Bank of America unauthorized withdrawal of funds from my checking account

On the 15th of February, I logged on to my Bank of America (hereafter referred to as BoA) net account to verify my payment for the month. Funds are automatically withdrawn on the 17th of each month for a predetermined amount. BoA was having some sort of "We Love Our Customers" promotion (Valentines Day?) and offered a one-time deal of paying just $15.00 for the February billing period. I "signed-up" made the proper changes, authorized it and that was that. Move ahead to February 26. I go to my bank to make a deposit and discover, to my horror, that I have only $13.00 in my account: my balance should have been $940.00. Coincidentally I get my latest statement from BoA that afternoon. Instead of billing me $15.00 for February, they have billed me TWICE for $300.00 ($600.00 total) and then on 02/19 they bill me again for $327.00, apparently for the March bill (which isn't due until 03/17). I call customer service right away and although I'm assured, after 45 minutes, that I will get the initial $600.00 back, I am told that this probably happened due to "Operator Error"... ie, it was my fault (!) I make a second call the next day when I learned of the $327.00 taken on the 19th. And while the guy ultimately agreed that I was owed the money, this twit actually had the nerve to come right out and say that it was my fault. When I asked for a letter from BoA explaining what had occurred so that I could present it to my other creditors when I was late for any payment, I got a flat out "NO". Flash ahead to Monday, 03/05. I receive a check for $327.00. I call BoA and ask where the other $600.00 is. The CA tells me that she sees a request for the funds, but that it has not yet been authorized. Today: 03/07. I call Customer Satisfaction w/ BoA. I inquire, once again, as to the status of the $600.00 . This person proceeds to tell me that there is no refund coming, that $300.00 was used to pay last month's bill, and the other $300.00 is for this months bill, again due 03/17. In disgust I finally said, "here's the deal, you folks send me my $600.00 AND a letter of apology, or you won't see another payment from me. Let's see...$600.00 versus $11,000.00 in an unsecured loan. YOU FIGURE IT OUT".

I have a debt with BOA and I'm working with Counsel for Debt Solutions on this matter. I contacted BOA back in April and advised them of this situation and I also told BOA that they are not authorized to withdraw any funds from my account. All was well last month (May) and BOA did as expected. Today, when I checked my account, I noticed the BOA had processed an automatic payment for $570 without my permission. This equates to a financial hardship for me this month. My bank, Frost Bank, has filed a complaint on my behalf, but that will take at least 30 days to resolve. The simple fact is that BOA took money from my account without my permission, which is theft. Since this was done electonically, this is a federal crime. I'm sure that BOA slips money into the coffers of our elected leaders so I don't expect any help from the federal government, but I would like to make an example of BOA and let everyone know the type of snakes at BOA. They have stole money from me and perhaps from many others even though we, the American public, lent them money to stay solvent.

I ask our government and any public official or prosecutor to take a look at this matter because BOA is stealing from the American public and no one is holding them accoutable. Think of it this way, if I was to take money from you, you'd call the police and I'd be arrested. We need to call the "police" on BOA and have them arrested.

If you're with me on this, let's work together to end the reign of terror by BOA.

I closed on a BOA mortgage last year, and just found out they did not send the lender closing instructions to the title company for 2 more business days and they changed some of my forms that I signed on at closing. I had Dept. of Insurance investigate and $98, 000 was taken out of my escrow account closing. I closed my accounts so they cannot get money out of them but the money was missing and spent on something else. I was told I was getting a Fannie Mae loan which I find out I do not have. Do not take complaints through Executive Office in NC or OCC because it is worthless. Write to your State agencies. They will help.

BOA changed my checking account type without my knowlege and start charging account fee. When I contacted customer service regarding the fee, they simply said that the fee free checking account is not available and I have to paid the fee.
Here is another incident.
I deposited $15,500 with american express travellers check using ATM. when I checked my balance after 5 days it did not show up. When I called BoA customer service I was told that it will take half a month until they verify the check since it could be a fake and I can not access my money until they collect money from american express. After 12 years as a royal customer, I was treated like a criminal. I called american express and they told me if the bank called them they could clear the check immediately. I called BoA customer service again to ask them to call the american express but was told that they do not provide those kind of service and can not return my money until it goes through their internal process which takes 15 days and if I write a check before they clear it will be bounced and they going to collect fee for the bounce check.

I turned them into the bbb and the ftc, i hope it helps.

Bank of America balance transfer fee scam

I recently applied for a Bank of America credit card. The offer that was mailed to me specifically stated, in at least 3 different places, "No Balance Transfer Fee". It was stated on the front of the offer as well as the back. I wanted to consolidate my debts so I transferred 4 balances totaling a little over $19,000 to the card. Now they are fighting me tooth & nail over the Balance Transfer Fees that they are trying to charge me. This bank has the worst customer service I have ever seen. Some seem nice on the phone, tell me to fax them the offer and that they will call me back, and they never do. I just got off the phone with the sixth customer service rep I've spoken to, and this woman was as nasty as they come telling me that my credit will be ruined if I don't pay.

Quite honestly I don't know where the confusion is. The offer states "No Balance Transfer Fee" all over it!

I've been a member with them for 16 years. Never missed a payment. Never even ever been late. I call in to simply transfer a balance from another credit card. I get transferred to another depart. This other department tells me they're updating my profile; since it hasn't been updated in 11 years...so they say. BofA asked me every question under the sun. past residences, base salary, commissions receipts, bonuses, any alimony, wanted to know about my stock portfolio. I finally stopped the guy and asked him all I want to do is simply transfer my balance from another credit card to my existing bofa credit card. I have the available balance and I've done this a hundred times since 1998. He finally tells me I can't. I called earlier this year when I found out they raised my interest rate. This is killing people. I hope Congress sticks it to the banks.

It seems to me, a IT professional that they have some kind of a program in place that holds back filing overlimit charges until you get close enough to the limit so the charges themselves put you over again... I.E. recuring income for them, this time around they waited almost six weeks.. After they put me over last time I transefered money over and swore not to touch it so that when the $35 went of eventualy there would be enough to cover the charge.. ha ha the funny thing it seem I only had 34.82 available when they decided to bill me for the previos time they put me over the limit! there should be a law that stops banking from putting an personal account over the limit with charges! and then charging an overlimit FEE for THAT action! Nice scam though! Last word! If I go over my limit- charge me! teach me.. But putting me over the limit with charges... hmmm I dont know man :) I'm over with 0.18c so they'll be keeping an eye on my balance i suppose untill they can put me over the limit aggain! I have news for them though! I'm getting out while I'm young!

My interest rate jumper over 20%, my credit rating is excellent and all bills are paid on time, paid $500 to these pirates last month and thought the bill would be lower, however, they tacked on "purchase and adjustments.$185.41... card has been cut up and not used..where are the purchases? Finance charge of $256.12... minimum payment is $396.00... after sending them $500.00 5 days ahead of due date..this notation was on my statement...Your account is overlimit (geez... I wonder why?)

We must receive a conforming payment, that brings and keeps your balance below the credit line... within 20 days of the above statement. Needless to say, I was boiling and tried calling these idiots to try and lower the finance charges, I no longer use the card and had used it to consulate other bills quite awhile ago... huge mistake!

Now... I agree with other complaints on this site, but what can you do?
See a lawyer and do a bankruptcy?... No. I worked to hard for my excellent credit rating..am just venting my frustrations and cursing the day I signed up for a Bank of America credit card!

I have the B of A Alaska Airlines Business Card, and you would think at least business customers would get decent service. It's not the case. I got the card for three reasons: 1. consolidate accounts to a single vendor; 2. Alsaska Airlines Miles; 3. No Fee Transfer.

The first statement came with a $450 transfer fee, which on the first call (when I could get a human) I was shaken down like a criminal for trying to get my money back. I called back and got another human and warned them I wasn't going to be very pleasant and that if they would prefer getting a manager I would be ok with that. The rep decided to take a flier on me and agreed there shouldn't be a fee and would remove it. When it didn't get removed by the next statement I had to call again (and was lucky enough to get another human) where the person actually got the fee removed. Meanwhile I've spent more than $450 in time and agony.

Now I am trying to resolve another issue that deals with another card on this account, and I think they have pegged my number because I can't even get close to a human there.

Long story short I think I will move my business back to the previous card where at least I could always get my issues resolved quickly. The only thing I didn't like about them was I couldn't access the corporate card online. Bank of America is tarnishing Alaska Airlines good name.

Same thing happened to us. We purchased a new home, and haven't liquidated the old one yet Credit report went from 802 to 780 not like it even dropped out of excellent, we haven't missed any payments have paid ahead but the interest on card jumped from 9 to 21%. We opted to pay off the card and to cease doing all business with BOA, but that may not be an option for everyone. This kind of predatory lending seems to be a pattern with certain lenders of which BOA is one, and it has significantly increased profits for shareholds.

There are two things you might consider.

Option 1. Buy a share of stock, you can even charge it to your card, as a shareholder you can attend the sharehold meetings, which means you will have to attend this meeting to effect any changes, large shareholds rarely attend meetings they send in proxys however shareholds have the power set or reject policies, if all card and mortgage holders were also shareholds they could band together to change any policy.

However if you are waiting for the good fairy to come along and wave her magic wand you might want to opt for option 2.

2. Write your congressman and support and vote for the guy that actually doses something about this. There was a bill introduced by Sen Dodd, D Banking (the one running for president), about actually setting rules for predatory lenders, however it has been my observation there can be unintended side affects to this sort of legislation.

I actually did both so see you at the next sharehold meeting.

All the best,
LA.

We have had a Bank of America Credit Card (AAA Auto) credit card since 2005 with an ARP of 7.9%. All payments have been on time. Suddenly the rate went to 21.99%. The first person I talked to said maybe it had something to do with our credit report. All our payments are on time, and we have not had any recent changes but I checked it anyway, and it was fine. The second person I talked to said it had nothing to do with the credit report, but we did not use the card enough. He said he did not have the authority to lower the rate. Can the percentage rate be raised just because you don't charge enough on the card? Is there any action that can be taken against the company.

Thank you!

Bank of America late fee rip-off!

This complaint is against Countrywide Home Loans. Countrywide posts there payments late to intentionally charge customers a large late fee. This has been done to me numerous times. I would warn anyone against taking a loan with Countryside Home Loans. There practices are deceptive and rip off the customer. Anyone taking a home loan - Stay far away from Countrywide Home loans. They will not post their payments timely even when provided with bank information.

The company address is:

Countrywide Home Loans
Po Box 660694

This consumer complaint will save other customers from having the same problems.

In preparation for the birth of our daughter in June 2008, my wife contacted Countrywide in Feb of that last year. They told her that they could put us in a Hardship/Forebearance program that would delay our mortgage payments for 4 mos. while she was on Maternity leave. This sounded great as we are a dual income family and without one income it would be hard to make payments. The rep told us that after she went back to work we would negotiate how to catch up. Whether that be adding the amount to the end of our loan or making larger payments. We jumped at the chance for this. When my wife went back to work in Sept. the top item on our list of priorities was to get our mortgage taken care of. We called Countrywide and they told us that a negotiater would be in contact with us. About a month later we called again with the same answer. This is the same thing we have done for the past several months with the same answer every time. They said not to make any payments that it would go to the principal and not to the past due balance. The last contact before now was in January. We were told that they were so busy with the Mortgage Crisis that we would be dealt with soon. On March 17, 2009 my wife was in a Head-On car accident. Luckily by the hand of God, my wife was not hurt. The accident was not her fault, but the car was totalled . My wife called the bank to see about getting a loan and because of this mortgage thing our credit is ruined. At this time she decided to got to a Countrywide branch and sit until she got it taken care of. When she went of course nobody at the office could do anything but her on the phone. The rep informed my wife that our home is in foreclosure, and would be sold May 5, 2009. We were devistated of course. We have the money in savings to pay the arrearages. We just have been told not to pay. Over the past few days we have spoken to an attourney, and contacted several different people at Countrywide with no help. I told them 'I want to pay my mortgage. I don't want to file for Bankruptcy.' I asked for them to tell me who, where, and what to pay. They can't give me any info. They claim we were offered modification. Which we never received. They claim that we were sent notices of foreclosure which we never received. I read that it is the law to send certified mail(signature required)before foreclosure can start. When I mentioned this to the Countrywide rep she agreed then when I told her that we never received it, she changed her story saying that we must have gotten it. I explained to her that this alone was grounds for litigation. She told me to do what I needed. Suprisingly when we got home today there were four diferent letters stating foreclosure. When we called they said our file is still in foreclosure for May 5, but we were being considered for modification. We asked when we would know if we qualified the rep said to call back in 30 days. That is 9 days before our house is to be sold. This is Ridiculous! I just want to pay my mortgage! I can afford my mortgage! We both have Jobs! Why can we not get this resolved! Anyone that can Help please contact me. I am desperate. We don't want to lose our home, we dont want to file ch 13 and ruin our credit for years over a mistake by a Scandalous company.

I have never dealt with a company before such as Countrywide. Not only have I found that they are lying scoundrels and will tell you anything to get money, but they are totally UN-AMERICAN. When you attempt to talk to someone in customer service, you get someone that can hardly speak english. I initially thought it was someone working here in the US at first but later found that I was talking to someone in INDIA.. SO UN-AMERICAN.

I had a great credit score, 829 before I started dealing with countrywide, my initial loan was sold to them. Hurricane Katrina caused all insurance premiums to increase. My insurance premium increased from 2, 000.- to 6, 000.- . I had initially allowed countrywide to draft my checking account for the principal and interest of $653.96 plus insurance and taxes escrow bringing the total to $842.00. Due to the insurance premium increase, my payment now has jumped from the $842.00 a month to $ 1, 372.58 a month. Countrywide starting drafting the account without a notice to me at all. When inquiring about the increase, I was informed to the situation after spending over 3.5 hours on the phone with countrywide. Since I was deliquent according to Countyrwide in the amount of $2, 762.92 which represents 2 payments, I agreed to pay the sum of $2, 000.00 on July 31, 2008 with a payment the middle of August 2008 of $762.92. Now I am getting a call from Countrywide India saying that I owe them $2, 771.44. COUNTRYWIDE really sucks. They took the $2, 000.00 payment i made and put in in escrow. Not what we agreed on. Something really needs to be done about them. They are nothing but liars and cheats.

My wife and I have been battling CountryWide (which is now Bank of America) for several months. We started a few weeks ago contacting everyone we could in Washington D.C. We were pleasantly surprised that almost all of the government agencies we spoke with seemed to be pretty flabergasted and fed up with CountryWide's behavior. Everyone that posts a complaint here also needs to go to the website of the Comptroller of the Currency. They are the Government agency that regulates CountryWide . Their website is WWW.helpwithmybank.gov. If enough of us file complaints there, they will have to act.

As a first time homeowner, back in 2007 when I took out a loan with Country Wide, I had a credit score of 705 and had had a down payment of 43, 000 ...a 20% down payment, because of the down fall of mortgages starting to rise, CountryWide stated that I would only qualify for a fixed rate of 8% interest rate, I could not refinance due to high penalties and had to wait a year.
NOw, my credit has suffered and unable to refinance due to poor credit...SCAMMED!

I was notified by Country Tax Services that I owe them over $11, 000 because they erroneouly paid my property taxes. I have received threatening letters with a return envelope demanding that send them a check for the amount or they would add payment penalities and take collection action against me. I have never had any dealings with this company and have paid all of my property taxes. They seem to expect me to pay for their negligence. These guys sound like a bunch of bottom feeders. I can understand why the financial services industry is in such a mess.

I recieved a notice that my payment would increase by $305. due to "escrow Shortage" they claim i have a "projected " shortage of $805 for the year due to my taxes increasing. Now I'm no rocket scientist but $305 x 12 is a hell of alot more than a "projected shortage" of $805 for the year ! This being bad enough...but my proerty taxes are slated to GO DOWN by $860.00 this year! THESE GUYS ARE THIEVES ! DO THIS TO ENOUGH MORTGAGE HOLDERS AND THEY GET BILLIONS TO HOLD AND COLLECT INTEREST ON FOR THE YEAR! BTW THEY ARE NOW OWNED BY BANK OF AMERICA...MY SOLUTION? APPLY FOR A BANK OF AMERICA VISA CARD...GO ON A SHOPPING SPREE AND THEN CALL EM UP AND SAY THE CARD WAS STOLEN! YOUR ONLY RESPONSIBLE FOR THE FIRST $50.00 BY FEDERAL LAW...TWO CAN PLAY THIS GAME !

Absolutely! And then when you call and challenge them they are rude and combative! I do not ever plan to purchase a home again but if I do find myself in that position, Countrywide will absolutely be the LAST place I turn to for financing. We also ran into the tax issue last year when we went to close on a property we sold. We closed within DAYS of taxes being due - COUNTRWIDE-SCREWME said they'd paid the taxes - county (who I would trust WAY before I would CW) said no they hadn't. Had we NOT gone to closing when we did and coughed the money out of our pocket - we would have been delinquent, etc.

It takes ALOT to get me mad, but let me tell you - having just got off the phone with an egotistical jerk at CW, I am almost in tears and he had the absolute BALLS to tell me that "oh no, our company is not in any financial trouble" . . . Maybe not but you sure are KILLING alot of good, honest people, with your unethical practices!

Countrywide misspent our escrow account, making payments that were not even on the escrow schedule. This put our account behind, NINE months later they come at us with a $700 a month increase in payments that were already $1800 a month. When we call them and try to talk to them and point out that THEY mis-spent it, not us, they put us on hold ad infinatum till we give up and hang up. (6 hours at one point) This is criminal and the american homeowner is being raped but this company is continuing to get away with this as the nation focuses on the variable rate mortgage problems.

Oh shut your lying mouth. You are obviously a plant from this corrupt company. I almost got a mortgage through this company until the contract was deliberately confusing with numbers going all over the place. A fast talking broker tried talking so fast as to hopefully confuse us. We were dissatisfied with his behavior and the numbers not being right from one page to the next, so I did some research. The complaints are universal, into the thousands with the same complaints being registered over and over all over the country. How do you explain the FBI investigating them? They are labled a predator lender who lend money to people they know in advance cant pay it back. The number one complaint from people is that their payment is conveniently not registered until its one day late, even on bank transfers. This is to generate millions of dollars in rip off revenue. The hell with the fact that thousands of lives are being screwed with, let alone late fees and credit ratings. I had 2 different brokers I went to after I opted out from signing with Countrywide, and both said they wont do business with them. Both told me horror stories of deceit and fraud from the local CW branch. I decided for our own safety to redo the whole process with a legitimate lender. It was much tougher, but I was glad, because it showed me the lender was being very careful who they lent their money to. CW is basically organized crime. And we don't need an idiot like the previous blogger blaming tens of thousands of people when one corrupt company is to blame. Do not deal with them.

What a bunch of whiners! Most stories are from those with bad credit and therefore high interest rate loans. Guess what, you have to pay those off, its not the banks fault you have bad credit and have to get a high interest rate loan. Now your blaming them for you having no money to pay it. Thats the rules, you lose your home if you can't pay. Try to Pay attention!
Some have ARM loans which is your mistake because yes the interest rate can go up, hence not being fixed...duh! But guess what, the change in the rate and increased monthly payments has nothing to do with the lending organization. The bank has to follow set rates so yes you can get screwed, but this is your own fault! Again, Pay attention! You signed up for it and didn't know what your doing, so its not just the banks fault. Take some credit for these mortage/foreclosure problems, its mostly your fault. Most don't know what they are signing and don't understand how loans work. You asked for the loan and now your complaining about paying for it? Good luck in your lawsuit, and if you don't realize, lawsuits will end up costing you money too.

There are only a few who have justified complaints about customer service and especially about appraisals. I do support those with problems dealing with customer service. Most businesses put the least amount of effort in customer service.

Bank of America illegal charges!

I had a no annual fee credit card from Bank of America, but I haven't been using it since 2001. I have not received any new cards to be activated, and no mail or phone calls of any kind related to my credit card account from Bank of America since 2001. My balance was $0 every month in 2002, $0 every month in 2003, $0 every month in 2003, $0 every month in 2004, $0 every month in 2005, and $0 every month in 2006 until September, when I was charged an annual fee of $39, and my balance became $39. There have been no statements sent to me, and I have found out about my balance when checking my credit report in February 2007. Not having an active account and no communication with the bank for 5 years, the sudden charge charge is illegal. The bank keeps adding interest every month, so that my balance almost doubles every 2 months. In addition, they reported the account as being delinquent, and damaged my credit scores. I am currently seeking legal action against the bank.

I had the same thing happening, my account was closed for almost a year and I was finishing paying off my credit card, they charged me the same amount that you mentioned, I called them and simply told them that my account had been closed since a year and they refunded me. Good luck!

I have been using my card for nearly the same amount of time. Only one late payment and that was 3 years ago. Then all of a sudden, my rates went from 0% to %15.99%. Pure, unadulterated usury. And this is after I've been paying more-than-minimum payments and even paying when I was given a "payment holiday" for two months in a row. They need to be stopped. I'm working hard to pay off my card, but their finance charges are making that extremely difficult. I've learned my lesson, now I want to get on with my life.

Bank of America I payed 79 dollars for nothing!

One of their representative sign me up for Card Holder Security Plan I asked her, "You are saying if "you" Become unemployed" If I am not employed then it will not work for me but she said No It will and Mama you have 30 days money back guarantee to review the papers we will send you.

Ok I received that packet after 15 to 20 days. I try to call cardholder security plan on weekend; I came to know I have to call them from Monday through Friday. I just thought if they do not have access for customers for weekends must be 30 days means 30 working days, and on December 18 I was able to talk to a representative I told him! Plan is not what at the day of enrollment she told me at the day I talk to that representative and instead of cancellation, he was willing to convince me I have to give it second thought and I have more days for trail. I hang up. On December 20, I call them again for cancellation. I came to know My ENROLLMENT starts from November 17 and I am calling them after 30 days I asked why they charge me before 30 days answer was because plan starts from 17 of November. charge after 30 days It was about refund and now 30 days passed you are not able to get those 79 dollars back we charge you been fail to call us in given.

In short I pay 79 dollars for nothing that plan was not for me I told that lady I do not have job I do not think this will work for me she told me no in event of divorce we will do this and that you do not pay minimum payments for card just like unemployment. When I review paper work that was not this and I receive that paper work after fourth of December in this case I have only 09 working days to call them but because they count down weekend also and I am tired of that person when I call for cancellation why he urge me to think more they just care about their commission not about customer at all otherwise they have to be available on week ends when We not have college and other things to do and call them.

I am in California and from here when their 10 PM starts ours 8 PM and this time is most busy time for a single MOM. However, who cares.

Bank of America they lie and I lose $9000.00!

I took a cashiers check made out to me for $9000.00 to my bank of 43 years and asked them to make sure it was good because I thought it could be a phony check. The teller told me it would clear by midnight. I called the next day to make sure it was truly okay. I spoke to a man named David and told him to check this check out again because I still thought it could be phony. He put me on hold for about 2 minutes and came back and said the check was okay. I asked him again would this check ever come back to haunt me and be no good. He again said no it won't. I started spending the money and a few days later the bank sends me a notice that the check was no good and they took $9000.00 dollars out of my account. It took the notice right down to the manager of the bank and he said there was nothing he could do. Call customer solutions. I called them and they told me there was nothing they could do but teach the persons who told me the check was good how to do it correctly. They also said there was nobody else they would give the name of higher up than them so I could plead by case to them. So they lie and I lose $9000.00.

Bank of America pmi remove problem

I currently pay over 30$ a month for Payment Mortgage Insurance for a home loan that was 80,000 at time of loan. When I was closing on loan, loan officer said "PMI will be removed when remainder of loan is 80% or less of home value." Within 2 years, the value of house had exceeded that amount. I asked Countrywide to remove PMI. Informed that I had to have another appraisal to confirm. OK. BUT, I had to use their appraisal company and it would be $300-350. The average appraisal fee in this area at that time was 100-150$. I called complaining about fee being too expensive. Problem never resolved and I continued to pay PMI. Mad, I refused to pay and waited until the remaining loan amount was less than 80%. Then, at that time, I phoned again to have PMI removed. Was informed that they required loan to have 78% or less remaining. I was also told that "when you have paid off over 22% of the loan, if you have had less than 2 late payments, by law, we are required to remove PMI" by a Countrywide representative. I have not had any late payments. It is less than 78% of loan remaining now, but now I have to pay a 150$ fee for CVI! That is to ensure my house is still worth atleast the original $90,000 appraisal. What makes me even madder is Countrywide has sent me atleast a dozen offers for a home equity loan with their latest valuing my home at over 175,000$! What is the truth and when will I have the PMI removed from a loan with less than 70,000$ remaining on a home valued by a realtor of atleast $225,000?

Bank of America has just started putting seven-day holds on my deposits.

I have been a customer for 20 years and have never had a deposit returned. They tell me the reason is that they have started to receive fraudulent deposits on other accounts. I asked them why I had been put in that category. They said they have no answer to that.

I would suggest that anyone wanting to purchase an IRA with Bank of America think twice. Along with exceptionally low interest rates, if you want to transfer your IRA (s) to another financial institution you will be charged a transfer fee of $50 per IRA transferred. Discover Bank does not charge transfer fees.

Bank of America’s "overdraft" system is a crafty positive cash-flow scam in my opinion. Here's why I feel this way:

I have two accounts with BofA that I manage using the same Online Access ID (I see and manage both accounts after logging in). One account "A" is where I keep the majority of my funds and the other "B" is from where I write checks, make credit-card purchases (card has a Visa logo), etc.

When I make a CREDIT purchase (not Debit) on a weekday (Monday-Thursday) using "B", I transfer funds from "A" to "B" using www.bankofamerica.com that same night. The snafu is, for my location, I need to make such a transfer BEFORE 10:45pm "cut off" for some unknown-to-me reason, or the funds will NOT hit the account in time to cover the credit transaction. In that scenario, BofA will charge me $35 PER transaction that it now considers in overdraft.

On a side note, their transfer confirmation page does NOT bother to list their server's current time for your records (eg: a print out). I find that equally as frustrating, since you would have NO proof to refute a claim that you did indeed transfer before their "cut off" time.

Why question is WHY would my transfer from "A" to "B" -- two BofA accounts BOTH managed by my one Online Access ID -- not be INSTANTANEOUS? The funds are MINE already (not from a recent deposit), so why not just consider the funds instantly moved when I do an online transfer (even if the physical funds still have to go thru a wire-transfer or similar process the next business day)?

I firmly believe that this is a HUGE money maker for Bank of America; to scam extra cash from their customers who are less fortunate, living paycheck to paycheck thereby keeping a low average balance.

Again I say, if the funds are already in my account "A" and I transfer them online to "B", why is that not immediate REGARDLESS of the transfer time?

I am exploring other banks and their policies at this time.

Ever since MBNA was bought out by Bank of America, my credit card transactions has been a night mare. I am an involuntary victim of their poor customer service.

On Oct 2006, someone cashed a promotional check for $8600 that was mailed to my old address. I called to report a fraudulent transaction and the Rep said that the check was used to pay-off a chase Credit Card balance. I was confused since I also had an account with chase that I had just paid in full. I told her it couldn't be me. Her reply was, You did the same thing a week ago so it must be you. I was furious, put on hold for ever. I tried arguing and asked to be transferred to the Manager. They finally found out it was a different chase account that belonged to somebody else. Had it not been to that stupid thief who left fingerprints all over the place, I was liable for their own clumsy service. Before the fraud happened, I was on a zero% promo which was taken away when this happened. I now call every month to get credit for the Fin charges which should be cleared at once. I can't wait to pay it off and Close my account with them.

Bank of America bank of america is the very worst one to deal with

Bank of america promised me a settlement on my account. The account was mishandled and they never even came close to settleing with me as promised. Everything they told me never happened and was a complete lie. I have worked with several credit card companies, but bank of america is the very worst one to deal with. They are not trueful, and they could care less about their customers. They do not work with individuals with disabilities. Do not consider opening a bank of america credit card! There are many good companies like chase, discover, & capital one. The very best being chase! They will work with you and be kind. They will lower interest rates. They will not lie like bank of america and ken lewis.

I also tried the Freddie Mac Home Retention Program and to no avail, waited one year and called almost every month and all I wanted was to go from a 15 yr to 20 yr fixed to make my monthly payments a little more affordable. at the time I got $8K behind and was told oh don't worry, you cant be foreclosed on in this program. After sending in numerous lengthy docs, still no answers or solutions. I was lucky enough to sell something else and bring the note current. Went thru a bad spell like a lot of other folks, my escrows, I had always paid myself. And I did get a little behind in my taxes, but set up a payment plan with the county and was making payments, so since I am now over 65, I can make quarterly payments, which I made the first of Jan 2011 and next thing I know BAC home loan servicing sends me a letter dated Feb 24, but I did not receive until Mar 6 that I was delinquent and now they would be increasing my mo. mortgage to include an escrow account even though, I have already paid 4 years and have always paid my own escrows. Funny thing, they made payments on my property taxes without consulting with me and in fact payments were done just 4 days after their letter dated Feb. 24th. I had already made the first of my legal quarterly payments and then went ahead and paid the entire amount owed on mar 7th just a few days after receiving their Feb 24th letter. Now my taxes are paid double and I called customer service and said is this how you do business... Do not communicate with your customers I was told that evern if their was a shortage of $5 on my taxes, they could take over the esc row accounts anyway... That is news to me... Also, when trying to get things straightened out, and calling to recofirm with the tax dept., I was told that the escrow account had already been set up and I did not need to speak with that dept. I said... Are you refusing to put me through to the tax dept., before the really rude individual actually put me thrugh. Unbelieveable, also, they have quite an attitude, like, what the hell we set the rules, and thats it... I sent the receipts for all property taxes paid and was told that that was all that was required and things would be back to normal after BAC received their refunds of taxes paid .. Now I have gotten a statement saying that because I had applied for the loan retention program 2 yrs ago, that now I would have to have an escrow account.. Funny thing, because my payments are not being acknowledged, they want to charge me an extra $700 a month on top of my $1, 200 a month mortgage. Even though I was told that I would not be set up on an escrow. Whose pockets do they thing they are lining? I was tld initially, when I received the first letter about how they were going to take over my escrows, tha I was not "allowed" to make partial payments to the county. Guess what? and this in a very rude many by their oh so courteous customer service dept., What in the Hell, do you think, its called when you have an over 65 exemption... it means you can make quarterly payments with no penalties or interest. Is this also, BACs idea of help you lower your monthly payments to do a loan retention? Unbelieveable... Yes, I want to pay you an additional $700 per months to help me out when I am getting ready to retire. I am ready to get out of this loan and will sell anything to do so... and would advise anyone to NEVER EVER THINK ABOUT A MORTGAGE WITH BANK OF AMERICA...

Bank of America and its President, Brian T. Moynihan, and one Robert Flores who says he's "from the Office of the President, Bank of America" are arrogant [censor]s totally out of touch with the rest of us Americans. I have been fighting with BOA since November 2009. They had someone call and offer me a program for my credit card balance at a reduced rate from 26.98% to 5% if I made an electronic payment transaction over the phone that day. I did the transaction and the following month when I got the statement it showed the electronic posting but the reduced pament schedule and interest rate as promised had not changed. They also charged me a late fee because the payment was only $200.00 not $250.00 even though that was the required amount they said they would accept for the electronic payment and thereafter. I called and spoke with another representative who apologized and said they would take care of it and maybe the statement just did not reflect the program agreed to yet. That was three months ago. No one has called. I wrote a certified letter that they did not respond to. I made the next payment on time, the posting for the following statement was the same, no changes, late fees, increased payment due of $1, 350.00. I called again and again they said they'd take care of it. This time I got the representatives name, confirmation number and agreement. When the statement came this month, same thing, no knowledge of the agreed upon program. It reflects two payments one for Jan. and a early payment for February, but a late fee because they have not changed the payment from $250.00 to $200.00 as agreed upon by both of their account reps. Today I called and again the representative said he was sorry, apoligized and would take care of it. He would deduct $245.00 in late fees and set up the program as promised. He gave me his name, a confirmation number, his direct phone number and promised the agreement in writing within 10 business days. I asked him "why should I bother to make another electronic payment (which I went ahead a did) so that they know I'm sincere about the new terms and conditions! when they continue to make my balance increase with late fees and interest at 27% and no acknowlegement of their agreement from the past 3 months? I told them I've seen old movies about LOAN SHARKS and the Mafia who used to operate this way...except they went to jail. Now I'll wait and see next month if the fourth representative apologizes and is truly sorry!

I recently applied for a mortgage with BOA and was told a $400 application fee was necessary. I am on limited income (SSI) and had been told by the town I live in that I qualified for an affordable housing unit. BOA knows all the details. Well, the town made a mistake and I was not qualified for the affordable unit. I asked BOA for my application fee back and I was told "that is the cost of doing business" ! I told them that they had done nothing for me, maybe pull a credit report? and again I was told "that's the cost of doing business". They are disgusting to take advantage of a person who is trying to find an affordable place to live and who is disabled. They shouldn't do it to anyone! I plan to tell everyone I know to stop banking with BOA because they don't care about you as a person just the $$$$

I took my money out of Bank of America when a nasty teller had all her friends cut in front of me on line and then when I said something talked about me to them in spanish. I withdrew everything I had and never went back.

They give bank accounts to illegals and once I went in there to use the ATMs and they were both in spanish. When I complained, they were nasty.

If you love America, take your money out of bank of america because there is nothing American about it.

For all of us who are sick of Bank of America's fraudulent practices:

Apply for a job via their website or local branch. Of course they will turn you down (especially if you are white or male).

Make sure they send you a denial letter and don't just ignore you.

Once they turn you down, lodge a complaint against them at your local EEOC office.

I mean good grief, they want to grab all our money, but yet so many people cannot find jobs these days. It's not like they would hire any of these people they rip off.

Let's all send off an avalanche of EEOC complaints (instead of a class action suit.) BOA can fight lawsuits with their armies of lawyers. BUT they would HAVE to answer to the EEOC. (The EEOC is the most mortal enemy that any business can have.)

Many of victims should consider this. The very people who cannot get jobs or pay their bills are the ones that BOA rips off the worst.

Since Bank of America lowered my credit limit and jacked my rates to 27% for no reason other than a high balance I started checking on line to see if a pattern existed, it does.
Many of the credit card companies including Bank or America and Wamu seem to offer these special promo checks, 2, 000, 3, 000, 4, 000 dollars, they tell you to spend the money anyway you wish but oooooh, when you do it is not long before they cut your limit back, then they say your balance is too high and has lowered your score and they must raise the percent rate, when you complain they tell you to pay the high rate or they will close your account and ruin your credit.

What a game, wonder who thought that up?, it should be concidered "Loan sharking" to lure you in, then purposely ruin your credit just so that they can make a profit. I have found that Bank of America is the worst, American Express is also in the game as is Wamu.

Thise are all well known banks, so how can they get away with it? because no one sat down and looked at the criminal element of it all, these peope conspired to commit a crime, to con all of us and basicly extort high interest out of us or ruin our names.

Class action law suits should be brought against these firms, if the government will not protect us then we have to ourselves.

Bank of America is the worst at customer care, I have never been late, never missed a payment, yet thise people jacked up my rates to 27% for no reason other than a high balance and they are the ones who offered the "promo checks" in the first place.
When I complained wanted to close my account and put me on some kind of special payment plan which would lower my rare but also blemish my credit rating which could cause my other creditors to raise my rate.
I have found no government control over these people, it seems they can do anything they want including ruining your life.
I intend to seek legal advice and possibly sue if my credit is damaged which is what a lot of other victoms should do, if the government will not protect us then we must do it ourselves.

Bank of America credit problem

I have a credit score of 748. My credit card statements were lost/mis-directed and I was late on a payment. My introductory 0% rate credit card immediately jumped to 16.99% costing me over $200. B of A policy is that upon request their manager will call within 24 hours. Eight days later I called back and finally spoke with a manager. If I had been a B of A customer in any other way, in addition to the credit card, I may have had some leverage to have the introductory rate reinstated. However, I am now stuck paying the extra interest, but I just sent the full payoff amount so they won't get more than the $200 out of me. I requested that I be put on their 'do not solicit' list and told Clinton P., the manager, that if they made a mistake and contacted me that I too would be unable to show any mercy and I would push the situation as far as I could. I'll never consider B of A with either my personal or my company accounts again. Credit Unions have been so much easier to work with!

Bank of America did not pay out the promotional bonus I should have been paid. This is truly the worst customer service I have ever received. Even among big banks they rank worse than Wells Fargo. I can't see myself doing business with them in the future.

My question is in regards to the state depositing money into my account and not be able to access my funds till the following day! Is a program that the state set up with the bank so it should be deposited into the account and I should have access to that immediately ! I think it's kind of silly that they make you wait a day to access your funds

Bank of America should have their contract yanked from the state of California. Deposits are always late. Unauthorized charges consistently hit the account and BOfA does nothing to resolve in a timely fashion. They are a fraudulent bank and should not be in business. They're rude, incompetent, and down right a bad bank.
