I accept that from now on I should read the “terms & conditions” a lot more closely, but I just couldn’t conceive of a company offering a trial that starts the day you place the order. Well that’s exactly what this fraudulent crook of a company decided to do and I get some third world inept operator taking my call that tried her hardest to up-sell me on another month of a product I didn’t even want one month of.

So I tell her that I received the acai product on Monday it was now Wednesday and I’m wondering why they charged me $89 after 3 days, she replies no it is charged 10 days from the time you place the order, you failed to call us back in time. I exploded! What sense does that make to start my trial of something before I receive it? I didn’t get to TRY it! She say’s oh well since you’ve already paid for it now why don’t you try it for the rest of the month. This crap went on for way too long and finally when I was frustrated to the verge of tears did she give me the cancellation instructions.

Can you believe after the 10 times I said I didn’t want it had I hung up too soon I would have still been in the system to get hit again next month! Scam artists! I am pissed and still out of money. And the cancellation process is so detailed and ridiculous, and they cover their criminal butts by putting this stupid info in the terms they know people rarely read through completely. Uuuggghh!

I canceled my subscription to this product two months ago and am still receiving the product and being charged to my credit card. This is completely unacceptable.

You order a sample of acai berry for $1.95 and they don't send it to you but put a charge of $88.95 for a product you did not order or receive.

I don't know anything about you not receiving the product, but your "free" sample (just pay shipping) works like this...
I was offered the same deal (by another company), but when I called, before accepting their offer, I asked some questions of a most reluctant representative and FINALLY got some answers that might apply to your situation:
When you order their "free sample", they automatically also ship (and charge you) for their full-sized product, (at a 'discounted' price) because you "cannot get the full effect" with just the "sample" and they assume you want more!
Of course you can return the full-sized product to them (at your expense) and they will deduct that portion of what you are billed!

How's that for a "free sample--just pay shipping charge!

When I received the trail package, I returned it unopened the very next day. I included a note asking that no future shipments be made. They could not be reached by phone. Two weeks later, another shipment arrived and my account was charged. I called again, and was told that it was too late to cancel this shipment. The phone attendant was very rude!

Have been trying to cancel this product for 2 months. Cannot get through to a live person on calls and most of the time, the line disconnects. I am still being charged on my account and have not yet stopped my card since I use it often for other products. This company has got to be stopped.

I only asked for the free sample and now I get this product every month and am being charged. I even sent back the rest of the product to the address and have not received any money back.

The 800# is [protected] Monday – Friday, 8:00am – 4:00pm PST. I am trying it tomorrow. I agree that the website is very deceptive the binding contract is hidden at the bottom in a link you have to open up by clicking terms and conditions and no contract for a diet club is mentioned at all on the homepage itself or anywhere near the free sample application or when you are putting in your credit card info for the purpose of paying the shipping and handling which is what you're led to believe is all they are doing with the credit card info. Upon further research it seems the company Cheshunt Overseas Ltd is owned by British company Tesco which shocked me. You wouldn't think a reputable company like Tesco would be scamming people online but, under another name, apparently they do. If you need the addresses to write to they are: Cheshunt Overseas PO Box 642, Charlestown, Nevis, West Indies, St. Kitts. and Tesco is Tesco, Customer Service PO Box 73, Baird Avenue, Dryburgh Industrial Estate, Dundee, DD1 9NF

I ordered ACAI BERRY on 12/19/08. By 12/30/08 still did not recieve it. I e-mailed the company to find out what is going on. No response! On 1/2/09 $87.83 was deducted out of my account. On 1/5/09 I finally recieved the product. I called the complaint line to demand a full refund. I was informed my refund will take 7-10 days. "I HOPE!"

I ordered the "free" trial of this product and the "free" 30 day supply of Colon xR and was ask to only pay shipping. It arrived and I have not used it, but my checking account was debited the shipping charges and an unexpected $78.00 and another $78.00 from the Colon xR (for nothing) and $78.00 from the Acai Berry. I looked online and found this is happening to lots of people and I really feel dumb. I went to the bank and they were able to contact Acai Berry and they said there were a certain number of days to return it and the information was on their website. I went home and searched the website and in my opinion the only way in the world to know it wouldn't be the free product would be to read the "Refund and Exchange Policy" at the bottom of the page. Why would anyone look at a Refund and Exchange Policy unless they had purchased a product and wanted a refund or exchange? I did not purchase a "free product", I paid shipping and had no idea I would have to cover the entire website to see if their were strings attached. If there were stipulations about the free offer it should have been clearly visible in the area that needs to be filled out for the free product. The way this offer was presented in their website seems to me to be fraudulent and/or misleading. When I returned home from the bank the Acai Berry person sent an email that said he will credit my account $20.00, I wrote back and told him I wanted all of my money back and would send the pills back (none were used). I haven't heard anything but did file unauthorized transfers at my bank for all three unauthorized transfers of money from my account and tomorrow I will be contacting the Attorney General of my state and the Attorney General for the state of Florida. I did a little research and found the same person owns both companies and his name is Nicholas Molina and is from Miami, Florida. Next I will contact the better business bureau for both states and the Consumers affairs division for Florida. Oh, and the Attorney General and better business bureau for Nampa, Id. SO FAR that is all I've thought of. I am elderly and this made my banking account overdrawn and I am really mad!

I just called in and made a cancel on my free trial just as well. they told me i would only get back the $2.00 because thats what i paid for in the the S&H. However they said they would not charge me because i canceld my shipment. now i dont knwo if it will stop it. but i guess all i can do is sit and wait. to see what happends. I mean i started to believe that this little pill would help give me the energy that i want. but really i felt tired and wanted to sleep in alot. as i seen more and more stories about how females losted the wait i started to noticed that they would always have the same name word for word same people just a different name. and also they would have just the body shown NEVER the whole face or a real live seen on you tube or something just to prove its really real. i do hope alot of us can come together and really do something about people taking our money for putting our trust in them.

I have read more and more complaints about the Acai Berry. And I want to thank everyone for putting them up here. I have been trying to call the customer service number to cancel my order before I was billed. I had a feeling in the pit of my stomach when I first agreed to the "trial offer". I can not get thru to anyone at the customer service, so I have cancelled my card and they will not be getting any futher money from me. They were supposed to send me a month supply, but all I got was 10 days worth. Thanks again everyone for posting your comments, you saved me a lot of money.

On October 24th I ordered a free sample for 3.95 and notated that my account would be charged on the 15th of every month of $89.31. Imagine my surprise when on November 11th my account was charged and still no free samples. I called and was told that they were backed up and my free samples went out that morning and I would have a refund processed back to my account. I called the next day to get a transaction number and was told that it was processing and hung up on.

I have called nearly everyday for 14 days and have been told 9 different stories. I am promised I'll get my refund right away and in the next breath I have to wait. When I ask to speak with someone higher I am told they are in a meeting no matter what time I call. I still do not have my refund and the company continues to hang up on me.

I have contacted my bank to see if the charges can be reversed and as of today still nothing.

DO NOT DO BUSINESS WITH THIS COMPANY. IT IS A SHAME.

I ordered their free sample, it came in a prepaid envelope with no statement for the shipping and handling fees, when I called the number on the website no one answered, I kept getting a busy tone. I couldn't cancel my order so I had to cancel my card and place my account on fraud alert, the bank stated that if anymore charges come through to my account I can file fraud charges against them.

I also ordered a "free" sample of acai berry that not only did nothing for me but I cancelled 3 days after receiving the product and now am being billed $29.95 on my debit which also overdrew my account because I was not expecting it. Who do I contact to file for this lost money besides my bank and possibly an attorney if it happens again?

I opened AOL and found all this wonderful information about the ACAI Berry as we have all heard about on CNN and Ophra and I clicked on the order button to read the terms & agreements for the 14 day risk free trial just $6.95 for shipping & handling. I continued to read that I would continue to be billed each month and that I would also receive the product each month possibly forever unless I cancelled.

I wanted none of this since I was already stuck in this situation by my own stupidity and I immeidately closed out the page without giving any information SUCH AS MY CREDIT CARD NUMBER and I was billed on my next stated $70.65 by a company called Direct Marketing which I can only assume is involved with my first mistake which I am still receiving.

I need to get the new charge removed I consider this charge to be a crime.

I also need to make sure I keep from getting no further charges from either company that is if they are 2 different companies. I have been receiving the merchandise faithfully from the second situation at least.

This company charged $89.31 to my card without authorization! I don't even have the product nor did I order it. The only thing I agreed to is $1.00 for a free trial offer. They said all I had to pay was shipping and that is what the $1.00 was for. Instead I am now being changed $89.31 for a product that I did not order.

I tried contacting this company today and they REFUSED to refund my money. They said that I 'signed up' for this product which is false. I did not sign up for anything. I didn't even get a pop-up window to sign up for a product!

I have had to go through my bank in order to get my money back and have had to cancel my debit card. It will be 10 days before I will hear anything back from my bank regarding this erroneous and illegal charge and equal amount of time for a new debit card.

I am irate. Something has to be done to stop this company from lying and stealing our hard-eared money.

The same thing happened to me. I thought I was only going to be charged the 3.95 for the FREE bottle. I even called before the 14 day trial was up and the guy obviously didn't take care of it because I was charged the 89.31. This is a RIP OFF! I am furious and I will pursue this and get my money back!

Everyone should file a complaint with their local Better Business Bureau.

I applied for a free sample of acai berry diet and colon cleanse to pay only shipping.
I used my debit card for payment.
In the last week over $200.00 has been taken out of my account as a purchase. I had no idea what it was and through the help of my bank I found out it was this diet company and all it's related companies. I am now working to be reimbursed for these withdrawals. I am very upset and can not understand how they can get away with this.

I need my money back. I only ordered a free trial of Acai-Berry that I have not received, but found out that your company withdrew $39.95 from my account plus $2.20. I never authorized your company to take a cent more that $ 2.20 that was supposed to be for shipping and handling. IT IS VERY SAD THAT AT SUCH AN ECONOMIC STRESSFUL PERIOD, YOU COMPANY HAS DECIDED TO STEAL FROM PEOPLE! I need my money back.

I ordered on-line a free sample S&H $3.95 of Acai Berry. But if I would have gone down to the bottom of the second page screen, I would have seen fine print. But since I was only ordering (I thought) a sample, I did not read that they would be deducting $44.95 from my bank account. They tell you $3.95 then take out more. It is theft, pure and simple. This is purely a scam.

The second time I went on the site after I found out they took that money from my account, I saw the paragraph, and also saw that Pennsylvania was not even listed on the state dropdown menu.

I phoned the number they gave to cancel, and get a refund, but they never answer. The second number you call disappears from your screen on the phone, and does not connect.

A friend and I decided to give this diet a try. I rec'd the free tablets of Acai berries and colon cleanser and a few weeks later rec'd another bottle of Acai berry tablets. Didn't think much about it since the first bottle only had 14 capsules and my friend's had 30. She came to me a few days later telling me about all these charges on her checking account from different companies associated with the Acai berry free trial. she started trying to get the trial canceled and after she couldn't reach anyone she called her bank.

I decided I should take a closer look at my account and noticed that I had been charged fees from Body Cleansing for $80, Pricelimbo for $8.51, Price Saver for $10 and decided it was time I called my bank. I asked to have my debit card canceled, but was told it wouldn't do any good. I gave the CSR the 800 number on the bottles I rec'd and was told he could put a block on them for a year.

I noticed another fee today and called my bank back. I was told again there was nothing they could do and I would have to go into a branch and have a new checking account opened. I asked if I could at least give him the other 800 numbers that had charged fees to my account so they could be blocked and he had no idea what I was talking about. Explained what another CSR from the same bank told me a few weeks ago and he put me on hold to go see if anyone else there had any idea what I was talking about.

I am getting ready to start calling all the 800 numbers I have to try and get this thing canceled, but I hope no one else falls for this scam. I can tell you I have the websites support@colonex700.com and mytrialsupport.com to try and cancel some of the fees and I have the numbers [protected], [protected], [protected], [protected]. Good Luck to all!

THE "ADVANCED WELLNESS RESEARCH INC", OF NAMPA, IDAHO, IS IN MY OPINION A COY BUNCH OF CONFIDENCE ARTIST WHO ARE APPARENTLY PERPUTRATING A "SCAM" WITH THEIR PITCH TO THE INTERNET PUBLIC (NAMELY ME) TO TRY ONE (1) "FREE" BOTTLE OF "PURE ACAI BERRY", WITHOUT ANY MENTION OF A FUTURE "AUTOMATIC" ROLLOVER ORDER/SHIPMENT OF THE SAME PRODUCT EACH MONTH WHILE SILENTLY/STEALTHLY CHARGING MY CREDIT CARD IN THE AMOUNT OF $78.81 FOR SAID SHIPMENT, ALL WITHOUT MY KNOWLEDGE/AUTHORIZATION, WHEREUPON I HAVE BEEN UNWITTINLY "SWINDLED" AND "SCAMMED" BY THESE INTERNET HUNSKTERS. YES, THIS ORGANIZATION HAS DONE THIS TO ME WITH WHAT THEY CONSIDER "IMPUNITY" ...NO FEAR OF ANY LEGAL REPRISALS/REMEDIES FROM THIS DUPED CUSTOMER. I SAY TO YOU ALL OUT THERE IN AMERICA WHERE THESE PEOPLE OPERATE WITH "IMPUNITY", JUST BEWARE! AS IS PROMULGATED IN BUSINESS LAW THROUGHOUT THIS COUNTRY, "LET THE BUYER BEWARE" (CAVEAT EMPTOR). THEY PURPOSEFULLY DO NOT E-MAIL YOU IN ADVANCE TO GET AN AUTHORIZATION FOR THE IMPENDING SHIPMENT...LEAVING YOU IN THE DARK LIKE A MUSHROOM.

IN ATTEMPTS TO CONTACT THIS COMPANY TO CANCEL ANY AND ALL PARTICIPATION I HAD TO SPEAK WITH AN OUTSOURCE CUSTOMER RELATIONS AGENT IN INDIA WHO HAD SOME "CANNED" COMMENT THAT HE REPEATED SEVERAL TIMES IN SOME SORT OF PIG LANGUAGE AND ENJOYED MY FRUSTRATION EVERY STEP OF THE COMMUNUCATION IF ONE COULD CALL IT COMMUNICATION. IF YOU ARE LOOKING TO BE TAKEN AS THOUGH YOU HAVE FALLEN INTO A NIGHTMARE AND WANT SOME REALLY DREADFUL FRUSTRATION IN DEALING WITH THEIR DISPUTE RESOLUTION MARKETING TACTICS OF OUTSOURCED CUSTOMER RELATION SPECIALIST ON THE TELEPHONE IN INDIA...THEN GO FOR THIS SCAM.

I ordered Acai Berry, free sample and paid shipping. I immediately found reports of fraud. I never received the product and called to cancel. They canceled the account no problem. Few days later I got two bottles of the free product in the mail. I also got something called Total Cleanse. I apparently paid shipping and handling on this product as well.

Problem: I never ordered this, I didn't even know who they were. Thanksgiving long weekend came and they quickly charged my account $84.79. I requested new card from my Bank. Christmas came and I had a bad feeling. Sure enough, when I checked, they quickly pulled off another $84.79. They also sent me a product this time, which is in its original package. I have invoices, where phone numbers are never listed.

Please contact, if class action lawsuit is filed.
