again. I wanted to refinance to lose them as the holder of my mortgage but am unable as now my credit is blemished.

I am sick at what people take advatage of hard working homeowners. not happy with a payment need to keep sucking blood from us thats ok because what comes around goes around i hope they all lose what they work so hard for real soon. people like me trying to make an honest agreement or come to terms so i dont loose my home.they dont want to hear it.little do they know the house has been for sale for three years nobody wants it so i think i should just walk out and let them have there cake and eat it to. ther e will be a day for all .

I checked into the post by Mr. Lewis. It seems there services would just put you further in debt, try $1000 for starters, and that not the only charge from what I understood. I think that would probably just be adding fuel to the fire. Contact HUD, they can probably give helpful advise or direct you to someone who can help for free.

I guess my question is blunt and to the point, if you get to where you cannot make another payment, and have asked for modification, and they himha around and tell you, you will here from us in 45 to 90 days. How long before they foreclose on your home, and you are forced to leave.

Congress needs to investigate these bunch of crooks. they are the wrost company i have ever seen. if it was only one or two persons complaining it would be understandable but its almost everybody suffering stress and grief. Let us everyone write our congressman and request a formal investigation of the company.

I just went thru that. I was able to send in enough to catch up the payment, so they didn't foreclose. I hired a foreclusure specialist. And he told me that it takes a month or so after they tell you they are going to foreclose. Then they have to sell your home. You can stay in it. Then if they sell it, you can rent it. And if you don't pay, they have to file to get you out of it. It is much easier for the mortgage company to just let you keep it. So don't worry. Just get the money in. They really don't want your house.

My husband is in the same position. ASC is the worst company we have ever dealt with . My husband became ill in august 2006. I had to catch up on two payments because of his illness and they have made it almost impossible to do so. they set the repayment plan so high that we can barely afford to live. we are now in danger of losing our home. We are a family of 5 and soon we may not have a home. Thanks to ASC!

This is the worst nightmare Ive ever had . Americas servicing company is a rip off! They lied to us about setting up a payment plan to catch up on 2 missed payments they were to send the paperwork right away! it took 2 weeks to get to me and after talking to loss mitigation now they say I'm too far behind they will not accept partial payments. I have no choice but to pay in full or...

America's Servicing Company [ASC] Filing false foreclosure

Trying for the second time! to foreclose on my home without providing any documentation. They were the 4th purchaser of a 1994 mechanic lien.I had a 1st & 2nd mortgage @ the time. Sent my check back in 2004 saying "note matured". I called to verify that knowing that it was true but since they never responded to attempts to pay in full in 2000, I knew they were screwy. I did nothing in 2005 & foreclosure never took place. But, right at Christmas this last attempt was very disturbing!

ASC is really a rip-off... I'm 73 years old and have never had any trouble with any of my other mortgage companies until ASC took over. Things have been a mess ever since. They change my payment what i was sending in every month without even notifying me. However when i tried to resolve this problem they told me to stop payments for they could research it. They even sent my payments back and then all of a sudden they are asking for one lump sum or they will foreclose on my home. It does not take a rocket scientist to know that this is a rip you off type of company. You can never talk to the same person and whenever you get somebody you have to start all over with your reason for calling. I must say this is a pain in the ### company and if anybody want to take these rip-offs to court please count me in.

First of all i am a collections rep for asc out bound collections... and first let me tell everyone do you know what asc is... its a NON-PRIME Loan servicer for everyone who doesn't know what that means it services bad credit loans, wait let me rephrase that horrible credit loans, and it makes me laugh when im talking to you and your there talking about how perfect your credit is and i see when im calling you and i see your true double digit credit scores... also your payments are due on the 1st not the 16th people who have bad credit seem to find this confusing thinking the 16th is your due date because thats when you get your late fee... also have you ever wondered why you get stuff from wells fargo with your mort. payment stuff , because asc is affiliated with wells fargo but wells fargo just doesnt want to be labeled the company with all the bad credit loans... how does asc end up with your loans... companies suck as freemont, countrywide, emc... etc companies originate loans the, prime loans (excellent credit) sub-prime (mediocre credit) and non-prime(bad credit)... the originating company keep your loan for 2 months if your lucky ,then thats where the fun starts the prime loans get sold to a company the non prime loans get sold to a company and then asc get all the non-prime loans get sold to asc... so i hope all this info answers your questions to why you have this horrible company servicing your loan... all because you all have horrible credit no one to blame but yourself!

Oh yeah i know asc is a screwed up company but i also find it funny when i hear people talking about sueing asc... and winning... yeah right when you walk in the court room with your bootleg lawyer and then asc/wells fargo comes in with its all-star team of lawyers who get paid more in 1 day then your lawyer will make in a year... do you really think your going to win your lawsuit.

ASC --The company is nothing but a bunch of crooks! Our mortgage was sold as well from Option One and all the rest is the same. We were paying on time and then one day they called and asked where our payment was. The payment had already been taken out of my bank so I knew they had the money. They insisted that it wasn't paid, what we finally found was that it was posted to the wrong account and they said they could do nothing to fix it. We had to make a repayment plan and pay an extra 200 a month to catch up. The very next month they said we broke the agreement because the payment was posted after the due date. They admitted that the payment was there, but said it was our fault because it takes them 10 days to post it. That we should have sent it that much sooner! Who does that? We then had to do another repayment plan this time paying an extra 400 a month. It was fine for 2 months, and we started sending via certified mail to make sure it was on time, then one month the check was sent back to us stating that we didn't have any agreement for that amount. It was fine for 2 months and all of a sudden it's not? What the HELL? They threatened foreclosure and we had to ask for a hardship loan from our 401 k to catch up. Then they denied our loan modification anyway. We had to hire a third party assistance company to mitigate with them. Every stage we paid out 900, then 3300, and this last time 4500 dollars. The letter said that if the loan mod was denied they would give us the $4500 back, the 3rd party mitigator came back to us with a loan mod agreement from ASC but said we had to come up with 5000 in 4 days! We never got the 4500 back from the bank so I'm waiting to hear if they will credit us the 4500 towards the loan modification. My house is up for auction May 16th. It is now May 2nd. Still waiting to hear. I'm sure I'll be totally screwed and my credit is already at it's worst ever! Where am I supposed to move my children to? These jerks care nothing about the people who are paying their salaries! CLASS ACTION LAWSUIT!I f anyone can help me out give me a heads up!

I have been totally ripped off by this company, they are charging me an extra $230 a month for an escrow shortage that never existed! Their customer service reps are horrible and have bad attitudes and when I said I wanted to drop the escrow she said they would need it in writing and that there was no guarantee that they would stop the escrow! I feel so helpless and I don't know what to do, I have paid over $3000 extra to them and I probably will not get that money back. I want to refinance to get away from these people!

Like the rest of you, but with a little bit different circumstance. We have had to call to ask for help as we were affected by the storms and power outages here in Western Washington, our area had been declared a FEMA national disaster area. We were assured when we call ASC that they would work with us, though our payment would be a couple of days late in December & January. They offered that as long as we were caught up by March 31, they would not report us as late.

Every subsequent statement showed a late payment fee, but they would reverse it when we called yet again and confirmed that the arrangements we made were in effect. We talked to them 10 times from mid-December until now. We talked to them on 3/16, again, no worries, account status is good, will not report to credit agencies. At this time we are re-financing and on 3/20 the mortgage loan processor runs our credit report and it has plummeted 50 points and shows that on 3/16/07 ASC reported us as 30 days late twice!

Sickened by this, because we have a 20 year record with ZERO late payments and this happens at a very inconvenient time.

We are finally allowed to talk to the collections people, rather than regular (non) customer service. A woman there sees all the calls, all the arrangements and says they are wrong, have your lender call her and she will confirm this is ASC's fault. She will also immediately send a letter to the 3 credit reporting bureaus. Well, now this is where we learn about the afore mentioned 5 calling centers and the lady we need to talk to is in Maryland. We are advised to just keep calling back and we may get lucky enough to find this needle in the haystack representative.

We do receive a letter in a week's time, but instead of advising of the above-mentioned error, it states there is an investigation and research being conducted and we will receive a letter with their findings in 15-20 days.

Well that's where we stand right now. Waiting for this letter. Luckily our mortgage guy did reach the lady in Maryland and got a verbal from her that they had mistakenly reported us. But that only allows us to retain our dignity with him. The re-fi can not go forward without the actual reversal of the late payment report to show up on the bureau reports. I am so afraid to stay with this company, but now we are stuck. There are so many more reports of this similar difficulty across the country with ASC, something has to work in our favor...

CLASS ACTION PLEASE.

I sent them a certified check for $57,000.00 and they still wanna foreclose. They said it would stop the foreclosure. They said I was only 39,000 past due. Makes no sense.

America's Servicing Company [ASC] GMAC mortgage and funds

I agree, they just assumed my mortgage from GMAC & I made payments to GMAC prior to 12/1/06. GMAC assured me via letter that any payments that I made during this transition would be applied as a payment with America's Servicing Company. However, since 12/15/06, I receive numerous calls at work and on my cell phone. I answered one of the calls & requested they don't call me at work & change the number & she said she can't do that. I need to find out where they are located & contact the better business bureau to report them.

I just found out from GMAC the funds that I paid were applied towards my principle and not my mortgage payment.

My loan was recently purchased by ASC from GMAC as well. I had been sending GMAC payments twice a month, with a small excess amount to be applied to principal.

ASC completely messed it up. In fact, because I sent 2 payments a month, each "1/2" payment was put into what they call "suspense" as non-payment. Then, when the other half got there, they would put it all toward principal.

In addition, and now it's been 6 months, the last 2 payments to GMAC never were posted to my account. Over the last 2 months, I've mailed them 4 total payments just to keep even, or they said they would consider the account late.

I am about to refinance to a loan not quite as attractive just to get away from this company.

I have been trying to refinance a loan that my clients have with ASC since September 06, . The history of this situation will leave you completely dumb founded. " BE EXTREMELY CAREFUL " when refinancing your loan, you could find yourself in default or foreclosure, as is the situation with my client. She Had good credit until that time " NOT NOW".

When ASC purchases loans or has a loan transferred ( ASC is 3 or4 separate companies, in a dozen location in the US all operated by Well Fargo Bank ) they will not report to the credit reporting agency for 60 days , this loan will not show-up on your credit report.

If you send a VOM, it will not be returned until after the 60 days has run, " as was and is the case NOW ", at which point
the loan " MY " reported as late , as in this situation.

I have been trying to work this out with ASC, but I get bounced around, from department to another. ASC has refused payments, given false information to me and the client, made promises and so forth, and as of April 25th, 2007 has started foreclosure. This is true, I have the documentation to prove it. " DON"T TRUST ASC ".

ASC has attempted to force place insurance inspite of the fact that the insurance payment is made with my payment and they have been sent the insurance information every month for the past 4-5 months.

This business practice is clearly evidence that they have no regard for the Consumer Protection Act and that fact that there is already insure on the subject property.

I am quite certain the Washington State Attorney General would be interested and/or we could consider a class action suit to assist them in developing a more appropriate service level.

My loan has been transferred to ASC about one year ago. Since then I am going trough a nightmare with mortgage. Almost every three months they have adjusted my escrow account. I am still waiting for an explanation. Their web site is always down. Last week I was told by one of the escrow agents that they do not read any note sent along with your bill. ASC is really a rip-off company.

It looks like I will be able to help both clients and give them great benefits on top of their dissatisfaction with ASC. Every since my loan as be transferred to ASC. I have problems after problems. They stated during my transfer period, I had a late payment and never did. They started a escrow on my account, stating I had a lasp in insurance coverage. I would like to know why nothing has been done about this company. I don't know what to do, and I am still having problems with this company about my mortgage.

The day I found out that America's Servicing Company had purchased my mortgage, I knew was going to have problems. This company is known for having problems with receiving payments. The biggest problem is sending the customer the coupon or letter for the next monthly payment. I have written and called AMERICA'S SERVICING COMPANY about not receiving the letter with the coupon for next months payment. So far I have not received the letter with the coupon for the monthly payment.

According to AMERICA'S SERVICE COMPANY, they will mail you next months letter with the coupon as soon as they receive your monthly payment. I had received and posted on January 15, 2007 and I haven't received a letter as of January 29, 2007.

If this company keeps the delay or not of sending the letter with coupon by the first of the month, I will contact the Attorney General for the State of Kansas.

My mortgage was sold to ASC on October 20, 2006 by New Century. After reading the letter, I jumped on the net only to be totally amazed at the poor reputation this company has. After a few phone calls, I totally understand why. Everyone on here has basically all the same complaints, interested in doing something legally?

America's Servicing Company [ASC] Harassing phone calls

I currently have 28 mortgages and ONLY America's Servicing Co. (with which, unfortunately I have 8 loans with), repeatedly (10-12 times a week), places calls to my workplace or to my cell, to "remind" me that my payment hasn't yet reached them... Although I've never been behind by even 1 day over 30, they are so worried about me not paying them that each month if their payment doesn't reach them by the 5th, they start their HARASSMENT calls. All 20 other Lenders/Servicing Companies are fine. None call me. They told me its to assist me in keeping my account current... That's crap... It's my credit that will suffer if I'm more than 30 days late, not their's! They try to get you to do an Auto Withdraw from your bank account, but they aren't on the level, so I refuse to do that, as this group appears to be totally out of control!

First of all i am a collections rep for asc out bound collections... And first let me tell everyone do you know what asc is... Its a NON-PRIME Loan servicer for everyone who doesn't know what that means it services bad credit loans, wait let me rephrase that horrible credit loans, and it makes me laugh when i am talking to you and your there talking about how perfect your credit is and i see when i am calling you and i see your true double digit credit scores... Also your payments are due on the 1st not the 16th people who have bad credit seem to find this confusing thinking the 16th is your due date because thats when you get your late fee... Also have you ever wondered why you get stuff from wells fargo with your mort. payment stuff , because asc is affiliated with wells fargo but wells fargo just doesn't want to be labeled the company with all the bad credit loans... How does asc end up with your loans ... Companies suck as freemont, countrywide, emc... Ect companies originate loans the, prime loans (excellent credit) sub-prime (mediocre credit) and non-prime (bad credit)... The originating company keep your loan for 2 months if your lucky, then thats where the fun starts the prime loans get sold to a company the non prime loans get sold to a company and then asc get all the non-prime loans get sold to asc... So i hope all this info answers your questions to why you have this horrible company servicing your loan... All because you all have horrible credit no one to blame but yourself!

Oh yeah i know asc is a screwed up company but i also find it funny when i hear people talking about suing asc... And winning... Yeah right when you walk in the court room with your bootleg lawyer and then asc/wells fargo comes in with its all-star team of lawyers who get paid more in 1 day then your lawyer will make in a year... Do you really think your going to win your lawsuit?

My mortgage was sold to ASC in January 2007. Since then I receive voicemails requesting to call the ASC toll free number. After several minutes of wait-time and the company prompt telling me that "you have received this call because you are delinquent..." I will be connect to a rude, angry, ignorant representative for this ASC company. It is ONLY the second day of the month and they treat me as "delinquent!" There is a 15 day grace period for payments. The company's rude representative hung up on me after I asked her, "Have I have been late with a payment? Why do you request that I call your phone number that is in the delinquent collection part of your company?"

I am happy to read that I am not alone. This is a terrible way do business. Shame on you ASC!

I totally agree. I currently have 5 mortgages, ASC assumed 2 of my mortgages from WMC my payment was up to date during the transition and I have paper work to show but ASC is charging for late fees and my mortgage payments are always current but they insist also on calling me 5 to 8 times a day on all my phone numbers harassing me for payment even though I have 15 days grace period to pay. They always insist of getting a payment over the phone. This has come to a point now that I'm looking to refi my ASC mortgages with another company cos I cannot take the harassment any longer and Ive complained several times. May be I'll write a letter like my other friend did and see what happens.

I had the same problem with America's Servicing Company with numerous calls. I wrote a letter to them stating I did not want them to contact me by phone- at work, home, or on my cell phone. I sent the letter priority mail and received a letter stating that they will honor that request. I keep the letter on file in just in case that might try it again!

I agree, they just assumed my mortgage from GMAC & I made payments to GMAC prior to 12/1/06. GMAC assured me via letter that any payments that I made during this transition would be applied as a payment with America's Servicing Company. However, since 12/15/06, I receive numerous calls at work and on my cell phone. I answered one of the calls & requested they don't call me at work & change the number & she said she can't do that. I need to find out where they are located & contact the better business bureau to report them.

America's Servicing Company [ASC] harassing people, refused to acknowledge their mistake

Asc - america's servicing company is absolutely horrible to deal with in any way. Their customer service department employees have no idea what customer service is. I have asked several times to speak to a supervisor and have been refused. This company has repeatedly sent late notices and demand letters in addition to making repeated harassing calls regarding payments that they say have not been made. Even after we have submitted every piece of documentation that we can possibly obtain from banking institutions and the previous mortgage company, asc has refused to acknowledge their mistake, they refuse to correct the mistake and remove late fees and other "suspended" moneys, and they refuse to correct the information reported to credit bureaus.

Their refusal to assist us in this matter is causing financial hardship and unnecessary stress on our family and finances. What can I do? Who can I contact that will listen and take action? I know I am not alone in my total disgust for this company that says they "service" america's customers. They do nothing of the sort. I only hope that their home loans get sold to asc and they get screwed like the rest of us have.

Any assistance would be greatly appreciated.

My husband and myself did a loan modification with asc january 2011. they lowered our interest rate from 9.75 to 7.0, also our payment went from $1400.00 per month to $706.84, the first payment was not due until april 2011we sent the first payment in on february 2011. then again march 2011 we just wanted to stay ahead of schedule. everything was going fine payments were being made on time and we thought we were doing fine. I kept all the documentations of payments being made okay here comes the best part we get a phone call from america's servicing company in april of 2012 they were wanting to know why our mortgage payment was two months behind? I said excuse me but if anything our payments should be current plus two months. no in fact we needed to send them payments for january2012 because the payment that we sent in jan went for dec 2011 and february2012 payment went for jan 2012 I explained when we did the loan modification in 2011 we sent our payments earlier than were due. latisha woodside was who I spoke with on the phone said she was a loan preservation specialist and she would be happy to start a new loan modification process. latisha started telling me what documents I would need to start process. again I told her that we already did a loan modification in 2011 and the payments were not due to start until april 2011 I might as well have been talking to the wall all latisha was doing was making me angry because I know our payments were not late and I told her that, then ask to speak to her supervisor so she rang for her supervisor and it was a recording, boemi williams was unable to take my call at this time leave my loan number and name and phone number she would get back with me as soon as possible. she never got back with me. latisha is the person that got back with me. we are just dumb founded by america's servicing company. this is our second time around with them the first time our loan was sold to them by aegis mortgage company, that was the worse mess we had encountered we ended up filing chapter 13 bankruptcy in 2007 so they would not foreclose on our home. my husband and I have all the documents of proof of payment each month from2011 through2012 and now they are refusing to take our april 2012 payment nor will they take our may 2012 payment. what can be done about this? it is almost june 2012 that will make us 3 months behind plus late fees and any other fee they wish to put on our account. wells fargo d/b/a america's servicing company cannot win every time!

We are in northeast, asc purchased our mortgage from new century. it been a down hill ride ever since. attempting to change our homeowners insurance, purchasing flood insurance at twice the cost to us, when we were already covered. asc took the money right from our escrow account to pay the second flood insurance policy. then attempted to tell us that our payment will increase for the lack of a % in our escrow, after asc took $1600 for flood insurance that we had already paid for. we had to fight to have the money put back and the second flood insurance policy cancaled. paper work sent over, over & over again by our insurance company stating that our home was covered in the amount that was stated by asc. payment amount changes for really no reason. asc was not willing to work with us after we had major flooding.
we didn't ask to be sold to asc. phone calls come in to our home before the payment is due, then cservice states "it just a reminder" we have never been later, we have alway had the insurance amount that was requested for our home.
I would like to say what I personal feel about asc but that would be very rude to all of those who read this. but I think you are all feeling the very same way. thank you for letting me vent about this poor excuse of a mortgage company called america servicing co..

You loan is due on the first day of the month, not on 17th. if you go past 16 days you will get a late fee, plain and simple. the payment must be processed no later than the 16th day of the month, not in the mail by the 16th. pay your bill on or before it's due date and your problems will go away. the company is doing nothing illegal, it is doing exactly what is spelled out in your contract. so like the company you are complaining about, abide with what the contract says to do.

America's Servicing Company [ASC] Trying to make money off the consumer!

Just a few months ago my mortgage loan was sold to America's Servicing Company. I have always mailed my payments out on time and never had a problem with the previous mortgage company EMC. Now every month i have to call ASC daily just to make sure my payment posted. It seems to take around 15-20 days for them to post a payment. When i do call to inquire they tell me that it goes to a posting center, well this does not help the consumer at all. They gave me two options pay online and get charged a fee of $10.00 or pay by phone and get charged $20.00. It is my belief that they are intentionally trying to make money off the consumer either by paying the fees above or posting payments to your account late and charging a late fee. As i researched the internet about this company it seems that there are many complaints and lawsuits pending against this company and their practices.

So very sorry for the loss of your husband. After spending hours on the internet, I can see A.S.C. has hurt alot of people with their ruthless tactics. My husband and I are still fighting for our home and I wondered if you had found any relief from their thievery. So many have suffered at their hands but I havent seen anything recent and am hoping folks havent just given up and walked away from their homes. My husband and I got our loan sold to ASC 4 years ago. We had no trouble before them. But, they have 1/2 payment on the books then wait till we would get charged more interest and more service charges. We have been in foreclosure for 3 years. But now it looks like the are coming to the end.I have hired 2 lawers, both have taken my money and left me standing alone. Now I have to fight the fight alone, my husband passed in the last few months. i'm lost. I would LOVE to SUE the ###S. So if anybody in FL. is wanting to sue please let me know. LOST AND ALONE IN FL.

i agree with everyone on here about this sorry for and excuse mortgage company i have been with them for five long horrible years. i fell behind on my payments and they were already trying to foreclose on my home. the reps, arehorrible, nasty attitudes, and do not care if you loose your home are not. they are not trying to here anything you have to say. i want to participate in the law suite againist this company, and when they fall i hope they fall hard.reason being they didnt give us a fair chance so why should we give them one. also i have reported them to the B.B.B.watch out for this company they mean no good. they will hurt you instead of trying to help you i am a living wittness.

My wife & me are in the same boat. I just called the CT Attny General about them filing a lawsuit like the one they just recived 8.5billion from Bank of America(look it up) write your Attny General with enough complaints they will do the nessasary thing to bring these companys to there knees

I feel the same way we were granted an arm, and for the first two years we had no problems the arm expired and the problems have begun. Because of the problems with ASC we have been thrown off our budget due to late fees and so on.

You are all correct and something needs to be done about it. My mortgage was sold to them as well and they tried to foreclose on my property numerous times by trying to charge me bogus fees and etc. Also i registered on thier website to pay my mortgage online and when I go to pay it for some reason it doesn't take my password therefore i have to call to pay and be charge those outrages fees. Who can we complain to ? it's just too many people on here with the same issue...WHERE DO WE TURN I HAVE HAD ENOUGH!

I can't stand ASC, they do not return calls inwith 48 hours as they state. They do not try to help you in any way and they are rude and they never let you talk . Today I was actually on the phone with them today and they just hung up on me as I was talking. I feel like they are trying to scam me for more money.

Where can I find information on the law suits against ASC?
Or info on changing mortgage company?

Every month except for two I have sent my payment on time. However each month my payment does not post until after the 16th which then gives me a late fee. I have been complaining about this for months and now see that I am not imagining anything. I understand this company services people with bad credit however does that mean take advantage of us and make our credit worse. This company is horrible and their services are no where near perfect. I have read other comments. Where can I find information on the law suits against ASC? I would like to look into this future before this company puts me and other people in a deep hole.

After paying a $15.00 phone service fee every month to pay my mortgage because Americas servicing company had no website is bad enough but to add insult to injury the company now has a website and has the nerve to charge $10.00 to use that service as well. Americas servicing company is ran by a bunch of crooks!

America's Servicing Company [ASC] Consumers have no protection and little recourse when they get screwed

On October 30, 2004, I received a notice from Option One Mortgage (dated 10/15) that my mortgage was sold (again) and servicing was transferred to America's Servicing Company in Maryland ("ASC")...effective November 1, 2004. I was given a PO Box at ASC to send the November payment, but no phone number, fax number, email contact, or new loan information. I live in Hawaii and it takes a good 5 days even for "overnight" mail/fed ex/UPS to get to the east coast. Further, I'm not about to mail money to some corporation on the east coast without having at least a loan number to write on the payment to ensure it gets posted properly. Mailing the payment was not an option.

On November 1st I went on line to try to get information on ASC and see if I could pay on line that day. ASC has no web page...what I found instead was this site. I got ASC's phone number from here and called them, but they were closed (time difference, 6 hours). I got a recording saying "the mailbox for extension 3904 is full and you cannot leave a message", so I tried the switchboard extension...also a recording, also not able to leave a message. I tried to call Option One and to reach them on line to get information on ASC, but they don't recognize my loan number anymore and would not give me any information.

I called ASC back during business hours on November 3rd and 4th...more recordings. November 5th came (today), and still no payment coupon or even information from ASC, and still more recordings when I call. From this site I've gleened that I probably can pay over the phone, if I can ever get through to a person. I hate paying by phone, but at least my bank will have a record of the payment date so ASC can't say they didn't receive it when paid.

After what I've read here, I'm very concerned about my payments being posted on time to the right account, irresponsible credit reporting, and the real potential for my property taxes and insurance to not be paid by ASC.

I used to run the "portfolio department" for a large timeshare developer, and part of my job was to sell the developer's Notes Receivable with their securing mortgages to various lenders, and each lender had its own servicing company. In my experience, most loan servicing companies do a decent job, but one in particular was horrible and should be called an "un-servicing company". I got frequent complaints from frustrated buyers about the same things I've read about in this site, and I constantly struggled, to no avail, with the idiots who worked at the unservicing company to do their jobs right, especially getting loans set up quickly and payment coupon books sent out in time for the buyers to send their first payments on time. And I was on a first name basis with the idiots and was supposed to have some clout! Even their top managers were buffoons. Any individual buyers who tried to get help from them got stonewalled, which is why they came to me.

After my experience on a professional level with that unservicing company, and then reading the complaints against ASC here, I'm concerned about my own loan, to say the least. I am hesitant to send them any money, but I have no choice. I can only hope that ASC sells my Note and Mortgage to yet another company as quickly as BNC and Option One sold them (this is the 3rd mortgage company in four months!).

I understand how "the mortgage game" works, and because of the very nature of it (what each transfer entails), there should be strict limits on the number of transfers allowed per year (no more than two), and companies like that Unservicing Company and ASC should be shut down and sanctioned. Consumers have no protection and little recourse when they get screwed.

Beware of both ASC and Wells Fargo these people are all story tellers and you just might loose your house. Go elsewhere and check internet for background of other bankers you might go to happy hunting and good luck.

Guess what those stupid ### ended up relieving me from that mortgage because they know that they screwed up in the past, in fact I think that they still owe me some money, , I'm in the process of filing a law suit on them to get the remaining of my monies back, because they have been screwing customers all around the country. Therefore everyone should be getting there monies back, and put there ### out of Business along with Wells Fargo for taking on the responsibility of that Bogus company...I hope that they have a nice life, and go completely out of business, because of their screwed up Illegal practices ..

There is a better way for everyone posting on here to work with ASC. We were transferred to them and they started changing the terms of the mortgage and we took immediate action against them. We filed a complaint with the BBB in Iowa (their headquarters) and now they are being really quiet. We have not received an harassing phone call, letter, or anything in the past days. We have also reported them to our State Attorney General and the Department of Banking and Financial Institutions. Both government departments are taking action against them and the original holder of our mortgage as well. One thing that many do not seem to realize is that they are a mortgage servicing company and they are not your mortgage holder in most cases. With the recent breakup in the subprime market, it is very difficult to know exactly who officially holds your mortgage. Many of the recently fallen subprime lenders were what we call wholesale lenders and they basically fund their loans through lines of credit that they have with other banks. When they fold, it is unknown by most homeowners what has happened with the loan and who currently holds it. There is a difference between being the lender and being the loan servicer. A lot of the fraud that you are complaining about is actually a result of your original mortgage company. This is what happened in our case. Our mortgage ended up being a violation of state law and we are protected now by our state. We will hopefully even be entitled to fees that we had to overpay in the past as well. Check your state laws especially concerning predatory mortgages. Many states have laws out there now that have stipulations on the fees that can and cannot be charged to your account as well as the posting of payments. There is a way to fight companies such as this but you really have to be on your toes and do all of your homework. We have several agencies working together to help us and ASC knows not to try to foreclose during this process or they would just get in even more trouble. Congress is currently holding hearings concerning the subprime market so subprime lenders and servicing companies know not to do anything as they are all being watched very closely now. Also, although we all agree that the fees to pay online and by phone are ridiculous, they do have to pay to accept payments electronically and that is why they charge the fees. Some companies are willing to eat the cost for that, but ASC is either not able to or not willing to. Hopefully some of this information helps. Also, do not talk to customer service representatives if you are having problems. Insist on talking to someone higher up. It is actually even better to have a paper trail. Send everything via certified mail with a signature required then if they should ever try anything against you, you have proof that they have everything and they would lose in a court of law.
