Subject: Request for Damages and Resolution of Credit Reporting Error
Dear Sir/Madam,
I am writing to bring to your attention a serious matter regarding the mishandling of my account by one of your employees, which has resulted in significant financial and emotional distress for me and my wife. I opened a bank account with Bank of the West in May of 2023 and subsequently obtained the Bank of the West secured credit card in July of 2022 to improve my credit scores.
I have been diligently making all of my credit card payments on time without any issues until February 2023. On [date], I received a call from a Bank of the West representative who requested my new bank information to process a payment of $800 towards my credit card balance. I promptly provided the requested information and settled the outstanding amount. However, approximately two months later, I received another call from a Bank of the West representative informing me that I was 60 days late on my payment and currently 30 days late.
Upon further investigation, it was discovered that the representative had erroneously inputted the numbers to my account, leading to the incorrect reporting of late payments. Bank of the West assured me that all late fees associated with the payment would be removed, and any negative marks on the three credit bureaus would be rectified. However, despite their acknowledgment of the error, my credit score had already plummeted by almost 150 points.
The adverse impact on my credit score has had severe consequences on my financial stability and future plans. I had recently purchased land with the intention of building a house and a shop for work. However, due to the significant drop in my credit score, I was no longer able to secure a mortgage with the original terms, which had a monthly payment of $150. Bank of the West advised me to improve my credit scores and have the late payments removed before attempting to obtain a mortgage again in six months. This setback has left me devastated, unemployed, and without a home.
In the following months, I have invested countless hours in attempting to rectify this situation, but to no avail. Despite Bank of the West acknowledging that they were not at fault for my predicament, they have failed to resolve the issue satisfactorily. As a result, my life has been severely impacted for over a year, leading to lost wages, the loss of my mobile home, and immense mental anguish for both myself and my wife.
Therefore, I am seeking damages in the amount of $75,000 to compensate for the financial losses, pain, and suffering caused by Bank of the West's negligence. I kindly request that Bank of the West resolves this matter within 14 days from the date of this letter. If a satisfactory resolution is not reached within the specified timeframe, I will have no choice but to pursue further legal action through arbitration.
