here is the content of a letter I sent to customer service at B of A concerning a "hold" they have on check I deposited a week ago. This is a scam being run by B of A. What they do is withhold deposits for the full legal time they can withhold them to get the advantage of your money for a period of time. Meanwhile, you can't pay the bills. The spirit of the law is to protect from phony deposits from disreputable sources. I can only say that the source of this deposit is in better shape than BofA-and BofA knows it.
I would ask you to immediately release the rest of the funds from a deposit I made a week ago. The check was from a a major insurance company, as reputable a source as any. (if the source was suspect I would possibly understand). The only possible justification for holding back the money-which is causing us huge problems-is that Bank of America is stealing-holding the money hostage so they can use it for the full legal time they are allowed to do so. If done on a massive scale this could benefit the company, at the expense of the deposit holders.This is disgraceful behavior. I know you have stated you will release it Monday. Release it today.
bait and switch fraud
This mega bank is playing bait and switch with CD rates.
We asked to move a CD to the interest rate that was advertised on their web-site, when the CD matured and I was assured by their Customer Service dept. over the phone, that would be done, twice!
But, after it was too late to move the CD, as it had passed it's 10 day 'grace' period, up comes a response on their obscure customer service page that "Sorry, that can't be done".
The complaint has been investigated and resolved to the customer’s satisfaction.
Lesson to be learned. Never do any banking transactions over the phone.

I am writing to file complaints concerning this branch, Matthew Taft, and Arin Faison. I have been treated poorly as a customer. I have been lied to, called a liar, and have felt threatened. All I have ever requested was to have my account fixed.

Reps there lie about their names and mphantom offers for buyers who do not exist. They will call you with a fake name then call you back with another to close you. The pitch goes like this: hI YOU ARE A CLIENT OF OURS... DO YOU HAVE YOUR ADMIN NUMBER? ( A FAKE NUMBER, NO MATTER WHAT YOU SAY YOUR WRONG...) THEN THEY WILL PROCEED TO TELL YOU, HEY HOLD ON LET ME GET MY PROPERTY MANAGER OR VICE PRESIDENT OR WHOEVER... LIES ALL JUST SALESMAN... SO DONT BE FOOLED WITH AN ILLEGITIMATE COMPANY... ALL THEY DO IS STEAL MONEY FROM PEOPLE AND RUN... NEVER RETURNING PHONE CALLS AFTER YOU SEND THEM MONEY!
They gave my info to a 3rd party
Through my bank, Huntington National Bank, I applied for a Master Card. FIA processed the application, turned me down and still has not sent a decline letter.
What they did do was illegally send the letter to an address I had more than ten years ago and no longer use! FIA claims the address was on the hand-written application. WRONG! The app was generated on a bank pc that had only current info on it! I though it was illegal to send personal info to an UN-authorized third party, but FIA says otherwise. When I find out the culprit, I will file charges with the feds.

excessive overdraft charges
My son has an account with Bank of America. He is new to the Banking business. He thought he had more in the bank than he did. He used his ATM card for a small purchase of $6.89. The following day a purchase of $ 7.66. Atm card no problems right? no he was charged 2 overdraft fees of $35.00 each. My complaint is when does the Bank stop allowing you to overdraw your account? Are they out to collect as many fees as they can? Would they allow you to come into the bank and withdraw money that wasn't there? At what point do they look out for you when you overlook something and put a stop before you incur numerous fees? I also have an account with BOA and have never activated or used ay of my ATM cards because of this reason.I just keep enough money in to keep it open so if I need to cash a check or anything I can But my banking loyalties belong to Wells Fargo even though I bank from afar due to there are no Wells Fargo Banks in they city I live in or close by for that matter. Think twice before trusting BOA as they apparently are looking out for the bottom line not you.
Very similar situation happened to me several times over the years with BOA!
I was going through chemo and didn't know my balance had dropped below by less than ONE DOLLAR and I accrued almost $300 in over-draft fees because they continued to pay bills going out.
It was awful and didn't help while fighting for my life!

Beware old customer or new customer: Bank of america is doing what is called a research fee which charges you 20.00 an hour. I just opened an account with boa which should not be there name they do not represent america. Anyways I put in my payroll check which is from a huge and well known company. I took out half my check than 3 days later I got a decline...

Countrywide Home Loan's Full Spectrum Lending division is a disgrace to an increasingly disgusting mortgage business.
Last April, my wife and I decided to refinance our home. So, we made a few calls and settled on Countrywide's Full Spectrum Lending because we liked the agent we dealt with. His name was John Donaghue, and he suggested getting an interest only loan because we were only staying in our house another year or two and we wouldn't be paying off much principal balance anyway. This way we could save more money. I checked into it, and he was right - the money we could save by paying off an interest only payment was dramatically higher than the money we could save paying off a 30-year fixed.
So, we went with it. John Donaghue was able to lower our monthly payment by an astonishing $500 a month! We were so happy! So, we signed the paper work.
Imagine my surprise four months later when we looked at our principal balance and it was FOUR THOUSAND DOLLARS MORE than what it was after refinancing.
Now, I admit, we did not thoroughly examine the contracts. And that is a mistake we will NEVER make again. Because if we had thoroughly read the contract, we would have seen that the reason our payment was so low was because John Donaghue roped us into a negative amoritization loan. Which basically means that we pay only PARTIAL interest and the rest of the interest is getting added to our principal balance every month.
So, we were saving $500 a month in payments, but $600 a month was being added to our principal balance! I admit, we should have picked that up when signing the contract, but shouldn't Mr. Donaghue have TOLD US THAT WHEN HE WAS TELLING US ABOUT THE DAMN CONTRACT?!?!?!? What kind of company allows their sales force to do that kind of crap?
So, we had to refinance again. We're back to where we started and have had to pay closing costs twice in the past year. Not good times.
I wish the story ended there. But, on Christmas Eve we found out that our new mortgage company (Allied Home Mortgage) had sold our mortgage to another firm. Take a wild guess who they sold it to!
You guessed it - COUNTRYWIDE!
So, now we're dealing with this deceitful company again and we have no recourse, but to bend over and take it from them. (Not unless we want to refinance yet again)
To make a long story short, Countrywide Home Loans and Full Spectrum Lending are two companies that you should avoid at all costs.

unauthorized debit
Bank of America uses incorrect dates for transactions. Here is the scenerio...on the evening of August 14 I went to bed, knowing that my paycheck from work would be direct deposited at midnight on August 15th. I told my husband that if he was up later that he could go ahead and pay our cell phone bill online when he saw that my paycheck was direct deposited. He kept checking the online account to see when my paycheck was deposited. He finally saw it deposited into my account at 1:45am (Eastern Time). So he then pays our cell phone bill right after he saw that my paycheck had been credited to my account. Well the following day, the 16th of August I noticed an overdraft fee of 35.00. I immediately called the bank to find out why this incorrect fee was posted to my account. The customer service person said that I payed my cell phone bill on the 14th, BEFORE my paycheck was deposited. I told him that my husband stayed up and payed it at 1:45 am right after he saw my paycheck was deposited. I even offered to prove it by taking my cell phone statement into a Bank of America branch to prove that the bill was paid online on the 15th. The customer service rep told me that this would only prove when my cell phone company RECEIVED the payment. He just kept saying over and over that the debit was made on the 14th when in fact it was made on the 15th. I have given up trying to get them to credit the fee back to my account after four emails to customer service and just canned responses received in response to my emails. If anyone is starting a class action lawsuit then I am in!

The fraud dept. at FIA Card Services aka Bank Of America is crazy. They closed an account over a year and a half ago due to fraudulent activity and opened me a new account. They said all the fraud charges were taken care of and I signed an affidavit. The newer account was closed in Nov 2007 due to divorce and was paid in full in the settlement. In Feb. 2008 I received a statement for $218 owed due to charges that had been found on the original account. It was from a Best Western in Europe and I have never even been to Europe. I have signed affidavits, talked on the phone for hours (mostly to people with an accent from another country) only to be told the issue is resolved then a month later the nightmare comes back in the mail. Today I faxed them 15 pages of items i had received, filled out, etc... from them. I sent it 2 times and sent the affidavit 5 times plus I am mailing it. This has been one of the worse experiences ever! They are sooooo screwed up. I wish I had never heard of them! Beware, stay away, close your account while you can!
My family has been a victom of Idenity theft! Two diffrent accounts were opened up in mine and my husbands names. We followed all the protacals to resolve this problem and FIA services denied our claim saying we profited form it. The person's investagating our complaints has NEVER EVER talked to me or my husband! My husband is a Chief ADA and has been for 27 years and if they are doing this to us, then they will do it to ANYONE! My husband is the LAW and these people WILL NOT CALL US BACK TO EXPLAIN IN DETAIL WHY WE WERE DENIED! We got a letter and I've called my husband has called and nothing! Then yesterday I opened my mail-box and there was the BILL man I was pissed and then on top of that the interest rate was 27%!

late fees
I paid my credit card bill on saturday the 2nd. It was due on sunday the 3rd. I got hit with a late fee which then put me over the limit and and then the over the limit fee kicked in. That cost a total of 70.00 dollars for a bill that was paid on time. This is a pretty nice scam they have going here. Payments made on a weekend don't count but billing is ok...

I have had a Savingslink savings account with Countrywide Bank for two years. Bank of America has now taken over since purchasing Countrywide. For most of this time, the money just sat there earning a decent interest rate.
Recently, I have found better deals and decided to withdraw my money. Since this is a virtual bank, one way to do so is to link this account to an existing checking account at a bricks and mortar bank. I set up the link to my Wamu account and confirmed the small test deposits in my Wamu account. I even tried transferring a small amount first to confirm everything is working fine.
I decided to withdraw the bulk of my funds and initiated the transfer all according to the bank’s rules. One screen even confirmed that my transfer was within the daily maximum limit allowed.
Couple of days later, I received an email stating my transfer was declined and my transfer ability was suspended. I should contact customer service for more assistance.
Knowing that there is no documentation of a phone call, I like to test their customer service by email. I logged into my account and sent them a pointed inquiry as to why they had taken this action of declining my transfer and revoking my transfer ability.
I received a response two days later. The response was rather cryptic and did not answer both of my questions. Their response was “when this happens, transfer is suspended.” I sent them another email asking why “this happens, ” referring to the declined transfer. I am waiting for a response.
One of the phone numbers left in the email is to their Loss Prevention department. Undoubtedly, they believe I am a thief who has stolen my account access information and am trying to steal my money. When I transferred the smaller amount, they apparently didn’t care about a ‘thief’ taking that little amount.
In actuality, I believe this is their way of preventing large sums of deposits from leaving the bank. They will just say that they trying to prevent theft. They don’t care about inconveniencing their customers. They don’t want their customers to get access to their money. They only care about their own needs. As far as I am concerned, my money is being held hostage until I can prove I am not a thief.
My whole purpose with electronic banking is for convenience and funds accessibility. Their policies are contrary to my purpose even though they appear to provide the means to serve my purpose.

Well like other people, this company its nothing but lies! They took $415 from my credit card they tell me that with that money i was going to lock teh rate .etc etc... I tell the them that if in case i didn't get approve would they refund my money and they tell me YES! Well they didn't approve my loan and guess what; now either Sergio Lopez or his manager Will Cervantes have give me a call.
PLEASE BE CAREFUL WHEN YOU DEAL WITH THIS COMPANY. If someone knows what can i do, i really appreciate if you can send me an email.
I have a mortgage with Countrywide. I always pay my mortgage on time before the 16th of the month grace period. In November I paid my mortgage online 3 days before the 16th and was charged $6.00. I wrote to them and received no reply. In December I paid my mortgage 5 days before the 16th and was charged $3 extra. I wrote to them again and their excuse was that I choose to pay online and that because I choose to pay online I will be charged these fees. I am paid bi-weekly and for that reason cannot always pay by the 1st. I have called them to pay by phone and there is a significant fee for that. If i pay by snail mail the payment would probably be late and I would be charged a late fee. The internet is the only way for me. I feel this is very unfair and would like other people to know this before doing businesswith them. It is a small fee but does add up over time. In this time of financial hardship for alot of people, it's too bad that banks choose to gouge people
advertising fraud
This is now the fifth company I have listed my timeshare with and been scammed. I know, why did I do it again. I was contacted on 5/20/08 by a man named Frank Johnson who told me he had a overseas buyer for my Bonnet Creek timeshare that was generated from test offer ad that had been placed in Nov 2007 by a Jason Rivera. The offer was for $52, 360. They told me I needed to pay them a fee to actually get me into their system so the sale could go through. I asked tons of questions about the buyer, I wanted proof that there really was a sale in progress. I asked to speak with Franks supervisor and I got Richard Burton who again assured me that everything was ggod to go. I refused to verify the first time with Maria Rayes and thats when I got the call from the "manager" Brian Cole who once again assured me and convinced me to give them my money for the "for sure" sale. They said it would take 2-4 weeks and that the money I was paying them would cover the closing costs and the broker fee. I would not have any more out of pocket costs. I have been calling every 2 weeks since May and for a while I could get ahold of one of these people. Then they referred me to a Dave Falzone who said they had title work completed and that they were just waiting for the buyer to send paperwork. He said I should call back in 2 weeks if I didn't receive the paperwork. I started calling back on Monday [protected] and would get a receptionist that would transfer me to an operator. I called 2 times every day since and would get the same answer - They are not in yet, they have gone home for the day(mind you this was at 11a.m. in the morning, they would have someone call me.
Up until this week I still had faith (like an idiot) that the sale would really go through. I know I just wanted and needed it to go through. Today [protected] is when I actually got on line and started to read the familiar stories. I want these people stopped!
I want my money back!
they called me saying that they had a buyer for my timeshare in orlando, fl. they kept bumping the price up untill i could not say no.they ask me to fax them a sales type agreement and my credit card number for closing costs. they were to send me a cashiers check for 30, 000. after two weeks and a couple of phone calls i could no longer reach anybody but the secretary. i fould a 1, 500 charge on my card and they claimed that it was for advertiseing. unless you have money too throw away, stay away from them.
Charles..Keep fighting this SCAM company. You are not the first and will not be the last. Keep writing every complaint site and get the word out so everyone knows about this scam they have going. I still get calls thanking me about my warnings about this company. I have to keep getting back here more often to warn people. FIA Cardservices (Bank of America) offered me a settlement agreement for my past due credit account, but failed to mention that in order to secure this agreement they would be autodrafting a payment. I made my monthly payment as instructed and 2 weeks later, they tried to take more money out of my account. (They had my banking information from when I setup a draft months prior.) The payment cleared, so I had at that point made 2 payments for the month, and this created a chain reaction of bouncing in my account ending up in fees over $600+. The account rep agreed that I should not have been set up on a draft, and that I had not been properly informed. So she put in a request for a refund to my bank account. I was eventually told that I could not get any reimbursement for their abuse of my banking information, basically because of the settlement - since they were giving me a break, I wasn't entitled to any money back. If they did process the refund, it would cancel my settlement. That was the last thing I heard. Then today, I see that they went ahead and gave me a partial refund. When I call in to find out why I received a refund at all, when I was just told that I could not - the manager then tells me that they processed the refund but now they have canceled my settlement! These reps are NOT TRAINED TO UNDERSTAND WHAT THEY ARE OFFERING TO CONSUMERS. The first rep that offered me a settlement, DID NOT TELL ME that every single settlement agreement MUST have be paid with autodraft. Then the next rep that is "helping" me did not tell me that a refund to my account would result in cancellation of the settlement. How the hell am I supposed to make decisions to remedy this account, when these people do not know how to do their job and do not provide accurate information?
I have been told that they will offer me another settlement later this week... I guess that is their way of making up for their series of effing my account up! We shall see.
over draft charges
When you do an over draft Bank of American will reshuffle all the amount for the last 3 days by largest to the smallest, not by date. Then this will empty your acount quicker. I got 5 $35 overdraft charges all of the items were done the day before I the one I should have been charged for. On of them was $35 on a $2.00 charge.
Yesterday we were notified online that we were in an overdraft status. We immedately add enough cash to cancel charges. Last night a direct deposit was added, giving us an even greated balance. Everything was fine this morning and a couple more items were added with no problems.
After 2 pm we were notifies that we were again iin over draft status. The strange part is items appearing yesterday as pending and having already beed deducted from our account. suddenly reappears today as beiing deducted from our accound again. We tried to point this out to the bank rep. that they have deducted the same charges times 2. all she can tell me is that there's nothing she can do and that the charges will stay in place. So now not only am I complaining here but we are also changing banks. We've been with Bank of America for 20 years and often have found and reported these same practices before. It is my belief that over those 20 years they have probably erroneously taken several thousands of dollars from us.

Step One:
Apply for a job via their website or local branch. They want your money, so they should give you a job so you can pay them. But wait there is a catch. That is - they will turn you down (especially if you are white or male or over 40 or straight or a non-drug user). Of course, your application will end up in the batch where they will discover that you do not meet their "profile" of a ghetto employee.
Step Two:
Make sure they send you a denial letter and don't just ignore you.
Step Three
Once they turn you down, lodge a complaint against them at your local EEOC office.
Step Four
BOA cannot evade and also employees cannot lie to a federal investigator. (It is a crime to lie to a federal investigator.)

I mean good grief, they want to grab everyone's money, but yet so many people cannot find jobs these days. It's not like they would hire any of these people they rip off - people who are hard working and intelligent.

(In the old days when you owed money you could at least work off the debt or negotiate to get out from under it. But BOA wants to hold you down as a servant to them. They know everyone is struggling right now and they are always one step ahead in accounting tricks and deceptions.)
Once you launch an EEOC complaint, instead of evading your consumer complaints based on their illegal (or at least immoral business practices), BOA management would HAVE TO answer to the EEOC. BOA would have a certain amount of time to respond. (The EEOC is the most mortal enemy that any business can have.)
Many of victims should consider this. The very people who cannot get jobs or pay their bills are the ones that BOA rips off the worst.
Think about it, they want your money and proceeds from fees but yet they won't hire you? It's time to put Bank of America (a con-job name for Ghetto Bank International) out of business FOR GOOD.
Five years ago I closed my B of A checking account. I opened one with Wells Fargo. Three months later, I was notified by Wells Fargo that my account was to be closed due to the fact that B of A took action against me for having unpaid overdraft charges. This action made it illegal for me to have any banking in California so I had to go out-of-state and open an account with a Federal Credit Union that my family members belong to. I am a disable person and this has been an extremely hardship on me. How could I have been allowed to close my account without B of A (at that point) withholding any fees, overdrafts that existed on my account? I went back and checked my bank statements and discovered that I did not have any outstanding fees or overdrafts on my B of A account when I closed it. Now I am being hassled by collection agencies for the amount of 133.00 dollars (B of A claimed my overdraft was 30 dollars). Can I fight this? Is this illegal for B of A to place an overdraft on my account after I closed it?

I have had SO MNAY over drafts from them that I do not know about and all were never legit. I started to evaluate and analyze why and how since they have the WORST customer service in the world. Imagine thinking like "YOU" but thinking that way for a whole weekend and imagine that total about $1200 before Rent, Car payments, insurance, gas, groceries, phone bills, etc...
NOW DO YOU SEE HOW PEOPLE UN-INTENTIONALLY OVERDRAFT?! It is not fair for banks to run your charges through by order from high to low to maximize their profits when you made your deposit before spending the rest of the money and deposited cash! The middle and working class are the victims. The people that barely get by are trapped and the ones that have lots of money, profit with interest which is paid for by our overdraft fees.

Bank of America did the same to me..I checked my online balance and the balance at the ATM . I should have only been charged $35.00, instead they charged me $35.00 x 3. The 2 checks had already cleared my account according to the online statement and the atm...huge ripoff
Yes, they do use this practice. You may want to be aware because many banks are now moving towards this practice. It is in the terms of the account.
However, keep in mind that you can always avoid this by not over-drafting your account.

Will someone please contact me if there is a class action lawsuit filed against Bank of America for the way they handle their online banking and overdraft fees? I have an attorney in the family and I am having him check in on it and see if I have a case. Its not so much that I get charged overdraft fees for going over my account balance when using my Visa check card. If I go over and get charged a fee, I deserve it. Its that BOA's online banking is designed so that you are FORCED into overdraft fees. Let me explain what happens and if you are a lawyer, please contact me because I want to sue this institution on behalf of EVERYONE LIKE ME THAT GOT RIPPED OFF.
Example: Lets say you don't have $10000 in your account at all times. If you did, there wouldn't be a problem. The problem arises when, like me and every hard working American who because of the economy or other situations, is forced to live paycheck to paycheck. Lets say are coming to the end of the week and you only have $10 left in your account. You get gas and you accidentally pump $11 in gas. You do not get paid for another two days so your account online is shown in red (negative). You borrow money from a friend to cover the charge. Its past the cutoff time at the ATM, but to make amends you deposit $11 in your account to cover the overdraft. You check your account online and it shows you have a positive balance of $10. You wake the next morning and your account is still positive so you figure you got the money in on time. Wrong! You got the money in past the cut-off time, so the money will not post until the end of business the next day, but the online banking shows a positive balance. You therefore decide that you still have $10 and so you use your card to make purchases. Lets say you make 4 purchases for $2 each and 1 purchase for $1.99. You check your account that afternoon (the day after you overdrafted and made the deposit) and your account shows a balance of 1 cent. You go home figuring you are OK, but instead you get screwed by BOA. That afternoon after the cut-off time, they charge you the $35 fee for the original overdraft. Being they use the 'largest transaction first' this fee gets placed for posting first and your 5 charges (worth $9.99) get placed in order of amount after that. Therefore your balance shows you being in the red for $44.98. Worse yet, now the five transactions you made will get overdraft fees if you don't deposit another $44.98 in your account by the cutoff time. The problem lies in that in most circumstances they post the $35 AFTER it is too late to make a deposit to cover the overdraft, therefore you are caught in a vicious circle of overdraft fees which unless you deposit a huge amount in the bank you cannot get out of.
I have spent well over $4000 in fees this year ALREADY and its only July. I have finally decided to drop the BOA account and get one elsewhere. I should have done it MUCH sooner. I should also have kept a written register of my transactions, but BOA made me feel as if their online banking was excellent.
If there is an attorney out there willing to take my case, please contact me as I will certainly jump on board and I am sure there are PLENTY of people out there like me, that has plenty of evidence to prove my case.
Moral of the story is STAY AWAY FROM BANK OF AMERICA.

Bank of America's online screen shows that my 2 checks were posted in my account on August 15th, but it did not show on the screen until August 16th. I have deposited a check to cover this amount on August 15th; However, Bank of America still charged me $35.00 of over draft fee twice and additional $35.00 check returned fee. This is criminal acted by Bank of America. In total, including other similar incidents, Bank of America charged me approx. $315.00 of their fees. Bank of America charged their 'over draft fee' and/or 'check returned fee' on the same date I have deposited a check to cover this amount. Bank of America post our account activity (from largest to smallest) in the certain way, so that they can charge us their fees. If there is a class action against Bank of America, please count me in. I had 3 credit card accounts with Bank of America for several years and I authorized them to withdraw payments from my checking account before due date. The accounts were never late however a few months ago they lowered my credit limit to what was due on the accounts maxing out the accounts with no reason why. I exhausted every means to get their decision reversed to no avail. My credit report reflected VERY GOOD. I then applied for a credit card with another company and was approved for $10, 000.00 at 7.4 percent. This shows just how customer oriented Bank of America really are. It appears that they have a bunch of uneducated idiot's making decisions.
I am paying off the accounts and NEVER do business with them again even if they were the only bank in existence and I advise others to do like wise because they are scam artist, and will rip you off .
My only alternative is to report their action to the BBB, Consumers Affair and the Attorney Generals office with full details of past and present.
BofA is horrible. I'm researching other banking institutions to find the correct replacement. BofA has horrible customer service. I'd estimate they were rude and unprofessional with me or my husband 1 of every 3 contacts. This is either in person or on the phone. They also have an unreliable automatic payment service online. Every couple of months or so, one of the automated payments I have set up will just disappear. I find out when I do my monthly reconciliation. I now have to do my reconciliation every week. They have also never gotten it right for both my husband and I to see bill pay transaction schedules. If I set up a monthly automated payment for the electric bill from our joint account, my husband can see the transaction logged in the account but can never go into the actual scheduled transaction to modify it. Pretty silly considering that the technology is there to do this. I'm going to have a celebration dinner when I finally get rid of them.

B of A is ripping people off, they ...and I say they offered us a loan mod took $400 out of my account then made bogus docs, and denied our loan! I have perfect credit . and I cant get my $ back
Something not being said? My father spent that time in an alzheimers unit till he finally passed away. With a known balance on a 3.5% simple interest loan, the math said that the loan should have been satisfied this year.
Knowing that my part of the agreement was being upheld, I did not have reason to be suspicious until I found out the truth.
I personally wrote a check, 5 years ago, to bring the home out of foreclosure and bring all balances up to date. This was coordinated with BoA. All fees and penalties were satisfied and I have been paying the agreed upon monthly payment all this time even though BoA has never agreed to send me account balances.
I dealt in good faith and trusted that an established bank would uphold their agreement.
The lawyer I originally contracted to bring the home out of foreclosure and have BoA set up the repayment of the debt for the past 5 years is looking into why ALL the payments went to fees and penalties when it was paid exactly as requested.
He claims to be up against a brick wall because I did not establish 'executor' status and so they have no obligation to explain the missing money.
Being out of state, BoA knows the burden and is taking advantage of it. From reading other people's experiences with them I am sure that this is their true culture.

This is a capitalist society what do you expect? Businesses want to make money so they have policies that lead to that end. If Bank of America did not make money then you wouldn't want to bank with them. What do you think pays for the tellers, branches, security, website, debit cards and the convenient ATM machines that are located just about anywhere? If the bank didn't have money making policies then you never would have entered one to begin with. I have banked with B of A for 7 years and the only money they have ever made off of me has been through using my money while they have it to the best of their ability. From a business standpoint why would they want to change this policy if it is lawful and makes them money without bothering a large number of their customers?. I am happy to allow them to take advantage of my money for the smal time they have it so long as I gain the security and convenience that banking with a large bank provides.
Why isn't everyone outraged over this! Bank of America has done the same dirty little tricks to me, and I have been robbed of hundreds of dollars by them since they bought out LaSalle Bank in April of 2008. B of A WILL lose a whole population of customers b/c they are greedy pigs. I disdain most banking policies - they are created to take, take, take and not much else. However, nobody has balls the size of Bank of America, don't you think? They just helped themselves to how many billions of dollars in taxpayer money for their so-called "bailout"? They sicken me. Something has to be done in this country to stop this blatant robbery of the common people. You just don't know how I would love to have Bank of America's Executives to myself, alone in a room just once. NO CONSCIENCEs! NO ACCOUNTABILITY! WORST BANK EVER!
