Re: Liberty Mutual Holding Company Inc. d/b/a Liberty Mutual Insurance and Ryan Kane Claims Specialist III
Date of Loss: 10/2/23
I am concerned by demonstrably Bad Faith Insurance Conduct:
(1) Liberty Mutual Claims Specialist III Ryan Kane denied in Bad Faith Claim number: [protected].
(2) Liberty Mutual Claims Specialist III Ryan Kane changed my name to “Steven” in Claim correspondence email dated October 4th 2023 enclosed herein. I presume Ryan Kane is confusing my name with another claimant on a different claim.
(3) Liberty Mutual Claims Specialist III Ryan Kane called me on 10/12/23 to tell me my claim is denied but he refused to provide an explanation of denial when asked for one on the phone.
(4) Liberty Mutual Claims Specialist III Ryan Kane failed to provide any correspondence with explanation of denial as promised
(5) Liberty Mutual Claims Specialist III Ryan Kane failed to provide even a letter confirming the existence of its denial.
(6) Previously, On 10/11/23 and on 10/04/23 Kane informed me that my claim "is a very simple straightforward claim” and that he was “all set to pay claim just need to speak with Barbara” He implied the policy was active and valid.
(7) Liberty Mutual Holding Company Inc. has failed to remit a Good Faith payment towards the damages incurred. Mr Kane’s aforementioned statement(s) constitute improper and Bad Faith denial including misleading the claimant.
(8) If a Good Faith payment cannot be made, I intend to retain Counsel to report the aforementioned misconduct to regulatory bodies including but not limited to Civil Action(s) to recover monetary damages from this Bad Faith Denial.
Desired outcome: Payment of Claim
022, I was injured at a Save a Lot store in Clendenin, WV, when six cases of cake mix fell on my head, neck, and back due to improper stacking. This accident left me with severe injuries, including a traumatic brain injury, migraine headaches, loss of cognitive abilities, a neck injury with a disc bulge, and damage to my mid-back.
Despite having substantial medical bills, Liberty Mutual’s adjuster offered me a mere $5,000 in August 2022, without any consideration for my medical expenses. This offer was grossly inadequate given the extent of my injuries. As a result, I had to hire an attorney.
Now, it has been 2 years, 6 months, and 19 days since the accident, and Liberty Mutual still has not made any meaningful offers to settle my case. My attorney and the adjuster have had at most two conversations. It seems they are aware of the situation and are avoiding settlement because of the complexity and cost of my case. It appears that Liberty Mutual has no intention of resolving this matter without a trial, showing a complete disregard for my well-being and the evidence provided.
Liberty Mutual's delay and lack of communication have caused significant stress and financial burden. I hope this review helps others be cautious when dealing with Liberty Mutual and consider the experiences of other customers who have faced similar mistreatment.
