Rooms to Grow Poor Service and Fraud

On 12/31/13 I went to the Rooms to Grow Showroom and purchased a crib and dresser set + a crib mattress and changing pad for a total amount of $1904.39 including delivery and set up. I made a down payment for 1/2 the balance per their policy in the amount of $950 with a remaining balance of $954.39 and was told that the order would arrive within 8-10 weeks- which meant the furniture would be expected to arrive some time between 2/25/13 and 3/11/15. I was told that the full balance must be paid BEFORE the furniture could be delivered and that when the furniture arrived in the store they would call to schedule a delivery and collect the remaining balance. In light of this information, I budgeted to pay the remaining balance within that order arrival window accordingly. A few days later I cancelled the order for the crib mattress + changing pad in keeping with their 7 day cancellation policy, which left a reduced remaining balance owed for the crib and dresser of $638.39.

I received a phone call around February 1, 2013 from Rooms to Grow indicating that crib and dresser had arrived and they wanted to schedule delivery (several weeks early). At that time I indicated that I wasn't prepared to pay for the crib before the due date according to my budget. They indicated they needed additional monies to hold the crib and dresser. I agreed to make a payment in two weeks, which they said was okay. On February 18, 2013, I called Rooms to Grow and provided my Mastercard information for a payment of $50, which they accepted as promise to deliver the crib and dresser on March 15th. They reconfirmed that the balance needed to be paid BEFORE the furniture would be delivered and that they would call the day before to confirm. I told them during this phone conversation that I would have a check from my bank mailed to them for the balance of $588.39 and they indicated that this was acceptable. That same day, February 18th, I scheduled this bank check from my BECU Bill Pay account to be mailed to them by March 15th per our conversation.

Rooms to Grow called yesterday 3/14/13 around 4:30 pm and later around 7 pm while I was at work and left a message that they wanted to deliver the crib this morning 3/15/13. I called yesterday after work (after hours) and left a message for them to deliver assuming that they had received the check.

The delivery service arrives this morning 3/15/13 and assembles the crib. In the mean time I confirm on my account that the check has been withdrawn from my account (which it had been this morning for the balance- $588.39). I also notice that my account is overdrawn by roughly the same $500+ dollar amount, but I am not sure why. After the crib is assembled the delivery guy asks me to sign for receipt of the dresser and crib and noted the damages that would be repaired by a service guy that they would send out + then I notice a credit card receipt from my bank- that they want me to sign. I say to them- You should have received the check for the balance that is already withdrawn from my account which is guaranteed monies. The delivery guy calls Rooms to Grow and they say they did not received the check and stress that they need their money in order to leave the furniture. They ask for a check number which I showed them the amounts withdrawn from my bank on the computer- but couldn't locate the check number at that time. I also told them I could call my bank and let them speak to them to confirm the check. They stressed they needed their money. Things became heated- I told them I wanted a full refund and for them to take the furniture because they were supposed to verify according to their policy that the money had been received. Instead they fraudulently used my mastercard to pay themselves for the balance by keeping my debit card information on file from the payment on 2/18/13 unbeknownst to me. They took all of the furniture back with them and when I spoke to the manager Paula- she rudely indicated that she had never heard of a bank check in all of her 29 years of work and that I must be confused. I explained to her that this is common and I used to work in banking and this check that was withdrawn from my account is guaranteed money BEFORE they ever have to receive the check or make a deposit. She indicates that they are taking the furniture and she says she would refund the amount they debited today for $588.39 but not the balance including the $1000 I had paid through 2/18/13. Rudely stating I signed a contract despite my request for all of my monies back. I have since had to cancel my Mastercard to ensure that they do not magically debit my account for anymore monies and my account is minus $588.39 + overdrawn by the same amount for the unauthorized amount that they swiped this morning AND I have NONE of the furniture. I asked the bank to place a STOP PAYMENT on the check assuming they have not already cashed the check- but if they have- my bank and or I will go after them in court for this amount as well. I will be filing a police report once the unauthorized monies fully clear my account as listed on a transaction report. I have filed a formal complaint with Young America- the crib and dresser company that makes the furniture and have since had to re-purchase the set from them today for over $2000 to ensure that it is here in time for my child due April 23, 2013. I am 8 months pregnant currently and due in less than 6 weeks- the amount of time it takes for a crib and dresser to arrive.
