My car had broken down in Kansas and it took me a month to get it home, when it got to the dealership I had $4000 repair bill so I tried to get a loan on line. Lenstart (scammer) agreed to loan me $10 K to cover auto repair and transporting. They deposited two checks into my account which I did not know know were checks at the time since I used a bar code at Walmart per their instructions...the checks were $2469 and $2462 and USAA FSB failed to place a Hold on the checks and allowed the scam to be executed ...USAA FSB only gives immediate credit for deposits under $500 and usually places a Hold on checks over $500...once the two checks that the scammers deposited in my account and were found to have no financial backing, USAA hit my account with the amount of the checks as a negative withdrawal and when my Social Security hit my checking account they took it. So USAA knows that SSA deposits are protected and Non-collectable and to cover up their error of not placing a hold on the checks the scammers deposited they classified the deposits withdrawals to cover up their failure to follow their own policies and procedures and took my Social Security deposited that was the sole amount in my checking account plus maybe an amount less than $10...So instead of treating the case as a Fraud case as I reported it to them and identity theft they classified it as an overdraft and took my SS deposit...they created the overdraft by not following the safe and sound banking practices they are required to follow and their failure to place a hold on two large checks allowed the scam to continue. Plus their personnel that I reported the fraud to when asked why they did not place a hold on the checks answered because I was a member of USAA for 11 years. USAA FSB personnel were not trained in Fraud prevention and did nothing to help me. The scammers could have had an accomplice in the bank since the checks should never have been approved for a mobile banking deposit due to way they are written, so the questions did someone internally approve not placing a hold? Plus, I got a call from a supposed employee of USAA telling me to just forget trying to get my money back, it was gone and I should get on with my life. Social Security funds are protected and USAA did not protect my funds nor make them available to me as required by Federal law..USAA is knowingly violating Federal law in taking my SS deposit and by failing to treat this as a Fraud case so that they can hide the numerous error in what took place on August 14th through the 16th.
Desired outcome: Return of my Social Security deposit of $2674 that they used in their efforts to disguise their failure to place a hold on two checks that were maliciously changed and should never have been allowed to be deposited through their mobile app.
