Formal Complaint Regarding Misrepresentation and Recurring Issues with a 2017 Kia Vehicle SX Turbo Purchased on August 6, 2021
Dear Complaint Service Department,
I am writing to formally address a serious issue that arose after I purchased a 2017 Kia Sportage SX Turbo from your dealership on August 6th, 2021. I was assured during the sale that this vehicle was in excellent condition. However, since the purchase, I have encountered continuous mechanical issues from the mooon roof not working to close, seats not being fully conditioned, including a cracked window that was not disclosed that has not been resolved despite multiple service visits, including a prolonged inspection and attempted repairs by having to tow back and forth to Kia, and was able to rent a car but was given a grace period of a day longer than the car being in your possession without any notice.
Background of the Issue Upon my purchase, I believed this vehicle was in proper working order and met a certain quality standard. After experiencing recurring issues, specifically the engine itself blew and cylinder 3 keeps having a misfire, misfire in compartment #2, and the moon roof will not close all the way, and your services I paid for extra were not able to receive and couldn't get them, such as the detailing of the car inside and out buffing it scratches, etc., I returned the car for repairs to your dealership and later to an authorized Kia service center. Unfortunately, the problem persists, creating ongoing inconvenience and financial strain.
Misrepresentation and Potential Fraud Concerns
Based on the assurances given at the time of sale, it appears that key details about the car’s mechanical condition were either withheld or misrepresented. Under consumer protection laws, including federal statutes and Arizona’s consumer protection laws against misrepresentation and fraud, consumers are entitled to accurate information upon which to base their purchase decisions, the false marketing of being able to get the Kia fixed at your location.

Claimed loss: I have lost my salaried position twice, I have lost interviews because the car would randomly shut down and lost jobs.
Desired outcome: I'm seeking compensation for expenses from the repeated breakdowns of my 2017 Kia Sportage SX Turbo, which I bought on 8/6/21. I want a replacement vehicle and a refund of the purchase price..

When writing your complaint you should put the emphasis on all the serious problems that the car poses, concentrating yourself on the mechanical failures of the car and how it was offered for sale in a deceiving condition. Be clear in stating that you are dissatisfied with how the issues are still there after several repair attempts and point out the monetary burden that this has created.
