Bank of America can not resolve a simple issue

I just refinanced with Bank of America in Diamond Bar Calif. To make the story short they did not lock in my loan as promised. I did get a letter fromt he VPresident of the Bank that they would honor a certain rate and would make good on a .475 loan origination. They took 3 steps in retifiying this problem. First no credit then a partial credit then another credit and still to this day have not given the amound promised on a company letter head statement from the bank. I have received one call from the CEO of Bank of America and have not to this date received a call back. I have written to the BBB in hopes to retify this problem. MY loan went thru but at this point I cannot trust the word or work and will not do my banking there at this point. What happened to the the Consumer Relation and Customer Service for which I have knowledge and expierence in for the 20 years of my life. Hoping to get the credit I deserve. Still awaiting a call to correct this complant. My refinance took 6 whole months to complete. This is not what people want to do in trusting in their operations.

Bank of America debit card overdraftfee

Ongoing charge of high debit card overdraftfee of bank of America is causing many account holders (including mine)severe damage seeking. And another overdraft fee occurs if account holders can't pay negative balance in their account in 5 days.I have collected main informations regarding this bank's outrageous conduct-lawsuit case, consumers upset complaints and settlement case.
I can't attach files, so I am writing their web addresses here.

Bank of America bank of america screwed me over

Bank of America screwed me over. I was away and overdrew my account several times through automatic payments of a few dollars here and there. each time it happened i was penalized a $35 fee. For about $50 in purchases i was charged $600 in fees.

Never got an email alert or anything. This despite many years of being a good customer and lots of money in other accounts.

Now i know some would say it is my fault for letting my account default but the issue is that they know i am a good customer and might have said something.

Bank of America has never failed me in 10 years of banking with them. You gotta know the rules and what you sign up for... if you wanted to get e-mail alerts, then sign up online for the "overdraft alerts" option they offer... that simple. They even have a "low balance" alert to prevent you from getting any fees. If you dig into it and really care about your finances... you can even tell the bank to freeze your card when your account is overdrawn, and they will do it. They use a system called "coin" in which a simple code will make that happen. BOFA has saved me many times from fraud. They disable my card when they see suspicious activity going on and let me tell you, 90% of the time, they were right. I can live with the other 10%, knowing that they did it putting my safety as their first priority.

BOA is not there to hold your hand. It is your responsibility to know what is in your account at all times. They have many, many, many customers and you are not special. Try using a check register and keeping track of what goes in and what goes out correctly. I have been with them for 20 years and when the occasional issue does come up I don't get a call. The fees and everything pertaining to your account is spelled out in the booklet that you get when you sign for your account, or you can request one at customer service.

i got robbed by the cab driver who was taking me home when i was drunk as hell and couldn't even walk to the ATM when i realized i didn't have any cash to pay him for the ride and just me being nice and willing to pay cash... son of a ### looked up my PIN and took my card because i forgot to take it out of ATM, after that all cash was gone and account was overdrawn, BofA seemed like a good deal when they refunded money day after and straightened everything up but the branch worker who live across the street from me was insistent that his ZIP code is the same as mine when it was different ( los angeles, baby) and put in my address wrong ZIP so i've never received any paperwork to fill out about the fraud with ATM, after one month i got charged for that refund, money were taken back and put me overdran with 10 transactions pending so do the math - 350 in just fees and then for each automatic payment from my cell phone company they charged another 35$ for each attempt from the side of the cell phone which took them like 5 times to realize, my account is not givin any money... so i had to pay BofA around 600$ in fees plus that 500$ that was stolen... then they were pushing me around that they're still investigating my case and they will return everything that got affected... yeah, one day i had to call and talk to supervisor because it took them about 3 months to investigate it and then i get a letter that since PIN was used - they're not gonna do a thing about it... slap to my face... i pay everything off, close account and forget about those ###... now i bank with chase and got no problems...

Bank of America loan modification scam

I was reading the other persons complaint and the people at bank of america are the dumbest people I have ever dealt with. They should have never gotten a cent in the bailout money. I have not heard of them helping anyone. I dealt with countrywide and they were great they gave me a modification within a month. Then bank of america took over and they cancelled it 2 weeks before it was finalized. I have been doing this modification process since dec. 2008. Over a year me and my two little boys have been in fear of losing our house. I have applied and reapplied 4 times it goes so long that months later they cancel you without any knowledge. I lost 700 dollars a month in child support but I still have the children full time and I just need some help to lower my 1000 dollar a month payment but they will not budge they just put me on hold and cancel me so I have to pay to resubmit all the paperwork. Last time I called they had no programs for me so I said fine I will have to foreclose well that is what is happening my house will be at auction june 11 2010. My house is 800 sq feet and 1 1/2 bedroom. I was an idiot and paid 108, 000 still owe 106, 000. They will be lucky to get 50, 000 it needs lots of work. But you know what it is their stupid behavior that put them in this loss. They could of had the full amount if they would of worked with me. So lets give bank of america a hand for their loses they are taking and the families they are stressing because they cannot help people they need to keep it for themselves I guess. All of my friends and family are taking their accounts out all over too for their stupid business mistakes they have made on me and my two little children... Guess they don't need money like you and I they have the government to scam. Please do not do business with them. They might do it to you as well. All their reps do not know a thing or you cannot understand them. Bad customer service.

Bank of America account closure fee

I opened a checking account with bank of america at the lasalle & adams branch in chicago. They gave me an account number, temp checks, and an atm card. The woman told me to make sure to fund it with at least $100 on that same day to complete the process. Two days later, I find out that my balance is - $40. It seems that they decided to "close my account" due to information from check systems. They put a freeze on the $100 that I deposited, and then charged me $40 to close my account!

I told them that this was a non-disclosed fee, and they said that it was a "research fee", and that research fees were disclosed. But it's not a research fee. It's an application fee that seems to only be charged to those who are not accepted as customers. Had I known that any part of my deposit could be taken as a fee for applying for a checking account, I never would have opened it.

The racket is to make it appear that you have an account, when in fact you don't (If they are still screening you). That way, they can say that they are closing it instead of denying your account application.

Has anyone else been charged these "research fees" or "closure fees"?

I recently decided to open an account with Bank of America due to the fact that my current bank is beginning to charge service fees to all account holders unless you have a specific dollar amount in the accounts. I only work part time and have two children so I cannot afford to just give money to anyone. When I opened my account with BOA they debited $25 out my Chase account for the checking and $25 out my account for the savings. Then I was told that I would receive my welcome package in the mail. About a week later I received five different letters from BOA, one was a welcoming letter, one was the pin for the debit card, one had the debit card attached, one had a online passcode, and the final letter was notifying me that they closed the accounts. Well I didn't understand this so I called the Risk Account Closure Unit mentioned at the bottom of the letter, and they simply responded: that under their Depository Agreement the have the right to close any accounts for any or no reason. After further probing the rep on the phone, there was no reason given to me for closing the accounts. So my next question was when will I get my money refunded to me, I was told that a cashiers check had been mailed to me. I was gonna leave it at that, but something told me not to, so I asked what the dollar amount of the cashiers check was, the rep said $10. I told the rep that I deposited $50 into the combined accounts, where is the rest of my money, and I was told that a non refundable research fee was assessed to me in the amount of $40. I questioned the rep further; asking how is it you can just take someone's money and not give them a reason for doing so, and how do you even have that right? The response was that I had agreeded to the terms and conditions of their organization and that those terms and conditions allowed them to basically do what they want. They stole money from my children, I will never do business with them again. On another note, I still have to pay Chase a monthly service fee for them just holding MY money, unbelievable.

This exact same thing happened to me. Despite every current friend saying, you are so smart why would you even considering putting money in Bank of America. This is a racket and i will file a complaint with the local police in Somerville, MA.

We have to get politically active on a local level to stop the Corporate Fascism that is taking over the US through PACs and the new January 2010 limitation lift to allow banks and other corporations limitless contribution rights to buy all future senators, congressmen, and presidents to insure this is only the beginning of the corporate fascism we can look forward to.

Yes, they, Bank of America, screwed me too! I opened the account, was given a temp bank card, temp checks, a BIG WELCOME package and told to make sure I activated my new card at their ATM before leaving. Well, now I am magically overdrawn by $65 on a $50 deposit that I had only withdrew $20 at their ATM to activate the card and drove across the street and put $20 in my gas tank.
HOW IN THE HELL IS THIS POSSIBLE?
Is this how they are trying to repay the BILLIONS they STOLE from the TAXPAYERS?
UNDISCLOSED Research Fees?
I am going to report them to everybody who will listen, FTC, Federal Banking Commission, I am even going to contact every fricken NEWS channel who will listen!

DO NOT GO TO BANK OF AMERICA! YOU WILL LOSE!

Bank of America make home affordable program negligence

Bank of America is neglecting and abusing the Make Home Affordable program. They have no desire to help anyone or extend this offer in the way they are supposed to.

I have never been late on anything and had no late payments ever on anything in my credit history, but lost my job due to disability in Jan of 09.

Bank of America refused to work with me, and after many months continued to tell me there were no options and that I couldn't qualify for the MHA program because FHA was not a part of it. Yet they continued to send me letters with options and I would call them every time. When I called they continued to say there were no options for me and that in fact I would have to pay even more than I did before monthly.

I started receiving Social Security Disability and am able to pay my mortgage but BOA refuses to even work with me. Then one time I called they said that FHA joined the MHA program. So I applied - by then it was Sept 09. I meet all the criteria. But I'm still waiting. It is now April 10, 2010. Every two months they send me an identical package to fill out and request the same paperwork that I've sent 5 times. They continue to stall. I'm not allowed to speak to my negotiator and every time I call I get different information from the flunkie who answers the phone.

Once, they even told me that it was incorrect that FHA joined the MHA program (after they told me they did and made me jump through hoops many times). Then next time they told me, no, that person was incorrect and FHA did join.

I can not believe the incompetence BOA is exhibiting with this government program designed to help people just like me - who WANT to keep their home and need a little understanding and a fresh start. BOA doesn't want to help anyone.

Today they told me my negotiator is on leave of absence and my case is now in limbo while they try to assign a new one, but they don't know when that will be.

I feel like I'm dealing with a used car lot every time I call. Their gross mishandling of my case is inconceivable - especially since I've been in my home for 18 years and really want to do a work out. I don't know where to go for help. I got an attorney to handle the foreclosure and hopefully be able to stall that while the HOPE dept of BOA gets off their collective butts and reviews my case. BOA even told me that if a sale date is set on the foreclosure before they get around to reviewing my case for a modification, I will lose my house. I'm HELPLESS against this bank.

MY HUSBAND AND I WENT THROUGH THE SAME THING. BOA TELLING US THAT THEIR REVIEWING OUR LOAN BUT ACTUALLY THEY WEREN'T DOING ANYTHING. THEY TOLD US THEY HAD'NT RECEIVED THE MODIFICATION PACKAGE WE SENT THREE TIMES BY THEIR SELF ADDRESSED FED EX PACKAGE. A DIFFERENT LETTER CAME OUT EVERY MONTH STATING WHAT DOCUMENTS THEY NEEDED WHICH I SENT TO THEM BUT THE OTHER FORMS THEY RECIEVED. HOW DID THEY GET ONE WITHOUT THE OTHER? THEY WERE IN THE SAME PACKAGE! FINALLY, THEY SENT LETTERS REGARDING FORECLOSURE STATUS AND THE ONLY OPTION WE HAD WAS TO DO A SHORT SALE. WE CALLED BOA AND THE FIRST THING THEY DID WAS GIVE US THE NUMBER TO HUD. I THOUGHT WHAT WERE THEY GOING TO DO GIVE US ADVICE ON HOW TO MAKE IT WITHOUT OUR HOME! SO I CALLED THEM AND MADE AN APPOINTMENT FOR US TO SEE THEM . WE WALKED INTO THEIR OFFICE AND THERE WERE POSTERS OF MAKING HOME AFFORDABLE MODIFICATIONS. THE SAME MODIFICATION I SUPPOSE TO HAVE HAD EIGHT MONTHS AGO. WE SAT DOWN WITH THE COUSELOR SHE DIALED BOA NUMBER AND WE WERE ON SPEAKER PHONE. SHE IDENTIFIED HERSELF AS BEING HUD AFFILIATED AND "OMG" THEY WERE TELLING HER THINGS THAT WE COULD DO THAT THEY WOULDN'T TELL US WHEN WE CALLED OURSELVES. THE OPERATOR TOLD US THAT WE COULD APPEAL THE DECISION FOR THE DENIAL OF MODIFICATION. SHE TOLD US TO CALL BACK IN FIVE WORKING DAYS AND WHEN I DID THEY SAID OUR MODIFICATION WAS APPROVED FOR THE MAKING HOME AFFORDABLE PLAN.
FOR EVERYBODY WHO IS IN THE SAME POSITION WE WERE CALL HUD, HUD, HUD, HUD. BOA WILL GIVE YOU THE NUMBER. ALL I CAN SAY IS THANK GOD FOR HUD, THEY ARE THE BEST!SAVE YOUR HOME AND CALL HUD!

I have been in nearly the same boat since November of 2009. Bank of America absolutely refuses to work with customers. I have been promised many things, but zero promises were kept. I really think it is a corporate ploy to continue to collect fees as long as possible in order for B of A to make more money. There is no other reason that they should be so totally unresponsive.

Bank of America They took my money, but left me stranded with a car that still needs to be transported across company

I placed an order with Countrywide Auto Transport in June 2009 to have my daughter's car transported in August from California to Virginia. I paid the full price ($795) to "lock in the price" just in case the price of gas went up. My card was charged on June 22, before they ever pick-up my car and when I called last week to change the pick-up date, they had gone out of business! They took my money, but left me stranded with a car that still needs to be transported across company!

Bank of America excessive and incorrect overdraft fees

I chave a reserve account just in case of an overdraft. On 29 March 2010 I had a $5.63 overdraft. I had a positive balance of $20 in my reserve account.

Bank o America charged me a $35 overdraft fee on 29 March 2010. Bank of America charged me an additional $35 since I did not deposit the funds to clear up the $5.63 overdraft AND the $35 overdraft fee.

I contacted the Bank of America and asked why my reserve/overdraft protection account was not used to cover the $5.63 and the customer service agent told me that the reserve/overdraft account fees were only distributed in $100 increments and I only had $20.

This inadvertent overdraft for medications has now cost me $70 + $5.63.

Bank of America should be brought to task on this and should be ordered to refund the $35.

In addition, Bank of America should be instructed not to overstep the boundaries of overdraft regulations.

I agree that the banks are actually the terrorist to americans. They have us bail them out then use our fees to pay back loans. The bank should be charged with fraud for re positioning checks or debits to creat more fees. Our government needs to step in and do something.

Bank of America mortgage modification status unknown

We have a mortgage that was acquired by BOA when they bought out Countrywide. I contact them almost a year ago about my husband going out on disability because of knee surgery. We sent in all the appropriate documents and made sure to make ourselves available for any calls fromt the bank.
In August we were denied the Making Home Affordable program and placed into a modification request. We recieved paperwork from BOA the week after Christmas for the modification, signed and returned it the first week of January. The paperwork stated that the modification loan would begin in February. I sent in the February payment (which was supposed to be the 1st payment for the modification) the first week of February. I noticed online that our payment had not posted by February 16th so I called to get a status. I got ahold of my negotiator and found out that the paperwork we had signed and returned was sent to us in error. There had been some issues with several modifications being sent out even though they had not been approved.
I then asked my negotiator what to expect next. She told me several times that any further paperwork received she would notify us about. Stating that she would personally contact us about EVERYTHING that was taking place because of this error.
At the end of February (not even 2 weeks later) we received more paperwork. Again we signed and returned the paperwork. Now I have been contacting the bank only to get NO RESPONSE from my negotiator. She does not call me, does not answer my calls, and does not respond to ANY of the messages that I have requested to have sent to her. I don't know what is going on and just want a status on our modification. I feel like something shady is going on and am appalled to see that the LARGEST mortgage company is treating a customer like this. I have hired a cousilor to assist us with any further contacts with BOA and have also obtained a lawyer to help with the situation. I am sick of being jerked around by BOA.

I know the frustration that comes with this matter, and I myself feel that BOA is just giving us the "run around"... I, myself been given the round around, and as a single mom, trying to keep a roof over my child's head, I decided to not have them, ruined my life, by either selling and moving on, or just walk away and start over! with no family to turn to, it is a hard choice to make, but, after doing the right thing, I will no longer let a "bank" keep me from living a life of freedom! Find within your heart, what is really important to you, no one, should live a life of such uncertainty, just because $$$ has given the "big boys" power over us...

You will find the bigger piggies
Stirring up the dirt
Always have clean shirts to play around in.
.
In their ties with all their backing
They don't care what goes on around
In their eyes there's something lacking
What they need's a damn good whacking.

Everywhere there's lots of piggies
Living piggy lives
You can see them out for dinner
With their piggy wives
Clutching forks and knives to eat their bacon.

In Cyberspace, the First Amendment is a local ordinance. Think for yourself and let others do the same

Unfortunately, when they're in the spotlight they're subject to the brightest lights. One may not like exposes, which is your right. One may think it's NOT your or anyone else's business, which is your right. If I find that it is MY business, I can read about it and write about it. That's my right and my freedom. All democracies require I be an educated citizen and that I voice my opinion. Asking if web site owners, or owners, is or are a patriot or a terrorist is a valid question. Asking if web site owners, or owners, is or are a patriot or a terrorist is a valid question because an open and free media is essential to democracy. I join in the fight against B of A we have been treated very badly. Each time we call regarding our mortgage, loan modification, we are told "someone will get back to you."
We have been living under this cloud of fera of losing our home for a year. The people we have spoken with makes us feel we have done something wrong. We had a bad loan thru Countrywide. This company is as bad as Countrywide.

Bank of America gold option line of credit (hardship)

Hey,

My name is James and I have been unfairly reported to credit agency's by Bank of America. I called up to get a reduction of my interest rate to get a callback 2 days later from the gold option hardship dept on November 25th. They offered a deal if i close my account and tried for hardship they could get me a lower interest rate. They gave me till DEC 15th to make a decision. I called back on DEC 11th and accepted and gave 640 dollars to start in program. I asked the CSR if they would be any other charges due and she replied all I needed to pay was 640 dollars. I was accepted to the program and advised that my next payment would be due in January.

January came around and I received my acceptance letter and my terms explaining what was said to me on the phone including no late charges and only having to pay anytime in that month it was due. Amounting to 640 dollars. 2 weeks later received a letter on the 26th on January from Bank of America saying I was 1280 dollars behind and needed to make arraignments for payment. Called CSR at Bank of America on the letter provided and was informed that I was a payment behind and still owed 738 dollars for my November payment. I read the letter to the CSR that Bank of America sent and she agreed to what was in the letter and was told i needed to pay the 640. She told me that billing was still catching up. 1 week later was called again after making a payment for 640 and was told I was still behind 640 dollars and need to make payment. I then made 2 more payment for 640 dollars in February to be caught up on account.

I called Bank of America to find out what was going on and found out that I was 1 payment behind but it is only reflected in my DEC 09 billing statementing, other statements are saying 640 dollars. The CSR tried to keep harping on DEC 09 which should have been 640 because there billing was behind. Every statement from then on has said I have only needed to pay 640 dollars. I argued and caught them out on a tall tale in which they could not explain where the 768 dollars extra had gone and I had been not adjusted. The big issue I have is they have reported me late for two 30 day late and their online billing and payment option has told me from the DEC 28 that my payment has been 640 dollars. I am sick of dealing with their hardship department and they have been proven wrong. I was not happy when told I needed to get legal action to fix. Also where is the 768 dollars that has now disappeared from my statement that they are dinging my credit for 2 months in which I had paid 640 dollars. They accepted and told it was taken care off by the CSR. I have had this loan for 10 years and it had originally owned by MBNA which I never had issues with. Bank of America has deceived me and caused damage to my credit history which was in good standing with all credit agencies. Has anyone else had this same issue

Update

CSR at Bank of America admitted on the phone that any hardship accounts have to be delinquent in order to be accepted to the program. Bank of America accepted my payment on time but deleyed my acceptance on paper so i was forced into deliquencey so i would get accepted to payment program. I never agreed to that and was never informed by their officals on paper.I have talked with credit agencies and they where shocked at the story. Even on paper they said my credit was in good standing till i hit the november and december statements. I have been advised to seek legal action if my 2 adjustment request's are denied.

Bank of America inflated flood insurance costs

Our mortgage was recently sold to Bank of America. Right before we closed on our home, we found out it was considered to be in a flood zone, so we had to purchase a year of flood insurance in advance, at a cost of $1781.00 per year, for a $ 58, 913.00 flood isurance policy, (the amount of our loan) in addition we obtained $109, 100.00 in homeowners insurance. Bank of America just sent us notice that our flood insurance is not adequate and we need to purchase an addition $50, 187.00 in flood insurance and must do so within 45 days or they would do it at a lender placed insurance at our expense of $258.77 per month. It is there policy that the homeowners and flood insurance be of the same value. This was not the policy of our orginal lender. Upon checking with my insurance company, State Farm we were told the cost to purchase the addition required insurance would be $31.00 more onto our mortage. How is it possible for the lender placed insurance to be that more exspensive? I was told FEMA was the only source for this insurance. Why are the rates so different? And why does Bank of America require you to purchase more insurance than what the loan is for and what our home is appaised for This bank is a scam and a con.

Google Bank of America Flood Insurance Class Action Lawsuit. We got the same exact letter from them stating that we MUST get insurance because the FEMA maps were recently re-done and we are now in a flood zone..yadda yadda yadda. We decided to refinance with a different company after reading MANY complaints about this. The new lender checked to see if we actually ARE in a flood zone, and low & behold we are NOT! So Bank of America is LYING to us, and probably many others! Also, I have found comments by others on other sites where they did what BofA asked, got the amount of insurance coverage they demanded, and obtained it within the 45 days stated, but BofA STILL forced them with their own insurance group after all! Some of the people were setup on a $5, 000 per year insurance plan! That's outrageous! And when they contacted BofA over and over, they would get to no one most of the time, but one woman said she finally got someone who told her they (BofA) would have to file a claim with their very own department of such and such. When the woman asked to speak with this "department", they told her that department doesn't accept phone calls. ? um...okay..right. ? Then after that she couldn't get ahold of anyone! They tell you that you can get your home removed from the flood zone through FEMA, but one person tried this and if you google about it you'll find it takes months upon months to send forms, receive forms, communicate, etc. to get a surveyor to your house and THEN it costs YOU $1500 to have it surveyed! So, if you got a letter like this from Bank of America, I HIGHLY SUGGEST you get a lawyer NOW or refinance IMMEDIATELY!

If your home is in flood zone per the FEMA map then you have to have flood insurance..period. I fyou don't think you're in a flood zone, check online with FEMA and you can see the map. Just go get your own policy, the premium any lender charges is always MUCH higher that you can find.

Bank of America bac home loan process

The current raid on law firms representing people in modifications, is a way to deflect the press from reporting what is really going on. Which is the abusive modification process that is taking place by BofA and other too big to fail banks. Let's face it, the elephant in the room is not the American Dream concerning health care, but the American nightmare concerning the loan modification process. It is OUTRAGEOUS, considering that they have received a bail out from the American Tax Payer, who is also the average American Home Owner. After receiving a bail out in the billions from the American people, these banks have the audacity to harass, delay and humiliate us during the loan modification process called HAMP. How long do these banks think that the American people will tolerate this? One of the BofA representatives even went as far as telling me that the government can not tell them what to do. I found this strange, because I never mentioned the government with the BofA representative. So, I can not help but feel that BofA is bitter and is taking it out on those of us seeking a loan modification. It is also readily apparent, that BofA feels that they only have to meet their obligation to the government by CONSIDERING a loan modification with zero accountability. It is time that we make BofA accountable!

BofA knows very well that the average homeowner requesting a modification does not have the funds to represent themselves legally. So, the FBI raiding one of the largest and most reputable law firms, will only serve these banks potential agenda. An agenda that might be to scare any law firms from representing the people. This current action by the FBI is not the solution, but a symptom of the over all problem. It is also blurring the lines in regards to who the real bad guys are. It will also further delay the process of reputable law firms like United Law Group from filing legitimate law suits. In retrospect, United Law Group is not only helping me represent myself in this law suit, but every American who is going through the loan modification process.

So please, help me and United Law Group send a message to BofA which states, that we will no longer tolerate their potentially irregular, fraudulent and abusive business practices. In the end, the American tax payer did not fail to deliver the BofA bail out in record time, but BofA failed to deliver the American Tax Payer’s bail out in the form of a loan modification. It reminds me of that song by John Lennon and George Harrison titled "Piggies" I invite you to listen to this song on youtube and see if it appropriately fits.

God bless,
John Wright
Tax Payer and Home Owner

Bank of America home modification program

I like many other contacted Bank of America about the Home Affordability Program and was given the run around for months and finally was contacted by a representative about the program. I supplied some basic information over the phone and was told I would be contacted if I qualified. In June of 2009 I was sent a package requesting financial information to verify my earlier statements which I did immediately.
For the next nine months I was either contacted by phone, letter, and Fed Ex mail for more information, continually stating they had not received the requested documents earlier. I called every time to verify receipt and was told the documents were received. I allowed representatives from Bank of America to drop in unannounced to verify I was living at the address. I allowed an unknown person with documentation that they were a representative from Bank of America, come to my home unannounced to take profit and loss statements from my business for Bank of America. I wrote letters, faxed and phoned trying to speak to my adjuster and was ALWAYS met by a representative that would take the message and tell me they would contact me.
This went on for nine months and finally I received a package saying that my loan would be modified.
Sounds good, doesn't it?
The program works.
WRONG!
Bank of America lowered my interest rate .65% while adding on 9 months of the difference of my trial period payments to my original monthly payment and added it onto my original loan. That's right, if I accept their modification I owe them seven thousand dollars more than my original loan and my monthly payment is just fewer than sixty dollars less. I other words a qualification that was to take up to 45 days and my new payments once accepted would be my trial period payment or slightly higher took nine months for Bank of America to do their job while making seven thousand dollars from a client that was already experiencing financial hardship. The best part is not only is my "new" adjusted payment which is eight hundred dollars more than my trial period payment, it's due in seven days or Bank of America will seek all back money owed and immediately seek foreclosure. Also, this months trial period payment I have been given a grace period of 30 days to send that in. In sixty days I have to send Bank of America two house payments and a trial period payment.
They got me!
This is not how the plan was intended to work. This was not to be another way of Bank of America to make more money. They owe us, remember the bail out?
What can be done? I am at a loss, just having received my acceptance into this great program.
Any help would be greatly appreciated.

I also have been trying to work with BofA for a loan modifacation. Every time they call me and say that I did not send in the paperwork. I have faxed and faxed and fed-exed paperwork into them with no change in the situation. I am also looking to see if I can join a class action lawsuit against them. They continue to loose personal information and tell me that they never recieved it. When you fax documents into them, it does not go to the person working on your account but to someone else the scans them to a computer file that is then trasfered to your accout person. It is this proscess where they are loosing information. They do not scan it as one file but break it into groups like, Bank Statements, Tax Returns and so on. Who evere they have scaning the information in looses some of it during the proscess. This is a planned system of denial. They do not want to help you they just want to keep earning the intrest off of the bail out money.
The entire government needs to be replaced with good men who are willing to get some things strait. I am all for a man earning more than me when he can out work me or out think me in business but not steal from me or the American people. There are laws in this country and these men are no better than some of the gangsters from the early 1900's. They may not be leaving bodies on the ground but they are destroying families and lives through their actions.

I also got the run around from BofA. I lost my job and fell behind on my payments. I received a letter about the HAMP from them, in August 2009, I started the process. In December, I received the paperwork for the trial period. I contacted them, stating that the payments were too high (35%) of my income. They stated that 35% was still in the acceptable limit range. When I asked them how they figured my income, I found that they were including a part time job that I had not had in 6 months (even though I told them when I lost it). They stated that they would refigure and send me new paperwork. This never happened. When I contacted them again in January, they told me that they were not going to refigure the amount, and that I had to sign the trial paperwork or lose my house. I signed and sent back in. After making the payments until August 2010, I received a statement showing that my payments had gone up by over $200 per month. When I called them, they said that they had not had a payment from me since January. I told them that was not possible since they were taken directly out of my bank account. After they looked more into their system, it showed that my money was being placed in another account. I told them I wanted them put into my account. In September 2010, I got a foreclosure notice. I called them, and they stated that they still haven't received my payments since January 2010. That was the last straw for me. Since this was affecting my health, I could not take it anymore. I sent them my keys. Then they called me in March 2011, stating that I needed to make 15 months worth of payments. I told them that they were wrong and that I received a foreclosure letter and sent them my keys. They said that their records showed my foreclosure was on May 4, 2011. I told them, the last letter I received showed that it was in February. I don't know how BofA is allowed to do this. Is there anyone planning a class action suit against them for the way their modification program was run? I am asking them to send me my complete file. When (IF) I get it, I plan on sending it to my representatives in Washington.

I have been working on a modification with BofA for over a year now, they contacted me and said I should qualify, I have sent every document know to man in over and over confirming each time they got it but amazingly they get lost. I have sent in over 800 pages of faxes in the past year only to be told we need this or that...again...or because they have taken so long the old is now expired. I have sent in so many P&L statements its crazy and over 4 years worth of tax statements (my accountant bill is huge). To date still dont have a modification and each month my house is set for foreclosure sale then suddenly at the last second its removed and postponed to the next month as if to a wave a flag in the neighbors face each month about my situation. I was even told I dont live at the house when I met their rep two days before outside when I saw him staring in a kids bedroom window (this is the 3rd guy they sent out btw) Good news is I am getting back on my feet and if I dont get a modification then they can be expect a lawsuit as not only did their previous actions drive our entire economy down the tubes and cost me around 48% of the value on all 8 of my homes but this is the knife in the back and Iam one guy that keeps my word and if it cost me a million in legal fees I will pay the lawyer instead of BofA my house payments and BofA can kindly wipe away my loan to them as payment for this nightmare that seems to have no end and its seems its happening to a lot of people. And also, why cant the different departments at BofA share info? You guys really need to get your act together.

Always having dirt to play around in.

Have you seen the bigger piggies
In their starched white shirts
You will find the bigger piggies
Stirring up the dirt
Always have clean shirts to play around in.

In their ties with all their backing
They don't care what goes on around
In their eyes there's something lacking
What they need's a damn good whacking.

Everywhere there's lots of piggies
Living piggy lives
You can see them out for dinner
With their piggy wives
Clutching forks and knives to eat their bacon.

Thanks for writing, we all share the same long, tortuous story and I want to make all the Banksters PAY for what they have put us through. I cannot afford an attorney right now to file suit, but I have had consultations and have been told that you can file, once you are on your feet. My idea is to get all us to file in our local small claims court on the same day or week, it is cheap for us to file and the Banksters will have to provide attorneys for EACH of those cases or lose by default! Usually there is a local magistrate and local juries that are not lawyers and are sympathetic to the consumer who has been abused. The Banksters cannot stop us or prepare, even if they know what day or week it is! Check your local small claims court for the rules and cost and then send a RESPA letter to your loan servicer by certified mail. When you get your response to your RESPA letter and gather your evidence. I will keep you posted on what day we will do our National Political Action, go to every blog you can and post this email and my mail addy, we have to get the word out!
Sincerely

i also have a problem with BOA... first they gave me a trial modification... then after that they sent me a letter saying that it would expire such and such date... then many months later, when I finally found a job and reapplied for modification, the representative said i did not qualify and goodbye and good luck. Sad to say the representative sounded very sad about it and all the people who have to answer the phones were very very good... they have to have a job too. But BOA won't help me... I never missed a payment and was always on time, and the fact that they could not spend the time to reprocess the application. President OBAMA, i hope you read these...
And i finally got something in writing from them telling me to pay up or loose my home.

This exact same thing happened to my husband and I. Last Septeber we were offered the MHA trial period. We were experiencing hardship because I was in nursing school and not working. For six months I was told that i was in the trial period and to keep making the payments. Everything was fine. I called twice a week. Spoke to people all over the world and was told the same thing. Appraisers came to my home, several copies of documents were sent.
We were told in March that we did not qualify for the modification. That we were actually declined in Jan. We were told that we had to make up the difference of our trial period payments and then pay regular months mortgage and have it all within three weeks. 5600.00 our our home would go into foreclourse. I was frantic. I had written everyones name and date associated with this offer. I had every piece of mail ever sent to me and sent it all back to them (copies) and still they claimed that it was my word against theirs. They claimed that they notified me of the disqualification back in Jan. They did not.
I drained my savings account of 3000.00 to pay them and made an agreement with the bank to pay over my regular monthly payments to pay off the remainder of the balance. I paid an additional amount in April of a 1000.00. Every month for 5 months i paid two hundred dollars over my regular mortgage. I called them every week regarding our agreement. they stated that this was fine. When checking my balance on the internet I was schocked to see that it stated that our payments were 3 months behind! I called and a representative informed me that I was still actively in the modification trial process for a second look that they take with everyone. None of my money paid since March had been allocated accordingly. it was sitting in a partial bank balance because I didnt have the money in full. I never even gave them consent for that!
I was livid. out of my mind angry. For the entire month of june and july sleezy appraisers came out to my house again to make sure that the property was still "occupied"At the end of July I suggested kindly sueing the bank if the modification was not take off of my account and they told me that I had to send an official letter. What? Ok so I sent a scathing letter telling them to leave me alone.
When they finally took the modification off my account after hounding them for 5 months about it I received another letter stating that once again there was an intent to accerelate on my loan for 1556.00. I had two weekds to pay it or we would loose our home again. They also wanted Septembers mortgage payment as well.
I freaked out again and called for the 400th time and was able to set up a payment program of 1400.00 a month for 5 months until the balance was paid off.
No way.
My husband and I worked overtime for two weeks. I didnt see my children for six days. I paid the 1556.00 in person at the bank. They had no idea how to process this payment for this random charge.
After paying this random charge I paid my september mortgate befor the 16th. I thought I was free.
I called the bank that morning and was graciously reassured that after i make my september mortgage payment I would receive no more suprises. This was it . I was done. I could go back to being a regular home ownere again after a year of headaches and frustration. Yes this is correct.
A day later I received a letter postdated from two weeks previously stating that a payment in August was not received. That once again we are in danger of being intent to accelerate on our loan. [censor].
I am calling a lawyer.
Someone from the bank promised me that he would take this serious issue to heart and fix this seeing that I refused to cooperate on any level ever again.
We have lived in this home for 8 years. my husband, two and seven yr old. I have never missed a payment nor have I been late.
I have to fight for my 1300 square foot 2 story cape cod every day. I am freaking sick of it! I feel like I live in a socialist society. Even know our financial situation has changed now, (we are both employed) we just can not seem to get up because the bank is keeping me down.
Sincerely Erin Bartling

why is there not a government mandated law that requires only a certain number of bank employees to be able to work on an accournt at a time?
Bank of America employs hundreds of thousands of people all over the world and all of them have had acess to my account and have made changes without ever even speaking to eachother.

Bank of America cc rip off

Recently, I noticed my Bank of America balance going up, and figured it was just the outrageous interest the bank charges on their credit cards. Upon further review however, I noticed it was not only due to their predatory interest rate, but the due date was changing from month to month, so an additional late fee of $39 was added to my bill. They said it was due to by billing cycle, of course, their motivation was to rip me off. Part of the new credit act, is to assign fixed dates from February of this year. It is a crying shame, it took an act of congress for predators like this bank, to change their ways. Bad word of mouth will also be expensive, and that it my guarantee. If you can avoid this fraudulent bank altogether, then do so!

Bank of America Communication

My Home Mortgage was just sold to BAC Home Loans Servicing, LP this company has no direct website, No Customer service department. Everything is Automated by computer and when called the only real option is to either make a payment or schedule a payment.

This is not the way to do business especially when dealing with someones Mortgage. This company need to be more available, People need to speak to people, not computer. I bet if don't pay my Mortgage someone will call then...I've never spent 45 minutes trying to just get a person on the phone with no success.

Hello fellow "victims" - I use that term lightly but really it seems appropriate? Add my name to this ever growing list of hard-working individuals that are being scammed. I received the letter stating that my home loan was transferred to BAC Home Loans - which as I now see is a big fraud agency. For the past year I have been working with BAC to modify my loan - each time I didn't qualify due to the year my home was purchased, income, etc., etc. etc. I was desperate to save my home so I agreed to a repayment option to bring the mortgage current. The new plan added $200.00 to my $937.00 mortgage payment for 5 months I was so relieved that they were willing to work with me and admit that I agreed to this payment under duress - I have not been able to keep things current with the extra $200.00. I have mixed emotions about finding all of you - it is so validating to hear that other intelligent, hard-working people are in the same situation - HOORAY! But I am peeved and saddened about why we are here? I do have to say that the story about the person with cancer is absolutely heartbreaking and it makes me sick to think about the heartlessness that permeates our country has impacted so many lives. WHAT DO WE DO? I can't afford an attorney - I just completed a Chpt. 7 bankruptcy process so all my $$ went to that?Good luck to all of you - if I win the lottery I will share the $$ with all of you...true story and true promise!

I so agree, we have been trying to get a modification for over a year with BOA and you guessed it just a bunch of bs with them. We have been told so many different things about the status of our modification its unbelievable, how do they get away with this. They have strung this out so long we are now 30, 000 in debt on house payments, just got notified we are not able to get a modification and our home is being auctioned off June 10, 2011. I was diagnosed with breast cancer last year and I thought that was horrible, boa's business tatics are way worse than my cancer. At least with my cancer I might have a chance, but it's not that way with boa. They mislead, misguided, and out right lied to us and now were loosing our home, life and dream as far as I'm concerned. I have four animals, cancer and no where to go after they auction my house, but that doesn't matter as much to me as the way they went about it does. If they had been truthful in the beginning we could have saved this house but they kept telling us your trial period is in the mail and we waited and waited. I started filing complaints with OCC, FTC and anyone else that would listen trying to get some help. No one really listened they just put me off on someone else. So I've finally given up my health can no longer take battling them. I will sign anything to help stop boa from being able to do this to anyone else. I'd go to the white house and stand on the steps for days if I thought it would help. Please let me know of anything that can be done to bring attention to this matter. cbaken5@hotmail.com yes I'm posting my address...

BAC Nightmare
US
May 12, 2011 5:27 pm EDT

It is so frightening to see how many people are experiencing this nightmare. We have been through the exact same experience. Our last resort was to write to the Office of the Comptroller of the Currency. I would encourage everyone here to write to them. Even though they haven't actually resolved our issue(they are afterall a government agency), our experience with all the rediculous responses from BAC (along with dates, names, times and lists of lost documents) are now on file with a federal agency (specifically designed to monitor national banks) so that if BAC does attempt foreclosure, we have evidence of their incompetence and potentially illegal activity. OCC is charged with monitoring the safe operation of the banking system. Setting people up to have their homes foreclosed on doesn't seem to me in any way to be a safe opertion of the national banking system. This situation must run deep for the government to be allowing the banks to be so reckless with the bailout money they received, even after being sued by so many State's Attorney's General. There is something more dangerous than incompetence and even greed going on here.

It's so funny how all of us America are having so much problems with BofA and yet the president doesn't know any of this. Or does he?!
My husband and I are also going through the same thing for about 2 years already. We have been doing exactly what they wanted us to do, and yet still they say either fax this or apply for Fannie Mae ( we use to be with Making Home Affordable) so we did and now they say they NEVER or have received the papers. Every time we call we get someone diffrent and doesn't have a clue or he/she is telling us something is missing! We just about had it! All this stress and problems. Is it worth it?! Well I think we should ALL send our stories to the news! It's time that President Obama know about all this and solve this problem, because something needs to be done!
We want to sue BofA as well, but we are not sure how to go about it. We need a good lawyer that is willing to fight this with us up to the White House if we must so this wont happen NO MORE!

The same for us. Our BoA loan was not Fannie Mae / Freddie Mac. We pplied for modification "Make My Home Affordable Program" with nothing but inexperienced "call center" telemarketers answering the phone. Excuses like, "didn't receive it, need another copy... I said, " It's a 20 page tax return, can't you just copy the one you have. "Oh no sir, we don't have the capability to do that."
Now, property has just reverted back to lender, as no one bid on it at the Trustee's Sale. Realtor (supposedly a rep for BAC Home Loans Servicing, LP) came the next day and started looking in the windows without even knocking at the door. She left a moveout agreement. Has anyone experience this?

When Countrywide sold our loan to BAC we were just fine with it until they decide to add our escrow and then they call themselves adding our insurance and for the last year and a half ago, I notice that they were charging us for the insurance and called and told them they had never paid our insurance before so where was the money, they told me that the money was sitting in escrow and I could move it over towards a house payment, well I did. But in the meantime we were behind in our mortgage 2 months, so they said to us let’s see if you can get remodified I personally knew it was a bad idea but we said OK like everyone else we have had a decrease in pay because of my husband lay-off. We were decline remodification and then they tell us they were rechecking our information but then when I called they tell me we were getting ready to go into foreclosure so when I asked them how much we owed on the two house payments the guy told us 2481.54 so what I did I borrowed it from my mother and now we are on track but I can tell you this much I would like to go to another mortgage company but our credit score is shot but I will tell you this much I don’t trust this BAC company and the people act as though they cannot tell you anything. OH yes don’t let them draft your payment because they will draft before your do date, this happen to us and we had a shortage on some of our bills. And when I ask them to put our money back they gave us the run around and like I told the man I knew they were full of [censored] and they need to check their people. They really don't care about anyone and they need to quit giving us all this [censored] about how they are here to help us. I know they would love to get their hands on our property but we will give them that right. I hate that Countrywide sold us out to those devils.

I agree and I am having the same problems since my loan was transfer to them from Whilshire last year in March 2010. I had completed the trial payment successfuly and then my loan was transfer to BAC and now I am still waiting on a decision and its March 2011. I have gotten the same run around. My remmodification had been denied or it was denied in error, now we taking a second look, file and appeal or the comments that you were told were wrong. Or they had me in review for making homes affordable and an in-house modification. I did everything I was suppose to do. I was out on medical leave for 6 months and then when I returned to work hours and income was reduced from 40 hours a week to 24-27 hours due to the economic crisis at the end of 2008. Which cause me to get behind along w/ taking care of 3 children, but I was denied b/c of my debt to income ratio. Well what is the program for, of course if someone has a hardship then usually a person ends up w/ more debt than income b/c of loss of income. My am so fed up and I call every month, week and day! There got to be some one that could help us, please. I just needed help getting back on track. I went from owing a lesser before my loan was transfer and for some reason that amount had doubled.

OMG..after reading all of the above comments I am more frustrated than ever. We applied for and were approved a loan from PHFA to make our BAC loan current. Then of course we have to pay them back starting the very next month along with the BAC loan. Has anyone ever tried just getting a mortgage with another bank? Also has anyone ever gotten a statement from BAC with the figures not adding up? I swear out mortgage was just increased and they never told us. Yes we have the escrow included but when you add that figure with teh late charges and the regular monthly payment it does not add up to the figure they have listed that we owe. NO ONE AT BAC can explain this. They are all idiots and I totally agree with everyone's comments. What to do?..Well see what happens when PHFA makes my account with them current at the end of April.

Bank of America increased interest rate/decreased credit limit

Bank of "America"? Please! I have never dealt with a company more UN-American in their overall business philosphy than Bank of "America". Their business motto appears to be screw the consumer every which way they can, take their tax dollars, and ruin credit scores. It is my firm belief that this major corporation has no appreciation or respect for their customers, even those who have perfect credit with the company. I pay my credit card bill on time every month (NEVER late!), have NEVER gone over my credit limit, more often than not pay more than the minimum amount due, and haven't charged anything in many, many months in an effort to get out of debt. Unfortunately they also hold the mortgage on my home as they purchased the original mortgage company my home was financed by. Again, NEVER late on a mortgage payment, and often pay additional towards the balance due. What's my reward for being a good customer with this company for in excess of 10 years? My credit limit on my credit card has been reduced and my interest rate increased for no reason several times in the past couple of years, which in turn raises my debt to available credit ratio, which in turn lowers my credit score, which could subsequently prevent me from obtaining credit elsewhere to pay off my debt with this company. All while Bank of "America" owes "America" billions of dollars and their corporate managers receive sizeable bonuses? Is this their ultimate long-range business plan? Can we say SCAM? As I told an agent with Bank of "America" today, I WILL pay the company every dime I owe them, I WILL attempt to get my home refinanced and pay my hard-earned money to a more deserving financial institute, and once that is accomplished I will NEVER do business with Bank of "America" again. I encourage others to do the same. Let's give this company a taste of their own vile medicine!

As for the recent credit card reform act, well, needless to say it has, from my viewpoint and that of many others I know, done more harm than good. Many of the credit card companies merely got their top weasels together to find ways around the new law, and have done so quiet successfully, all to the detriment of consumers. Hooray for us!

Bank of America escrow account

BOA raised my house payment 36.00 a month due to the escrow increase (property taxes and insurance). This doesn't seem like much to most people, but I live in a small town, so I made a quick trip to the State Farm office & my local tax offices, where I dicovered my taxes went up 100.00 & the insurance 38.00 for this last year. So what does BOA need with the other 250.00 or so? When I called them on it, I was put on hold for 45 minutes and they never came back on! Just think... what if they are doing this to millions of Countrywide account holders! I am in touch with the Attorney Generals Consumer Affairs Office (Wyoming) hoping for some advice and help. Good luck fighting the evil giant!

I had Taylor Bean and Whitaker. You think $36.00 is a lot Bank of America got my loan when TB&W was raided by the feds. The first month our loan was $200.00 more then normal. I called and was told it was a transfer fee. The next month we got a letter stating an increase in our mortgage of $600.00 a month, I called after noting they had put both our summer and winter taxes as $2100. The increase in escrow was still more then the double taxes, but I thought it was s simple mistake. I contacted the city I live in and they informed me my taxes had gone down (because of the extreme decrease in value where I live) $75 a year. I called BoA and they were not helpful. 2 months later my mortgage was increased for a grand total of $2789, my payment was $1200 a month before BoA got ahold of my mortgage. My husband called this time and was told State Farm had not sent them the correct papers and they had given us there home owners, contacted State Farm who had no clue was BoA was talking about. We contacted a lawyer who told us BoA wasn't willing to work with us, they claimed the change was for fees and other things. Least to say we are now having to let our home go. A home we didn't pay more then we should have for, and a home we love. I've heard of many peoples homes being taken after BoA raises there payments so high they cannot afford to pay.

Bank of America fraudulent fees

I have been a bofa customer for 17 years now, with some fraudulent charges on my account that were always quickly resolved when I called. (Wonder how many times other people were charged that maybe didn't notice like I did?)This time was the last straw, though, and I have contacted the Federal Reserve. I recently deposited my income tax return money to my account. A few days later, I transferred some of it to my savings account via online banking, knowing I had overdraft protection in case anything came out of my checking. A few days later, I received 3 overdraft charges! I promptly contacted bofa, and the 3 people I talked to agreed that the charges didn't make sense and would transfer me to the correct call center so this would be fixed. Then I got diconnected and their call centers were closed. So I called back today (3-11-10), and was transferred multiple times before they finally came to the conclusion that they were keeping my $105 worth of fees and that they were right! Really!?!? They say because I transferred it out of my checking account, it was no longer in there, and it hadn't posted to my savings account yet (even though my online banking confirmed that it was), so it was not available there. Where then, may I ask, WAS it? It's MY money, but it's somehow out in "limbo-land" where it's not available to cover my charges? I have been in the wrong before (not had enough money, etc), and I have understood why a fee was charged. But this time, I had plenty of money available, just not "technically" available when I actually needed it. But I am the "little man" and they are the big banking institution, so how do I fight that? This is so frustrating!

I am suffering a lose of $1, 521. 27 phone calls later and a cancelled invitation to consult with my "personal banker" (which I did not know I hired!) I suppose it is wise to use our Government resources which are available to us. The reason: seveal transactions NOT authorized by me were made. Money was taken out of one account- then placed in another account that I hold - and then placed back in the original - and transfers fees were charged to my account! TRANSFERS THAT WERE NOT AUTHORIZED BY ME! - HAD NO PURPOSE - THE OTHER ACCOUNT HELD MORE THEN WHAT WAS BEING TRANSFERRED IN.
THERE WAS NO NEED!AND THEY SAY "PROVE TO US THAT YOU DID NOT CALL THE BANK AND AUTHORIZE THIS"
Why don't they say "we will prove to you that you called and authorized these transactions. Tranactions that make NO sense!
