Complaints against gmac mortgage:

Despite numerous faxes and phone calls from myself, my insurance agent, and the insurance company, gmac purchased a separate hazard insurance policy for my home, duplicating coverage that I had, and proved at least six times that I had. This raised my payment. Because I did not know that they had not completed the cancellation for a few months, I was late on a payment that I actually never owed (the regular payment was made on time every month automatically.) all late fees were refunded, nice of them, but it was sent to the credit monitoring services as late payments and that stands.

This year when my hazard insurance policy was renewed, I requested that gmac not escrow the insurance, that I would make payment directly to the insurance company as I had been doing for numerous years. They refused as I have pmi, which cannot be cancelled due to the late payments that I actually made on time. They then tried to charge my escrow account over $5, 000.00 for the hazard insurance that they already know cost less than $1, 500.00. How do I know that they knew the amount? They had already paid it. And yet, I am making payment to gmac every month based on the incorrect amount of $5, 000.00. Gee, just today, I opened mail from gmac and there is a refund check for $682.22 for overpayment of escrow. At the same time I received a phone call from gmac that I still owed $681.00 more than the payment I sent. I would say this is funny except that it is tragic.in fact I would go so far as to say I was extorted out of $681.00 today to avoid another false allegation of failure to pay my mortgage payment.

I was promised in early may by the escrow analysis department that the payment difference from the incorrect escrow charge of $5, 000.00 would be fixed in time for my correct payment amount to be made by may 15. This did not happen. The escrow analysis department was appalled that they showed a payment in full made of $1, 500 for the insurance with a pending charge of over $5, 000.00 still showing as owing on the escrow analysis. Apparently not appalled enough to fix it however, or maybe instructed by their superiors to keep it incorrect so they could use my money.

I do not ever think that gmac will pull this together. It is too lucrative for them. I do not hope that they will remove any late payment dings from my credit, because then the threats that they make would not work. I am going through the credit reporting services to try and get them removed. I would rather not refinance my home as I hope to sell within two years. But I guarantee, that I will never use gmac mortgage again. I will also send this complaint to everyone who will listen to it, including any regulatory organizations that I can find. If I had the money to do so, I would hire an attorney and sue for the great amount of stress that I have endured.

I really wonder this: what is gmac doing with my money? They are taking extra by threatening to ruin my credit, to then refund it later. So they are using my money interest free. This sounds like a scam, take an extra $400.00 a month from people, use the money for several months, threaten us so we shut up and pay it, then refund later. Sounds like a full investigation is in order.

We have had our motgage with gmac for approx 4 years. We have never skipped a month. We never had an escrow acct with them as we paid our taxes and insurance on our own. Yesterday we got a letter from gmac that they analyzed our "escrow" and they are looking for $4000 to "catch up" the escrow. Called today and spent my entire lunch hour and then some trying to get to the bottom of what they were up to. They had paid our 2010 school tax and our 2011 city tax. Ok, fine. That came to a little over $1900. So, I asked, what is the $4000 all about? "Oh, we had to protect our loan". WHAT THE HELL? Suddenly, they are demanding we have an escrow and are back-charging and future-charging for the so-called "escrow re-analysis". After talking with six different people who were allegedly there to "help" us, the only options we were given were: 1. Pay the whole $4000 now. 2. Pay it off in "installments" which would add another $347.81 to our current payment or 3. Oh well, guess you'll be celebrating Christmas in a cardboard box down by the river. Options? What options? It was kind of like being asked whether you'd rather be shot or stabbed. Well, GMAC, we have chosen option 4. That is the option that is known as calling the BBB and the attorney general. What was that? You don't offer that option? Well, these are two consumers who are not accepting your half-assed offer of "help". By the way, you might want to have a makeover. The TV cameras should be rolling in your office pretty soon!

Graduate Management Admission Council [GMAC] unprofessional customer service

I am in the process of a short sale and one of my mortgages is with gmac mortgage. I received a letter from them with a telephone number/individual to contact to 'discuss details'. Three weeks of daily calls to this number provided by them, to the 1-800 number plus the supervisors number with absolutely no response back. I understand that it takes between 5-7 business days however the individual that initially provided her contact number to discuss decided to lie and say that she has tried several times to contact me but I didn"t answer phone. It is appalling that someone could be so unprofessional to lie, but disgustingly arrogant to not realize that it is 2011 and every cell phone lets you know if you have missed a phone call. I have been a good customer for 6 years and deserve a phone call back.

Graduate Management Admission Council [GMAC] fraud/scam

This person named Ms Kim Grant was calling me for months, saying that they rent timeshares, and they have events booked and they are desperately looking for rental timeshare units. She swore up and down that he GMAC Timeshare was different and your property will be rented in less than 30 days. You will get $2000 plus for 30000 points. I registered with them in July 2010. So far I have not received any phone call or agreement for renting. By the way, after listing with Timeshare GMAC, I received many phone calls from other Marketing companies like TRU Marketing. THIS IS A Big Big SCAM IN FLORIDA.

The same thing happened to me in 2010. I also have not heard from them even one time. This is false advertising and is a scam. They do nothing for the fee. REMEMBER: HAVE NOTHING TO DO WITH GMAC - TIMESHARE DIVISION. Also I will never do business with GMAC--PERIOD----NEVER.

In july 2010 we called to ask for a reprieve from our montly mortgage payment. We were facing a financial hardship due to unexpected surgery bills and a broken down vehicle. We had never missed a payment and in fact always pay 14 payments a year vs. 12. Gmac was totally unwilling to work with us; we offered a 1/2 pmt, but they refused stating they could only take a whole pmt. Imagine, someone trying to pay and they refuse! They stated we would have to let the payments go into a foreclosure status before they would help us! What kind of company would do that? Needless to say, we have been in a battle since. We have made all the back payments, but the new dilema is they keep drafting our account every week for the monthly payment! I have been on the phone for over 8 hours over the last two weeks trying to get out unauthorized draft money back. They have put us in an even deeper financial crisis. Talking to their outsource indian service center is a joke. They claim they can see the issue was thier error, however, we need to provide they documentation to prove it! I even had our bank conferenced in to confirm their error, yet they won't do anything to fix it! I will never use or recommend this company - they are unwilling to work with costomers, charge excessive usary fees and are unwillinging to fix issues they caused! This company should be put out of business or at the very least be investigated!

I received a government [H.A.M.P.] modification [after experiencing pure hell for 1-1/2 years with GMAC. I cannot understand why our government does not shut them down. [Is it true that the mortgage servicing division is Canadian owned?]. I was awaiting foreclosure, had just finally accepted I would be on the streets, ill and 63 years of age, with uncaring people who were literally reading from scripts, as it seemed, and got a surprise call that I had been approved for a modify. I could not believe it, after being turned down for not enough income. The income they quoted to me that they were basing my payment on was 3x the amount of my actual income. They told me if needed, I could get a 2%, rather than the 3% they were offering. The payment was quoted a few more dollars than my social security check, so, of course, I told them 2%, but the rep just kept reading from the script. Could not answer my questions direct. I worked for a few months, living in fright every month trying to get the funds together, afraid foreclosure was again eminent [they work fast, robo signatures?] I was told I could apply for a 2nd modify, but got rejected the 1st day of submittal and was told no such thing as a 2nd one! Numerous calls to GMAC that payment was more than my social security check, call to Senator's office, call to FreddieMac itself. No one cares. Wouldn't it be better to pay back the principal balance with a lower rate than letting a property sit for 2 years or more, as a next door one has, deteriorating, with no piped water, and no loans available. Is this who we want to service our tax monies? We get treated like this and our government gave them all that money. I need a good lawyer in Arizona.

When gmac changed to ally and gm went bankrupt, there was a definite change in policy regarding lease vehicles. I have been buying and leasing vehicles from gm for 20 years. When leasing, I have always turned my vehicles in in perfect condition with never a charge for excess wear or damamge. Since I did not intend to immediately replace my truck that I recently turned in due to my impending move out of state, ally slapped me with a $400+ charge for excess wear. When I complained, they immediately lowered the amount by 40%. According to the rep on the phone, that is the maximum amount they can lower a charge. It is an arbitrary amount with absolutely no connection to the actual case in dispute. This proves that the policy is pre-set to charge something and hope that a portiion iof it sticks. I can see the internal memo now stating that ally can grow profit by $200/vehicle if they charge random fees and hope that some of the public pays them. I'm truly not a conspiriact theorist at all. But, how can they arbitrarily reduce an amount and not admit that the policy is a general corporate policy to charge "exit" fees? After writing a letter and several more long phone calls, I was told today that "it's your credit, there's nothing esle we can do for you,..." just before the rep hung up on me. Never have I had such terrible customer serevice. All I asked for today, after calling back, was an acknowledgement from an ally rep that the company knows that i'm upset and will not return as a customer if this random, unwarranted charge is not reversed. The rep on my call responded by sending me to a "supervisors" voice mail.

I just turned in my 2015 Camaro lease with Ally, the car was returned in great shape since it was covered and stored for the winter time and turned in 6k miles under what my lease allowed. 3 weeks later I got a bill for $500 claiming excess wear on the rear tires which were checked prior to returning with no signs of anything more than normal wear. I have reviewed the inspection and from pictures of the rear wheels you can clearly see plenty of tread left. Never will I lease another car from Ally.

I handed in a spotlessly clean car with one small bump on the trunk (first time ever) my cars are always immaculate when I hand them in. I had the car detailed before I handed it in. There was a picture of a 4" scratch on the roof that they said was from a roof rack. I have never had a roof rack so it wasn't from me. I had the car detailed before I handed it it. It looked like it had been driven through a rough road with mud and stones. The front drivers mat was a real mess, it was spotless when I handed it in. I am glad that I haven't leased from Ally this time. They are lying rip of merchants. I wish I had read this site beforehand I would have taken a video and copious photos when I handed my car in. These people need to be called out for how they get extra money out of people. I will be calling to complain.

I returned my 2014 Camaro one day early at a Chevrolet dealership. It was in perfect condition after a 3 year lease and I used only 25, 600 of the 36, 000 milles. Now, a month later, I got a $375 bill from Ally for a new headliner, tire wear and being a day late returning it. (Remember, I was a day early.) I agree that Ally is making these things up to squeeze an extra payment out of us. Before the lease was up, they offered me an extra month lease extension for the same amount as the monthly payment which I paid before the month. After returning it, they charged an "extension fee" of one months payment amount which was never mentioned. My lease extension contract never said there was any extension fee. I had a copy. I asked the rep to read me her copy of the agreement where it says there's an extra fee. She said they already shredded it.(obvious lie) I read her my copy but she kept talking over me while I read it. I was on the phone (half on hold) over an hour in a heated argument. Called two more times. Same thing. These people are in the Philippines and can barely speak English. Finally got someone in US and settled it. No apologies from anyone for trouble.
Now this return fee charge! Let the battles begin again. I'm NOT paying it. They are just bullying everyone to squeeze money out.

Same here, just got ripped off for $1000 and theres nothing I could do about it. They said a 1/4'' windshield crack was >1/2'' by drawing white lines on both sides and INCLUDING THE LINES in the measurement. This is clear in the picture of their report. Also I gave both keyfobs back and they said one was "damaged" . Nothing else noted just a picture of both key fobs completely fine. I told ally I gave both keyfobs back in perfect condition and there is no evidence of any damage in the pictures. The response was "the inspector has no reason to lie".. Just take my money

When I turned in the car to the dealer at the end of January and it was in great shape. I had just washed it, the dealer looked it over, and agreed there was clearly no "excess wear and tear". Six weeks later I get a letter from Ally that the car had been inspected in Chicago and they found a 17 inch scratch across the doors and I am expected to pay $340. I look at the pictures on line, the car clearly needs a wash, and the supposed excess wear looks more like dirt/salt than a scratch. However, when I cal to complain they don't care about the dealership inspection, the car had already been sold, and I cannot arrange to get it independently inspected. Now that they were dumped by GM, Ally is clearly trying to rip off a couple hundred bucks on each lease turn in. If you're going to turn in an Ally car, take inspection videos of every inch of the car to avoid bogus charges. And use GM Financial for future leases...

My 86 yr old mother turned in her lease. She had a 3 yr 30, 000 mile lease. Turned the the car at a dealership who noted that the car was spotless, not one door ding and only 11, 000 miles. Fast forward 3 weeks, she received a bill from Ally indicating that she was being charged for a cracked windshield, excessive wear and tear, milage overage and lease termination fees (she did lease pull ahead and leased another vehicle in the same brand).. She called Ally and was given the run around. She called the dealership who said that they would look into it as they completed the inspection paperwork. Ally says they don't care what paperwork the dealership completed this is the way the car was received. Vehicle was garage kept and only driven when the roads were dry!

WHEN IT LOOKS LIKE A SCAM AND SMELLS LIKE A SCAM IT'S PROBABLY A SCAM! I seem to be caught up in the same scam. I returned my 3 year old VOLT 8K under my allowable miles and in absolutely cherry condition. Some wear to the front Bumper-Fascia from parking-lot stop curbs. Hard to avoid as the front Bumper-Fascia is designed as an aero dam and so extremely low it hits the road on elevation changes (gently slopping drives and such). Aerodynamics in the VOLT were exceedingly important in it's design in order to achieve acceptable charged battery mileage. So the design compromise was the design of a flexible rubber front bumper-fascia/air dam promoting better aerodynamics. Returning the car without some scraps to this body piece is therefore impossible. This presents Ally an opportunity to charge for "excess wear" and of course they are taking advantage of it. I'm being asked to pay $209 to replace it! And this isn't the most aggravating charge, it's the other $648 being claimed for "Dull Paint." There was nothing wrong with the paint. I had the car detailed every 3 months and clay treated every year. The car did experience body damage and was repaired, but repaired by Chevrolet at their chosen body shop. I'd dare say the repaired area's paint was better then the factory paint. Ally's inspector took pics (see attached) but in them, there is absolutely no evidence of dull paint. There was none when standing next to the car. No one buying the car would every know by looking or by touching that any bodywork had been done. It would appear the inspector had access to an accident report on the car and then chose those body pieces repaired as now being dull. This may be one of the contributing factors leading to Ally no longer allowing for inspections in front of owners - doing them off site and away from owners, gives them access to all kinds of time and data to build a conceivable but entirely engineered wear report. Or as some on this blog have accused, damage the car. If an inspector, via an accident report, were to know a car was repaired and what parts were involved, they could point to those repaired areas and call them into question, rendering suspicion that said area was repaired in substandard fashion. All they have to record their "dull" claim are the photos they've taken. The photos don't support their claim and I know this because I’m a car guy who’s meticulous about my cars. Other less knowledgeable or aware owners may just conclude the body shop repairs made must have been somewhat defective – or just not up to factory standards. But I know better and still, to fight them, I've got to hire an attorney spend more then the amount they seek and as I fight, Ally slams my credit rating. It's been less than a month and Ally has already reported my payment as late. If Ally can charge for excessive wear on the near pristine car I returned, they can charge for every single lease return in their portfolio! This has the smell of a systemic, measured plan by Ally to squeeze an extra payment (or two) out of every lease return and GM sits by like a false savior forgiving these trumped up fees if (and only if) if you are buying or leasing another car from GM. Ally's a division of GM. They're in collusion - what money GM forgives they've already collected through Ally. A racket is defined as “a service fraudulently offered to solve a problem.” This isn’t just a scam, it's RACKETEERING!

Ally jumped on the G.M.A.C. good name. G.M.A.C. knew a car 3 years old was not going to look show room. When they sold the car at auction they would make a profit or at least break even. Ally rips the turn in car. Then makes a profit at auction. I insisted with my new car. I would lease with anyone but ally. Ally makes up damage. Paint scrape is changed to gouge. Over mileage was wrong a month later. Ally will lose a lot customers. In the mean time. They will rip unknowing people.

Hey guys,
I finally caught Ally! This is big! After my lease ended, they slapped me with BS charges, like all of you have had...but I requested to see this supposed damage, and they LIED and told me the dealer still had the car on the lot. They told me this 10 days AFTER they'd picked up the car! When they finally told me about the photos of the inspection that were online, I went to look at them...and didn't recognize my car! It looked like someone had driven the car through a rocky, muddy, 3 foot puddle! No way did I return it that dirty, and with a huge rip in the tire! The photos look faked, but that's not the real issue. The real issue is that after telling me in a letter that I could hire a professional appraiser and view the car, and after requesting to do so, they lied about where the car was and never gave me any opportunity to view the car, in person. GOTCHA! Any lawyers out there smelling blood yet?

NOT SURE IF ANYONE HAS BEEN ON THIS BOAT BUT MY MOTHER AND I WENT TO DROP OFF AN END OF LEASE CAR. IN THE SAME NIGHT WE LEASED ANOTHER VEHICLE. AT THE CONCLUSION OF THE NEGOTIATIONS THE ONLY THING OF NOTE WAS THE ADDITIONAL MILEAGE THE DEALER WAS GOING TO ABSORB. NO INSPECTION OF THE VEHICLE WAS DONE (NOTE THAT WE GOT THE CAR WASHED AND IT WAS IMMACULATE WITH NORMAL WEAR AND TEAR). FAST FOWARD 2 MONTHS LATER AND ALLY IS CHARGING US FOR MILEAGE, WEAR AND TEAR AND TIRES. WHEN WE LOOKED ONLINE TO LOOK AT THE INSPECTION OF THE CAR, IT WAS COVERED IN MUD AND DID NOT LOOK LIKE THE ORIGINAL CAR WE BROUGHT TO THE DEALERSHIP. NOW WE ARE IN NEGOTIATIONS FOR DEALER TO EAT THE MILES AND IN DISPUTE WITH ALLY REGARDING ALLEGED DAMAGES, THAT WE KNOW FOR A FACT WERE NOT ON THE CAR WHEN WE BROUGHT IT IN. DOES ANYONE HAVE AN OPINION ON THIS?

Graduate Management Admission Council [GMAC] screwed me over

This was a very unethical company. These guys will suck all the money out of you. They may seem cheap, but you get what you pay for. So I struck a car and I was liable. I've been a perfect driver for nearly 5 years when I started driving, no tickets, no accidents. Nothing. One day I finally got in a accident, oh no problem... My family been dishing out 1000's of dollars to gmac i'm sure they got me covered. Nope, my policy was canceled a few days before the accident because we owed them four dollars. Four freaking dollars because we changed address. No mail, no call, no nothing about it. We also pay every 6 months, and I haven't gotten a bill from them since so this was a very ugly suprise. Ultimately I got 0% coverage. Thanks a lot gmac your company really cares. They canceled the policy, then a few days later they had the guts to ask for almost 900 dollars to renew the policy, the claims rep then had the guts to ask if I wanted to pay the money we owed and continue doing business with them even though I felt like I was screwed over and that they were absolutely not going to pay for my accident in any way. This is a very dirty business and I hope they burn. Please stay away from gmac, sometimes paying a little more for a better company is worth it when trouble comes along. Thanks to gmac i'm going to lose about 4000 dollars or mor.

Don't listen to them... I truly feel for you, and I simpathize with you. I completely understand where you're coming from. Especially when you always do the right thing for years and one moment of misfortune now, has become a nightmare. Don't listen to this Bi#$% Dawniette she a F#@$%en looser... She a lonely, vibrated using sicko that stalks people in this site and gives her sinical 2 cents. Seriously...She's an inspiring manager/CSR that dares to vent in the complaint board on how is unfair it is that she BOUNCES her bank acct and get charge $35. of drafts fee and complains about the hotel that charged her but yet has no simpathy for other people with misfortunate events. What goes around comes around. Good luck to you...

On sept. 28, 2010 I called ally/gmac and spoke to a representative to get the pay off on on my husbands truck, after placing me on hold he came back and gave me the total of $26, 187.08 he the connected me with chase so that I could pay by electronic check. I paid the amount in full plus a $15.00 charge for the using this service.in october I recieved a statement showing that I owed $687.37 so I called and was told that yes I owed this and that they had no record of me calling for pay-off, I explained that I called and was given the total and then was connected by them to their payment server, they still insist that the amount was not payoff and was applied to our account. I asked them to investigate this and to use some common sense, why would a I pay $26, 187 and leave a balance? I was told that they would investigate and get back with me within 48hrs, after a week I called them back because I recieved a statement that claimed I now $1309.28 once again I was told that I owed this, I asked to speak to a supervisor and was told that I would be told the same thing and was not transfered I told them that I wanted the title to our truck and that when you call for "pay off" and then pay the amount that you are given then your balance is zero and that the account is "paid off" and I want the title and if their employees screwed up that is not my problem.

I called Ally (formally GMAC, National and some other company) you have to hold more than 10 minutes to speak to a customer specialist. The reason for my call is I am trying to get my payoff amount for my vehicle so my bank can process the payment. I first called on February 8, 2011 and they stated they would fax the letter to me within 24-48 hours. On 2/10/11 I called back since I had not received the fax and spoke to a representative again after 10 minutes on hold (Employee Eren Employee # 663-EEN) and she told me she will send me the fax priority and she apologized for my inconvenience again. It is now February 11, 2011 and I have still not received the fax. I called Ally again and was of course on hold for over 10 minutes then transferred to the payoff dept. were I asked to speak to a Supervisor. I talked with an Assistant Supervisor that asked me if I could hold for three minutes. He stated he was calling over to the faxing dept.? After being on hold for about a minute I was hung up on. Now I am calling back again and of course on hold for 10 minutes only to be transferred to the payoff dept. again. What ever happened to customer service? My car is paid every month on time and auto deducted from my checking. You would think that when I go to buy my new car in the next year or so that they would want my business but I will tell you they will not get it.

On October 14 2010 My Chevy Silverado was repossed by whomever company GMAC/Ally Finance contracted to do so "a recovery Company" It is now November 15 almost a month after and I don't know where my truck is!. Graduate Management Admission Council [GMAC] lip service, not actual service

I called GMAC customer service on Oct. 5, 2010 to set up a payment deferment on my car loan. The rep said that was not a problem, and explained I would need to make a partial payment on my normal due date this month, call back 24 hours later, and that the rep would process the deferment manually. I made the partial payment, and on October 11th, I called back to confirm and proceed with the deferment. I was assured that no further action needed to be taken by me, that I lived in a state where a physical signature was not required. She asked for the reason I requested the deferment, and I explained money was tight right now, and my plates were due that same month for my car. We finished up our call, and I hung up. On October 23rd I received a letter stating my account was past due and the rest of the partial payment was due immediately along with a $17 late charge, or else my credit would be effected, and the car would be repossessed. I called them immediately, and they were not available on weekends, so i called back again Monday morning on the 25th. I spoke with a rep who apologized and said he would submit the request for the deferrment and would waive the $17 late charge. My grandfather is the co-signer on the car, and followed up my call, and the lady he spoke with insisted my account was still past due and needed to be paid immediately. I called back again, Monday afternoon, and got another rep who said she saw the first representative's request and it would take 24 hours to process. Again, I asked if there was anything further that I needed to do, because I felt like I was getting the run around and nothing was being taken care of. I asked her when I could verify the account charges had been cleared and she said in about 24 hours. Wednesday morning, today, I called back again, and the deferment STILL HAD NOT BEEN PROCESSED! I called back, and the rep stated she would put in a request for a deferment and it would take 24 hours to process, and they would remove the late charges just this one time as a customer courtesy. ARE YOU KIDDING ME!?!? I explained to her that the late charges were not stemming from my error, and that they should be removed because they were the company's mistake. I told the rep that in 2 1/2 years of payments, I have NEVER been late, and I resent the way my business with them had been and is being handled. I've looked for customer service escalation/supervisor's contact information on their website, and of course, there is none. Does anyone know of any contact information I could use to get this problem cleared?

For the past few years we been asking all the paperwork on our Mortgage. They tell they will send it but they have not... I do not know why they will not send it... I was thinking today if everyone stopped buying GM Car's that might open their eyes.

I was contacted by a company, refinance.com, who was working for gmac mortgage to "clean up" some of its mortgages so they could get help from the government. I was told by this company that gmac would rewrite my mortgage to lower the percentage and pay off all my existing credit cards, even pay off my auto loan. I did not give these crooks any money and their number was not working the day after I started asking questions. Many other calls just like this - even from gmac. About 3-per week on average. I am now starting a log of fake timeshare calls. This industry of rip-off artists needs to be cleaned up... Fast.

Graduate Management Admission Council [GMAC] loan modification

Hi! I just got off the phone with gmac loan services and they denied my loan modification and asked me to reapplied.

On feb 19 2010, I got a fedex package from gmac... So open it up and saw a loan modification package. I was surprise since he denied me in the past. I been working with them since june 2009. I noticed that the due date was feb 22 2010 so I called them and gmac said "it is due on the 25th". I will not be home until feb 21. 2010 and it was a sunday. So scheduled a notary thru gmac for 22th.. Sign it and send it back to them on 23th in original package and return label provided by gmac.

On march 10, 2010 I called to confirm everything is ok. The representative told me that it was denied because they got the package on march 5, 2010 and it was late. I told her that I sent it on feb 23th and you guys got on the 24th and it was due on 25th and I was late! I gave her the fedex number and run the tag and saw it was received on the 24th. She then told me that gmac/obama organization did all mod schedule so close to the due date and 90% was late and got denied. She said she will escalate to see if they will review and accept my loan modification since I wasn't late.

I keep calling every two weeks and gmac keeping saying that it is still pending. I even show up for the local representative to redo the whole package and show her about the modification loan package. So finally, they told it was denied because I was late.. So no more question.

My thought is that either gmac or obama loan modification is just to setup to make themselves look good in the public but in behind.. They don't wan to help. Cnbc announce that only 20% accept the loan modification.. Now I know why.. When people like me accept the modification yet got denied because gmac can denied me.

I really don't know what to do now.. With three little kids and don't know when it is my last day in our first house...

On July 2008, We requested to GMAC the Loan modification for our current occupy property ( Bighorn). As per the Lender GMAC there was an agreement for borrowers to pay a monthly mortgage $2, 400.00. Which Borrowers agreed to purse the Loan Modification and to pay this amount. They were about to send such payments. We called GMAC and every time some else was answering and we were receiving from GMAC different response. On December 222, 2008 the attorney sent a letter rquesting of expnation of why a default notice was sent to the client when we were still in process of 3 months trial loan modification. GMAC never answered this letters from the attorney instead they porceeded suddently in taking the pricipal primary home foreclosed/took away in now we are with 3 kids in the street. GMAC tood my other two investment properties are on a trustee sale.
What a surprise that after being notified by the Law Office of Cesar Fumar that the payments will be $2, 400.00 per month ( Period of trail told by GMAC). We were then informed that the loan Modification was stopped.
Suddenly, on May 19, 2009 the Bighorn property was sold by trustee sale by GMAC.
Now we have the other two properties on trustee sale.

The hardship are:
• We have 3 kids, 17 years old, girl 13 years, girl and 11 years old boy. We are afraid where are going to go with the 3 kids.
• I have a husband ill and he is on permanent disability.
• We were both working before, however when my husband became ill, now, I am the only one with a salary.
• 2006 we moved to our dream house on 4512 Bighorn Ct. Antioch. Putting $140K as dowmpayment. We do not understand how GMAC accepted the application for this loan which we were not aware of the kind of loan GMAC was offering. We were not explain about this type of loan were on this GMAC market and we were not explain about the drastically change coming on July 2008 instead of November 2008.
• We were not aware what of kind of loan or income it was submitted to GMAC to make us to qualify. when the changes arrived on sometime last year 07-2008. We were not aware on time about this either.
• We were paying the mortgage on time $1, 725.00.
• On November 2008 there was a change coming to change drastically the loan amount to $4, 232.37.
• We thought we had enough time to apply for this loan Modification and not to loose our dream house for our kids to live. WE WERE NOT AWARE OF THE OVERCOME FOR YOU ( GMAC) TO drastically TO CHANGE the amount of $1, 725.00 to $4, 232.37 at once on the same month of July 2008 as you informed we owe you from July 2008 when the change was suppose to start as November 2008 the amount of $4, 232.37. Since, you informed us that we owe you this amount starting July 2008 of course we were coming delinquent/ default starting July 2008.
• We did not receive any responses to our letters sent to you from the Law office WE wanted an explanation why that change took place on July 2008 and not on the date that it was supposed to be which it on November 2008.
• This is that hardship that lead to be on default and this hardship made to lead to loose our dream house “Bighorn.” The house was on trustee sale and no body from your GMAC seams care about. Where is Obama Plan to rescue our dream house. Where is the program affordable plan from Obama. Where we can find any body to helps us. I have a husband who is permanent disable. Why in the first place you people accepted the application loan and accepted my down payment of $140, 000.00 and now we are on the street with 3 kids. Is any body there - a Lawyer who can fight for us. we want this loan to go in investigation. We want Obama to hear our hurt finances from this giant loan departments. Called customer services and one person answers and next day is other person and so on.

GMAC took my dream house unfaily. We were doing our payments on time.
When we requested the loan modification and we wanted to continue in making the payments then we could not make the payments online.
GMAC started returning the payments back because they advanced to charge the monthly mortgage of $4, 232.37. as July 2008 when in the reallyty was suppost to strat that change on November 2008. This is why everything started. It make us to become in default on the payments. GMAC mortgage promised our loan modification during previous contacts earlier in 2008.
GMAC Mortgage is the worst company we've ever dealt with.

My husband is disabled and we have a daughter who is going to be hospitalized sometime next week.

Is any body there to help us. Please Obama help us. We want Univision to know this.

Is any body there with the same situation call us.

GMAC has been absolutely useless in helping its customers avoid foreclosure! Banks and other institutions were paid BILLIONS of DOLLARS to help people keep their homes. WHAT is GMAC doing with its share of the cash? My husband and I are both disabled seniors, and we live on a VERY limited income. We have NO savings, NO retirement funds - we don't even have CEMETERY PLOTS! The ONLY thing we have (besides one another and our children and grandchildren) is OUR HOME! We both worked VERY hard throughout our lives. Now, in our GOLDEN YEARS, instead of FINALLY being able to sit back and relax, we WORRY NIGHT and DAY about being HOMELESS! We were SO excited when we heard of the loan modification program - we thought it was the ANSWER to OUR PRAYERS! After filling out numerous forms and making copies of EVERYTHING (and I mean EVERYTHING!), we mailed in our application and waited to hear the GOOD NEWS! You can imagine our UTTER DISAPPOINTMENT when GMAC turned us down! Although we have more than $100, 000.00 in equity in our home, GMAC offered us a "DEED" DEAL - we hand over the deed to our beloved home to GMAC and they will KINDLY forget about our mortgage!

I am tired of Gmac telling me I do not qualify for a loan modification. My income was cut in half July 17, 2009. I called GMAC to let them know whats happing because I'm told they have all this help for people in my situation. Well the first time I called they make it seem that everything will be fine and dandy. They put me on (what I know now ) a forbarance plan and told me fill out a modification application and sent it in. I didnt hear from they for two months. Finanly I called them and they said it was denied. I have to either reduce my expenses or increase my income. They teenager I spoke to on the phone had no information. I asked why and what that meant and he kept repeating the same thing. I have to reduce my expenses or increase my income. Now I had no clue why and what it was they were looking for cause he couldnt answer anything. I reduced my income and resubmitted an app again. Two weeks later I'm told Im denied again. This time the decide to tell me I will have to go back to my old payments and at the same time pay for the past three months that they cosidered behind. that's over $3200.00. Oh yea they also decided to tell me it will effect my credit. They said I still dont qualify for a modification and I now have to increase my income. I got a part time job and just got my check stub so I called to send in the information. They told me it wouldnt matter cause my loan is an Fha secured loan and they arent doing anything with that right now. OMG! All she wanted was for me to make an extra $700.00 payment and make two payments for the $3200.00.
All they want is money and I felt since I had extra income they, by the way told me to get, just wanted me to pay and forget about the help they should be offering.

For three months they are dragging me along making me feel theres is light at the end of the tunnel when infact they have put me in a hole I can not get out out of.

I BEEN TRYING TO GET A LOAN MODIFICATION FOR MONTHS, I SEND EVERYTHING THEY HAVE ASKED ME TO SEND, AND STILL THEY MANAGE TO SAY THAT THERE IS ALWAYS SOME MISSING INFORMATION, I RE SEND ALL THE INFORMATION ALL OVER AGAIN, THEY NEVER CALL OR TELL ME IF SOMETHING IS MISSING OR WRONG UNTIL I CALL. THEY ALWAYS TELL ME TO WAIT 6 TO 8 WEEKS AND THEN I FIND OUT I BEEN DENIED, I DID ANOTHER MODIFICATION WITH THEM AGAIN AND SUBMITTED EXTRA INFORMATION TO SEE IF I GET TO GET APPROVED BUT STILL THEY HAVENT CALLED OR SENT SIGNALS OF SMOKE. I BEEN VERY DEPPRESSD BECAUSE OF MY SITUATION, IAM TRYING TO SAVE MY HOME WICH IS THE ONE I LIVE IN WITH MY KID, I DONT WANT TO SELL IT OR GO ON FORECLOSURE. Due to the economic crisis my husband’s business began to slow down dramatically to where he could no longer earn a salary. We contacted our mortgage company, GMAC, to see if we could be eligible for a loan modification. Since we have a 15-year loan we just wanted to change that to a 30 a year mortgage to reduce our monthly payments. We tried to refinance but our home value had fallen and we were not able to do so.

GMAC sent us a letter stating that we would first need to go through a “trial” period where we would pay an amount less than our full mortgage. In other words – GMAC was requiring that we “default” or pay less than what was owed to even first be considered for the loan modification. They said the amount they wanted from us included “fees” but there was no breakdown indicating what the amount covered.

I called one of their representatives to try to find out what the new amount covered – i.e. how much was a principle, interest and what the fees were for. The representative could not answer my question about the amount requested – he also told me that if we signed and went through the process and were not approved for a loan modification – that we would receive a bad credit rating.

I explained that we merely wanted to go from a 15 to a 30-year loan and we did not want to risk our good credit to do so. He repeated that we could receive poor credit and that since we had money in the bank for our son’s college – etc – that they may not give us the loan modification.

We did not sign the GMAC letter agreeing to the loan modification and sent in our full October payment (see enclosed check). I mailed our payment on the 11th of the month – but noticed that it did not clear the bank. I contacted GMAC again to ask what happened to my check.
I spoke with another representative who said that she had my check but was “holding” it because if we paid in full we would not be eligible for the loan modification.

I told her we did not want to risk our good credit as my husband would have to get another job and they sometimes pull credit reports. She said that the modification would not affect our credit at all. I told her I wanted to get an attorneys advice.

I sent a letter to GMAC asking them to put in writing and clarify the following:
1- What did the lump sum encompass that they were asking us to pay and what were the fees?
2- Would our credit be poorly affected even though GMAC was asking us to go delinquent on our loan?
3- It appeared from their paperwork that they were “allowing” people to have up to 3 months of savings – from this language it appeared that they might not provide a loan modification to someone that had more than 3 months in savings. I asked if this was so.

I received no response to my letter. I sent another letter certified mail and still received no response over a period of several weeks.

I then received my statement and saw that GMAC was charging me a late fee on the October payment. This is the payment that their representative told me she was “holding. I also saw they had applied our money to the trial even though we did not agree to the trial nor did we sign any documents for the trial.

I sent a letter of complaint explaining that they could not charge me a late fee. They never responded.

I then sent in my November payment in full, which GMAC cashed at our bank on the 13th of November, I then received a letter from their collection department stating that we were in default? And owed over $6, 000 to GMAC?

I called a representative who claims to have remedied the late charge and the incorrect application of our two months payments however – I just received another statement from GMAC saying that we still owe payments and late fees?!

We are very distressed at how poorly we have been treated, the lack of communication and the fact that GMAC is failing to apply our full payments to our mortgage and is unwilling to provide a mortgage modification from a 15 to a 30 year mortgage without jeopardizing our credit and forcing us to go in default!

Is this what President Obama intended? Is this what our tax money is paying for?

I was going to attempt a loan modification also, to try and avoid forclosure. I am having the hardest time with GMAC, and have turned to this board to see what others have had success with. I am struggling...I have 3 children to support-one with special needs. I am going to try and call GMAC one more time today and see what other options are available to me.

GMAC is the worst .ever thing you read about gmac and howe bad are they its true. i have 3 accounts with gmac they misslead customers .they dont send statment even after you called them and asked about it.they want customers to b late on payment so they charge them a fat fee for late payment. i made payment on 12/28/2010 thrue there automated system and i got conformation no .this payment was for my 01/01/2011 payment. on 01/14/2011 i checked my account on the net.i found my payment was not posted, when i called them they said we have system problem but you can make payment now.still no statment send. THE other account i checked on the net my next payment was 05/01/2011 that was last month after i made my payment.so i called them to confirm .the customer service said you made enogh payments and your next payment is 05/01/2011. today is 01/23/2011 i checked my account on the net .i found that my nex payment is 02/01/2011 again no statment.so dont b fooled by lower intrest rate,

Graduate Management Admission Council [GMAC] loan modification fraud

I have had a GMAC mortgage for seven years. Never been late on a payment. Never had an escrow account with them for taxes or insurance as I pay that myself. They contacted me recently to do a loan modification. I agreed and sent them the zillions of forms and papers they wanted along with my hardship letter. I was denied by the Obama program so they told me to apply for their own program. I again did all the paperwork, tax copes etc. I was again denied with them saying I make enough to make the payments. I am in the hole each month by about $1, 300.00. Next I get a new statement and letter saying they have now set up an escrow account for me. they paid my property tax that was not yet due, they paid my homeowners insurance bill which had already been paid. Plus they now want my tax payment for next year in advance. Mind you, never late on taxes period! so their help was raising my payment from $727.00 to $1287.00 per month. They now know that I have a large amount of equity in my house as I had to disclose all that with the modification papers, they know I have a hardship, so there you go. Now I can not make my payment and they will take my house.
I verified with the tax collector that my tax payment was made in full by me. But, GMAC also paid so now there is a credit. The tax people have been trying to contact GMAC to give them a refund, but they will not return their calls. My insurance co sent me a refund as I was already paid and GMAC has also paid, so now all my paperwork shows that I now have an escrow account which I do not. GMAC finally sent me a letter saying they have reversed my escrow account, but today I get a statement in the mail wanting me to pay the $1, 287.00 for my June payment. They are sick sick people.Writing to your state department of Justice is a start. Fair lending companies, I have filed a formal complaint but at this point am looking for an attorney to file suit. This should become a class action for all the people that have been harmed by these fraudulent and illegal actions against Americans. They took money and are supposed to help us not cuase us un-due stress, financial ruin and harm.

YES I AM INTERESTED. I HAVE BEEN WORKING WITH THE DEPT OF JUSTICE ON MY ISSUE AND GMAC HAD THE NERVE TO SAY THAT I MADE A MONTHLY INCOME OF OVER FIVE GRAND, NEVER IN MY LIFE. MY FINANCIAL APP SAID 2, 600, THEY JUST LIE. LET ME KNOW

Your letter is wonderful and so heartfelt and true. It made me cry. No one seems to care and you are so right, there is NO enforcement at all. The companies only care about money and what they can get, not at all about mankind. Congrats on your wondeful son. I hope you get a response to your letter, please keep me posted. I have file complaints all over and with the attorney general. Even if you are late, they wont do a modification as then you wont qualify, it is all about them not us.

Well, I'm still new to this loan modification process having started it in January after losing my job due to disability. I have to say I have seen the writing onthe wall though their customer service is poor, they have inefficient paperwork process, and there seems to be a moving target as to what or when you are eligible to actually apply for the program...I am working with a local non-profit who is advocating with GMAC on my behalf in addition to my work with them which is helpful as we now have twice the documentation of the changing communication. You should always be suspicious when your company rep will not give you their e-mail address. INSIST. Also always get the name of the individual you are speaking with as well as their location and record the start and stop time of the call...ALL calls are recorded, they say they may record but computer systems just record everything and then allow the supervisors to pull calls randomly by the employees user or loginID.REQUEST that you be sent a copy of the voice file at the end of the call and then again by e-mail. DOCUMENT everything and when sending e-mails make sure to cc yourself and get a read receipt so you know when your request was actually opened. If everyone did this when working with GMAC the amount of documentation lawyers would be able to present in a class action suit would certainly be able to establish a pattern. If a suit does materialize I may be interested.

I THINK GMAC SUCKS TREMENDISLY, I'VE BEEN TRYING TO GET A MODIFICATION LOAN SINCE LAST DECEMBER, THROUGH THE NACA PROGRAM. I'm all for a class action lawsuit - please notify me if u are interested in one too - the point of a loan mod is for people who havce experienced a sudden change in finances - hardships - and modifying a mortgage reduces payment - so when a mortgage company says you don't make enough (and lowering your mortgage even 300 makes a huge difference) what is the point of a loan mod for hardships if a bank is going to say you don't make enough? Makes no sense

Here is a letter I just emailed, sent and faxed to Our President Obama. It reflects the similar situations I have read all through this complaint page! Come On It Screams Class Action. We need to do something!

Mr. Obama, I am going to let you know a little about myself then my husband. Then I am going to tell you how all your loan modification programs are not being followed how the big banks are in RESPA violations and how they do not seem to follow your instructions. Leaving us homeless after fighting for the last 10 months to have our loan modified and our payments lowered, and finally how it was sold on May 18th leaving us essentially homeless. Shame on somebody but no one knows whose fault it is!
I am a 50 year old female this year who has worked hard labor all my life. From the Oilfields to Driving Semis to finally working in a Phosphate Mine where I was injured on the Job. 10 Years with no accidents, the accident of which I speak was deemed not my fault. I was fired as the outcome because my Doctor at the time would not release me. Nice Isn't it. I sustained severe nerve damage rendering me unable to lift, sit or stand for more than an hour at a time. I have to lay down on the couch after doing any activity, on my back for at least two hours. Which is where you will find me most of the time. Nice existence would you say? I use to be a very strong person until this accident. My job entailed carrying one bucket of ore in each hand up forty two stairs for twelve hours. Piece of cake until I was hurt on the job. Now I guess you could say I am as close as an invalid as you can come with out being in a wheel chair. I am being sued for twenty six thousand of medical bills as the Ins. I had was cancelled as was the workers comp when I was fired. Also Nice Isn't It!? Oh and let me not forget to tell you that I have a 16 year old boy who is excelling in his High School. He is an Honor student with a 4.0 GPA. His Senior year will be next year and he has already compleated almost a full year year of College credits. What do you suppose will happen to this young man and his future because of all these events leaving us homeless? Something I am sure you will never experience. We should never have had to either if your wonderful programs really worked. Where is the enforcement for such programs?
Now my husband Donald E. Long was a Vietnam Vet. He has two purple harts a silver star and was offered the medal of honor of which he refused because when he came back from fighting for our Country full of Shrapnel, missing one lung and having an eye which he will never see out of right again! Why, Let me tell you because he laid in a rice patty swamp for twelve days while his eye lay on the side of his cheek. He came home and was treated worse than most people treat their dogs! That did not detour him. He lifted his head up high and went to work. He has ran every piece of equipment you can name. He has driven any truck you can mention. He has logged, worked in the log mills. He has ran the log skidders. Wages then wore horrible but the cost of living was not ten times higher than wages. Thus he survived. Now because of his age no one will even look at hiring him. Pretty nice is it not!? Now we come to the house issue. We bought this house in July of 2004. From GMAC with a VA Ryder. We were doing fine. I was working making four thousand a month (before Taxes). My husband made thirty thousand a year for a while. He was increased in salary up to the point of fifty two thousand a year. Then comes my accident. Bang loss of a several thousand a month income. Next we were called by a VA Rep. who told us our loan was being sold over seas and the interest rate was going to go up to twenty three percent so we should refinance and since Donald was a Vet. we would get a fixed interest rate of four and a quarter. We would not have to pay anything. We thought boy we had better do this or we will be in trouble. Well when it was all said and done we did get the refinance but the interest rate was six percent and they had tacked on another ten thousand dollars. There goes our Equity!
Not only that but when I went to make our first payment I had received no payment papers. I had no idea where to send the payment. I called GMAC and asked if they might know who bought our loan so I could pay. Guess what I was told? We still have your loan you need to keep sending it to us! Amazing isn't it? We knew we were not going to be able to make the extremely high payments. I put in for a hardship loan modification. I was denied, Why, ? because I was not behind. Well we are really struggling now. Again I put in for the modification. Again I was denied. We were not far enough behind. I then went to a loan modification Co. who submitted my modification. Again Denied. This time was because the bank decided we made too much money. Went through another Modification Co. Again Denied. This time because the bank said if I could pay a loan mod. Co. I could pay the payments. Is the picture getting clear to you yet? Tried it on my own two more times now we don't make enough money. Went to three more loan Mod. Co's, was denied again. Then my husband was laid off due to Our wonderful state of Economy! The last mod. co. took my money and never gave it back as their contract said they would. Now We are out that money! Went through one more to save our beloved home and property. The bank had a sale date. It was for April 24th. The lawyers got it postponed until the 18th of may. The bank was working our modification finally and we thought maybe we were going to be able to keep our home. Guess what? They by your federal law was not supposed to sale our home while working on our modification, they did. Sale went through at ten o'clock on May 18th. Where is the honor due to people who have nearly died to fight for our country? There is none. Where is the honesty in the big corporations now days? There is none! Oh the bank gave us two options. One I could have someone buy the home and rent it back to us. Like that is going to happen, unless maybe you will feel gracious enough to accomadate us as such. How about it, would you buy our house back and rent it to us? Or option nimber two is I can give them twenty thousand to re-instate us back on the loan then we can try the modification course all over again. What a bunch of BS. Come on Mr. Obama you are our Comander and Chief. You are giving billions of dollars away to other contrys for homeless. Try taking care of your own countrys people for a change. Have you ever thought there are people here who need their homes as well?
I realize that people who make the measly wages as we were making are nothing. I realize that people who work hard all their lives mean nothing. I realize that people who have fought for our country, almost died and came home is nothing. I realize these people are all treated as if they are nothing. But I would like to tell you that all these nothings are the reason people as yourself are where you are! You who keep putting out all these great programs to help Vets. To help people who are unemployed. Who are in great debt. Let me tell you Mr. Obama none of these are real. None of these WORK! I suppose If I were a minority, which by the way, it would seem these days the Caucasian is truly the minority I could get help. So I ask you, when do people who mean nothing get to recieve some help so they can in their retirement age at least have a home to call their own and at least a meager existence?
I would truly love to here your answers on this because we are now homeless. We are honest law abiding people whom I believe should be shown a little respect along with several other people in our United States with the simalier situation!

Graduate Management Admission Council [GMAC] federal fraud

I have a $200, 000 mortgage on my house with gmac mortgage. I was behind payments on my mortgage for several months. My total default amount for all the months I skipped payments totaled out to $9, 724. The gmac loss mitigation dept kept on calling me and harassing me. They called me several times a week and demanded I pay the entire default amount of $9724.00 in full in order to get current on the loan, or that I at least begin partial payments on it. After several weeks of harassment, I finally agreed to pay them $1000, I gave them my bank account information so they can withdraw the stated amount of $1000, but instead they withdrew $3000! Only a few days later after checking my bank records I found out, and right away I called the gmac loss mitigation dept and demanded to speak to the manager in charge, and they made me hold on the line for over an hour, and then disconnected me, I called back the next day, and again they made me hold on the line, this time for 40 min. Finally I spoke to the manager, and they refuse to give me back my $2000, because they claim I owe them $9, 724.00 and thus they are giving me a hard time returning my $2000 which they stole. Yeah right they made an accidental error by over charging! I doubt it was an error, this is probably how they operate! They are crooks and thieves! Don't ever use gmac mortgage! I have a mortgage with GMAC. I stay exactly 30 days behind each month. Had some Health issues over a year ago and to behind. I have never been able to catch back up. I pay GMAC $34 late fee's every month, and have for over a year now. They call me over and over and over again. I spoke to them once and they said I need to fill out a loan modification. What I need is a way to pay $200 or $300 hundred extra each month until the month that is late is caught up. I am late then, 30th day hits I make payment with late fee $1109.00 . Then I am due again on the 1st- grace period till the 15th, then this starts all over again. However I have learned, they are not interested in helping me. When you take out a mortgage, you have to have home owners ins. And its attactched to your note, and your property taxes are as well. One other thing you are paying is called Mortgage Insurance. That has to be paid for the first 10 years of the loan by you- however it covers the lender in case you default. So they don't care if you pay them, because hey are insured if you don't. Then they can foreclose on you and sell your home, and still bill you for the remainder. Homeowners ins is for you.. Mortgage insurance is there to protect the lender in a default. So if you default within first 10 yrs they don't care, they are insured for that. These bankers don't care about you and me the little guy. They aren't very nice with their harassing calls.

I was also defrauded by GMAC Loss Mitigation Department, GMAC Mortgage, [protected], [protected]. I fell behind one month, and they sent me into foreclosure. I owed $167K on a $171K loan. After a one year ordeal with GMAC, rude condescending people, sending them hundreds of documents, they forced me into signing a $180K new loan / huge late fees / higher monthly payment amount. House is worth about $100K. These guys are crooks and thieves. I had to contact my local Senator, for help. He was not able to do much, and said I should get legal help to go up against them.

As a legally deaf person, I learned that GMAC Mortgage tried to reach me at my phone number via the ZVRS (my relay service provider) this morning. We refused to answer their phone call because GMAC Mortgage refused to leave me their call message at the same time. I received an alert message with GMAC's foll-free number sent from my relay service provider. I checked out their number through the Internet to identify name of the company where they called me directly. Now, I do not have a mortgage from GMAC but I still have a mortgage loan. I believe that GMAC will continue to harass me and other disabled people who do not have mortgages with GMAC. We could file complaint with the US Dept of Justice's ADA Civil Rights and any state attorney generals against the GMAC Mortgage for phone-call harassment. I just want to warn. Thanks.

We have a mortgage with GMAC and we had lived in our home for 17 years when our business was so slow it affected our ability to pay our mortgage on time. After the first late payment I contacted GMAC, they didn't call me, I called them to express my concern due to the economy and our business. They went over our financial obligations and determined that we could not afford our home an longer and told me they will need to foreclose. After many calls, I convinced them to work with us and determined that we were short by $400 per month and so they added 7 years to the back end of mortgage which lowered our payment by $400. This did not lower our payment enough and I told GMAC we would like to go to a 30 year mortgage to get the payment lower. They refused and stated we need to take the modification they offered or they will foreclose. We were bullied into it. We only had 8 years left to payoff our mortgage and they were threatening to foreclose. Since our home had equity, they were pushing us to give up. Just after we took the modification, I lost my job of 18 years in management. I had to live on unemployment and our business was gone. We are a family of 4 and still fighting to keep our home we worked so hard for. We go to court in 3 weeks for a ruling from the judge on whether or not GMAC can proceed to take our home.
I just want to say that this company was rude and sarcastic when I called them for help early on. That was 2 years ago. I recently spoke with someone at GMAC who was very pleasant about the situation. That took 2 years and the lady said they are being mandated by the government to work with homeowners under certain circumstances. So when they are forced, they will treat you with respect. I would definately look for a better mortgage company. Hope this helps someone.

When I was struggling with GMAC they told me we "don't have to do anything or help anyone because we are privately owned. We only have to do something when it is federally mandated". Nice policy out of curiosity who had there hand out first when Obama was handing out money?

I have GMAC too. My mortgage went up over $500/month because of an error in the initial loan with regard to my annual property tax. So I have to pay the new, increased property tax, plus the amount in arrears for last year's taxes. I am struggling with the new payment due to having been laid off twice in 13 months and I contacted them and offered a partial payment and asked if I could have a month's grace period. In the past I have gotten letters from another mortgage company that said that because I had paid on time for a certain number of months, I could take a month off. Of course, the amount is added on the back end, but a month's break would help me get back on track with my payments. Please note that I was only late that month. The previous month had been paid. They said I could send the partial payment but they would not apply it to the account. They would hold the money and I would still show delinquent on the full amount. What the heck help is that!? I thought the banks were supposed to be working with us. The wisdom has always been to contact creditors as soon as you start having trouble and try to work it out. Apparently, GMAC is not part of the "wise". Very disappointing.

Graduate Management Admission Council [GMAC] waste of my time and money

My father and I purchased a car in July of 2006. I made payments on the car on time every month no questions. In December of 2007 I sent a check that was cashed my banked verified for me but according to GMAC, they never received payment. I continued to send in my checks while attempting to talk to someone that knew where my money was, considering myself and my bank sent them copies of the check with their endorsment, but every month GMAC considered me a month behind in payments and tacked on late fees each month. Finally in July of 2008 after demanding to talk to someone with an IQ, my check was found, it had never been applied to my account. Mind you this was only after sending them nearly $1800 in one check. Ok things were fine until I set $250 more than mypayments actually were. Problem two with this company. I wrecked the car in Febuary of 2009 and was out of work. I sent them some money each month but not the full amount which again late payments were tacked to my account again. Finally I got notice from them saying they were going to repo my car if payment in full was not received by noon that day, they called at 11:30! So I sent payment in the next day via moneygram in the amount of back and latepayments but not the repo fees. They sent the money back and took the car two weeks later! When I called and my father called we were givin the run around with no answers and now out of the blue a year later with no notice my fathers wages are being garnished for $12, 000 even though we settled on $5, 000 since we had so many issues. My lawyer is pleased to see a pay check coming his way. What a bunch of crooks! Run from GMAC no matter how good that 0% interest looks!

Graduate Management Admission Council [GMAC] insurance fraud

In 2007 my mother had purchase a 2nd home (my mother being a single women with one income this was a high risk loan, just keep this in mind as you read on). For our family with the intention of one of us purchasing it from here within a 5 year period.

Normal practice:when any buyer goes to closing they must bring proof of 1years paid homeowners insurance to the closing table for the home to close. This is normal practice.

Normal practice: with-in 6months of closing our original lender sold our loan to gmac mortgage.

Gmac did contact us saying they were the new holders of the loan.

Not normal practice:1 month later gmac mortgage contacted us saying they did not have a copy of our homeowners insurance, so of course we mailed them a copy, after a couple weeks again they said they did not have a copy so we faxed them a copy, certified mailed them a copy, and had our state farm agent send them a copy.

Not normal practice: 3 months later gmac sent us a letter stating they are going to start the foreclosure process because we were behind on our mortgage payments.. Of course you could understand the shock because we had not missed a payment and we had it set up so gmac took the money directly out of an account every month. Gmac did take the full mortgage payments every month. However they were applying the mortgage payments toward homeowners insurance gmac placed on our home... This is not normal practice..

We spent hours on the phone with gmac trying to get them to reverse their imposed mortgage insurance because we already had our own in place. They also added on fee's such as late payment penalties, lawyer fees and any other fee they could dream up.. We got no where because we never talked to the same person more then once and nobody knew what the other person was doing over there...

Long story short we hired an attorney who "never heard of such a thing", we should of known then to find a new one..
Thousands of dollars later gmac got what they wanted. The foreclosed on our home and we now have to move by the end of june..
I tell this story to people and it is very unbelievable to them.. And there are many similar stories across the country like ours.

Gmac mortgage achieved in getting a high risk loan off their books and because of pmi (private mortgage insurance) the government paid for 80% of the loan value. This is why mortgage companies will not do loan modifications. This has become standard practice across the country

I am writing this note for the simple cause of awareness. This is why we see so many vacant homes and why there are so many short sales (which hardly every go through, banks will not approve them)
This problem is not going to get any better, we are going to see a turn for the worse. I would hope this story of ours if anything will help someone else...

I'm so sorry for your loss, I am going through my own nightmare to prevent them from stealing our estate also, they are obsessed with insurance coverage. They never bothered me about that until I found out they were using an email address I had not been able to access to gain access to my private POLICIES I was not required to provide for them, since they had already stated so in a loan document that I recently provided a copy of for them. Over the years they have taken control of every policy of insurance I have ever obtained and including policies not mortgage related, for their own financial gain. They are nothing but criminals and our government should do nothing less than see that your family and all the others who have been victims don't just receive financial compensation for our losses but be given their homes back, and especially with no further IRREVOCABLE FUTURE ATTACHED CRIMINALS. Graduate Management Admission Council [GMAC] harassing calls

We recently sent in a payment via mail. Gmac hasn’t received it yet and they keep calling and calling. They called my work number 20 times in two days while I was away from the office. It was a toll-free phone number [protected]. They call my house over and over with an automated voice message asking for your social security number. This morning my wife picked up the phone and a woman with a strong non english accent was on the other line. My wife told the woman that we sent in the payment, but the woman kept reading from a script. My wife could not understand what the woman was saying so yet again she told the woman that the payment was sent in the mail and she has no way to speed up the mailing process. If gmac wants to call and talk with you, they should have someone who can speak english. Gmac needs to invest in better customer service!

Graduate Management Admission Council [GMAC] phone payment debited twice, run-arround about refund

Did a phone payment on my mothers account with gmac on march 9, 2010 for 1, 114.15 (amount according to system) no confirmation number for the first payment, it transferred me to customer service. I explained, that I just made a payment but did not get a confirmation number and the rep said "it did not post i'll transfer u back to the automated system so u can do it again". Did another payment for 1, 147.90 (per statement) been told differnt things by reps. A manager phoned me on 3/15/2010 stating my money should be in my account on 3/16/2010 no later than 3/17/2010. 3/20/2010 no money! Took 2 days for gmac to get ther money. Now a rep says it'll be 7-10 business days! They have proof from my credit union off funds paid to gmac on 3/11/2010. They have given my mom n I the run-around, have names of everyone i've talked with from 3/12/2010 when it started.
