On May 31st, my significant other and I signed a contract to purchase a home from Toll Brothers at North Hill.
That was a very exciting time, we are blending families.
We paid the $10k earnest deposit and provided a pre approval letter to the Sales office.
On May 30, we had to terminate contract. Our lender denied the loan. Per the contract, we had 45 days to terminate based on lender approval.
Although we were very disappointed, we never thought Toll Brothers would refuse to return our earnest money!
Leslie Reed stated they're going to stick to their guns because the preapproval was written & that they're not going to refund the earnest money and my options are to fight it with upper management or get an attorney or walk away!
The denial letter was also written.
Not only this was the worse customer experience we have experienced (in addition to failing to disclose the home had no light package prior to signing the contract) this seems to me a violation of UDAAP rules as the sales person was deceitful and is being unfair.
10k is not a lot for Toll Brothers but it is for us and it will impact us (harming us) financially.
I would like Toll Brothers to return our earnest money.
