On July 31st I entered into an agreement with NY Habitat for rental of an apartment at 340 W. 48th St. #3, NYC 10036 from October 11th through October 20th.
I was notified TODAY (October 7th) that the apartment is "no longer available", that they would substitute an apartment on 116th St. in East Harlem, that they were "very booked" and this was the only other apartment available. I find this extremely hard to believe.
Talk about waiting 'til the last moment to bait and switch. I thought these people were reputable.
I would appreciate any thoughts on some recourse I could take - City, Housing Authority, etc.?

New York Habitat, does not always tell landlords the full truth about clients and leaving landlords in the middle of their mist of issues. It's not legal by against New York State law to rent any apartment for less than 30 days, Weekly and daily rentals are not allowed by City And State law. 65 percent of landlords gets messed around by New York Habitat poor business handling, when clients don't get their security deposits back at end of stay ? Because New York Habitat have miss lead clients within transaction at times New York Habitat split security deposits with NY Habitat. Any clients that loss any money with NY Habitat should sew in court. NY Habitat, allows landlords to have dirty rentals apartments and rentals with bugs, rats. The bottom line for NY Habitat is their commission fees and 70 percent of their web site rentals apartments pictures are old, some rentals are fake .Bottom line here, please do not trust NY Habitat, please do understand that their promises are only in place to get their commission fees.
New York Habitat is a vehicle through which owners list their property for rental. Renters need to take into account that such agencies don't control or manage the properties they list and of course, can't ultimately control the behavior of individual property owners.
Occasionally but thankfully not often, an incident or emergency arises that might necessitate a property owner canceling with short notice. On such occasions, New York Habitat's agents do everything possible to relocate their client to another similar property. However, on short notice at peak times the selection could understandably be limited.
New York Habitat realizes the inconvenience that such cancellations cause and it has strict policies on owner cancellations to avoid such incidents becoming a habit. New York Habitat will remove from its listings any owners that cancel repeatedly, thus weeding out the "bad apples" from the bunch and ensuring that the rental owners it does business with are the most reliable.

I've used services with New York Habitat and similar in the past, and when you use an agency, the agency is still committed to accept that owners break the rules and don't follow through on a booking that is pending. While this is certainly an inconvenience, it is surely not the agencies fault.
