Walmart - gift receipts

I received a TomTom Navigation GPS device as a Christmas Gift from my daughter.

I brought the TomTom Navigation GPS device to the Manchester, Missouri store on 12 26 09 to return because I had received a duplicate gift for Christmas. My daughter, who gave the gift to me taped a Gift Recept as proof she purchased this gift from Wal-Mart for me to return the gift if I wanted to. Sammy (last name unknown) was my customer service clerk and he stated he would complete my return by giving me a Wal-Mart Gift Card. I told Sammy I did not want the Wal-Mart Gift Card with the amount of the Gift on the card, I told Sammy I wanted cash instead. Sammy stated it was against company policy to give me cash, he would have to give me a Wal-Mart Gift Card instead. I told Sammy no, I wanted to speak with his supervisor. Sammy brought his Supervisor to me and the Supervisor stated to me the company policy was to give a Wal-Mart Gift Card, if the original receipt was not included with the gift receipt. I argued with the Supervisor - I do not know his name. The Supervisor further stated he could not give me cash because it was NOT MY MONEY that purchased the gift in the first place. I rebutted stating that was the purpose of the gift receipt. Sammy, the customer service clerk stated they could not give cash because I did not pay for the gift with my own money, again I rebutted the reasoning of it being a gift to me and that was the purpose of the gift receipt. I then asked the store manager to call the police. He stated he would not. I requested he call the police because he had money that belonged to me that he was not giving me and if I took something from Wal-Mart that did not belong to me, they would call the police. The store manager refused to call the police. I attempted to call the police on my cell phone, but I could not get a connection. The store manager told me to bring the original receipt AND gift receipt and they could give cash in return. This incident took place approximately at 8;00 pm on 12 26 09. I left this store in Manchester, Missouri. I then called my daughter to ask if she had the original receipt and she stated she did not because she believed that was the purpose of having a gift receipt. My daughter told me to get the gift card, give it to her and she would pay me the amount that was on the gift card. I agreed to do this. I then began driving home and decided to go to Wal-Mart Supercenter Store #295 located @ 131 Eureka Town Center Drive, Eureka, Missouri 63025. I was waited on by a customer service clerk named Lisa, who took my TomTom and my gift receipt, processed the return and without asking, gave me the return in cash. NO QUESTIONS ASKED of how I wanted this return. I then informed Lisa I had just walked out of Wal-Mart Store #1177 @ 201 Highlands Boulevard Drive, Manchester, MO 63011 and was TOLD IT WAS STORE POLICY that this return had to be in a Wal-Mart Gift Card. Lisa stated when she is given a gift receipt, she treats it as if it is a receipt - which is the reason for having a gift receipt in the first place. I thanked Lisa. My complaint is against Wal-Mart Store #1177, 201 Highlands Boulevard Drive, Manchester, MO 63011 for not giving me cash on my return and insisting I take a gift card because I only had a gift receipt and not the original receipt. Also I am making a complaint against the store manager for not calling the police when I requested him to do so 2 different times when he refused to give me cash for my return. This gift was bought at Wal-Mart Supercenter Store #805, 653 Gravois Bluffs Blvd, Fenton, MO 63026 on 12/09/09. There is NOTHING stated on my gift receipt that it is store policy to give me a return in a gift card and not cash and the store manager did not show me any store policy stating this fact.

I have filed this complaint with the Missouri Attorney General's Office.

I agree with the complaint. The previous comments above missed the point. It's based on principle. The difference between a Walmart gift card and cash is that you can use cash to buy whatever you want, and at whatever store you wish. You do not have to be confined to buying from Walmart as you would be with the gift card. So, if every time you returned an item to a store for a refund and they gave you a store gift card instead, would that be acceptable? No it would not. I would not have called the police, but if the original poster felt strongly enough about the situation, then calling the police would not be out of bounds. The fact is, that particular Walmart and the manager refused to give him what he was rightfully entitled to - his cash money upon refund of merchandise. By receiving the GPS navigation gift and related gift receipt from his daughter, all ownership and related rights of such gift transferred to him (he is the new owner). Including the right to return an item that belonged to him for a full cash refund upon presentation of a receipt. Bottom line is that a Walmart gift card would not have been an equitable solution, and I would not have accepted it either.

If you called the police would you not have been charged for calling them over something so silly. I mean it is not like your life was in danger. They were giving you some sort of money. You were being silly for asking them to call the police for this. The police do not have time for petty things. Are you the same person who called the police for some silly incident at Burger King.
