CVS - Security guard

I was assaulted by CVS third party hired security gaurd in the store Feb 28 2022

I was targeted and followed around the store. When in the middle of purchasing my items the security guard had an issue about my delivery bag. He escalated the issue after I told him to stop harassing me about the bag. The dispute was simple in nature. The gaurd just felt inclined to harass me about leaving my bag in the front of the store in the future.

The guard pulls out his phone and takes the harassment to another level.

I then take my phone out to film him.

We exchange words and insults. But when I speak my mind to him he gets offended to the point he punches me in my left eye.

Its been over 6 months and cvs hasn't come to a resolution this is negligence.

Cvs insurance agent claims cvs isn't liable. Cvs agent refuses discuss details on why liability isn't shared between both security company and cvs.

Cvs insurance is now blatantly ignoring me.

The security company is ignoring me.

This has now turned into the liability of CVS for using a negligent security company.

There is no resolution to the victim being assaulted and its been over 6 months and the insurance agent has had an open claim since Feb 28 2022.

My damages grew from 10,000$ to 1.5 million on grounds of gross negligence for such a huge company.

Desired outcome: I want to be paid for grossly negligent cvs behavior and discrimination and assault.

Dispute Details

3:30 am I go to CVS to buy an energy drink and a pizza.

I'm a regular consumer at this location during these early hours and generally know the staff by face and the security.

This day was a new security gaurd. The gaurd would follow me around the store peaking through shelves and over counters blatantly watching me. I felt disrespected but I figured the gaurd was just new and trying to do his job so I didn't pay him any mind.

But when I go to purchase my item the Security harasses me about my delivery bag i have on.

I told him to stop harassing me about the issue. He had stated some type of protocol that I needed to leave my bag in the front in the future. But he had kept badgering on the issue after I made challenging comments about my bag yet not disagreeing with wat he said.

He felt the need to escalate the issue due to my challenging comments. I told him stop harassing me.

He pulled out his phone and started filming me. Something I've never seen security guards do. I felt extremely disrespected. I pulled my phone out to film the security guard as well. We began to insult each other verbally.

We exchange words but then he punches me in my left eye and warns me to never talk about him.

I fall down out of my sandels and my vision is blurred for a bit.

Cvs staff that was at the register witnessd everything and was extremely negligent and refused to answer any questions when I called the police.

I left the scene due to escalating energy.

I place a complaint with CVS that same day.

The insurance agent calls me and informs me the security company has liability and not CVS due to a clause.

This is not what lawyers have told me when I have consulted with them. Lawyers have told me its a shared liability between CVS and security company.

I inform insurance agent of this fact. Insurance agent then becomes grossly negligent. Insurance agent refuses to discuss the clause in any detail but continues to make claims of not having liability.

It has now be 6 months

I have no resolution.

Cvs and the Security company both are now acting grossly negligent by completely ignoring me and being unresponsive.

This is bold face discrimination

Insurance agents claims no liability from cvs but this is fraud. Cvs is now liable also for its gross negligence. Cvs is liable for using a grossly negligent security company. Cvs is liable for damages that they're third party has caused now ultimately due to the fact the security company chooses to arbitrarily ignore me.

My original demand grew from 10,000 to 1.5 million on the grounds of criminal assault liability, discrimination, gross negligence, emotional distress, loss of business and over the counter medical fees.

The details of physical damage included swollen eye, eye pain, heavy neck pain, minor vision impairment, a cut over left eye that was bleeding, pain in the left side of face. Ultimately the physical effects lasted about a month or so to completely heal.
