Florida Department of Revenue child support payments not received

Case # 10-948-DR After years of not receiving CS the judge (McNichols) set CS at a paltry amount of $178.00 a month. Mind you Miguel Ramon Perales Sr.'s tax return shows he has made close to or over 200K for several years in a row. My son is also owed an arrearage of over 9K but the judge has "reserved ruling" since 2016. My son has not seen the arreages nor has my son received all the CS owed to him. Perales Sr. does not pay my son $178. as required but $170.88 monthly. Perales Sr. has skipped many payments and is behind on CS for my son (not including the arrearages). Please consider this my formal complaint on behalf of my son.

Florida Department of Revenue unethical business practice

I am writing this review as an employer and a Comptroller of a nationally owned automotive group.
Today I was amazed at the governmental behavior displayed.
Our payroll dept is comprised of 6 very hard working employees that are very self aware and always make sure the numbers check out.
From time to time a small mistake is made and corrected, no big deal.
We received a notice to terminate a withholding order for one of our employees and made every attempt to make sure everything was taken care of.
Because of the amount of moving parts to the deduction process, a payment was accidently sent to the Florida DOR .
I personally made the phone call to the employer line.
A agent answered and asked me to explain the situation .
I explained to the agent that it was a mistake on us, not the employee.
She wasted no time to tell me that The DOR DOESNT refund payments at all
no exceptions and we would have to settle it between the employee and employer.
She did tell me that the payment hadn't posted yet.
That didn't matter. No refunds as she said with a chuckle .
This is the absolute worst agency I have ever had to deal with.

Rene C

This is incorrect. My son's father has been refunded 4 or 5 payments that they continued to take after his obligation (the dor and cse), the amt that is calculated on the child support order, was fulfilled.

I have a wonderful father to my child and would have never gone thru the state for child support if I wasn't made to. This is by far the worst dept you can even imagine.

Florida Department of Revenue child support fsdu

The state has held my funds in excess of 10 days for the past three months. My rent has been late, I have been charged late fees.

I have called over and over and over. Spoken to customer service, supervisors and the Clerk of Court in my County. No one has answers, I have been yelled at, hung up on.

This money is court ordered, paid on time. It should go directly to my account no later than 3-5 business days.

I cam get no answers as to why. This is absurd.

Holding money for weeks to make interests while parent can't pay their rent. No explanations, no answers, yelled at by customer service, hung up on. Incompetence at its best. Who wants to join in on a class action law suit?

Update by TishRamsey
Sep 10, 2018 5:50 am EDT

For three months in a row the State of Florida has withheld payments that have been paid on time by the peor. These payments reach the state by the 1st of every month or not have not been in burst for over 10 days after receiving them.

I have called the State of Florida on numerous occasions, just to be yelled at by customer service, dismissed by supervisors. I have talked to the clerk of court in my County which says they have nothing to do with this state. The left hand doesn't know what the right hand is doing.

My rent has been late for 3 months in a row, I cannot pay my bills I'm getting late fees and overdraft on my account.

No one can tell me where my money is going, or where it's being held for the 10 to 11 days I do not receive it while I assume the state is drawing interest on that money. I will be contacting them again today on September 10th when this payment has been in their possession and cleared my ex's account 3 days after they received it.

This is a scam, fraudulent and unexcusable. Something needs to be done about this. This is pure fraud. When someone takes money and it's appropriate that money and cannot tell you where your money is or when you're going to receive it or even the amount, that is a scam, that is a crime that needs to be investigated.

I will be speaking with an attorney today and filing a class action lawsuit against the State of Florida. If anyone would like to join me feel free to send me just reply with an email if you can. Something needs to be done about this criminal activity. I don't care if it is the government they need to straighten this stuff out. They are ruining people's lives.

...These are things you should have thought about, BEFORE you made a baby with someone.

You think the standard of living is increased for your ex? They are taking care of your kid, while you whine about paying support.

Classic Deadbeat Dad Syndrome. It was fun to make them, but now that you are on the hook for 18-21 years, you dont want to pay? You should be ashamed of yourself.

Go take the money, that you dont want to spend on the up keep of your children, and AT LEAST get a vasectomy, to spare any future partners your cheap and selfish ways.

Florida Department of Revenue payment withheld from my child with no real explanation or investigation

My name is Brenda Pedroza and I'm filing a complaint because since March of 2018 the department of revenue has withheld over $313 from my child alleging that I was receiving government cash benefits when that is completely false. They claimed the same thing in 2017b and after months of back and forth and proving that I did not they finally released the funds in January of 2018. However, once my child's father finally paid a big amount they held a portion alleging the same. To be clear, I did receive cash benefits on a trial bases of Sept & Oct of 2017 and $60 in Aug of 2017; HOWEVER, the non-custodial parent started paying child support which EXCEEDED the actual cash assistance and they kept the entire thing to include the difference. When I withdrew from the program in October of 2017 all departments were notified verbally, electronically and I made sure it was faxed as well. This has been an ongoing issue with the department of Revenue because I am a single mother and those $300 they are holding are in dyer need. First off it's unfair that they kept the difference of the actual child support and the cash benefits but I accepted it because they claim it was the law; but then to keep more monies without reason or proper investigation is unethical and cruel to do my child. I have called and have screen grabs of the department claiming its been transferred or payment processing is reviewing but its been since March 2018 and we're now into Sept 2018 and this is becoming ridiculous. I need help and this is becoming extremely stressful.

Florida Department of Revenue child support case opened

Hello,

I've been harassed by third party with notices of non-exsisting child support! All those thieves want is your social security number, this is pretty crazy as they are making the form the exact the same way as the Florida Department of Revenue looks like and it all looks legit and real. This is huge and needs to be punished as fraud. Many people will fall for it unfortunately. When you call them, first question they ask you is "What's your SSN?" Absolutely fraud! We need to get Inspector General involved into all of this and get it resolved as soon as possible.
I'm attaching the copy of the letter that they sent. Feel free to contact us. Thank you!

Walter Castro.

Florida Department of Revenue the call center is a waste of time.

DOR send me a letter on July with the intent of drivers license suspension if i did not pay $404.00 within 20 days, so i send in this amount. Now i get another letter saying that they are going to suspend my license on August 23.
I call the [protected] which is their child support customer service and now the representative tells me that is is going to be suspended on August 21, because i still owe $ 200.00. And even though i had send them $404.00 on July 6, and then i made another payment on July 27 if $496.00 Looks like the DOR cannot keep their promise. And now my new employer has begun to withhold the child support from my weekly check.
But still whe you call this office they are not authorized to make any changes, now this representative tells that if i want they can call me back but it may not be today or tomorrow but maybe on Friday and today is Wednesday August 8, 2018.
I ask what good it does on having a call center if they cannot fix the issues that i am having.
We need to call our State Representatives to make changes in the law so that good parents are not being punished for the wrongdoing of this Department of child support and the DOR which enforces it.

Florida Department of Revenue child support issue

I have called on a couple of occasion trying to rectify an issue that has come up with my licence, only to have the issue still persist to this day. MY licence was suspended by the department of revenue for failure to pay a child support order. the problem is that there was never an order of payment at any time. So, not only was an order of payment fabricated, my licence which i use for work and to support my family has been suspended and the original order that suspended it was not taken off, it was only amended to reflect that the was no longer a suspension. this reflects poorly with the department of revenue which made the mistake and is not taking the appropriate actions to rectify it. it needs to be TAKEN OFF OF MY RECORD COMPLETELY BECAUSE IT NEVER SHOULD HAVE BEEN THERE TO BEGIN WITH< NOT AMENDED TO REFLECT THAT I SATISFIED SOME FABRICATED ORDER. i was told that it was up for revue almost three weeks ago. the first person that i talked to said to call back on Monday, which was three days later, and i talked to another person who said to call back in two weeks. well, here i am almost three weeks later and this has not been rectified. i will write whoever i have to to get this taken care of. at this point its a matter of principle and competency, neither of which i lack, and is evident that the department of revenue and child support does lack. i will not be another man who is swept away by a broken system. i fix broken things, this needs to be fixed.

Florida Department of Revenue harassment/wrong person

Hi. I am [removed]. I have been being harassed by third party notices due to me being the victim of identity theft and a person using a variation of my name attached to other information of mine. Upon researching i learned that the person who stole my identity has a pending case in Florida under the name [removed] which is being attached to me through third party contacts. One of these third parts contacted me and notified me that they had t o hunt down my information because they were being harassed by the Florida Department of revenue sending Police to their house to serve summons to the name that is similar to mine and has been wrongfully attached to me. The lady who contacted me stated her name was Carol Massey and she stated her and her husband served the Florida Department of Revenue a cease and desist order in regards to the matter stating none by the name [removed] lived there or was on their lease which could be researched and t he company ignored the cease and desist and are still harassing them and violating their right t o privacy. I live in Pennsylvania, but the person who used the name [removed] lives in FLORIDA and I am not interested in being held liable by Carol Massey or others due to this company using deceptive practices in order to attempt to collect an alleged debt that is obviously not validated as required by law. I am not in their jurisdiction or the right person. I filed an identity theft report against the [removed] name and the address that FLORIDA OF DEPARTMENT OF REVENUE has because that is not me, but it appears to only affect me and my finances and if the company is making an honest mistake due to this person stealing my identity and possibly providing them with a fake name and address or something, i don't wish to file liens on their company or agents nor sue them, but wish for them to resolve the issue. I understand they are not eyewitnesses and i just want this resolved so the homeowners of [removed] don't sue me or claim i caused them damages because of this company .

I serviced agency and its attorney Pamela A. Schneider with a notarized affidavit of letter of appointment of beneficiary notifying them that I am the Executor of an estate titled [removed] and provided them with proof of ownership of the fictitious name/entity which is registered with the state of Pennsylvania and not within the florida venue fraudulently alleged. UCC 1 lien was also filed against said agency and its attorney for conspiracy against rights under the color of law which breached terms and conditions of lawyers quid pro quo contract as well as various other frauds. Upon servicing of the unrebutted affidavit of notice of Executor and proof that [removed] is registered as an entity with limited liability within the state of Pennsylvania, there will simply be a deprivation of rights under the color of law suit filed against DOR and the Lawyer. I have an FBI agent that is my eyewitness to servicing, failures to respond and file said evidence, etc. I no longer wish to have these complaints be public.

Florida Department of Revenue child support

Case FMCE 13-3315 has been sent to the general magistrate. Because a judge had to be recused for stating that what A former judge did was illegal and also the father of my child. We agreed on 50/50 time sharing, because a Lil incident happened in 2013, the father of my child took her without alerting me or without my consent and he never gave her back, I have had attorneys take my money and a series of Miscarriage of justice done to me. The father is harassing me for child support, and refuse to communicate with me or give me my child back. DCF told him he doesn't have full custody and none of my parental rights was not taken away. I don't know where my child is and I don't even get to see her. For 4 years the father of my child has not asked me for child supprt. There was a restraining order placed when the father of my child falsely had me arrested in 2015 that stated I couldn't have contact with him or my child until 2020. I ask Laquita Cole in the Williams vs. Cole case ask that the department of revenue terminate child support, Dervol Williams refuse to give me my child, on grounds of parental alienation and child abduction. Dervol is greedy for Money he has put my child on medications with out my consent or alerting me. He refuse to co -parent with me

Florida Department of Revenue incompetent and unprofessional toward clients

I had file a complaint in the Orange county child support due to 4 years explaining and showing concrete evidence that a credit to my account t was not placed...Taking time off driving 3 .5 hours costing me a days pay and 80$ in gas and tolls back and forth being treated as a low life trying to fix the issue..In 2017 I was finally called by a representative from the dept of renevue Florida by the name of David Walrat. He took his time getting paperwork for the case and finalizing that I was owed a credit to my account by Oct 2017...He also explained to me he was retiring Dec 2017 and I was scheduled to have a hearing in Orange County to set the arrears to my case...I as sent a letter from the orange county court room for a Jan 21st 2018 hearing along with my daughters mother. We both got there 30min prior to our hearing in which it was set for 9am..we were the last one scene that day waiting an entire day for them to ask us "why are we here"...a total wasted of a day..It was dismissed and found to have paperwork on the case..I asked where is David Walters paperwork and they didn't have any..So they gave me a name of a new representative from the dept of renevue Florida to fix the case her name is Dawn renee..from the January 2018 til the April 2018 I have left her several messages in regards to my case...no calls, no mail, no emails...I contacted another number to find out what was going in with my case and within a week Ms Dawn renee returned my call stating she submitted a motion in court March 5th 2018 to be heard.. I was finally sent a letter for a May 1st 2018 hearing in court. Once again I took another day off I drove 4 hours gas and tolls 80$. I and my daughters mother went into the hearing room to once again" why are we here" I was told by the judge the arrears were 4k...and he asked how much do I think I owe..My response was nothing I am owed a credit. He then asked the mother the same question and her response was he doesn't owe me that amount but wasn't sure. He was quick to state parties not in agreement and was ready to dismiss it again..I tried to asked him where was the Packard that the worker David Walrath had investigated ...No response from the hearing judge. The mother got so fed up with this she demanded to set the arrears on zero...My complaint is we are all tax paying people and I am responsible with my family life they get paid to do a job and David walrath was excellent in doing so but Dawn Renee never even looked nor they and fix the issues costing me and the mother time and money just to wanted our time...

Florida Department of Revenue child support services jacksonville fl

I have a general complaint about the whole system entirely. This process for obtaining child support and actually receiving the child support has been painful and tedious. Why is this a cumbersome process? I can't imagine what others are doing if they don't have adequate income to maintain the wellbeing of the child or children. From start to finish it has been approximately 2 years to actually get a court order for child support. The office line to actually call someone doesn't exist. I have to drive 45 minutes to Downtown DOR office to talk with a person. There is no phone line! The phone number they give you goes to an automated voicemail that offers the options of going online. The online option tells you the phone number, it's a crazy circle! And this just blows my mind, the person requesting funds has to prove how much money they have! If I didn't have the means to a computer or car or income that I do have there could be no way that I would be able to get this court order through. This is a disgrace! And letting the other parent get off so easily! I just don't understand, put the single mothers through hell to prove how poor they are while the men do nothing, and oh yeah your back pay?! We will just pay that off over 75 years! It makes me so sad!

Florida Department of Revenue unsubstantiated negative credit reporting

My company currently deducts my child support payment from my paycheck. 2 years ago I detected a discrepancy where my companies payment cycle differs from Florida Child Support Enforcement billing which made them constantly send past due notices and making negative credit reports to the Credit Bureau's. To correct the situation I've been making additional payments every month to cover any shortages. I found out that in January they made another negative credit report even though there's a 0 balance due. If fact I have a surplus in the account.

Florida Department of Revenue unethical behavior

My Ex waited 3 years to come forward and tell me I have a son. I recently discovered that my ex hasn't been living in Florida for years. She's been living in Indiana. So not only am I paying child support for a child I've never seen before, I'm paying for a child that isn't in the same state as me. Recently, the DOR took all of my tax return money and gave it to Danielle. I've never been late on child support. The lawyer I talked to said it was a retroactive child support and they couldn't take more money from me. I'm not behind on purpose. How could I have known I had a son? My ex never came forward for 3 years to say I had a son. Am I supposed to be punished for something that isn't my fault? They told me they wouldn't take all of my tax return because they know I have bills to pay. What a bunch of [censor].

Florida Department of Revenue unethical behaviour

On January 18th, 2018 I submitted a revised court order to 400 W. Robinson St. which states that my employer is to deduct weekly from my salary $133.38 weekly with $0.00 in arrears, but instead the Florida Department of Revenue began deducting the amount of $233.15 and after I've made numerous calls and complaints they are now deducting 50% of my income despite the many apologies now totaling the amount of $1585.26.
Now they are trying to intercept my 2017 tax refund. What more do they want? I've called the Florida Department of Revenue numerous times to express my concerns and I was told that an adjustment to my employer has been electronically sent which is what I was told each time I've called.
So what is the point of having a court order if the Florida Department of Revenue can choose to ignore the order and impose whatever amount they feel like, this has already put me out of a home, what else is the Florida Department of Revenue trying to prove or accomplished. Their actions and lies can only be viewed as a personal vendetta. Can someone please help me?
