I bought a car from Drive time, made all my payment, paid the payoff amount, was waiting for my title in the mail, instead I get a phone call saying I owe 896 bucks plus interest on it cuz it is last and I have 10 days to pay up, I argue with them and they argue back, I talk to the Regional Manager a mousy lil snot with his head up his A**, he disrespects me and laughs at me.

I hang up and go threw all my payment then realize the $800.00 I put down on the car is not on the original contract, and that there was a buy down that if you put X amount of dollars down your interest drop's from 24% to 21% to 18%... ect the more you put down the more it drops, this is an incentive to get you to put more down on your car.

I only had $800.00 which I borrowed from my Aunt who was there with me when I bought the car, she handed me the cash and I gave it to the sales woman who was doing the paper work, it was late about 7pm and they were rushing me out as they wanted to go home, so we rushed threw the paper work, I did not have a job at the time and I started my new job the next day at 4am so I to was tired and ready to get my car and go. My credit was bad as I had not been working and bills piled up.

So I took my paper work and car and started to leave and the told me I had to pay for insurance to leave the lot, so I went back in and wrote a check for $150.00 for one day of insurance or (23 hours) then I left I never check the contract after that day. I just made my payments. So now I am checking my contract and see that there was no notation of my down payment of $800.00 and my interest never dropped from 24% to 21% with the down payment.

So I call the company and tell them I found the error that no one put my down payment on the original contract, which was my only receipt. And they say if its not on there it never existed in our eyes, I said I have my Aunt who was there who loaned me the $800.00 dollars and saw the transaction happen with the money, they said that was not good enough I needed a receipt and if I didn't pay they would take my car and it would wreck my credit.

I asked them if they ever in there entire life doing business ever let a person with out a job and bad credit walk into one of there car lots and walk off with a car with no money down. They said 'NO' but if you don't have a receipt then you cant prove it. So I can let them take the car and file a civil suit and get all my money back but then I am without a car for 6 months to a year till I go to court, because I have a witness, or I can pay them the money they say I owe and do a class action against them, Which they will have to pay me the difference in 24% and 21% interest for 5 years and plus return my $800.00.

So that is what I want to do, If I could go with out a car and let them take it, then file a civil case I would get all of my money I paid for the car and be done with this $4, 000. piece of junk and get my 18 grand I paid for it back and buy a real car, wish I could do this but I cant do without a car for that period of time till I go to court. So Im here with all of you wanting to join a class act suit.

VERY BAD EXPERIENCE WITH DRIVETIME. I AM PAYING A CAR WITH AN INTEREST OF 32%, I LOST MY JOB AND BECAUSE THE NATIONAL INTEREST IS SO LOW, I CONTACTED THEM TO RENOGOTIATE MY LOAN. WELL, I WAS ALMOST RIDICULED. THEY DECIDED TO SEND THE TWO LATE PAYMENTS TOWARD THE END AND KEEP MY MONTHLY PAYMENT THE SAME AND EXPECT ME TO MAKE IT WHILE I AM UNEMPLOYED. I HAD TO PAY A FEE FOR THAT SERVICE! I WANT TO RETURN THE CAR BUT I WAS TOLD BY ONE OF THEIR REP THAT I WILL STILL BE RESPONSIBLE FOR THIS AMOUNT EVEN IF THE CAR IS RETURNED. THEY WILL MAKE SURE TO SUE ME AND GARNISH MY WAGES AS SOON AS I FIND ANOTHER JOB.
IF EVER I WAS LATE, THEY WOULD CALL MY JOB AND HARASS MY CO-WORKERS. MY BOSS ASKED ME TO TELL THEM THAT NO PERSONAL CALLS WAS ALLOWED AND THEY WERE A DISTRACTION TO THE OTHER EMPLOYEES, THEY DID NOT SEEM TO CARE AND KEPT CALLING. I ENDED UP WITH 2 WRITE UPS.
I WILL NEVER BE ABLE TO PAY OFF THIS CAR WITH THAT INTEREST AND THEY KNOW IT! I AM GOING TO SEEK FOR LEGAL ADVICE...

They will turn the debt over to this VERY Crooked attorney outside of Macon Ga and they use an alias in court as nemdegelt. BEWARE of these ###, because they will demand that you turn over very, very personal information such as your checking account and routing #'s. DO NOT GIVE IT TO THEM, WHATEVER YOU DO.
I am ready to file a class action suit against their unethical practices from the time they sale the car, up until something unfortunate happens and they repo it. I understand that I owe the money, but the company they use is using illegal tactics to try to scare people into doing what they want. I am calling an attorney on Monday to sue the crap out of nemdegelt. I am not some stupid ### here, and I know they can not get away with how they are treating people. I am also reporting them to the BBB.

a class action lawsuit over how you were treated when you didn't fulfill your obligations on a legally binding contract? good luck with that one lady. Everything that happened to you was a result of that.

I posted that and it would be a cold day in hell before I ever vote for Obama.. : )

One thing is this. You do not come after another car that has nothing to do with drive time. That is my entire point. These people took us to court. We showed up, they did NOT. So we are out of a days pay and these idiots do not have the common courtesy to show up to court when they are the ones suing us. The judge dismissed the case. Here we are almost a yr later and they have decided to place a lien on a car that I own outright which has ZERO to do with drive time or nemdegelt inc.
They send papers to me asking for me to fork over my checking acct #, routing #, w2's for the past 4 yrs etc... Who in their right mind would turn over personal info such as this to some back woods collector?
Also why wait 6 yrs to even send any papers on the car which has been gone since 2003?
And you Can file class action status if enough people file complaints against them for illegal tactics. Did you not know that bill collectors can not harrass you or threaten you? Well this company has.
Imagine that...

As, I am on a mission to get all those who have complaints to call the Federal Trade Commission. If they see a pattern, they will investigate the company. Their number is as follows;

I have filed a complaint against Nemdegelt Inc. with the FTC. I also looked them up on the BBB site, and they have a F rating with them.

They are now garnishing my husbands pay to the tune of almost $500 per month. We will lose our home due to these people now. Here's the kicker. My husband was NEVER served as to this court hearing, BUT the papers claimed that he was. LIES!
Also in the filed paper he was given 45 days to answer to said garnishment complaint. Funny thing is they waited until right after the 45 days were up to contest it to then send in the letter to his employer.
I beg out there if any others have had these same illegal underhanded issues with this company to leave a message here. I have every single intention of filing a class action lawsuit against them. It only takes 4 of us to start the preceedings.

I do not dispute the debt. I do however dispute how they illegally do things within this company.

they are garnishing my check right now for a hundred and sixty dollars a week and i gave the car back to them 5 years ago due to the 2 gear in the trans going out. I never got served but the court papers said i did. now i have to file bankruptcy to stop the garnishment.

I was served with papers sent to my employer regarding this lawsuit, but was never served notice of a court date or hearing. I would like to file suit as well. I'm going to the courts on my day off, Thursday, May 6, 2010. I received garnishment papers on Monday, May 3, 2010 for my employer. I have never rec'd anything else from this company(Nemdegelt).

The court paper does not even look legit. Please contact me with information regarding a class action lawsuit.

I have not idea what they are suing me for, I have not had a vehicle repossessed, nor have I every purchased a vehicle from Drive Time.

I did have to file chapter 7 over this nemdegelt inc. They went to another county to file the garnishment order against us, and of course we were never served due to that. That judge awarded them over $17, 000 when we only owed around $4, 500 on the car. They wait until the 7th year when it comes off of your credit to do these things. Ok so they also put a lien on MY car that had NOTHING in the sorts to do with the drive time car that was repossessed back in late 2002. When we filed chapter 7 we were told that the lien would drop off of the car. Well nemdegelt NEVER sent the appropriate paperwork to the state to drop the lien. I just sold that car for chump change, due to it not running and I wanted to drop it from my ins. The new owner called from the tag office, because he can't get the title over in his name due to the lien still being there. Nemdegelt put us through hell. My husband suddenly started having sometimes over 1/2 of his check garnished, and we were on the verge of becoming homeless over these people. We had no choice but to file chapter 7 in order to stop the ridiculously large garnishment. I hope and pray that nobody has to deal with the crooked wrath of this company. YES I owed money on that car from 2002. I have never once disputed that, but I do dispute owing $17, 000 and I think it's pretty low how a company can legally get away with filing court cases in counties which they know the people do not live in and then not have them served. I always thought we had the right to be served and to answer on it? Apparently this nemdegelt is able to get away with it some how. I want to sue. If any attorney reads this and will do this pro bono or on a contengency, I WANT IN!

I'm going through the same thing The NEMDEGE group say I signed paper work about a agreement on what I owe DRIVETIME I've never seen It
