**Notification Date**: December 21, 2024

1. **FTC Rules**: According to the FTC's Mail or Telephone Order Merchandise Rule, if a company charges your credit card before shipment, they must ship your order within the time stated in their advertising or within 30 days if no time is specified. If they cannot meet this timeframe, they must notify you and give you the option to cancel the order for a full refund.

**Noncompliance**:
- Baerskin failed to ship the order within the advertised 10 to 14 days.
- No notification or option to cancel was provided within the required timeframe.
- Notification on December 21, 2024, indicated a restock date of at most January 20, 2025 and then add 10-14 days for processing and shipping, which is well beyond the advertised and FTC-mandated timeframe.

**Options Provided**:
1. **Stick with Your Order**: Receive a $100 gift card towards merchandise at regular price. This is not a true value as discounts can typically be $100.
2. **Cancel for a Full Refund**: Based on other complaints, refunds are not immediate. My funds are tied up, making it too late to procure new gifts. These were Christmas gifts, and it's too late to find replacements.

**Lack of Communication**:
- Baerskin's email stated: "Important: Please don’t reply to this email – we won’t be able to respond due to the high volume of inquiries. If we don’t hear from you within a few days, we’ll automatically process your order as planned and ship it in January with the $100 gift card."

Claimed loss: Delayed Delivery: Depending on the delivery date, winter is over, and you can't get Christmas back. Winter will not wait.Gift Card Value: The gift card is of no true monetary value.

Desired outcome: Instead of offering a $100 gift card, use your resources to fulfill my order correctly with new products and overnight my order. Stop making sales without amending your advertised, and in my opinion, hidden delivery statement.
