Unauthorized charges, unlawful deceptive sales tactics and misrepresentation, disrespectful and unethical customer service, false promises of cancelation options, omission of facts, exaggerations of timeshare use of product anytime. We entered into a timeshare agreement with Sapphire Starpoint Resorts on July 17, 2024. On that day we were given a glowing presentation by a sales representative. Right after we in an office with a men named Geraldo Lopez who finalized the contract with us. We agreed on buying the timeshare with the purchase price of $6,990. On July 17, 2024, we paid the amount of $699 as a downpayment for the timeshare. The downpayment amount was to be deducted from the original price. We agreed to the monthly fee of $139.79, starting on August 16, 2024. The amount was deducted from my account on September 3, 2024. We agreed on an annual fee in the amount of $492.32. Which was going to be deducted on January 2025. On September 16, 2024, Sapphire Resorts, under the name of (EQ GEOHOLIDAY) collected the amount of $761.32 from my credit card on filled, without my authorization. After contacting the bank to inquire about the charge, I was told that the charge came from Starpoint Resort Group. I immediately called Sapphire/Starpoint Resorts and the customer service that I received was HORRIBLE, UNPROFFESIONAL, and DISRESPECTUL. The representative was arguing on the phone. I was calling in front of my kids and my 16 years old daughter got upset while I was on the call. I question about the amount that taken out without our authorization and the representative said, “that was annual fee”. I told her that when we signed the contract, the amount that due for the annual fee was $492.32, which was going to be deducted on January. She continues to argue back and forth for about 30 minutes. We call the bank and cancel the payment and any transaction was coming from Sapphire/Starpoint Resorts, until we come to an agreement on the correct amount.
After this event, we tried calling and sending email to cancel the contract. They keep saying that we cannot cancel. Today, January 6, 2025, we had our last conversation by phone with the Sapphire/Starpoint Resorts representative. She said that the amount that was deducted on September 16, 2025, was for annual fee. According to her there is another annual fee scheduled in December 2024 and a new one scheduled for January 2025. I asked her to explain to me how an annual fee is schedule every 2 months, she gave me the run around telling me that her job is to get the account up to date as far as the monthly fee goes and that she was going to transfer me to another department to discuss the annual fee. I requested to be transfer right away and she never did. She continue on saying that if we don’t pay the past due balance of 4 months (October, November, December and January), plus the annual fee of $761.32 from September 2024, plus the annual fee of $761.32 and the upcoming annual fee of $761.32 for January 2025. This company is a fraud. They think they have the right to go into members account and take out money whenever they want.
Most importantly, we were led to believe this was a valuable investment. We were assured any time we were not the least bit happy with our ownership, we could sell it back to Sapphire/Starpoint. WE tried canceling by phone and email; however, they insist that we cannot cancel. We found out quickly this timeshare ownership is far from the extremely flexible vacationing that we were promised. Nothing is EVER available when we were free and able to travel. We have tried to use it, for the first 2 month we had with them, only to be told there is no availability. Nor been able to use one time since we bought. We have been trying to get a response to our concerns from Starpoint over the course of the last few months. We have called, sent emails and letters to this company, and our legitimate concerns still have NEVER been addressed. Not only are we told that we are unable to sell it back to the company as promised but, our complaints have been completely ignored or responded to with a message that we are in breach of our contract. Also the finance company has been illegally Overcharging our account with excessive interest fees and late charges well over the agreed interest rate. They can never give you a formula to explain why.
We were misled into this contract with Sapphire/Starpoint we were told our session would only be 90 minutes we held there almost 3 hours. All terms of contract were never explained to us. We were told that we had 10 days to cancel and receive a refund for the amount we paid. We were told that if we wanted to cancel after the 10 days, we were able to do so, the only difference was not getting the refund back. Our credit was perfect. We are responsible with our finance. Due to this scam, our credit score went down from 780 to 640. We demand to have not only our contract with Sapphire/ Starpoint Resorts not only be rescinded but, to be refunded. The money we have regrettably invested in this scam. If there is a class action lawsuit, please sign us up. We are desperate to solve this nightmare.
