I have gone through so much aggravation with the Department of Revenue child support! They have constantly sending threats of DL. suspension, Interception of Tax refund, garnish wages. It has gone to the point of me loosing my home my car. They garnished my wages for years and when the children are emancipated they still say I owe? Even after they took payments months past the children emancipation. I have tried to negotiate with them and try to prove them wrong but nothing happens to my benefit. I can not afford a attorney I am lost as what to do. Is their some type of rights I have or a lawsuit that a attorney can file against them? I have minor children that I have to care for I can not afford them taking more money from me. Please help or comment about this situation.

Maryland did the same thing to me I had to file in court for a modification of child support before I could get it stopped and had to sue my ex wife for the over payment she received. They are fast to start collecting but when its time to stop they takes months and years sometimes. In my case I had paid for 2 years more then I should have. To date I have not received one cent back at least they are no longer taking money from me. Take this to court you can file your self and go to court your self. Good luck

You need to file a motion to clarify support owed. This could be done Pro Se by having a Doc Prep Service, or a Paralegal, create the motion for filing with the Clerk of the Court.

True florida child support and department of revenue is people that we pay there salary and yet they are the most rude and never have time to listen to you but is quick to send notices and warnings of child support that has been paid. I can not believe how and ex can walk in office and give wrong information and don't follow court orders and also say you owe more money after paying on time. It's worst fight to prove your innocence in this state.

i am a very responsible loving parent, my child does not live with me due to my crazy traveling work schedule. i have been faithfully paying my child support since the date of the divorce, which is also when they the dept of revenue ordered the support. my employer has been sending the money, i have proof of that. DOR sent an amended order for the amount to be lowered, but it also says that i have arearages too. how can i have arrearages if my employer has been sending the money on a weekly basis. my worries are this, my license can get suspended or worse, a bench warrant for my arrest. all very detrimental to me and my job. how can they just be this irresponsible with peoples lives. if these things happen to me in result of their screw up, who do i sue for expenses, loss of wages, and damages? Florida department of revenue are all high. they have half-witted idiots working in their offices. to get on the on the phone with them, takes approximately 45 minutes, and even when I do finally get someone, I'm treated like a criminal. in this state you are always guilty before innocent.
i also don't have money to pay for an attorney, they want 1000.00 to start? the attorneys get paid no matter what they do. i can barely keep my head above water as it is.

I'm not sure if your problems still exist but getting a full and accurate accounting will detail all payments and disbursements. In my case I was able to prove the money was deposited into the state's Wells Fargo account but was misappropriated. The money is being followed to see who got it. See if the court system with your case have a fraud division.

My husband has had nothing but trouble also. Always paying on time--a RIDICULOUS amount of money. We can't afford to pay rent anywhere and are forced to live with family because of how high his monthly payments are. He has received multiple letters that he is past-due on payments (which is he isn't) and just today received a letter that his license has been suspended. This office is a joke. And they never have to claim responsibility! Is it even possible to sue them ever? It's so unfair. They have caused us so many headaches and can't be forced to be held accountable.

Where do I start in dealing with the Department of Reapers, sorry they disguise the last R are as Revenue . I've been paying regular child support on time through my employer for past 7 years (2010) for my daughter, never late. Starting 2015 they came up with me being in the rears after I established time sharing modification. The lawyer bill for me is $3000 vs my child's mother =paid $0 as Department of Reapers/ Revenue represented her. They intercepted my tax return 2015 (which they have never done or given proper notice) and handed tax money over to my child's mother which she was not entitled too. When ask why they have done this to me, the representative pointed fingers to IRS and didn't want to help me after waiting 45 minutes to talk to rep. Makes me a logical person wonder why even do the right thing to file your taxes in the first place if the two organizations are in bed together and work hand-in-hand to separate you from your money legally. They get to good fathers mixed up with the bad and don't care the repercussions an impact it has on that individual to move forward financially. Now I have to either sue or beg on hands & knees for child's mother to give me what she wasn't entitled for in the first place because of D.O.Reapers blunder. When are there going to be held accountable for their mistakes in the lives that they're affecting negatively?

They've taken nearly 30k from me since 1991, yet I was raising my daughter, kept garnishing my wages all the way til 2013, plus intercepted my tax returns, when it was finally stopped after talking to a supervisor. Here it is 2017 and I have yet to receive my money back.they admitted that a serious mistake was made but still no refund, followed up with a call again in February and was told they can't find the money that was taken, how is that? Going to be looking for a lawyer to file a substantial lawsuit against them for negligence and failure to use do diligence.after reading some of this on here, almost wondering about a class action suit

I would be in on a lawsuit as well. I paid every Friday and they still threatened my license saying it didn’t come from an employer. Then took 2800 dollars and my ex wife only got 2000$ where is the other 800$. I never got notice of taxes being taken. The people you talk to on phone are rude or you get a different story every time you call. It’s on going that they just take and take. I’m always more behind then what I’m suppose to be by thousands of dollars. You go to court and you can’t say a word. If interested in starting something about it my email is mikeyd32073@gmail.com

I communicate with them via chat line so I can use my snipping tool to memorialize the conversation. It's a waste of time though. Media coverage is what is needed and this is an avenue I am exploring. It is wrong to know that funds were sent to support children and state employees cannot account for where the money is. Who can possible think that stealing from children while harming parents that are paying is ok? Please copy and paste experience in scam report. I have contacted the Governor's office, Political leaders in Washington, Office of the Inspector General both in Washington and Florida, FDLE and now focused on the media. Theft No More can be tolerated. The public entrust government employees/agencies to do their jobs in an upstanding way. This is criminal.

I would love to join this as well because I am paying my child support through my job in NYC, and they have no jurisdiction over my case since my daughter was never conceived in Florida, nor have I ever lived or owned anything in Florida. In fact, my child support was done through NY Child Processing Center. They keep sending me letters and last week I realized I did not get paid.

Please see my post with breaking news (3/27/2018) of missing child support and missing hard drives from Tallahassee employee desks...surprise!

You'd think that the custodial parent would be asking the State for their money when there is proof that payments were made.

Jurisdiction seems to be something that the Florida CSE agencies do not relinquish when they know they have no standing to be collecting the money. They love the out of state non-custodial parent who cannot afford to travel to deal with their mistake. Fraud to get the Federal funds for collecting of child support.

I would love to get in on a action against the DOR! They have put my life in jeopardy by violating a non-disclosure agreement and gave my information to my ex...a man who was convicted of domestic battery on me! I had 0 arrears, then, I file a Tort claim against them for the violation, and they throw $15, 000 in arrears on my account. My children are now emancipated and they are demanding that I continue to pay my full child support. They quote a Florida Statute, yet they don't follow the court order that states my support goes to ZERO and I pay $37.90 per month for any arrears. I have tried to get in contact with Ann Coffin over the issues...but she is "untouchable". Needless to say, they laughed at my Tort claim and only offered me $50 for the violation of my domestic violence victim rights. So, I have filed another Tort on them for fraud in a circuit court. They state that I was at a hearing that abated the $6500 that my ex owed me. I have proof that I was not at the hearing, as I have time cards showing that I was at work. The hearing was in 2013, but I was not told of the hearing until 2017! Too late to appeal the hearing order...how convenient! Plus, I requested my records and requested a full investigation/audit on my arrears...they have failed to respond in a timely manner, as stated by Florida Statutes. I have them on so many SERIOUS violations, but they scoff. I even had one person in Ann Coffin's office tell me "good luck trying to sue us!". They think they are untouchable...but they are not!

No they are not untouchable ... Federal Court is the way to go. They receive Federal dollars for their child support enforcement program and can be sued. Please try LegalShield. It's $24.95/month and if the assigned law firm can't help you, they direct you to the correct firm. I am done paying attorneys $500/hr to be influenced and not have my best interest at hand.

i am a single parent with the same problems...my kid is almost 5 and they havent done anything to enforce our court order and have ex[osed our info to the offending aprent with no parental rights but have refused to privie me with the information they have so i can enforce the court order myslef (as to his info like employer)
they abuse and discriminate agaisnt the people they are supposed to work for

Contact and send email requesting a "FULL and ACCURATE ACCOUNTING" to the Department of Revenue:

It's your right as a parent to get this. This will show you the monies logged and is disbursed. Just know that the document indicating disbursement doesn't necessarily mean it was sent to the other parent. Clerks can take the money and you'd never know. Hopefully you have your receipts. Write the clerk of Family court in your case and request a pay ledger. The pay ledger should match the Full and Accurate accounting. FRAUD is the ground for any late discoveries to be thrown out. I had the same thing where a judgement was entered against me and I had no clue. It's important to watch the docket on the clerk of court's website to see what is being filed. Often times you're not told of hearings so they can do what they want. It's something you have to do. When you know what these people are capable of, its best to be proactive and on the offensive rather than reactive and on the defensive.

Federal court is the answer. In Federal court they are required to prove you owe the money. If you have receipts then you should prevail. My child support disappeared also. I have the money order receipts but they refuse to accept them. Why? They won't set motion filed to address the misappropriation of funds. It's FRAUD, MALICIOUS PROSECUTION, and UNJUST ENRICHMENT plus lets not forget about the due process violations. The 2 of 3 attorneys for DOR/Child support (The State) at one point was my attorneys. Finding an attorney to take a Federal case against them is where I'm at. My child didn't live in the jurisdiction of Palm Beach County so they had no right to take funds. A recent article at the end of 2017 has a clerk arrested for embezzlement for another division in the court. I have contacted the governor, Attorney General, State Attorney, Media and the list goes on. A county can be sued and the state can be sued if they wave immunity in Federal court. My case was the result of an attorney hired in my paternity action being angry that I terminated her services. She orchestrated the taking of my children under false claims of child abuse and then continued her vindictive actions via DOR/CSE.

For people struggling with the cost of lawyers check out LegalShield ($24.95/month). This was the best spent money since all this stuff started 17 years ago. I intend to become a representative of this legal service. After paying my last attorney close to $20, 000 to hear that the best approach is to stay in limbo, I was done. A law firm will be assigned and will direct the case to proper jurisdiction. I am a mom paying child support and know that being targeted by the system has no gender preference. Jaded female lawyers will work hard to tear a woman down too even if that person is their client. Injustice has no color or gender.

If funds are missing and no one can account for it while there are receipts to prove the money has been paid then bring the matter into Federal court where the burden shifts and they can't be 1 penny off from their claim of what is owed. I'll post the information I have on the Office of Inspector General in Washington that I contacted to file a complaint against FL Child Support agency.

My husband and I went through all the nightmares of Florida Child Support enforcement for years. His ex was on the phone with them daily telling her sad story, lieing, setting the tone for a very painful jaded life of dealing with them. $40k in arrears, no proof to back that up. He paid $1200 a month for two kids, received letters every Saturday they were going to take his license. Etc etc etc. SHE was selling drugs, doing drugs, getting kicked out of every place she lived in and yet no ONE would listen. Not even the female judge at the time. In the end, she would no longer allow him to know where they were or talk to them on the phone so we lost touch. She eventually got them taken away from her and we were not contacted. The children were so damaged from all of this, they underwent psychological examinations and have been diagnosed with bipolar disorder due to all of this. CHild support enforcement and the department of children and families work hand in hand. These agencies ruined the kids, damaged them badly mentally. All this started in 2002 and we finally paid off his child support December 2017. Thank God we were able to hire an attorney which did dispute the arrears and were able to get it down from the ridiculous $40k to $10. Her brother had gotten custody of my husbands son because they did not contact us about it. So Her brother sued us for support even though he was getting money from the State. Instead of sueing the person that caused all of this, we had to pay. This was many years of aggravation, eating rice and beans, shopping at Goodwill and praying for gas money to get to work thanks for the Florida Department of Revenue for child support enforcement. 85% of my husbands paycheck went to child support.

So far I've found they ARE above the law and do not have to follow state or federal law. They took our land, home, income everything WITHOUT A HEARING! No lawyer will touch it. There is so much fraud and corruption and zero accountability! After 8 years of fighting to prove fraud and no notification of a hearing, the judge said they made a mistake and my husband overpaid $35, 000! Not to mention loss of income, home etc. They said DOR would address the credits overpaid. Two years later they still refuse to address it. Even after a judge ordered it! My husband bled for this country in combat and when he comes home this is how he is repaid. TOTALLY HAVE ZERO FAITH IN THE SYSTEM!

This is so unfortunate and disgraceful. I am in the progress of exposing their fraud and will be in a better position to detail the outcome. It'd terrible that in the specific counties the attorneys who are supposed to expose fraud to the courts are afraid to say anything because of their association within the legal community. They all are associated so they don't care to truly act in the best interest of their clients. I had many of those types of attorneys. They use your situation to enrich themselves. I have fraudulent court orders and my then attorney Jan Peter Weiss in West Palm Beach brought it to the administrative office of the court house telling me how it was going to bring down the entire court system. After meeting with them he informed me that it's not a fraud order and if I ever say anything about it I will never see my F-----G children again. So if it's nothing why the strong position. I recently terminated the services of an attorney named Lisa Macci due to the delays and game playing while collecting fees just to file motions she intends to do nothing about. Imagine more than $20, 000 paid yet I can't get a hearing. Why? Because a no-nonsence judge has my case and made it clear that I was one of the most credible witnesses he has ever seen. Imagine she got paid #500/hr and he told her to sit down so he could cross examine me because she couldn't do so effectively.

I know that my missing thousands of dollars are the tip of the iceberg. These people have been systematically stealing from children while imposing sanctions against people claiming they never paid. I say to keep looking because the right attorney is out there. If they know what they are doing and care about assisting the just to get justice, then they will accept the case on it's merits. You know they have the Innocence Project freeing the wrongly accused from prison and it something like that that is needed. These people need to start going to jail > prison for what they are doing then they will stop because they will be the example for those who think this is not criminal and that they are above the law.

My money was received and I sent money orders. I photocopied the entire filled out money orders including the stubs and have the original stubs. USPS, Money Gram and Western Union provides the proof of who cashed the money orders. In FL it's Wells Fargo Bank that the funds are deposited into and then the receiving party is paid from that bank. This information can be obtained to see where the funds went and when the money orders were cashed. These people try to financially bankrupt people because it takes money to fight. Without money people are stuck accepting the situation for what it is. It's systematic enslavement to them and I'm not saying this from a African American standpoint. It's the reality of what they have designed. Then they turn around and collect Federal dollars based on the moneys they force out of people who have already paid but need their driver's license so they pay or their professional license so they pay again and again.

I was advised that it was an attorney in Boca Raton named Terese A. Pike that I originally hired for my paternity action who put this all in place by lying to associates to target me in the courts system. I put their names out there so that if anyone is thinking of using them then they think twice. Now their go-to judges are gone and the court staff that followed their directives are getting exposed. It's beyond shameful-it's criminal. I will have exposed this more in the near future. Know that time will either expose you or promote you - nothing stays in the dark forever. Sooner or later the sun rises. Be encouraged and know that good people who went into law for he right reason will help. Unfortunately these days it seems like it's a rarity to find such professionals.
